En contrepoint à son œuvre mathématique et physique — et en relation avec elle — d'Alembert a développé une théorie de la connaissance influencée par Locke et le sensualisme de Condillac, mais centrée avant tout sur une épistémologie de la physique newtonienne. Réaliste, prônant le recours à l'expérience, il est en même temps profondément rationaliste, et même précisément, quoiqu'il s'en défende plutôt, dans la lignée de Descartes, Mais, bien que la Raison soit sa référence fondamentale, à tel point qu'il voudrait (...) fonder sur ses principes les plus évidents toute la science physico-mathématique — c'est-à-dire par excellence la Mécanique —, son programme ne peut être dit cartésien : non seulement il rejette les idées innées, mais il accepte la critique d'une rationalité apparente requise par la considération de faits irréductibles (l'attraction par exemple). Son épistémologie est un réalisme rationnel référé à l'être même de la Nature (la Raison et la Nature se rejoignent en profondeur). C'est en fonction de ces conceptions qu'il accepte ou rejette certaines notions physiques soit ambiguës, soit incertaines. Son rejet du concept de force comme celui de la considération d'une texture intime des corps semblent en faire, par le refus de ce qui ne serait pas directement mesurable, l'annonciateur du positivisme de Laplace et de Comte : une telle interprétation serait inexacte, et d'Alembert considère que la pensée peut parvenir à la connaissance du réel. Si ses conceptions s'élaborent en contrepoint de son activité scientifique, c'est en même temps en lutte et polémique contre la métaphysique, au sein de son engagement philosophique — il est tête de file, avec Voltaire, du « parti philosophique » — et notamment dans l'Encyclopédie. Bien qu'il se réfère, comme Newton, à une Intelligence suprême à l'œuvre dans l'Univers, il n'est pas déiste et affiche bientôt une position sceptique. Sa recherche et son affirmation de l'autonomie des lois de la Nature sont a-thées au sens privatif qui annonce Laplace. Il s'oppose au matérialisme de d'Holbach ou Helvétius, mais il se rapproche peu à peu — et notamment vers 1765, sans doute sous l'influence de Diderot qui rédigea vers cette époque Le rêve de d'Alembert et avec qui il venait de renouer — d'un matérialisme dynamique : mais, ce matérialisme, il ne le professe qu'en privé (essentiellement dans sa correspondance avec Frédéric de Prusse). L'âme est matérielle, et si « le plus simple raisonnement prouve qu'il y a un être éternel » , ce Dieu est matériel, il « n'est que la matière en tant qu'intelligente » , ce qui rejoint la définition du matérialisme donnée par Diderot dans l'Encyclopédie. Toutefois, refusant de se prononcer sur l'en-soi des choses, et sur la nature de la matière elle-même, comme de se définir métaphysiquement, son matérialisme tardif est encore marqué de scepticisme. A la fin de sa vie, en 1715‚ Leibniz rédige, en marge d'entretiens et de sa correspondances avec Adam Theobald Overbeck, l'opuscule intitulé ' Αποκατάσταστς πάντων. II y examine hypothetiquement une version originate de l'argument en faveur de l'Eternel Retour des mêmes cycles periodiques dans l'histoire des Etats ou des individus. Cette version est la suite et le développement de la preuve que Leibniz avait examinee en 1693 dans De l'Horizon de la Doctrine humaine‚ pour etablir le caractére fini de (...) l'ensemble des vérités qui peuvent être formulées avec les ressources d'un alphabet fini. A ce compte, le nombre des vérités de fait, qui constituent la matiére des livres d'histoire, est lui aussi fini. Si l'on accorde un principe de correspondance qui associe de maniére univoque les évenements aux énoncés qui les relatent, il en resulte que l'ensemble des evenements historiques est fini, et qu'a supposer que ies homines perdurent assez longtemps dans le meme 6tat ou ils sont, les memes evenements finiront par se reproduire, et lês memes acteurs reviendront sur le « théâtre du monde». L'article examine les presupposés de l'argument de Leibniz du point de vue de sa conception de la connaissance historique. Il esquisse ensuite quelques points saillants de Thistoire du mot et de l'idée d'άποκατάσταστς, à partir d'Origene et du stoïcisme tardif, afin de dégager le sens original que leur confere Leibniz. Enfin, il montre que la loi de continuity et l'idée d'harmonie, qui gouvernent le cours des choses, permettent à Leibniz de surmonter la contrainte apparente de Pargument tire de la Combinatoire: une perspective de progres infini s'ouvre alors aux esprits « qui connaissent et recherchent la vérite » ; il n'y a pas pour eux d’ « horizon de leur science future » , ni de retour a lidentique. S'il est vrai que l'auteur des Actes des Apôtres peut être en un sens considéré comme le premier historien du christianisme, s'il est également vrai que les Ile et Ille siècles ont vu naître des écrits qui ont entre autres une portées historique , c'est avec Eusèbe de Césarée que surgit la conscience de produire, avec son Histoire ecclésiastique, quelque chose de nouveau : « Je suis, en effet, le premier, écrira-t-il, à m'avancer pour ainsi dire sur un chemin désert (...) et inviolé. » Après avoir étudié l'oeuvre d'Eusèbe, M. Fédou présente ses continuateurs en Orient et en Occident avant d'examiner sa position par rapport à l'historiographie païenne et la manière dont les historiens plus tardifs ont interprété l'histoire de l'Eglise pendant et après la crise de l'arianisme.If it is true that the author of the Acts of the Apostles can be considered in a sense the first historian of Christianity, and if it is also true that the 2rd and 3rd centuries saw the birth of writings that, among others, have a historical importance, , it is, nevertheless, Eusebius of Caesarea who gave rise to an awareness of producing something new with his Ecclesiastical History. He wrote: “I am, indeed, the first to go forward, as it were, on a deserted and inviolate road.” After studying the work of Eusebius, M. Fédou presents his commentaries on East and West before examining his position as regards pagan historiography and the manner in which later historians had interpreted the history of the Church during and after the crisis of Arianism. Depuis 2006, le Québec débat âprement des règles gouvernant la laïcité de ses institutions et se trouve confronté à deux modèles apparemment irréconciliables : le républicanisme « jacobin » et le libéralisme individualiste, issus respectivement de la France et du Canada. En s’inspirant de la pensée du philosophe politique John Rawls, les auteurs proposent ici d’explorer une voie médiane mieux adap­tée à l’expérience québécoise. Dans ses travaux tardifs, Rawls met en avant une forme de libéralisme républicain affranchi de l’indi­vidualisme normatif (...) de Kant et de Mill et récuse le paternalisme qui vise à imposer aux citoyens une certaine éthique de vie. Tout en étant neutre à l’égard des conceptions individualiste et com­munautarienne de la personne, il cherche à équilibrer les droits collectifs des peuples avec les droits individuels des personnes. -/- C’est donc une conception strictement institutionnelle de la laïcité que présentent les auteurs, qui redéfinissent au passage l’interculturalisme, la liberté rationnelle et le consentement, ainsi que l’expérience religieuse, qui devient hybride, à la fois subjective et objective. En se servant de Rawls, ils expliquent clairement pourquoi l’expression de la religion fait partie de la liberté reli­gieuse, mais aussi pourquoi il faut faire la distinction entre les objets qui relèvent des libertés fondamentales et ceux qui sont sujets à des accommodements. Ils tracent ainsi une authentique troisième voie, qui pourrait bien faire sortir de l’impasse le débat québécois sur la laïcité. (shrink)

Le divorce entre théologie dogmatique et théologie spirituelle depuis le Bas Moyen Âge a été fréquemment dénoncé. Il a souvent été associé à la décadence de la théologie scolastique qui se serait éloignée de ses sources bibliques et aurait privilégié une technicité dialectique, finissant par tourner à vide. Le succès du nominalisme a été également invoqué comme cause à cet état de fait. On suggère ici une nouvelle hypothèse explicative: le Moyen Âge tardif voit l’avènement d’une nouvelle conception de (...) la volonté, non plus liée organiquement au jugement de l’intellect pratique mais conçue comme une instance auto-déterminante autonome par rapport à l’intellect. Les affects, l’influence d’autres volontés deviennent alors des instances importantes de la décision par laquelle la volonté opte pour Dieu. (shrink)

À rebours d’une telle interprétation, et prenant appui sur un ensemble de notes de jeunesse parfois inédites, (...) cette étude se propose au contraire de montrer qu’une telle « solitude », parce qu’elle permet de conférer à l’idée même de « subjectivité » une signification tout à fait nouvelle et originale, constitue aux yeux de M. Em minha tese de doutorado defendi que, para compreender como Hegel articula a passagem da contradição dialética à lógica, o conceito hegeliano de contradição deve ser analisado sob a perspectiva de uma antinomia. Para sustentar este argumento, propus uma atualização deste conceito a partir de uma estrutura antinômica. Essa atualização, porém, trouxe um outro problema: nessa reconstrução, a contradição, em Hegel, continua a se desenvolver de maneira gradativa, ao passo que a lógica tradicional trabalha apenas com valores de p e (...) -p, e não com níveis de gradação. Assim, para continuar sustentando o argumento de que o conceito hegeliano de contradição, sob a perspectiva de uma antinomia, pode ser compreendido como uma contradição lógica, seria necessário encontrar uma lógica que não operasse apenas com valores binários, mas também com níveis de gradação. Foi a partir dessa necessidade que surgiu a ideia de aplicar o conceito de contradição em Hegel à Lógica Difusa, e esta é, portanto, a proposta do presente artigo. (shrink)

As part of recent epistemic challenges to democracy, some have endorsed the implementation of epistemic constraints on voting, institutional mechanisms that bar incompetent voters from participating in public decision-making procedures. This proposal is often considered incompatible with a commitment to political equality. In this paper, I aim to dispute the strength of this latter claim by offering a theoretical justification for epistemic constraints on voting that does not rest on antiegalitarian commitments. Call this the civic accountability justification for epistemic constraints (...) on voting. On this view, voters stand to one another in a normative relation of reciprocal accountability that requires them to uphold an epistemically responsible conduct. Modest epistemic constraints on voting are justifiable because they secure that participation in voting is conforming to this normative requirement. Thanks to its distinctive features, the civic accountability justification can overcome two problems that egalitarians commonly associate with the idea of epistemic constraints on voting: the disrespect problem and the hierarchy problem. This essay argues that what separates poor mothers from their middle class counterparts are many factors — not simply couples' ability to plan, the power of their choices, and agency. For example, power, social clout, and access to health care influence status and parenting. Historically, for white women choice has been about abortion; for many women of color, choice is about being able to be a mother. This essay begs the question whether real parallels can be drawn on questions of (...) contraception, abortion, and ART simply by examining class and to what extent race and sexual orientation matter in research on parenting. We argue that in extensive decision problems (extensive games with a single player) with imperfect recall care must be taken in interpreting information sets and strategies. Alternative interpretations allow for different kinds of analysis. We address the following issues: 1. randomization at information sets; 2. consistent beliefs; 3. time consistency of optimal plans; 4. the multiselves approach to decision making. This paper applies Plato’s cave allegory to Enron’s success and downfall. Plato’s famous tale of cave dwellers illustrates the different levels of truth and understanding. These levels include images, the sources of images, and the ultimate reality behind both. The paper first describes these levels of perception as they apply to Plato’s cave dwellers and then provides a brief history of the rise of Enron. Then we apply Plato’s levels of understanding to Enron, showing how the company created its image (...) and presented information to support that image, and how the public eventually emerged from the cave to realize the truth about Enron’s actual accounting practices and financial state, which led to the corporation’s downfall. We find Plato’s allegory both useful in analyzing the relationship between Enron and the public and instructive about the power and moral responsibility of Enron’s executives. (shrink)

For nearly five years, bioethicists and neurologists debated whether Jahi McMath, an African American teenager, was alive or dead. While Jahi's condition provides a compelling study for analyzing brain death, circumscribing her life status to a question of brain death fails to acknowledge and respond to a chronic, if uncomfortable, bioethics problem in American health care—namely, racial bias and unequal treatment, both real and perceived. Bioethicists should examine the underlying, arguably broader social implications of what Jahi's medical treatment and experience (...) represented. On any given day, disparities in the quality of health care and health outcomes for people of color in comparison to whites are evidenced in American hospitals and clinics. These disparities are not entirely explained by differences in patient education, insurance status, employment, income, expressed preference for treatments, and severity of disease. Instead, research indicates that, even for African Americans able to gain access to health care services and navigate institutional nuances, disparities persist across a broad range of services, including diagnostic screening and general medical care, mental health diagnosis and treatment, pain management, HIV‐related care, and treatments for cancer, heart disease, diabetes, and kidney disease. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

The pluralist sheds the more traditional ideas of truth and ontology. This is dangerous, because it threatens instability of the theory. To lend stability to his philosophy, the pluralist trades truth and ontology for rigour and other ‘fixtures’. Fixtures are the steady goal posts. They are the parts of a theory that stay fixed across a pair of theories, and allow us to make translations and comparisons. They can ultimately be moved, but we tend to keep them fixed temporarily. Apart (...) from considering rigour of proof as a fixture, I discuss fixed models, invariant notions and fixed information about objects across theories. In technologically grounded organizations, culture is bound tightly to the material characteristics of the technology that the organization manufactures, distributes, or services. Technological grounding helps explain why high-technology organizations often experience cultural integration problems following a merger. Examining the recent merger of US West and Qwest, this article analyzes how powerful actors strategically used the process of technological grounding to enroll a core technology to situate postmerger integration in technological terms, creating a discourse of inevitability that then justified publicly Qwest's (...) cultural domination of US West. It is often claimed that democratic voters have epistemic responsibilities. However, it is not often specified why voters have such epistemic responsibilities. In this paper, I contend that voters have epistemic responsibilities because voting is best understood as an act that bears assertoric force. More precisely, voters perform what I call an act of political advocacy whereby, like an asserter who states or affirms that something is the case, they state or affirm that a certain course of political action is (...) the one that should be followed or enacted. Consequently, the performance of acts of political advocacy such as voting should be understood as bounded by epistemic norms mirroring those binding the act of assertion and yield epistemic responsibilities mirroring the ones required to satisfy these norms. This paper explores the similarities between a crucial passage in Robert Grosseteste’s commentary on Posterior Analytics and the commentary on Nicomachean Ethics 6 written by the Byzantine commentator Eustratius of Nicaea (d. ca. 1120). According to the present author, Eustratius may be the direct source of Grosseteste’s epistemology and concept formation theory in the commentary. A tentative revision of the chronology of Grosseteste’s Greek studies may be necessary to account for the relationship between the two texts.

Since the beginning of the 1990s, the debate on expert evidence has constantly been growing. This article tries to give two separate contributions to a subsection of this debate, the one related to the alternative between deference and education. First, it contains an attack to the arguments that Ronald Allen and others have given in favor of the thesis according to which experts should perform a merely educational role at trial. Second, it maintains that the question of whether fact finders (...) should ever “defer” to experts or should be allowed to draw on their opinions only if they “understand” them should be clarified by introducing a distinction between two different senses “deference”, which is paralleled by a similar distinction between two senses of “understanding”. The concept of the digital phenotype has been used to refer to digital data prognostic or diagnostic of disease conditions. Medical conditions may be inferred from the time pattern in an insomniac’s tweets, the Facebook posts of a depressed individual, or the web searches of a hypochondriac. This paper conceptualizes digital data as an extended phenotype of humans, that is as digital information produced by humans and affecting human behavior and culture. It argues that there are ethical obligations to persons (...) affected by generalizable knowledge of a digital phenotype, not only those who are personally identifiable or involved in data generation. This claim is illustrated by considering the health-related digital phenotypes of precision medicine and digital epidemiology. (shrink)

This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. Luciano Floridi was not the first to discuss the idea of group privacy, but he was perhaps the first to discuss it in relation to the insights derived from big data analytics. He has argued that it is important to investigate the possibility that groups have rights to privacy that are not reducible to the privacy of individuals forming such groups. In this paper, we introduce a distinction between two concepts of group privacy. The first, the “what happens in Vegas (...) stays in Vegas” privacy (in the following: WHVSV privacy), deals with confidential information shared with the member of a group and inaccessible to (all or a specific group of) outsiders. The second, to which we shall refer as inferential privacy, deals with the inferences that can be made about a group of people defined by a feature, or combination thereof, shared by all individuals in the group. We show why we unreservedly agree with Floridi that groups can have a form of privacy that amounts to more than the mere fact of being sets of individuals each of whom has individual privacy; moreover, like Floridi, we find it plausible that at least some groups (those satisfying our definition of type-a groups) may have a right to a species of group privacy (that is, WHVSV privacy) as groups (and not just as individuals who belong to those groups). However, by turning our attention to the context of big data analytics, we show that the relevant, new notion of group privacy is one of inferential privacy. We argue that an absolute right (either of individuals or groups) to inferential privacy is implausible. We also show that many groups generated algorithmically (those satisfying our definition of type-b groups) cannot be right holders as groups (unless they become type-a groups). (shrink)

The intriguing issue of pain and suffering in patients with disorders of consciousness (DOCs), particularly in Unresponsive Wakefulness Syndrome/Vegetative State (UWS/VS) and Minimally Conscious State (MCS), is assessed from a theoretical point of view, through an overview of recent neuroscientific literature, in order to sketch an ethical analysis. In conclusion, from a legal and ethical point of view, formal guidelines and a situationist ethics are proposed in order to best manage the critical scientific uncertainty about pain and suffering in DOCs (...) and ensure the best possible care for the patient. ABSTRACTCommerce changes the production of wealth in a society as well as its ethics. What is appropriate in a non-commercial society is not necessarily appropriate in a commercial one. Adam Smith criticizes Stoic self-command in commercial societies, rather than embracing it, as is often suggested. He argues that Stoicism, with its promotion of indifference to passions, is an ethic appropriate for savages. Savages live in hard conditions where expressing emotions is detrimental and reprehensible. In contrast, the ease of life brought (...) about by commerce fosters the appropriate expressions and sharing of emotions. Imposing Stoicism on a commercial society is therefore imposing an ethic for savages onto a refined society – something to abhor. Smith’s rejection of Stoicism in commercial societies can thus be seen as a defence of commerce. (shrink)

For the past two decades, Einstein's Hole Argument (which deals with the apparent indeterminateness of general relativity due to the general covariance of the field equations) and its resolution in terms of "Leibniz equivalence" (the statement that pseudo-Riemannian geometries related by active diffeomorphisms represent the same physical solution) have been the starting point for a lively philosophical debate on the objectivity of the point-events of space-time. It seems that Leibniz equivalence makes it impossible to consider the points of the space-time (...) manifold as physically individuated without recourse to dynamical individuating fields. Various authors have posited that the metric field itself can be used in this way , but nobody so far has considered the problem of explicitly distilling the "metrical fingerprint" of point-events from the gauge-dependent elements of the metric field. Working in the Hamiltonian formulation of general relativity, and building on the results of Lusanna and Pauri (2002), we show how Bergmann and Komar's "intrinsic pseudo-coordinates" (based on the value of curvature invariants) can be used to provide a physical individuation of point-events in terms of the true degrees of freedom (the "Dirac observables") of the gravitational field, and we suggest how this conceptual individuation could in principle be implemented with a well-defined empirical procedure. We argue from these results that point-events retain a significant kind of physical objectivity. (shrink)

This paper focuses on the ethical dilemmas created by advanced technology that would allow patients with motor neurone disease to be sustained by artificial ventilation. The author attempts to support the patient's right to informed choice, arguing from the perspective of autonomy as a first order principle. The counter arguments of caregiver burden and financial restraints are analysed. In the UK, where active euthanasia is not legalized, the dilemma of commencing ventilation is seen to be outweighed by the problems of (...) withdrawing this treatment. The lack of accurate data and protocols that would clarify the current situation is emphasized and the conclusion takes the form of a recommendation for further research. (shrink)

This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

"L'un des aspects les plus intrigants de l'œuvre de Michel Foucault réside dans son intérêt tardif pour la pensée antique, plus spécialement pour la culture grecque et son héritage romain qu'on peut faire remonter à ses recherches ayant mené, à partir de 1976, à son Histoire de la sexualité. Du fait même de l'infléchissement que connut alors sa pensée, Foucault fut à même d'établir des liens à tous égards originaux et même surprenants entre la pensée antique et la réflexion (...) moderne. En le lisant, c'est une tradition de près de 2500 ans qui s'offre désormais à notre regard. Que nous apprend, sur notre histoire, le fait de mettre en parallèle les propos de Socrate et ceux de Kant? À quoi peut servir l'interrogation menée sur la sexualité antique, si ce n'est peut-être à la « dépsychologiser », la « dépathologiser », la « détaxonomiser », et ainsi la « désenclaver » de ses classifications ultérieures? Que nous enseigne le fait d'entendre par « modernité » non plus une « époque » particulière de l'histoire, mais une manière d'être des individus, une certaine attitude adoptée, « ce que les Grecs, souligne Foucault, appelaient un ' éthos ' »? De quelle manière, finalement, l'esprit critique moderne s'éclaire-t-il de l'esprit critique antique? Les études ici rassemblées posent ces questions à Foucault, avec Foucault et parfois aussi contre Foucault, en écho toujours à ce « courage de la vérité » dont il incarna si splendidement l'exemple."--Page 4 de la couverture.
