This article discusses the use of orthodox rational choice theory in the context of moral contractarianism. The article’s goals are threefold. First, the article clarifies the nature of moral contractarianism and corrects a fundamental misconception. Second, it responds to criticism that follows from this misconception. It shows that the criticism either misconstrues the nature of moral contractarianism or does not apply. Third, the article clarifies the limited role that formalization can play in the context of moral contractarianism. At best, such (...) formalization complements and, at worst, distracts from the true nature of the theory and, more generally, from the central role that the context of choice plays for the justification of moral principles in contractarian moral theory. The advantages of adopting a realist semantics within linguistics are seen as: first, such semantics can allow for meaningful disagreements between speakers; and second, such semantics minimizes indeterminacy. These two advantages are translated into comparable advantages for such semantics if used in law. Three different versions of realist semantics are distinguished within recent legal theory. Only one of these is deemed capable of delivering the advantages of a truly realist semantics. Although a broad applicability of realist semantics is defended—to cover (...) terms referring to functional and moral as well as natural kinds—a limited role for realist semantics within legal interpretation is defended. Such semantics may provide the first word in legal interpretation; it never provides the last word. The application of realist semantics to law itself is finally assayed. One of the most powerful traditions of the Jewish fascination with language is that of the Name. Indeed, the Jewish mystical tradition would seem a two millennia long meditation on the nature of name in relation to object, and how name mediates between subject and object. Even within the tide of the 20th century's linguistic turn, the aspect most notable in - the almost entirely secular - Jewish philosophers is that of the personal name, here given pivotal importance in the (...) articulation of human relationships and dialogue. The Name of God in Jewish Thought examines the texts of Judaism pertaining to the Name of God, offering a philosophical analysis of these as a means of understanding the metaphysical role of the name generally, in terms of its relationship with identity. The book begins with the formation of rabbinic Judaism in Late Antiquity, travelling through the development of the motif into the Medieval Kabbalah, where the Name reaches its grandest and most systematic statement - and the one which has most helped to form the ideas of Jewish philosophers in the 20th and 21st Century. This investigation will highlight certain metaphysical ideas which have developed within Judaism from the Biblical sources, and which present a direct challenge to the paradigms of western philosophy. Thus a grander subtext is a criticism of the Greek metaphysics of being which the west has inherited, and which Jewish philosophers often subject to challenges of varying subtlety; it is these philosophers who often place a peculiar emphasis on the personal name, and this emphasis depends on the historical influence of the Jewish metaphysical tradition of the Name of God. Providing a comprehensive description of historical aspects of Jewish Name-Theology, this book also offers new ways of thinking about subjectivity and ontology through its original approach to the nature of the name, combining philosophy with text-critical analysis. Weakness of the will remains a perplexing issue. Though philosophers have made substantial progress in homing in on what counts as a weak will, there is little agreement on whether weakness of the will is irrational, and if so, why. In this paper, we take an empirical approach towards the rationality of weakness of the will. After introducing the philosophical debate, we present the results of an empirical study that reveals that people take a “dual sensitivity”, as we shall put (...) it, towards assessing the rationality of weak-willed behavior. Put succinctly, intending X against your value judgements is assessed irrational; yet, in the same situation, intending X is assessed significantly less irrational if you judge X as something you ought to do. After discussing this result, we turn to the question of whether there is a plausible theory of rationality than can account for the dual sensitivity of the rationality assessments. We show that a success-based account can make sense of the dual sensitivity our empirical results reveal. (shrink)

First, this article introduces the person and work of Jacques Ellul and highlights important aspects of his writing on surveillance, power, and violence. It shows that Ellul’s critique of surveillance predates the work of other critics of surveillance such as Michel Foucault, Gilles Deleuze, and Giorgio Agamben. This provides a conceptual sociological frame for the more philosophical, theological, and ethical work provided in the conclusion. Second, this essay engages Ellul’s reading of Ecclesiastes, as provisionally demonstrated here, to uncover the wisdom (...) of this curious scriptural text that can help individuals and groups to think and live well in surveillant environments. Studies have consistently shown that LGBTQ individuals are at increased risk for several mental and physical health challenges including suicidality. The relationship between religion and LGBTQ well-being in general and LGBTQ suicidality specifically has increasingly been the subject of scholarly investigation. This systematic review examines all peer-reviewed articles included in the EBSCO PsycInfo database since 2000 that examined the relationship between religiosity and LGBTQ suicide (50 studies in all). These studies reveal a complex relationship that is nuanced and, at times, (...) contradictory. Overall, 65% identified at least one religiosity-related predictor as a risk factor for LGBTQ suicidality, 41% identified at least one religiosity-related predictor as a protective factor against suicidality, while 53% found no associations between religiosity-related predictors and suicide risk. However, when specifically examining religious affiliation/denomination, salience, or beliefs and behaviors, typically, religiosity was either protective or unassociated with LGBTQ suicidality. This held particularly true for studies that had population-based samples, employed control variables and included comparison groups, thus enhancing their generalizability. The one religiosity-related predictor that was almost universally identified as a risk factor was when an individual felt conflicted between their religious and sexual-gender identities. (shrink)

Both trolleys and war leave innocent victims to suffer death and injury. Trolley problems accounting for the injured, and not only the dead, tease out intuitions about liability that enhance our understanding of the obligation to provide compensation and medical care to civilian victims of war. Like many trolley victims, civilians in war may suffer justifiable, excusable, or negligent harms that demand compensation. Chief among these is collateral harm befalling civilians. Collateral harm is endemic to war and comprises permissible but (...) unavoidable death or injury following necessary and proportionate military operations. Although state armies sometimes offer condolence payments for civilian death, injury, and property loss, they deny liability. Instead, they use compensation to enhance counterinsurgency efforts and assuage feelings of agent regret. As part of the medical rules of eligibility, Coalition forces in Iraq and Afghanistan also provided medical care to victims of collateral harm. However, they denied care to similarly sick or injured civilians. While compensation is often justified to cure the harm civilians suffer, the differential use of medical resources is not. Rather, medical care remains subject to the principle of beneficence and medical need. The duty to provide civilian healthcare in war, particularly in wars of humanitarian intervention, is far-reaching and imposes significant costs that military and medical ethics are yet to recognize. This essay examines Czech philosopher Jan Patočka’s phenomenology as a philosophy of freedom. It shows how Patočka’s phenomenological concept of worldliness, initially cast within a largely philosophical framework as the domain of human action and transcendence, turned toward a philosophical history of the modern age, viewed as increasingly post-European. Patočka hoped for the moral renewal of a fallen modernity, led first by non-Europeans after the era of decolonization and then by a “solidarity of the shaken” during the dark 1970s of (...) In this short note, I discuss the viability of truth-conditional semantics in light of Pietroski’s criticisms. I explore an alternative view that follows Pietroski in putting emphasis on the relation of meanings to concepts, but makes some room for truth conditions.

This volume explores the experiences of those with little or no power—usually, although not exclusively, animals. The theme of animals as experiencing entities is what links the chapters and characterises the volume. Broadly each author in this volume contributes in one of two ways. The first group, in Section 1, theoretically engages animal subjectivity, animal experiences, and ways in which these are to some extent accessible and knowable to humans. The second group of authors, in Section 2, offer narrative accounts (...) about specific animals or groups of animals and explore to some extent their subjective historical experiences. In summary, the first section diversely theorises about animal experiences, while the second section’s authors assume animals’ subjective experiences and construct narratives that take into account how animals might have subjectively experienced historical phenomena. This essay argues that Kant’s conception of regulative ideas of practical reason introduced in the Critique of Pure Reason serves an important twofold function in his political philosophy. First, Kant’s version of the ideal, Platonic republic acts as the a priori paradigm of a rightful state to which existing regimes can and should conform. Second, Kant frames the regulative status of such practical ideas as a resolution of the conflict between the extremes of dogmatism and skepticism. In his principal political (...) writings from the 1790s—i. e., “Theory and Practice,” “Perpetual Peace,” and the Doctrine of Right—Kant draws on his account of practical ideas in the Critique to articulate a counterfactual norm of popular sovereignty that distinguishes his political standpoint from opponents on the left and the right. Radicals repeat the error of the dogmatists by affirming that the norm of collective self-legislation is completely attainable in experience. By contrast, conservatives make the mistake of the skeptics by denying that rational political standards can be applied to reality at all. I show that Kant reconciles these extremes through his model of gradual, non-violent political reform guided by the regulative ideal of a perfectly self-legislating state. (shrink)

The COVID-19 pandemic crisis has necessitated widespread adaptation of revised treatment regimens for both urgent and routine medical problems in patients with and without COVID-19. Some of these alternative treatments maybe second-best. Treatments that are known to be superior might not be appropriate to deliver during a pandemic when consideration must be given to distributive justice and protection of patients and their medical teams as well the importance given to individual benefit and autonomy. What is required of the doctor discussing (...) these alternative, potentially inferior treatments and seeking consent to proceed? Should doctors share information about unavailable but standard treatment alternatives when seeking consent? There are arguments in defence of non-disclosure; information about unavailable treatments may not aid a patient to weigh up options that are available to them. There might be justified concern about distress for patients who are informed that they are receiving second-best therapies. However, we argue that doctors should tailor information according to the needs of the individual patient. For most patients that will include a nuanced discussion about treatments that would be considered in other times but currently unavailable. That will sometimes be a difficult conversation, and require clinicians to be frank about limited resources and necessary rationing. However, transparency and honesty will usually be the best policy. In particular they identify the “real distinction between act and potency (form and matter)” as “the key philosophical principle” that created the “essential (...) unity of their theological project.” This principle expresses the fundamental distinction between God and creation. Yet the prominence of this philosophical principle in Aquinas and his commentators raises a question: To what extent can a philosophical principle be prior to a theological project?2 Would not it be more faithful to the witness of Scripture and the creeds to begin with revealed theological principles and then adopt philosophical principles that fit within that theological worldview? [End Page 341]This way of approaching the problem reveals both a profound misunderstanding and a profound concern. First, nervousness over philosophical principles reveals a profound misunderstanding since human beings always remain within language and the world and thus the meaning of that language and its references to the world around us must necessarily be part of the reception and transmission of divine revelation. To avoid philosophical principles would be tantamount to adopting a philosophical principle of pluralism or eclecticism.3 Second, there is a legitimate concern that some philosophical principles or understandings of God and human beings could constrain the newness of divine revelation along the lines of a rationalistic deism as was attempted by Locke and others. This concern also takes the form of the desire to bring theology back to its central relationship with sacred Scripture, with the concern that a philosophically determined theological hermeneutics would distance theology from the world of biblical revelation.Aquinas’s presentation of theology, or sacra doctrina, as a scientia helps here by distinguishing between philosophical truths about God and human beings and philosophical principles by which human beings receive theological truths about God and human beings.4 Aquinas shows that the principles of the scientia of sacra doctrina are taken properly from divine revelation received by the faith.5 Thus, the principled understandings of God and the human creature come from revelation, not from natural reason or philosophy, by which only a few could come to know some truths, after a long time, with an admixture of error.6 Nonetheless, the human creature cannot but receive this revelation as true. Many religious thinkers-theists as well as atheists-might regard this as a vain project. The criticisms of Hume and Kant, as well as a certain suspicion of the validity of the principles of sufficient reason and intelligibility, appear to have demolished all grounds for such an argument. Many find no contradiction in affirming the existence of the whole universe while denying the existence of God. Barry Miller, on the contrary, does find a contradiction in affirming the existence of even one concrete individual unless the existence of God is also affirmed. His book is a sustained and intriguing attempt to show that contradiction. His argument is based not on the principles of sufficient reason or intelligibility, but strictly on the principle of non· contradiction (172-4). The concrete individual which serves as his starting point and remains his faithful companion throughout the book is a particular existing dog named " Fido," and the way to the existence of God begins with the simple question: " How ever can it be that Fido does exist? " Miller's first task is to establish that his question is not gratuitous by showing that Fido's existence is not a " brute fact" requiring no explanation. The argument given in chapters two and three shows that Fido's existence is very puzzling indeed, requiring conditions that are "apparently impossible to satisfy" (10). The argument begins with BOOK REVIEWS 365 the Fregean position that ontological categories are to he assigned in accordance with linguistic categories. Pp. 422 + viii. $44.50 (hardbound). Is there a rational justification for believing that God, as understood by traditional Western theism, exists? Richard M. Gale uses the tools of analytic philosophy to address some aspects of this question. He intentionally avoids any discussion of inductive arguments which (...) would try to show that the existence of God is the " only possible explanation " of some observable feature of the universe, and concentrates instead on arguments which more generally discuss whether or not belief in God is rationally justified (pp. 3, 241). His book is in some ways a response,to philosophers such as William Alston and Alvin Plantinga who have used analytic philosophy in defense of the theistic claim that God exists. Gale offers a more sbptical account of the ability of reason to justify belief in God. He views his work as beneficial to theism, however, in that it may lead believers to adopt a conception of God which is " more adequate " for inspiring worship and obedience than the traditional notion (p. 3). Before considering " theological arguments " in favor of the existence of God, Gale analyses a number of " atheological " arguments against it. The arguments fall into two categories, epistemological and pragmatic. Epistemological arguments are concerned with justifying any claim to knowledge that God does or does not exist. Pragmatic arguments try to show that belief (or disbelief) in the existence of God is justified by the moral benefits that accrue from it. With the exception of the last chapter, the entire book is devoted to epistemological arguments. Gale views his atheological arguments as " thought experiments " which test the internal consistency of the traditional understanding of various divine attributes and so lead us to improve the logical consistency of our understanding of God. When the traditional under· standing of some divine attribute is shown to involve logical incongruities, the theist is invited to go " back to the drawing board and redesign the particular divine attribute that is the focus of the argument " (p. 3). Atheological arguments are presented first so that the redesigned divine attributes can inform the subsequent analysis of theological arguments in favor of God's existence. Gale is willing to redesign a good number of divine attributes on the basis of often familiar and sometimes rather shaky atheological arguments. The traditional understanding of divine omnipotence, for in· stance, is tested in Chapter 1, using Gale's version of the well known 318 BOOK REVIEWS dilemma of whether an omnipotent God could create a stone so heavy that God could not lift it. Since it is necessary that God ls omnipotent and since it is necessary that an omnipotent being can do anything, it is necessary that God can do anything. Thus, " it is necessary that God can create a stone so heavy that God cannot lift it." But if it is necessary that God can create a stone so heavy that God cannot lift it, then it is possible that there is something that God cannot do. So it is not necessary that God can do anything. Thus we come to the contradiction that it is both necessary and not necessary that God can do anything (p. 18). Gale sees that his premise, " it is necessary that God can create a stone so heavy that God cannot lift it," itself involves a self-contradiction and is equivalent to saying that the omnipotent God can act in such a way that the omnipotent God is simultaneously not the omnipotent God (20). What he fails to see is that attributing to God any action that falls short of perfect activity (e.g., immoral action) involves the same self-contradiction. Nor does he seem to realize that self-contradictory statements of this sort are simply nonsensical. Being devoid of meaning, they can tell us nothing about what God can or cannot do, and so in no way require us to restrict or qualify God's omnipotence. These arguments carefully avoid the repetitiveness one might expect and rather skillfully succeed in (...) revealing a mind concerned with mapping out all the knolls and hollows on the intellectual terrain of the particular issue under consideration. Almost inevitably, any one hook's discussions of such disparate topics will vary in both quality and depth. Some parts of this hook (for example, the chapters on the existence of God and the problem of evil) should he generally accessible to the interested beginner in the philosophy of religion. Chapters 5 and 6 on the goodness of God and the problem of evil are especially well done. Some readers may find the author's use of logical notation to explicate his arguments distracting or alienating, though he takes great pains to explain the symbols he employs in the prose he uses. In addition, he is quite helpful to the reader at the start of each chapter in providing concise previews of the arguments to come. On the whole, this is a hook with occasional flashes of insight and innovation, hut with tangles and tensions in the arguments in other parts. JOSEPH M. Pp. xi + 173. $30.00 (cloth). The Belgian Jesuit Joseph Marechal (1373-1944) is little known in North American philosophical circles. Indeed he is simply little known outside the somewhat small circle of scholars interested in the history 154 BOOK REVIEWS of twentieth century Roman Catholic theology. There Marechal's work, in particular his five volume Le Point de Depart de la Metaphysique (PDM) has a special place of honor. One need but think of Karl Rahner and Bernard Lonergan among his intellectual heirs to recognize the impact of the thinker and of the volumes. The service of Anthony Matteo's Quest for the Absolute (QA) is to provide a clear and concise study of Marechal's thought. It makes a valuable companion to Joseph Donceel's A Marechal Reader (1970). To my knowledge, the only other full-length discussion in English is Otto Muck's The Transcendental Method (1968), a book which is nearly unreadable in its Eng· lish translation if not in its German original. Marechal was a committed and convinced Thomist, but discussing him under the rubric " transcendental method " brings home a critical conjunction between his Thomism and certain strategies more characteristic of Immanuel Kant and his followers. Instead of seeing Kant simply as undermining the objectivity of metaphysics and of natural theology, he came to believe it possible to take the Kantian "turn to the subject" and to show that it had possibilities not dreamed of by Kant himself. One early indication of Marechal's revisionary approach appeared in his notes for a 1914-1915 course on epistemology: "Kant deceives himself in recognizing, in the operations of spirit, only the pure synthesis of an empirical given. The human spirit is at once an empirical faculty and a faculty of the Absolute. This second aspect was only imperfectly grasped by the author of the Critique of Pure Reason." While not neglecting the fruit of that discussion, his (...) framing of the question under the headings of “Gospel” and “Providence” opens a new vista that is evident in his opening question: “What theology of Providence is needed today for the Gospel of salvation?” (7).Although contemporary theology readily affirms the biblical proclamation of God’s universal offer of salvation, its account of God’s salvific action on behalf of each person has become “uncertain and problematic.” Discussions of divine “kenosis, self-limitation, retreat, and powerlessness” have led many to the conviction God’s action must somehow be “limited” (8). The result is the paradox of a limited God attempting to offer universal salvation. The remedy lies in the recovery of a correct understanding of “the sovereignty of God”—the God who acts not only in the “intimacy of human hearts” but also in and through the “happy and unhappy contingencies” of human life (8-9).Durand begins by placing the question of divine action in the context of contemporary theology and culture, considering first the relationship between divine and human action, then the question of God’s action in history, and finally the understanding of divine action that has surfaced in the dialogue between theology and science (chap. 1). God’s action in the world is thought to diminish as humanity matures historically. The sovereign God gives place to the suffering God, who can act only through the actions of humans. The contemporary notion of history itself poses problems for divine action. It is difficult to affirm God’s saving and directing action in history, when history itself has lost its direction: “The loss of confidence in the intelligibility of history also jeopardizes the representation of God as sovereign, cause, author, director or guarantor of history” (29). Finally, the ability of science to explain natural events has led some to the conviction that there is simply no room for God to act in the world without interfering with the order of scientific laws. This book represents the collaborative attempt of a biblical scholar and an ethicist to determine the precise sense in which scriptural texts can be taken as normative for the Christian (...) moral life. The collabora· tion is a fruitful one, its results illuminating not only the problem of method in ethics, but issues of biblical hermeneutics as well. This re· sult is not serendipitous; for the authors, the question of how one ought to live the Christian life and the question of how one ought to interpret Scripture are inextricably linked. Indeed, perhaps it would be more accurate to suggest that, on the account that Fowl and Jones supply, these are different formulations of the very same question. There is no rigid demarcation here between the hermeneutical and the ethical realm, no rigorous sorting out of issues appropriate to each field of inquiry. The authors make good on their introductory promise "to write a single text " rather than simply to generate a series of " alternating perspectives " (p. 3). In the very first chapter of the book, certain typical, even dominant, ways of construing the relationship between Scripture and ethics are briefly reviewed and then rejected. Ethics is commonly perceived as being primarily "concerned with right actions and decisions," the authors contend, while the Bible is viewed as a moral guide for the " particular decisions made by isolated individuals " (p. 5). In contrast, Fowl and Jones argue that " Scripture is primarily addressed not to individuals but to specific communities called into being by God " (p. 8). Moreover, our ethical deliberations ought not to be focused on particular decisions and the formulation of moral principles that bear on those decisions, but rather, on " issues of character and the formation of character in and through socially-embodied traditions" (p. 9). The consequences of such a general position are carefully and sen· sitively explored in this first and in subsequent chapters. The authors reject the assumption that one such consequence must be the conclusion that moral behavior is not, after all, ruled behavior, that one cannot formulate and articulate the principles that govern much of what we do. Their position entails the conclusion, rather, that such principles cannot be meaningfully detached from the communally embodied traditions that engender them. Indeed, they have meaning at all only in· sofar as the individuals describing, interpreting and employing these BOOK REVIEWS 325 principles possess the peculiar habits and beliefs characteristic of the :members of a specific community. In the analysis of any given moral situation, then, the discussion of principles will necessarily presuppose.a discussion of character, of the sorts of persons involved in the situation, their moral beliefs and capabilities. Fossil fuel divestment movements have gained momentum since 2011, aimed at ending fossil fuel use and a move toward a cleaner, affordable, and sustainable energy system, for business and society. The present study investigates the direct impact of fossil fuel divestment announcements on stock prices of firms listed on the United States' stock exchanges. Using an event study and guided by the United Nation's sustainable development goals (SDGs), we test the effects of 116 divestments announcements between 2014 and 2019 on (...) 51 publicly traded fossil fuel companies. Our results suggest that there is a negative effect of these announcements on fossil fuel firm stock prices. Also, we find that the type of fossil fuel firm (coal or oil and gas), the type of divestment (partial, coal only, or full), the timing of the announcement, and the size of the divesting investor have some explanatory power in relation to the (cumulative) abnormal returns following the divestment announcements. While the negative impact on stock prices is not surprising, the reaction from the divested firms after such large divestitures is not consistent with what may be expected, given past reactions to divestitures seeking to achieve different social goals. Given the SDGs, it seems clear why investors are divesting themselves from fossil fuel firms, but why has the reaction to the 116 divestments led to very little change in the way these publicly traded fossil fuel firms do business given their direct and growing impacts on society? We conclude the study with some suggestions for future research. (shrink)
