Preemption is a powerful strategy used by special interest groups to undermine strong, local public health standards. Currently, 20 states in the U.S. have preemption ordinances in place related to clean indoor air initiatives. These preemption laws are the direct result of an ongoing and aggressive campaign of tobacco companies to thwart clean indoor air initiatives, which ultimately, according to tobacco industry internal documents, cause significant reductions in their annual revenues. Clean indoor air policies have arisen from a greater understanding (...) of the documented health risks associated with exposure to secondhand smoke and action by local government to protect the public from these hazards. The efforts of the tobacco industry undermine local authority and seek to shift policy action to the state and federal levels, where the industry has greater political influence. (shrink)

This book is concerned with how we should think and act in our work, leisure activities, and time utilization in order to achieve flourishing lives. The scope papers range from general theoretical considerations of the value, e.g. 'What is a balanced life?', to specific types of considerations, e.g. 'How should we cope with the effects of work on moral decision-making?'.

Due to the increasingly heterogeneous trajectories of aging, gerontology requires theoretical models and empirical methods that can meaningfully, reliably, and precisely describe, explain, and predict causes and effects within the aging process, considering particular contexts and situations. Human behavior occurs in contexts; nevertheless, situational changes are often neglected in context-based behavior research. This article follows the tradition of environmental gerontology research based on Lawton’s Person-Environment-Interaction model and the theoretical developments of recent years. The authors discuss that, despite an explicit time (...) component, current P-E models could be strengthened by focusing on detecting P-E interactions in various everyday situations. Enhancing Lawton’s original formula via a situationally based component not only changes the theoretical perspectives on the interplay between person and environment but also demands new data collection approaches in empirical environmental research. Those approaches are discussed through the example of collecting mobile data with smartphones. Future research should include the situational dimension to investigate the complex nature of person environment interactions. (shrink)

Cross-cultural differences in argumentation may be explained by the use of different norms of reasoning. However, some norms derive from, presumably universal, mathematical laws. This inconsistency can be resolved, by considering that some norms of argumentation, like Bayes theorem, are mathematical functions. Systematic variation in the inputs may produce culture-dependent inductive biases although the function remains invariant. This hypothesis was tested by fitting a Bayesian model to data on informal argumentation from Turkish and English cultures, which linguistically mark evidence quality (...) differently. The experiment varied evidential marking and informant reliability in argumentative dialogues and revealed cross-cultural differences for both independent variables. The Bayesian model fitted the data from both cultures well but there were differences in the parameters consistent with culture-specific inductive biases. These findings are related to current controversies over the universality of the norms of reasoning and the role of normative theories in the psychology of reasoning. (shrink)

Recent advances in the technology of creating chimeras have evoked controversy in policy debates. At centre of controversy is the fear that a substantial contribution of human cells or genes in crucial areas of the animal’s body may at some point render the animal more humanlike than any other animals we know today. Authors who have commented on or contributed to policy debates specify that chimeras which would be too humanlike would have an altered moral status and threaten our notion (...) of ‘human dignity’. This setting offers a productive opportunity to test the notion of human dignity and to emphasize some of its weaknesses as an ethical tool. Limiting chimerism experiments on the basis of whether or not it undermines or challenges human dignity implies a clear demarcation of those characteristics which are typically, and importantly, human. Evidence of our evolutionary ties and behavioral similarities with other animals seem to annul all attempts to define the uniquely human properties to which human dignity may be attributed. Hence, it has been suggested that the particular moral status associated with humans cannot be explained for beyond an intuitive basis. In what follows, we will argue that the difficulties inherent in the notion of human dignity lie not in the impossibility to acquire a list of properties which are unique to humans, but rather in the difficulty to demonstrate the moral relevance of these properties, and particularly the relevance of their being human. We offer an alternative interpretation of the concept of dignity which is not necessarily related to being human. (shrink)

Background 300 million operations and procedures are performed annually across the world, all of which require a patient’s informed consent. No standardised measure of the consent process exists in current clinical practice. We aimed to define a core outcome set for informed consent for therapy. Methods The core outcome set was developed in accordance with a predefined research protocol and the Core OutcoMes in Effectiveness Trials methodology comprising systematic review, qualitative semi structured interviews, a modified Delphi process and consensus webinars (...) to ratify outcomes for inclusion in the final core outcome set.. Participants from all key stakeholder groups took part in the process, including patients and the public, healthcare practitioners and consent researchers. Results 36 outcome domains were synthesised through systematic review and organised into a consent taxonomy. 41 semi-structured interviews were performed with all consent stakeholders groups. 164 participants from all stakeholder groups across 8 countries completed Delphi Round 1 and 125 completed Round 2. 11 outcomes met the ‘consensus in’ criteria. 6 met ‘consensus in’ all stakeholder groups and were included directly in the final core outcome set. 5 remaining outcomes meeting ‘consensus in’ were ratified over two consensus webinars. 9 core outcomes were included in the final core outcome set: Satisfaction with the quality and amount of information, Patient feeling that there was a choice, Patient feeling that the decision to consent was their own, Confidence in the decision made, Satisfaction with communication, Trust in the clinician, Patient satisfaction with the consent process, Patient rated adequacy of time and opportunity to ask questions. Conclusion This international mixed-methods qualitative study is the first of its kind to define a core outcome set for informed consent for intervention. It defines what outcomes are of importance to key stakeholders in the consent process and is a forward step towards standardising future consent research. (shrink)

In the management of common property resources, privatization is often advocated as the surest path to sustainability because of its reliance on human self-interest in natural resources decision making. This article demonstrates that the motive of self-interest, though powerful, does not necessarily lead to environmental outcomes that promote the common good. The key to avoiding the Tragedy of the Commons is not private ownership but controlling access.

The main focus of Lean philosophy is to create value for the stakeholders and end customers by reducing the non-value added activities or waste, and laying a strong foundation towards sustainable growth, by focusing on continuous process improvement. The overall philosophy provides a focused approach for continuous process improvement and the targeting of a variety of tools and methods to bring improvements. This paper presents case studies for Lean scheduling of manufacturing processes and exemplify how Lean scheduling processes allow organisations to maintain the continuous improvement philosophy. This paper also addresses the key elements of rescheduling processes i.e. how to schedule and when to schedule. Further, the paper will exemplify key benefits of Lean scheduling and how the Cable industry could benefit from the proposed approach. (shrink)

This paper aims to make an empirically informed analytical contribution to the development of a more socially embedded bioethics. Drawing upon 10 interviews with cutting edge stem cell researchers (5 scientists and 5 clinicians) it explores and illustrates the ways in which the role positions of translational researchers are shaped by the ‘normative structures’ of science and medicine respectively and in combination. The empirical data is used to illuminate three overlapping themes of ethical relevance: what matters in stem cell research, (...) experimental treatment, and responsible claim making (as contrasted with ‘hype’. Finally, we suggest that this kind of ‘descriptive’ ethical analysis has potential relevance for understanding other substantive areas of stem cell ethics in practice, and we briefly consider the questions our analysis raises about role positions and ethical agency, and the implications for bioethics as a field of scholarship. In our paper we will try to connect the dynamics of community decline to individual responses. We will operate on two levels of reality. At the first level we will discuss the circumstances surrounding the recent decline of small communities in North Dakota. At the second level we will discuss how this decline affects small town residents' attitudes toward economic development. In the first level analysis we examine the thesis that the natural environment of community growth is economic exploitation; therefore, (...) the decline of resource-based communities is natural and inevitable. We discuss the circumstances surrounding the recent decline of small communities in North Dakota. At the second level analysis, we operate at the level at which life circumstances and environments are shaped by political-economic institutions that in turn shape the behavior and mentality of communities, families, and individuals. We hypothesize that residents of declining small towns deny their powerlessness and adapt to their situation through intense dedication to economic growth. We develop a series of hypotheses to test this thesis using data from the North Dakota Rural Life Poll. In our conclusion, we discuss implications for rural development practitioners working in declining small towns where this intense dedication to economic development in prevalent. (shrink)

In response to calls for greater interdisciplinary involvement from the social sciences and humanities in the development, governance, and study of artificial intelligence systems, this paper presents one sociologist’s view on the problem of algorithmic bias and the reproduction of societal bias. Discussions of bias in AI cover much of the same conceptual terrain that sociologists studying inequality have long understood using more specific terms and theories. Concerns over reproducing societal bias should be informed by an understanding of the ways (...) that inequality is continually reproduced in society—processes that AI systems are either complicit in, or can be designed to disrupt and counter. The contrast presented here is between conservative and radical approaches to AI, with conservatism referring to dominant tendencies that reproduce and strengthen the status quo, while radical approaches work to disrupt systemic forms of inequality. The limitations of a conservative approach to racial bias are discussed through the specific example of biased criminal risk assessments and Indigenous overrepresentation in Canada’s criminal justice system. This illustrates the dangers of treating racial bias as a generalizable problem and equality as a generalizable solution, emphasizing the importance of considering inequality in context. Societal issues can no longer be out of scope for AI and machine learning, given the impact of these systems on human lives. This requires engagement with a growing body of critical AI scholarship that goes beyond biased data to analyze structured ways of perpetuating inequality, opening up the possibility for interdisciplinary engagement and radical alternatives. Google Trends reveals that at the time we were writing our article on ‘The Coming Crisis of Empirical Sociology’ in 2007 almost nobody was searching the internet for ‘Big Data’. It was only towards the very end of 2010 that the term began to register, just ahead of an explosion of interest from 2011 onwards. In this commentary we take the opportunity to reflect back on the claims we made in that original paper in light of more recent discussions about (...) the social scientific implications of the inundation of digital data. Did our paper, with its emphasis on the emergence of, what we termed, ‘social transactional data’ and ‘digital byproduct data’ prefigure contemporary debates that now form the basis and rationale for this excellent new journal? Or was the paper more concerned with broader methodological, theoretical and political debates that have somehow been lost in all of the loud babble that has come to surround Big Data. Using recent work on the BBC Great British Class Survey as an example this brief paper offers a reflexive and critical reflection on what has become – much to the surprise of its authors – one of the most cited papers in the discipline of sociology in the last decade. Inspiriert von den Vordenkern des amerikanischen Pragmatismus - William James, John Dewey und Richard Rorty - entwickelt Mike Sandbothe ein normativ nachhaltiges Konzept von Medien und Philosophie. Anhand exemplarischer Fallstudien zeigt er auf, wie sich dies in den Kultur- und Medienwissenschaften, den Bildungs- und Sozialwissenschaften sowie in der Psychologie nutzen lässt. Seine pragmatische Medienphilosophie kann dazu beitragen, die Betriebssysteme unserer Bildungsanstalten mit Hilfe von achtsamkeits- und körperbasierten sowie spirituellen Praktiken gesundheitsförderlich zu transformieren.
