The reasonable person standard is key to both Criminal Law and Torts. What does and does not count as reasonable behavior and decision-making is frequently deter- mined by lay jurors. Hence, laypeople’s understanding of the term must be considered, especially whether they use it predominately in an evaluative fashion. In this corpus study based on supervised machine learning models, we investigate whether laypeople use the expression ‘reasonable’ mainly as a descriptive, an evaluative, or merely a value-associated term. We find that (...) ‘reasonable’ is predicted to be an evaluative term in the majority of cases. This supports prescriptive accounts, and challenges descriptive and hybrid accounts of the term—at least given the way we operationalize the latter. Interestingly, other expressions often used interchangeably in jury instructions (e.g. ‘careful,’ ‘ordinary,’ ‘prudent,’ etc), however, are predicted to be descriptive. This indicates a discrepancy between the intended use of the term ‘reasonable’ and the understanding lay jurors might bring into the court room. (shrink)

How is knowledge of geometry developed and acquired? This central question in the philosophy of mathematics has received very different answers. Spelke and colleagues argue for a “core cognitivist”, nativist, view according to which geometric cognition is in an important way shaped by genetically determined abilities for shape recognition and orientation. Against the nativist position, Ferreirós and García-Pérez have argued for a “culturalist” account that takes geometric cognition to be fundamentally a culturally developed phenomenon. In this paper, I argue that (...) when understood as moderate versions supported by the state-of-the-art research, the nativist and culturalist views are in fact possible to reconcile. While Ferreirós and García-Pérez present the work of Spelke and colleagues as implying that geometric cognition is genetically determined, I argue that they fail to appreciate the role that Spelke and colleagues see for cultural factors. On this basis, I provide theoretical and terminological clarifications and show that moderate versions of the nativist and culturalist view are in fact consistent with each other. I then propose a unifying theoretical framework for future study that can integrate the two accounts in ontogeny by moving beyond the crude nature (nativism) vs. nurture (culturalism) dichotomy. Most contemporary philosophers of action agree on the following claims. Firstly, the possibility of deviant or wayward causal chains poses a serious problem for the standard-causal theory of action. Secondly, we can distinguish between different kinds of deviant causal chains in the theory of action. In particular, we can distinguish between cases of basic and cases of consequential deviance. Thirdly, the problem of consequential deviance admits of a fairly straightforward solution, whereas the possibility of basic deviance constitutes a separate and (...) difficult problem that requires its own solution. I will argue that the problem of basic deviance is no more troublesome than the problem of consequential deviance, as a solution to the former is implicit in the standard solution to the latter. The luck argument raises a serious challenge for libertarianism about free will. In broad outline, if an action is undetermined, then it appears to be a matter of luck whether or not one performs it. And if it is a matter of luck whether or not one performs an action, then it seems that the action is not performed with free will. This argument is most effective against event-causal accounts of libertarianism. Recently, Franklin (Philosophical Studies 156:199–230, 2011) has defended event-causal (...) libertarianism against four formulations of the luck argument. I will argue that three of Franklin’s responses are unsuccessful and that there are important versions of the luck challenge that his defense has left unaddressed. (shrink)

This paper explores whether it is possible to reformulate or re-interpret Lewis’s theory of fundamental laws of nature—his “best system analysis”—in such a way that it becomes a useful theory for special science laws. One major step in this enterprise is to make plausible how law candidates within best system competitions can tolerate exceptions—this is crucial because we expect special science laws to be so called “ceteris paribus laws ”. I attempt to show how this is possible and also how (...) we can thereby make the first step towards a solution for the infamous difficulties surrounding the troublesome ceteris paribus clause. Benjamin Libet’s work paved the way for the neuroscientific study of free will. Other scientists have praised this research as groundbreaking. In philosophy, the reception has been more negative, often even dismissive. First, I will propose a diagnosis of this striking discrepancy. I will suggest that the experiments seem irrelevant, from the perspective of philosophy, due to the way in which they operationalize free will. In particular, I will argue that this operational definition does not capture free will properly and (...) that it is based on a false dichotomy between internal and external causes. However, I will also suggest that this problem could be overcome, as there are no obvious obstacles to an operationalization of free will that is in accord with the philosophical conception of free will. There is a growing expectation, or even requirement, for researchers to deposit a variety of research data in data repositories as a condition of funding or publication. This expectation recognizes the enormous benefits of data collected and created for research purposes being made available for secondary uses, as open science gains increasing support. This is particularly so in the context of big data, especially where health data is involved. There are, however, also challenges relating to the collection, storage, and re-use (...) of research data. This paper gives a brief overview of the landscape of data sharing via data repositories and discusses some of the key ethical issues raised by the sharing of health-related research data, including expectations of privacy and confidentiality, the transparency of repository governance structures, access restrictions, as well as data ownership and the fair attribution of credit. To consider these issues and the values that are pertinent, the paper applies the deliberative balancing approach articulated in the Ethics Framework for Big Data in Health and Research to the domain of Openness in Big Data and Data Repositories. In two experiments (N=888), we explore to what extent the folk concept of art is compatible with the leading philosophical definitions of art, and whether it is an essentialist or a non-essentialist concept. We manipulate three factors: whether an object is created intentionally, whether it has aesthetic value, and whether it is institutionally recognized. In addition, we also manipulate the artistic domain (visual art or music). The results suggest that none of the three properties is seen by the folk as (...) necessary for an object to be considered art, which suggests that the folk concept of art might be a cluster concept. The paper explores the defence by the early sociologist of science Ludwik Fleck against the charge of relativism. It is shown that there are crucial and hitherto unnoticed similarities between Fleck’s strategy and the attempt by his contemporary Karl Mannheim to distinguish between an incoherent relativism and a consistent relationism. Both authors seek to revise epistemology fundamentally by reinterpreting the concept of objectivity in two ways: as inner- and inter-style objectivity. This paper proposes a causal-dispositional account of rule-following as it occurs in reasoning and intentional agency. It defends this view against Kripke’s (1982) objection to dispositional accounts of rule-following, and it proposes a solution to the problem of deviant causal chains. In the first part, I will outline the causal-dispositional approach. In the second part, I will follow Martin and Heil’s (1998) realist response to Kripke’s challenge. I will propose an account that distinguishes between two kinds of rule-conformity and two (...) kinds of rule-following, and I will defend the realist approach against two challenges that have recently been raised by Handfield and Bird (2008). In the third part, I will turn to the problem of deviant causal chains, and I will propose a new solution that is partly based on the realist account of rule-following. (shrink)

Synthetic biologists try to engineer useful biological systems that do not exist in nature. One of their goals is to design an orthogonal chromosome different from DNA and RNA, termed XNA for xeno nucleic acids. XNA exhibits a variety of structural chemical changes relative to its natural counterparts. These changes make this novel information‐storing biopolymer “invisible” to natural biological systems. The lack of cognition to the natural world, however, is seen as an opportunity to implement a genetic firewall that impedes (...) exchange of genetic information with the natural world, which means it could be the ultimate biosafety tool. Here I discuss, why it is necessary to go ahead designing xenobiological systems like XNA and its XNA binding proteins; what the biosafety specifications should look like for this genetic enclave; which steps should be carried out to boot up the first XNA life form; and what it means for the society at large. Given some reasonable assumptions concerning the nature of mental causation, non-reductive physicalism faces the following dilemma. If mental events cause physical events, they merely overdetermine their effects (given the causal closure of the physical). If mental events cause only other mental events, they do not make the kind of difference we want them to. This dilemma can be avoided if we drop the dichotomy between physical and mental events. Mental events make a real difference if they cause actions. But actions (...) are neither mental nor physical events. They are realized by physical events, but they are not type-identical with them. This gives us non-reductive physicalism without downward causation. The tenability of this view has been questioned. Jaegwon Kim, in particular, has argued that non-reductive physicalism is committed to downward causation. Appealing to the nature of actions, I will argue that this commitment can be avoided. What is the folk concept of art? Does it track any of the major definitions of art philosophers have proposed? In two preregistered experiments (N=888) focusing on two types of artworks (paintings and musical works), we manipulate three potential features of artworks: intentional creation, the possession of aesthetic value, and institutional recognition. This allows us to investigate whether the folk concept of art fits an essentialist definition drawing on one or more of the manipulated factors, or whether it might be (...) a disjunctive or cluster concept. The results suggest that none of the three manipulated properties are necessary for an object to be art, though some, even by themselves, suffice. The folk concept of art might thus well be a cluster concept instead of an essentialist concept. (shrink)

According to what I call the reductive standard-causal theory of agency, the exercise of an agent's power to act can be reduced to the causal efficacy of agent-involving mental states and events. According to a non-reductive agent-causal theory, an agent's power to act is irreducible and primitive. Agent-causal theories have been dismissed on the ground that they presuppose a very contentious notion of causation, namely substance-causation. In this paper I will assume, with the proponents of the agent-causal approach, that substance-causation (...) is possible, as I will argue against that theory on the ground that it fails as a theory of agency. I will argue that the non-reductive agent-causal theory fails to account for agency, because it fails to account for agential control: it cannot explain why the stipulated irreducible relation between the agent and an action constitutes the agent's exercise of control over the action. This objection, I will argue, applies to the agent-causal theory in particular, and to the non-reductive approach in general. (shrink)

This study explores the relation between pain sensitivity and the cognitive processing of words. 130 participants evaluated the pain-relatedness of a total of 600 two-syllabic nouns, and subsequently reported on their own pain sensitivity. The results demonstrate that pain-sensitive people associate words more strongly with pain than less sensitive people. In particular, concrete nouns like ‘syringe’, ‘wound’, ‘knife’, and ‘cactus’ are considered to be more pain-related for those who are more pain-sensitive. These findings dovetail with recent studies suggesting that certain (...) bodily characteristics influence the way people form mental representations (Casasanto, 2009). We discuss three mechanisms which could potentially account for our findings: attention and memory bias, prototype analysis, and embodied cognition. We argue that, whereas none of these three accounts can be ruled out, the embodied cognition hypothesis provides a particularly promising view to accommodate our data. (shrink)

Secreted signaling molecules act as morphogens to control patterning and growth in many developing tissues. Since locally produced morphogens spread to form a concentration gradient in the surrounding tissue, spreading is generally thought to be the key step in the non‐autonomous actions. Here, we review recent advances in tool development to investigate morphogen function using the role of decapentaplegic (Dpp)/bone morphogenetic protein (BMP)‐type ligand in the Drosophila wing disc as an example. By applying protein binder tools to distinguish between the (...) roles of Dpp spreading and local Dpp signaling, we found that Dpp signaling in the source cells is important for wing patterning and growth but Dpp spreading from this source cells is not as strictly required as previously thought. Given recent studies showing unexpected requirements of long‐range action of different morphogens, manipulating endogenous morphogen gradients by synthetic protein binder tools could shed more light on how morphogens act in developing tissues. The paper focuses on one central aspect of Karl Mannheim’s sociology of knowledge: his exemption of the contents of mathematics and the natural sciences from sociological investigations. After emphasizing the importance of Mannheim’s contribution and his exemption-thesis to the history and development of the field and the problem of relativism, I survey several interpretations of the thesis – especially those put forward by proponents of the so-called ‘Strong Programme’. I argue that these interpretations do not get the philosophical background and (...) impetus of Mannheim’s contribution right. By distinguishing between naturalistic and anti-naturalistic strands in Mannheim’s work I propose a new reading on which Mannheim did not exempt the contents of the areas in question principally or because of a lack of nerve and will. It is argued that Mannheim’s exemption-thesis rather is a consequence of his own sketchy sociological investigations of ‘the paradigm of the natural sciences’. (shrink)

Natural languages come in two different modalities. The impact of modality on the grammatical structure and linguistic theory has been discussed at great length in the last 20 years. By contrast, the impact of modality on linguistic data elicitation and collection, corpus studies and experimental (psycholinguistic) studies is still underinvestigated (van Herreweghe/Vermeerbergen 2012; Orfanidou et al. 2015). In this paper, we address specific challenges that arise in judgement data elicitation and experimental studies of sign languages. These challenges are related to (...) the socio-linguistic status of the Deaf community and the larger variability across signers within the same community, to the social status of sign languages, to properties of ;he visual-gestural modality and its interface with gesture, to methodological aspects of handling sign language data, and to specific linguistic features of sign languages. While some of these challenges also pertain to (some varieties of) spoken languages, other challenges are more modality-specific. In addition, the special combination of the challenges discussed in this paper seems to be a specific facet empirical research on sign languages is faced with. In addition, we discuss the complementarity of theoretical approaches and experimental studies and show how the interaction of both approaches contributes to a better understanding of sign languages in particular and linguistic structures in general. In this paper I will introduce a practical explication for the notion of expertise. At first, I motivate this attempt by taking a look on recent debates which display great disagreement about whether and how to define expertise in the first place. After that I will introduce the methodology of practical explications in the spirit of Edward Craig’s Knowledge and the state of nature along with some conditions of adequacy taken from ordinary and scientific language. This eventually culminates in the (...) respective explication of expertise according to which this term essentially refers to a certain kind of service-relation. This is why expertise should be considered as a predominantly social kind. This article will end up with a discussion of advantages and prima facie plausible objections against my account of expertise. (shrink)

I argue for the possibility of a proprioceptive art in addition to, for example, visual or auditory arts, where aspects of some martial arts will serve as examples of that art form. My argument is inspired by a thought of Ted Shawn’s, one of the pioneers of American modern dance: "Dance is the only art wherein we ourselves are the stuff in which it is made.” In a first step, I point out that in some practices of martial arts (in (...) the paper I will introduce “hyongs” & “katas”), we are, too, the stuff these performances are made of. Second, I show that we, as martial arts practitioners, are not in the first place visual or auditorial observers (as common in painting or music or ballet) but introspective, proprioceptive perceivers of our bodies and their movements. (As a corollary we get that we are, in such a case, necessarily our exclusive audience.) In an third crucial step, I show that the martial arts practices referred to, hyongs & katas, and especially the proprioceptive aspects thereof, can indeed count as art. Thus, proprioceptive art is possible because some practices of some martial arts are actual existing examples of that art form. (shrink)

Die Apokalypse und apokalytische Denkbilder haben seit Jahren und Jahrzehnten Konjunktur. In einer immer neuen 'Lust am Untergang' wurden und werden in schöner Regelmäßigkeit Endzeiten beschworen und Katastrophen prognostiziert. Ganz augenfällig greifen diese Konjunkturen dabei auf Bildtraditionen zurück, die ihre Herkunft aus der biblischen Überlieferung kaum verbergen. Der Band versammelt die Vorträge einer Ringvorlesung, die an der Universität Koblenz-Landau in Landau veranstaltet wurde. Ziel war die Zusammenführung von Forschungsinteressen, die in den verschiedenen Fachrichtungen in der einen oder anderen Weise auf (...) das Themenfeld sowie im engeren Sinne auf die Johannesoffenbarung und die unterschiedlichen Wahrnehmungen dieses wirkungsmächtigen Kulturdokuments gerichtet waren. Besonderes Gewicht galt den Untergangsszenarien und deren Wahrnehmung in der Moderne. Aus dem Blickwinkel der Theologien werden die biblisch-antiken Grundlagen des apokalyptischen Denkens und deren Fortschreibung in der gelehrten Diskussion bis in die Gegenwart vorgestellt. Die Bildersprache der Johannesoffenbarung und die vielfältig anschließenden Bildtraditionen werden in literatur- und kunstgeschichtlichen Überblicksdarstellungen entwickelt und in Einzelstudien vertieft. Analysen zur produktiven Aufnahme und Verarbeitung der biblischen Muster in der Literatur, Musik, Graphik, im Film und nicht zuletzt in der jüngeren Klimadiskussion zeigen die Apokalypse und das Apokalyptische als Deutungsmuster, auf die bei der Beschreibung von Untergangsszenarien in der Moderne bis heute immer wieder zurückgegriffen wird. In a recent article we argued that organizational ecology is not a Darwinian research program. John Lemos criticized our argumentation on various counts. Here we reply to some of Lemos’s criticisms.

Socialization theories suggest that, due to social change and technological transformation, peers and media have become important institutions of socialization for young people. Assuming that male adolescents use digital games for processes of peer self-socialization, this article investigates the values they mediate in digital games and how these values are related to their practice (with a focus on harassment) in digital games. Applying a qualitative research design, 36 male adolescents who frequently play various (multiplayer) online games were interviewed about their (...) values and practices when gaming. The results show that the young gamers share individualistic values promoting performance, competition, and achievement, which seem to facilitate practices of online harassment. We conclude that, in their gaming practices, male adolescents mediate and reproduce neoliberal values as increasingly shared by society. Regarding their practices of harassment, however, they seem to use digital games as a moratorium that lets them break free from societal restrictions. (shrink)

We claim that it is crucial to prioritize privacy, a fundamental right, especially in the case of changes in laws related to women’s health, such as Roe v. Wade in the US.

Versteht man unter Welt die Gesamtheit dessen, was ist, dann stellt sich die Frage nach dem ontologischen Status dieser Seinstotalitat selbst. Wie, wenn uberhaupt, kann die Existenz der Welt sinnvoll gedacht werden? Der Begriff der Unendlichkeit konturiert und verscharft diese ontologische Frage dadurch, dass wir die Ganzheit namens Welt als unendlich erfahren, d. h. so, dass sie (...) unsere in epistemischer Hinsicht endlichen Weltbezuge grundsatzlich ubersteigt. Mit Welt und Unendlichkeit ist daher ein begrifflicher Spannungsraum eroffnet, bei dem es im wortlichen Sinne ums Ganze geht. Einen der bedenkenswertesten Gegenwartsbeitrage zu dieser durch die Begriffe Welt und Unendlichkeit abgesteckten Grundfrage der Philosophie hat Laszlo Tengelyi (1954-2014) geleistet. Der vorliegende Band versammelt insgesamt elf im Andenken an Laszlo Tengelyi und in Anlehnung an sein letztes Buch Welt und Unendlichkeit. Diese Einleitung skizziert neben einigen begrifflichen Vorbemerkungen zwei Themenfelder, nämlich den Müll und eine Gruppe von Menschen, die in der Soziologie „die Überflüssigen“ genannt werden. Einerseits wird deutlich, dass der Müll die Rückseite der materiellen Kultur in ihrer Vielfältigkeit darstellt und dass die Geschichte der materiellen Kultur immer auch eine Geschichte dessen ist, was Menschen hinter sich lassen, wessen sie sich entledigen und was sie entsorgen.
