Based on an ethnography of French trials for trafficking in human beings and aggravated procuring, this article seeks to contribute to the analysis of the reframing, in penal terms, of the struggles engaged in the name of social justice and women’s rights, of which anti-trafficking policies are particularly emblematic. Studying the judging practices and logics at stake during trials reveals how fantasized representations of the pimp and the victim take on substance. In particular, I argue that judges invoke a set (...) of gendered, sexualized and racialized extra-legal norms, which, along with their legal foundations, constitute their knowledge base and impose a moral and penal hierarchy among litigants. Therefore, not only does this analysis contribute to defining the contours of the elusive figures of the pimp and the victim in the penal arena, it also exposes how maintaining public order is based on the perpetuation of a gendered and sexual national order in the name of gender justice. Languages show substantial variability between their speakers, but it is currently unclear how the structure of the communicative network contributes to the patterning of this variability. While previous studies have highlighted the role of network structure in language change, the specific aspects of network structure that shape language variability remain largely unknown. To address this gap, we developed a Bayesian agent‐based model of language evolution, contrasting between two distinct scenarios: language change and language emergence. By isolating the relative effects of (...) specific global network metrics across thousands of simulations, we show that global characteristics of network structure play a critical role in shaping interindividual variation in language, while intraindividual variation is relatively unaffected. We effectively challenge the long‐held belief that size and density are the main network structural factors influencing language variation, and show that path length and clustering coefficient are the main factors driving interindividual variation. In particular, we show that variation is more likely to occur in populations where individuals are not well‐connected to each other. Additionally, variation is more likely to emerge in populations that are structured in small communities. Our study provides potentially important insights into the theoretical mechanisms underlying language variation. (shrink)

The last decade has seen a rise in big data approaches, including in the humanities, whereby large quantities of data are collected and analysed. In this paper, we discuss long-form audio recordings that result from individuals wearing a recording device for many hours. Linguists, psychologists and anthropologists can use them, for example, to study infants’ or adults’ linguistic behaviour. In the past, recorded individuals and communities have resided in high-income countries (HICs) almost exclusively. Recognising the need for better representation of (...) all cultures and linguistic experiences, researchers have more recently started to collect long-form audio recordings in low- and middle-income countries (LMICs). We aim to help researchers to collect, analyse and use these recordings ethically. To do so, we identify four main ethical challenges linked to research that relies on long-form recordings in LMICs. We provide recommendations to overcome these challenges. These considerations should be useful to researchers employing other big data techniques collected via wearables. (shrink)

Mediation is an alternative dispute resolution process that is becoming more and more popular particularly in English-speaking countries. In contrast to traditional litigation it has not benefited from technological advances and little research has been carried out to make this increasingly widespread practice more efficient. The study of argumentation in dispute mediation hitherto has largely been concerned with theoretical insights. The development of argumentation theories linked to computational applications opens promising new horizons since computational tools could support mediators, making sessions (...) quicker and more efficient. For this, we need tools for close analysis of mediation discourse in order to explore the argumentative activity in depth, and ultimately get an accurate image of how dialogues unfold in this particular context. This paper therefore aims at laying the foundations of a theory of close analysis for discourse in dispute mediation. Theories provided by the literature serve as a basis for argumentative analyses of transcripts of mediation sessions in order to deliver a clear image of the argumentative structure. Analyses of the argumentative strategies in mediation discourse will allow for the development of a dialogue protocol that can be used to develop operational models which can be embodied in software to help make the mediation process easier and more effective. ABSTRACTMartin Luther famously denounced Pseudo-Dionysius as ‘downright dangerous; he Platonizes more than he Christianizes.’ In this 500th year of the Reformation I critically examine Luther’s judgement firstly by exploring the Neoplatonic background to ritual in Dionysius, secondly by presenting a Reformed critique of this background and finally by arguing for a distinctively Christian Dionysius who survives this critique.

We regularly intentionally expose ourselves to fictions we take to be likely to elicit in us emotions we generally find unpleasant when prompted by actual states of affairs. This is the so-called “paradox of tragedy”. We contribute to solving the paradox of tragedy by denying that, when fiction-directed, most of these emotions are in themselves unpleasant. We first provide strong evidence that these emotions, such as fear, sadness, or pity, are often enjoyed when fiction-directed. We then advance an explanation of (...) what makes these fiction-directed emotions often not unpleasant, while their reality-directed counterparts are generally so. In the last section, we advance an explanation of what makes fiction-directed emotions often enjoyable, and argue that a complete solution to the paradox of tragedy should be pluralist. (shrink)

Biology seems to present local and transitory regularities rather than immutable laws. To account for these historically constituted regularities and to distinguish them from mathematical invariants, Montévil and Mossio (Journal of Theoretical Biology 372:179–191, 2015) have proposed to speak of constraints. In this article we analyse the causal power of these constraints in the evolution of biodiversity, i.e., their positivity, but also the modality of their action on the directions taken by evolution. We argue that to fully account for the (...) causal power of these constraints on evolution, they must be thought of in terms of normativity. In this way, we want to highlight two characteristics of the evolutionary constraints. The first, already emphasised as reported by Gould (The structure of evolutionary theory, Harvard University Press, 2002), is that these constraints are both produced by and producing biological evolution and that this circular causation creates true novelties. The second is that this specific causality, which generates unpredictability in evolution, stems not only from the historicity of biological constraints, but also from their internalisation through the practices of living beings. Taking Kant’s suspicion of the morality as a simple phantom of the mind as a departing point, we are intending to investigate the central role of the moral consciousness, taken here both as the possible source of this illusion so much as the premise through which one can infer the normativity of reason and assure the reality of duty and of our moral experience. Despite the fact this suspicion be somehow inevitable and remains in the philosopher’s mind as a kind (...) of threat, it has been contrasted with a factual perspective of morality – according to which the experience of morality as an unconditional obligation is by itself an evidence of its intrinsic origin in reason. The semantic poverty of general nouns and their referential versatility could make them excellent means to achieve a co-referential anaphora. Many contexts, however, do not allow a general noun like chose (‘thing’), personne (‘person’) or individu (‘individual’) to reiterate a previously classified referent. The difficulties of such reiterations or the (often pejorative) discursive effects they produce are linked to the referent declassification they involve. In fact, general nouns are distinguished from other superordinate nouns by their weak classifying power. This feature, (...) instead, brings them closer to quality nouns (in Milner’s sense), which appear at the top of the generality continuum in some examples proposed by Halliday & Hasan. (shrink)

Affiliation is both an antecedent and a consequence of emotional mimicry (i.e. imitating a counterpart’s emotional expression). Thus, interacting with a disliked partner can decrease emotional mimicry, which in turn can further decrease liking. This perpetuating circle has not been investigated in the context of mental health stigma yet. The present study tested the influence of the label “schizophrenia” on liking, interpersonal closeness, and emotional mimicry. In an online experiment (n = 201), participants recruited from the general population saw several (...) videos of actors displaying emotional expressions. Actors were described with one of four labels: “schizophrenia”, “healthy”, “diabetes”, and a negative adjective (e.g. “hot-tempered”). Emotional mimicry was measured using OpenFace 2.2. Liking and interpersonal closeness were assessed with questionnaires. Overall, compared to other labels, participants reported less liking and interpersonal closeness to the actor with the schizophrenia label. However, no effect on emotional mimicry was found. The decreased liking of the schizophrenia actors was explained by a lack of knowledge about schizophrenia and the explicit stigma of schizophrenia. Our study contributes to the literature by highlighting the need to reduce the stigma of schizophrenia. (shrink)

Krueger & Funder (K&F) see social psychologists as driven to demonstrate that people's behavior falls below relevant moral and intellectual standards. We suggest that social psychologists search for demonstrations of when it is that people's actual behaviors and decisions deviate from expected or ideal behaviors and decisions, and what these “deviations” tell us about general decision processes, including those that do not produce unexpected actions. Often the discoveries are of positive rather than negative behaviors.

De nombreuses descriptions définies, telles le mari de Jill Biden, pour désigner Joe Biden, et le mari de Melania, pour désigner Donald Trump, y apparaissent sans lien avec le propos des articles, et cela parfois dans des contextes où un pronom personnel serait plus approprié qu’une expression nominale. Nous soulignerons d’abord combien ces descriptions définies s’écartent des emplois ordinaires des expressions référentielles très spécifiées (...) en général et des descriptions définies en particulier et quels risques certaines d’entre elles, relevant de la catégorie des « anaphores présuppositionnelles » de Milner, peuvent présenter pour la bonne interprétation référentielle. Bipedalism is one of the criteria that paleoanthropologists use in order to interpret the fossil record and to determine if a specimen belongs to the human lineage. In the context of such interpretations, bipedalism is considered to be a unique characteristic of this lineage that also marks its origin. This conception has largely remained unchallenged over the last decades, in spite of fossil discoveries that led to the emergence of bipedalism in the human lineage being shifted back by several millions (...) of years. In this paper, I analyze the uses of this criterion in paleoanthropology and demonstrate that interpretative biases (such as underdetermined inferences and circular reasoning) are at play in interpretations of hominin remains. By discussing Darwin’s hypotheses about the evolution of bipedalism, I identify major theoretical issues that need to be addressed in the current debates on hominin evolution. First, the assumption that “man alone has become a biped” (Darwin in The descent of man, and selection in relation to sex, John Murray, London, 1871) is analyzed in the light of recent empirical data. Three major issues are discussed: the definition of “man”, i.e. “human”, the uniqueness of human bipedalism, and the equivocal meaning of being a “biped”. Then, I highlight some of Darwin’s remarks that may be helpful for current debates in paleoanthropology, regarding natural selection in locomotor evolution, as well as taxonomic and phylogenetic significance of functional features. Finally, I analyze two examples of how fossil discoverers referred to Darwin in the recent years and discuss his role as an intellectual support. (shrink)

Recent research has investigated whether people think of their moral beliefs as objectively true facts about the world, or as subjective preferences. The present research examines variability in the perceived objectivity of different moral beliefs, with respect both to the content of moral beliefs themselves (what they are about), and to the social representation of those moral beliefs (whether other individuals are thought to hold them). It also examines the possible consequences of perceiving a moral belief as objective. With respect (...) to the content of moral beliefs, we find that beliefs about the moral properties of negatively valenced acts are seen as reliably more objective than beliefs about the moral properties of positively valenced acts. With respect to the social representation of moral beliefs, we find that the degree of perceived consensus regarding a moral belief positively influences its perceived objectivity. The present experiments also demonstrate that holding a moral belief to be objective is associated with a more ‘closed’ response in the face of disagreement about it, and with more morally pejorative attributions towards a disagreeing other person. This research investigated the effect of divided attention at encoding on feeling-of-knowing . Participants had to learn a 60 word-pair list under two experimental conditions, one with full attention and one with divided attention . After that, they were administered episodic FOK tasks with a cued-recall phase, a FOK phase and a recognition phase. Our results showed that DA at encoding altered not only memory performance, but also FOK judgments and FOK accuracy. These findings throw some light on the central (...) role of the quality of memory encoding to make accurate FOK judgments and provide new evidence supporting the relationship between memory and metamemory judgments. Cet ouvrage est un essai libre sur la vie et l'oeuvre d'Arne Naess, philosophe norvégien, écologiste engagé et alpiniste de renom. Dons les années 1970, Naess développe un "mouvement" écologique - plutôt qu'une philosophie - très personnel : une "écosophie", c'est-ô-dire un lien à l'écosphère et à la nature, cette entité dont nous faisons partie ou même titre que les autres espèces, et non une ressource inépuisable extérieure à nous. Il s'attache donc à adopter une attitude particulière vis-à-vis de l'environnement (...) et à vivre en harmonie avec Io nature. Au-delà de sa pensée philosophique, des ouvrages théoriques et des concepts qu'il développe, Naess invite chacun à découvrir son propre rapport à la nature, dans un processus d'identification - et donc d'empathie -, afin de fonder les bases nouvelles d'une écologie qu'il nomme "profonde". Jamais dogmatique ni extrémiste, l'oeuvre de Naess incite au contraire le lecteur à mettre en oeuvre sa propre "écosophie", créative et tolérante, à s'inventer une vie plus écologique sans bouleverser complètement ses habitudes, voire en améliorant sa qualité de vie. Une perspective écologiste qui pourrait sembler évidente, une nouvelle voie pour le développement personnel, sons école de pensée. (shrink)

Deep brain stimulation has been regarded as an efficient and safe treatment for Parkinson’s disease since being approved by the Food and Drug Administration in 1997. It is estimated that more than 150 000 patients have been implanted, with a forecasted rapid increase in uptake with population ageing. Recent longitudinal follow-up studies have reported a significant increase in postoperative survival rates of patients with PD implanted with DBS as compared with those not implanted with DBS. Although DBS tends to increase (...) life expectancy for most patients with PD, this medical benefit does not come without attendant negative consequences. For example, emerging forms of iatrogenic harms are sometimes induced—harms which were not initially expected when clinicians proposed neurosurgery and patients or their guardians consented to the treatment. We report and discuss the clinical case of a patient who was implanted with DBS more than 20 years ago and is now experiencing unexpected stages of PD. This case illustrates how extending the life span without improving quality of life may introduce a burden of harms for patients and families. As well, this case shows why we should prepare for the expanding numbers of PD-implanted patients experiencing a gain of longevity but with severe stages of disease leading to diminution in quality of life. This newly observed effect of DBS treatment requires us to explore ethical questions related to iatrogenic harms, informed consent, end of life and caregivers’ burden. (shrink)

Having a criminal justice system that imposes sanctions no doubt does deter criminal conduct. But available social science research suggests that manipulating criminal law rules within that system to achieve heightened deterrence effects generally will be ineffective. Potential offenders often do not know of the legal rules. Even if they do, they frequently are unable to bring this knowledge to bear in guiding their conduct, due to a variety of situational, social, or chemical factors. Even if they can, a rational (...) analysis commonly puts the perceived benefits of crime greater than its perceived costs, due to a variety of criminal justice realities such as low punishment rates. These conclusions are reinforced by studies of crime rates following rule changes. Many show no change in deterrent effect. Those that purport to show a deterrent effect commonly have persuasive non-deterrence explanations, such as a change in incapacitative effect. The few studies that segregate deterrent and incapacitative effects tend to reinforce the conclusion that rule formulation has a deterrent effect only in those unusual situations in which the preconditions to deterrence exist. Even there, the deterrent effects are quite minor and unpredictable, hence inadequate grounds to influence criminal law rule making. (shrink)

This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are dealing with professional boundary (...) issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. Ulrich Beck, Jean-Marc Ferry et Jürgen Habermas voient dans l’Union européenne la réalisation d’une démocratie postnationale, capable de se hisser au niveau des enjeux actuels. Les signes de cette réalisation ne se font toutefois pas jour dans des valeurs abstraites, mais dans l’expérience de l’européanisation, lors des commerces transfrontaliers. Après avoir présenté ce paradoxe dans les textes, nous suggérons que l’accent mis sur les expériences ordinaires tient à la place occupée par le droit dans la construction européenne. Le contrôle des (...) libertés de circulation par la Cour de justice de l’Union européenne, caractéristique du marché intérieur, est à l’origine d’une intégration plus large, qui a étendu les droits des opérateurs économiques et forgé le statut de citoyen européen. La jurisprudence de la CJUE a en effet permis d’élargir la portée des droits transnationaux, dans la continuité du droit cosmopolitique kantien, sans dissoudre les États membres dans une association supranationale. Une affiliation postnationale, alternative au modèle de la souveraineté étatique classique, semble ainsi se concrétiser dans l’Union européenne. Cependant, nous suggérons que le crédit accordé à la construction, par la jurisprudence de la CJUE, de la citoyenneté postnationale, risque d’occulter les effets problématiques d’une intégration judiciaire vouée à être essentiellement négative. The perception of time cannot be reduced to a simple percept produced by an internal clock. The aim of the present study was therefore to investigate the role of the individual consciousness of time on temporal judgments. In the present study, the participants’ awareness of attention-related time distortions was assessed using a metacognitive questionnaire. The participants were also required to verbally judge a series of stimulus durations in a single or a dual task condition. The results revealed that time was (...) underestimated in the dual task compared to the single task. However, the accuracy of time judgments improved in line with the participants’ individual awareness of attentional time distortion: The more aware they were of the role of attention in time perception, the lower the time distortions they exhibited. Conscious awareness of time therefore plays a role in the accuracy of the time judgments made by human beings. (shrink)

On a longtemps considéré qu'un seul archonte éponyme de Delphes avait porté le nom de Kléophanès. C'est cet état des connaissances que présente G. Daux, en 1943, malgré les remarques de R. Flacelière (Chronologie delphique L27, 172/ 1 av. J.-C.). En 1949, la publication d'un texte daté par un archonte Kléophanès et attribué au IIIe siècle relança la question du nombre des éponymes de ce nom et des textes qui pouvaient être attribués à l'année de leur magistrature. Grâce à une (...) nouvelle édition des trois textes en suspens et au réexamen des différents critères de datation disponibles, nous proposons de corriger la Chronologie delphique en ajoutant deux archontes nommés Kléophanès au IIIe siècle av. J.-C. : -G27, 2e quart du IIIe siècle (?), connu par FD III 3, 82 ; -K41, 2e moitié du IIIe siècle (?), connu par FD III 4, 427 V. Le texte BCH 63 (1939), p. 160, doit sans doute être attribué à K41 plutôt qu'à G27. L'archontat L27 demeure documenté par la liste chronologique des proxènes et par trois actes d''affranchissement, mais perd un de ses bouleutes. (shrink)
