This chapter sheds light on a response to experimental philosophy that has not yet received enough attention: the reflection defense. According to proponents of this defense, judgments about philosophical cases are relevant only when they are the product of careful, nuanced, and conceptually rigorous reflection. The chapter argues that the reflection defense is misguided: Five studies (N>1800) are presented, showing that people make the same judgments when they are primed to engage in careful reflection as they do in the conditions (...) standardly used by experimental philosophers. In a series of ten preregistered experiments (N=2043), we investigate the effect of outcome valence on judgments of probability, negligence, and culpability – a phenomenon sometimes labelled moral (and legal) luck. We found that harmful outcomes, when contrasted with neutral outcomes, lead to increased perceived probability of harm ex post, and consequently to increased attribution of negligence and culpability. Rather than simply postulating a hindsight bias (as is common), we employ a variety of empirical means to demonstrate that the outcome-driven (...) asymmetry across perceived probabilities constitutes a systematic cognitive distortion. We then explore three distinct strategies to alleviate the hindsight bias and its downstream effects on mens rea and culpability ascriptions. Not all are successful, but at least some prove promising. They should, we argue, be taken into consideration in criminal jurisprudence, where distortions due to the hindsight bias are likely considerable and deeply disconcerting. (shrink)

Computer assisted theorem proving is an increasingly important part of mathematical methodology, as well as a long-standing topic in artificial intelligence (AI) research. However, the current generation of theorem proving software have limited functioning in terms of providing new proofs. Importantly, they are not able to discriminate interesting theorems and proofs from trivial ones. In order for computers to develop further in theorem proving, there would need to be a radical change in how the software functions. Recently, machine learning results (...) in solving mathematical tasks have shown early promise that deep artificial neural networks could learn symbolic mathematical processing. In this paper, I analyze the theoretical prospects of such neural networks in proving mathematical theorems. In particular, I focus on the question how such AI systems could be incorporated in practice to theorem proving and what consequences that could have. In the most optimistic scenario, this includes the possibility of autonomous automated theorem provers (AATP). Here I discuss whether such AI systems could, or should, become accepted as active agents in mathematical communities. (shrink)

Hutto and Myin have proposed an account of radically enactive (or embodied) cognition (REC) as an explanation of cognitive phenomena, one that does not include mental representations or mental content in basic minds. Recently, Zahidi and Myin have presented an account of arithmetical cognition that is consistent with the REC view. In this paper, I first evaluate the feasibility of that account by focusing on the evolutionarily developed proto-arithmetical abilities and whether empirical data on them support the radical enactivist view. I argue that although more research is needed, it is at least possible to develop the REC position consistently with the state-of-the-art empirical research on the development of arithmetical cognition. After this, I move the focus to the question whether the radical enactivist account can explain the objectivity of arithmetical knowledge. Against the realist view suggested by Hutto, I argue that objectivity is best explained through analyzing the way universal proto-arithmetical abilities determine the development of arithmetical cognition. One main challenge of non-platonist philosophy of mathematics is to account for the apparent objectivity of mathematical knowledge. Cole and Feferman have proposed accounts that aim to explain objectivity through the intersubjectivity of mathematical knowledge. In this paper, focusing on arithmetic, I will argue that these accounts as such cannot explain the apparent objectivity of mathematical knowledge. However, with support from recent progress in the empirical study of the development of arithmetical cognition, a stronger argument can be provided. I will (...) show that since the development of arithmetic is (partly) determined by biologically evolved proto-arithmetical abilities, arithmetical knowledge can be understood as maximally intersubjective. This maximal intersubjectivity, I argue, can lead to the experience of objectivity, thus providing a solution to the problem of reconciling non-platonist philosophy of mathematics with the (apparent) objectivity of mathematical knowledge. Welt und Unendlichkeit sind nicht nur Grundbegriffe der Philosophiegeschichte, sondern stehen auch im Zentrum gegenwartiger Debatten um die Moglichkeit und Grenzen von Metaphysik uberhaupt. Versteht man unter Welt die Gesamtheit dessen, was ist, dann stellt sich die Frage nach dem ontologischen Status dieser Seinstotalitat selbst. Wie, wenn uberhaupt, kann die Existenz der Welt sinnvoll gedacht werden? Der Begriff der Unendlichkeit konturiert und verscharft diese ontologische Frage dadurch, dass wir die Ganzheit namens Welt als unendlich erfahren, d. h. so, dass sie (...) unsere in epistemischer Hinsicht endlichen Weltbezuge grundsatzlich ubersteigt. Mit Welt und Unendlichkeit ist daher ein begrifflicher Spannungsraum eroffnet, bei dem es im wortlichen Sinne ums Ganze geht. Einen der bedenkenswertesten Gegenwartsbeitrage zu dieser durch die Begriffe Welt und Unendlichkeit abgesteckten Grundfrage der Philosophie hat Laszlo Tengelyi (1954-2014) geleistet. This article applies the tools of experimental philosophy to the ongoing debate about both the theoretical viability and the practical import of partially aggregative moral theories in distributive ethics. We conduct a series of three experiments (N=383): First, we document the widespread occurrence of the intuitions that motivate this position. Our study then moves beyond establishing the existence of partially aggregative intuitions in two dimensions: First, we extend experimental work in such a way as to ascertain which amongst existing versions (...) of partial aggregation (localised vs. global) chimes more fully with moral common sense. Specifically, we document how, in tie-breaking cases, ‘irrelevant goods’ judgments (Kamm) are just as robust as the original aggregative/non-aggregative pair of judgments that constitute partial aggregation. Second, by pairing laypeople’s moral judgments in standard cases with their intuitions about the limits of permissible self-prioritisation, we investigate whether one prominent explanation of why irrelevant claims may not be aggregated (Voorhoeve’s ‘personal prerogative’ argument) can be said to underpin people’s intuitions about the (ir)relevance relation of claims in conflict cases. We close with a discussion of our findings’ practical and theoretical import and highlight avenues for future research. (shrink)

The concept of a good life is usually assumed by philosophers to be equivalent to that of well-being, or perhaps of a morally good life, and hence has received little attention as a potentially distinct subject matter. In a series of experiments participants were presented with vignettes involving socially sanctioned wrongdoing toward outgroup members. Findings indicated that, for a large majority, judgments of bad character strongly reduce ascriptions of the good life, while having no impact at all on ascriptions of (...) happiness or well-being. Taken together with earlier findings these results suggest that the lay concept of a good life is clearly distinct from those of happiness, well-being, or morality , likely encompassing both morality and well-being, and perhaps other values as well: whatever matters in a person’s life. Importantly, morality appears not to play a fundamental role in either happiness or well-being among the folk. (shrink)

This paper describes the interventions by the International Committee of the Red Cross to support a hospital in Afghanistan during the mid 1990s. We present elements of the interventions introduced in Ghazni, Afghanistan, and consider a number of ethical issues stimulated by this analysis. Ethical challenges arise whenever humanitarian interventions to deal with complex political emergencies are undertaken: among those related to the case study presented are questions concerning: a) whether humanitarian support runs the risk of propping up repressive and (...) irresponsible governments; b) whether humanitarian relief activities can legitimately focus on a narrow range of interventions, or need to broaden to address the range of challenges facing the health system; and c) whether sustainability and quality of care should be routinely considered in such settings. The paper concludes by highlighting the value of case studies, suggesting mechanisms for extending transparency and accountability in humanitarian health interventions, and highlighting the need of contextualising humanitarian work if the interventions are to be successful. This article makes the case for a specific variety of what we call Collective Capital Institutions (CCIs), by returning to the idea of Wage-Earner Funds (WEFs) – a 1970s Swedish policy proposal designed gradually to shift ownership and control over parts of the economy to democratically controlled institutions. We identify two attractive rationales in favour of such a scheme and argue that both can fruitfully be transposed to the current worldwide economic situation. The egalitarian rationale is that WEFs could help (...) in the pursuit of equality by giving a wider set of people a stake in collectively owned companies and a right to their profits. The democratic rationale is that WEFs redistribute not only these profits, but also the power over economic decisions made within companies. We then contrast such schemes for collective capital ownership with the similar but much more privatised proposals set out in, for instance, John Rawls's idea of a ‘property-owning democracy’. We argue that CCIs ultimately are more likely to contribute to the development of the ‘sense of justice’ within society that is needed for a stable just society. We conclude that CCIs deserve a great deal more exploration in academic and political discussions of egalitarian economic systems. (shrink)

Danaher (2016) has argued that increasing robotization can lead to retribution gaps: Situation in which the normative fact that nobody can be justly held responsible for a harmful outcome stands in conflict with our retributivist moral dispositions. In this paper, we report a cross-cultural empirical study based on Sparrow’s (2007) famous example of an autonomous weapon system committing a war crime, which was conducted with participants from the US, Japan and Germany. We find that (i) people manifest a considerable willingness (...) to hold autonomous systems morally responsible, (ii) partially exculpate human agents when interacting with such systems, and that more generally (iii) the possibility of normative responsibility gaps is indeed at odds with people’s pronounced retributivist inclinations. We discuss what these results mean for potential implications of the retribution gap and other positions in the responsibility gap literature. (shrink)

In this paper, I study the kind of questions we can ask about the existence of numbers. In addition to asking whether numbers exist, and how, I argue that there is also a third relevant question: why numbers exist. In platonist and nominalist accounts this question may not make sense, but in the psychologist account I develop, it is as well-placed as the other two questions. In fact, there are two such why-questions: the causal why-question asks what causes numbers to (...) exist and the teleological why-question asks for what purpose numbers exist. I argue that in a psychologist constructivist account, in which numbers are understood to exist as referents of a particular type of culturally shared concepts, both why-questions can get plausible answers. In this article, which is assembled from interviews, the main issues of in silico medicine, present and future, are discussed by three scientists who are directly involved in the implementation and development of in silico techniques.

Since the first diagnosis of an HIV infection in 1956, the number of victims infected with the virus has dramatically increased to 40.3 million in 2005. The countries of sub-Saharan Africa carry the largest burden of HIV/AIDS worldwide. Various programs against the spread of the epidemic in this region have been promised. The objective of this article is to analyze to what extent these programs can achieve a sustainable effect. This article examines in detail the sustainability of thirteen programmes initiated (...) by large American and European pharmaceutical companies. It finds that none of the examined programs offers a fully sustainable solution. However, programs that were organized in cooperation with local authorities or organizations appear suitable to reach sustainable effects in high-prevalencecountries. As a result, cooperation seems to be an important prerequisite to implement the infrastructural measures necessary to guarantee sustainable effects in sub-Saharan Africa. (shrink)

Work has always been a significant source of ethical questions, philosophical reflection, and political struggle. Although the future of work in a sense is always at stake, the issue is particularly relevant right now, in light of the advent of advanced AI systems and the collective experience of the COVID-19 pandemic. This has reinvigorated philosophical discussion and interest in the study of the future of work. The purpose of this survey article is to provide an overview of the emerging philosophical (...) field that engages with the future of work, with a special focus on equality and justice, and to outline a research agenda that can help the field to develop further. Section 2 provides some historical context for the current surge in interest in the topic. Then, we discuss what work is and whether there is a philosophy of work (Section 3). The four main sub-debates we then turn to concern the value of work (Section 4), distributive justice and work (Section 5), productive justice (Section 6), and institutional reforms prompted by changes in how work is organized (Section 7). The final section discusses the importance of the distinction between ideal and non-ideal theory in philosophical investigations into the future of work. (shrink)

If there is a duty of justice to contribute to society, which asks individuals to produce a specific amount of goods and services that can be redistributed, we need a decision-procedure to know when we have done our part. This paper analyses and critically assesses the commonly suggested decision-procedure of relying on market prices to measure the value of one’s contribution. It is usually assumed that a high salary indicates that one’s talents are put to good use, but this presupposes (...) both that market prices of labour are correct reflections of supply and demand, and that market prices are correct reflections of social value. I criticise both assumptions and argue that the social value of a contribution cannot simply be a function of its market value, but is also influenced by the principles of justice that support the duty to contribute. Further, the market solution is incapable of valuing contributions that lack market prices, like non-marketised care labour. The market solution thus fails as a decision-procedure under other than special circumstances. This does not mean, however, that we need to give up the idea of a duty to contribute. (shrink)

Condition essentielle de la responsabilité civile, la notion de causalité reste aujourd’hui difficile à saisir et sujette à nombreuses discussions. Les contributions présentées dans cet ouvrage abordent la question à nouveaux frais, en adoptant un point de vue résolument interdisciplinaire mêlant philosophie, droit et économie. Sont envisagées successivement des difficultés que le contentieux de la causalité met régulièrement en évidence. Ainsi, la difficile articulation entre causalité juridique et causalité scientifique conduit à s’interroger sur le rôle de la science : doit-elle (...) guider le droit ou faut-il considérer que la causalité en droit n’est qu’un “construit” juridique dégagé de toute perspective scientifique ? Sont également évoquées les diverses tentatives de formalisation analytique de la causalité comme l’analyse contrefactuelle, le critère NESS et les définitions probabilistes de la causalité, ainsi que leur capacité à répondre aux questions redoutables suscitées par la présence de co-auteurs multiples ou d’hypothèses de “surdétermination causale”. Ces réflexions fondamentales ouvrent alors sur les autres aspects clefs de la causalité en droit et en économie comme la preuve et le rôle du raisonnement probabiliste, ou les modalités de la contribution à la dette de réparation en présence d’une pluralité de co-auteurs. Est alors mis en évidence l’apport des sciences économiques, qui permet de classer les différentes techniques d’attribution de la responsabilité et de discuter des propriétés économiques des règles de répartition de la charge de la dette de réparation. Cet ouvrage s’adresse aux chercheurs et aux praticiens confrontés aux questions délicates posées par la causalité dans le droit de la responsabilité civile. (shrink)

There is a large literature exploring the effect of norms on the attribution of causation. Empirical research on this so-called “norm effect” has predominantly focused on two data points: A situation in which an agent violates a salient norm, and one in which there is no violation of a salient norm. Since the phenomenon is understood in bivalent terms (norm infraction vs. no norm infraction), most explanations thereof have the same structure. In this paper, we report several studies (total N=479) (...) according to which perceived causation depends on the strength of the norm violated – whether strength is conceived in terms of the norm’s strictness, explicitness or associated punishment. Consequently, the norm effect, properly conceived, is not bivalent but graded in nature, the standard data points (norm violation vs. no norm violation) are but a special case of a broader phenomenon. This, we argue, puts pressure on many, if not most, of the current explanations of the norm effect on causation. (shrink)

The revival of realism for francophone literature has been widely addressed. The essay argues that this comeback stems not only from a social crisis, but from an urgent need to justify the social world. If this new realism can be said to emerge at the end of the 1980s, then its driving force is a melting away of universalism – a loss of claims to global legitimacy, or to speak with a validity encompassing all of human experience, that manifests itself (...) as a fundamental problem in representing the world. The nineteenth century saw the invention of the national hero. His main function was to serve as an ideal for the nation. Latvia, however, is an exception to this general rule: after it regained independence in 1990, the national hero simply disappeared and no heroic image emerged. On the contrary, it was now the victim that became the emblem of Latvia’s regained independence. The country, of course, did not lack “heroes,” for there were in fact many candidates for the creation (...) of a national hero, yet the hero as such no longer seemed to fit the new state. While the path Latvia had chosen of rejecting or refusing national heroes had an impact on its integration into Europe, it also contributed to ongoing frictions among its own ethnic communities. In memory of Alina Margolis-Edelman ABSTRACT The Warsaw Ghetto Uprising is the symbol of the heroism of the Jews during the Holocaust. For decades after the war it has been central for commemorating the Jewish victims. The symbolic meaning of the Uprising has led in the past sixty years to a wide and lively discussion about the meaning of the symbol, for it has often been used to support or justify different political or moral arguments. This article argues against the (...) transformation of the Warsaw Ghetto Uprising into a heroic epic, and offers an alternative approach to its interpretation. (shrink)

The circulation and entanglements of human beings, data, and goods have not necessarily and by themselves generated a universalising consciousness. The "global" and the "universal", in other words, are not the same. The idea of a world-society remains highly contested. Our times are marked by the fragmentation of a double relativistic character: the inevitable critique of Western universalism on the one hand, and resurgent identitarian and neo-nationalistic claims to identity on the other. Sources of an argumentation for a strong universalism (...) brought forward by Western traditions such as Christianity, Marxism, and Liberalism have largely lost their legitimation. All the while, manifold and situated narratives of a common world that re-address the universal are under way of being produced and gain significance. This volume tracks the development and relevance of such cultural and social practices that posit forms of what we call minor universality. It asks: Where and how do contemporary practices open up concrete settings so as to create experiences, reflections and agencies of a shared humanity?
