The Human Tissue Act 2004 presents a radical change to the legal regulation of the use of human material in England and Wales. The Act presents a broad regulatory framework but much in the practical operation of the legislation will depend upon regulations to be enacted and a new Code of Practice. This article examines 'appropriate consent' for the use of human tissue for research purposes in the context of the living competent adult. It examines the provision of information as (...) part of the consent process for the use of human materials for research purposes, the question of when consent can be withdrawn, and the controversial exception enabling the use without consent of anonymized material for research purposes where the research has been ethically approved. The paper concludes by highlighting some of the problems which may remain after the legislation comes into force. (shrink)

In his denial that language refers to anything but itself and in his undoing representation, Joyce anticipates contemporary developments in the history of critical theory. Contrary to modern criticism, Joyce does not abandon representation, the idea that language affords access to reality.

A body of work in ethics and epistemology has advanced a collectivist view of virtues. Collectivism holds that some social groups can be subjects in themselves which can possess attributes such as agency or responsibility. Collectivism about virtues holds that virtues are among those attributes. By focusing on two different accounts, I argue that the collectivist virtue project has limited prospects. On one such interpretation of institutional virtues, virtue-like features of the social collective are explained by particular group-oriented features of (...) individual role-bearers that are elicited by institutional structures or goals. On another account of groups as moral agents unbound by formal institutional constraints, to the extent that group characteristics meet the collectivist requirement, they fail to stand up as virtues in the substantive sense of a character trait. These two positions’ respective drawbacks and insights support a non-collectivist conclusion: Where there is a substantive virtue of some social group, it consists only in certain group-specific attitudes and motives of individuals qua members of that group. I end by outlining some risks in adopting collectivism about virtues as an explanatory or normative doctrine, and suggesting that we can abandon it without embracing an equally undesirable individualism in virtue theory. The use of traditional ethical methodologies is inadequate in addressing a constructed maternal–fetal rights conflict in a multicultural obstetrical setting. The use of caring ethics and a relational approach is better suited to address multicultural conceptualizations of autonomy and moral distress. The way power differentials, authoritative knowledge, and informed consent are intertwined in this dilemma will be illuminated by contrasting traditional bioethics and a caring ethics approach. Cultural safety is suggested as a way to develop a relational ontology. Using caring (...) ethics and a relational approach can alleviate moral distress in health-care providers, while promoting collaboration and trust between providers and their patients and ultimately decreasing reproductive disparities. The article discusses the characteristics of virtuous persons in relation to their social role(s). It explores the key features of the neo-Aristotelian account of right action and some problems for this account in the context of a certain social role. The problem can be characterized as a dilemma. When evaluating an action in some role, one view is that the obligations and requirements of roles could be taken as something already given by social or professional role descriptions, such that the (...) virtuous person must respond to these demands in the right way. Alternatively, the virtuous person could evaluate the role itself in terms of what the “good parent, teacher, doctor” and so on should be like. Using two different neo-Aristotelian approaches to the ethics of professional roles as examples I argue that neither strategy is, as it stands, satisfactory. ‘Internalism’ about role demands takes institutionally specified role requirements in a way that is too strongly determinate for a virtue ethical analysis. On the other side, ‘externalism’ is all too indeterminate in bypassing or failing to accommodate the institutionally determined demands of social or professional roles. These shortcomings contour an “institution shaped gap” in virtue ethics such that it needs to attend to the qualities of social institutions as well as the character and actions of individuals. In response I suggest that there is a distinctly Aristotelian way in which the virtue ethicist can address it, by appeal to the distinctive function or “characteristic activity”— ergon—of the institution. This article aims to characterise the visions of ecologisation found within scientific approaches embraced by different epistemic communities, and which have inspired empirical work and public action on agrifood system transitions. Based on comparative readings of works anchored in our two disciplinary fields (ecology and sociology), we identified six large ensembles of epistemic communities as well as their points of convergence and divergence. We identify six ideotypical visions of ecologisation based on the types of 'relationships to nature' embedded in these (...) large sets of epistemic communities: protectionism, functionalism, structuralism, post-structuralism, relational and pragmatist-experience-based. We suggest that pragmatist-experience-based approaches allow us to transcend two classical oppositions: between realism and constructivism, and between a conception of nature as passive and external as opposed to active and relational. Without claiming to offer a detailed analysis of these approaches, we hope that our work can be used as a tool to support reflection among scientists and other actors involved in agrifood system transitions. The main goal of Henri Bergson’s philosophy of nature is to offer a dynamic understanding of living phenomena. It is in this context that we main­tain that the author left us a “bio-philosophy,” that is, an interpretation which, by adopting a positive model of biology as a cognitive paradigm, describes the essential character of living activity as time or duration (durée). Bergson’s posi­tive metaphysics, which brings science to the metaphysical field and provides an inner perspective of the vital principle, consolidated (...) itself in the study of evolutionary theories like Darwinism. However, the specificity of the perspective Bergson presents to us lies in the fact that he positions himself as a philosopher and not as a scientist: he does not seek a merely scientific explanation of reality, but an integral vision that allows us to give scientific evolution a metaphysical reading. Thus, when Bergson upholds the insufficiency of pure Darwinism, and proposes a true evolutionism, it is because he thinks that the only way to understand the evolutionary nature of life is by overcoming a strictly mechanistic perspective. For Bergson, such an interpretation results from the artificial way in which our intellectual functions deconstruct reality and lead to an incomplete and fragmented reading of the evolution of organisms. As a philosopher he seeks an explanatory level which, being scientifically based, is not restricted to the physico-chemical limits of reality. For that reason, Bergson claims that the inner cause of evolution is an activity where growth and division occur as a natural result of the divergence of life’s tendencies. (shrink)

Political obligation refers to the moral obligation of citizens to obey the law of their state and to the existence, nature, and justification of a special relationship between a government and its constituents. An indispensable guide to the major work of one of the twentieth century's most influential thinkers.

Employing a time-lagged sample of 371 North American individuals working full time in a wide range of industries, occupations, and levels, we contribute to research on employee outcomes of corporate social responsibility attributions as substantive or symbolic. Utilizing a mediated moderation model, our study extends previous findings by explaining how and why CSR attributions are related with work-related attitudes and subsequent individual performance. In support of our hypotheses, our findings indicate that the relationships between CSR attributions and individual performance are (...) mediated through person–organization fit and work-related attitudes. Additionally, when CSR is perceived as important, substantive CSR is positively related to, and symbolic CSR is negatively related to, perception of fit with the organization. These findings contribute toward our understanding of the complex effect CSR has on employees’ work outcomes. Practical implications and future research directions are discussed. (shrink)

Language is more than a source of information for accessing higher-order conceptual knowledge. Indeed, language may determine how people perceive and interpret visual stimuli. Visual processing in linguistic contexts, for instance, mirrors language processing and happens incrementally, rather than through variously-oriented fixations over a particular scene. The consequences of this atypical visual processing are yet to be determined. Here, we investigated the integration of visual and linguistic input during a reasoning task. Participants listened to sentences containing conjunctions or disjunctions and (...) looked at visual scenes containing two pictures that either matched or mismatched the nouns. Degree of match between nouns and pictures and between their expected and actual spatial positions affected fixations as well as judgments. We conclude that language induces incremental processing of visual scenes, which in turn becomes susceptible to reasoning errors during the language-meaning verification process. (shrink)

This paper is about the actual and potential development of an ethics that is appropriate to the practices and institutions of biobanking, the question being how best to develop a framework within which the relevant ethical questions are first identified and then addressed in the right ways. It begins with ways in which a standard approach in bioethics – namely upholding a principle of individual autonomy via the practice of gaining donors’ informed consent – is an inadequate ethical framework for (...) biobanking. In donating material to a biobank, the individual donor relinquishes a degree of control and knowledge over the way their material is used in large-scale and typically open ended projects; and the identifying nature of genetic material means that third parties have rights and interests which must be taken into account as well as those of the individual donor. After discussing the problems for informed consent in the biobanking context, the paper then considers three emerging alternative approaches which, broadly speaking, conceptualize the subject of biobanking ethics in communal or co-operative terms: one version sees participants in biobanking research as ‘shareholders’ whilst the other expands on the notion of participation to include the wider public beneficiaries of biobanking as ‘stakeholders’. It concludes by outlining a third view, on which the biobanking institution itself is conceived as an ethical subject whose defining function can do useful normative work in guiding and evaluating its activities. It is now being recognized across the spectrum of bioethics, and particularly in genetics and population ethics, that to focus on the individual person, and thereby neglect communities and the goods which accrue to them, is to fail to see all the ethically significant features of a range of ethical issues. This article argues that more work needs to be done in order for bioethics to respect not only goods (such as rights and interests) of communities per se, but also (...) to recognize the difference between different types of communities and their goods. The diversity of communities and the types of communal goods which accrue to them is first outlined. Following this, a basic distinction between two such types: aggregative and corporate community goods, is explained and defended, and it is then argued argue that this distinction is necessary to understand and address what and whom is ethically at stake in any situation. This is illustrated with the example of UK Biobank, the conclusion being that if current and future individual are to be respected then communal goods of both types must be recognized and respected in an effective bioethics. This study examines the first two years of a tactical innovation that emerged in 2012 in Egypt, which involved activist groups organizing patrol-type "intervention teams" to combat sexual violence against women in public spaces. Findings reveal that the new tactic took different forms in the two places in which it was deployed, even though the same actors employed it. I argue that the place in which a new tactic emerges shapes the form it takes. When coming up with a new (...) collective action tactic, activists elaborate visions about how to carry out their actions based on their collective identities and taste in tactics. But as they start experimenting with the new tactic on the ground, they learn about the places' material affordances, symbolic valence, and power relations, as well as the constraints and opportunities that they represent. The material properties of places shape activists' possibilities of movement, patterns of communication, field of vision, and capacity to escape repression or reach safe spaces. The configuration of actors in a place shapes the nature of their interactions with others on the ground, possible alliances, and sources of conflict. The symbolic meanings of places shape the resonance of a group’s actions and the degree of resistance that actors face. Place in part determines the ability of activists to develop a tactic in the form that best fits their preferences. (shrink)

PurposeThe purpose of this paper is to investigate how public policies may influence the way members of virtual communities linked with social movements perceive the legitimacy of their leaders and governance structures.Design/methodology/approachThis paper is based on qualitative research with three Brazilian environmental education virtual communities. It adopts an interpretive approach, grounding the analysis in institutional theory.FindingsThe paper shows that a public policy of funding the studied communities has reinforced the legitimacy of some leaders and legitimated more centralised decision‐making structures. The (...) influence of the funding has endured even after the end of the respective contracts.Research limitations/implicationsAlthough the paper is limited to three virtual communities in a very specific context, its conclusions may inform other studies on the institutional instruments governments may appropriate to influence the virtual interactions among members of social movements and civil society organisations and which impact their offline interactions as well.Practical implicationsThe paper calls attention to the need to discuss public policies with stakeholders, especially to permit social movements and civil society organisations to have a say in policies that may affect their social structures.Originality/valueThe paper contributes to understanding how public policies impact interactions in virtual environments and in a broader sense, and the relevance of considering the influence of institutions in online interactions. This paper argues that a certain way of thinking about the function of the biobank—about what it does and is constructed for as a social institution aimed at ‘some good’—can and should play a substantial role in an effective biobanking ethic. It first exemplifies an ‘institution shaped gap’ in the current field of biobanking ethics. Next the biobank is conceptualized as a social institution that is apt for a certain kind of purposive functional definition such that we know it by (...) what it does and what it is designed to do. This purpose is then characterized further as essentially incorporating the human goods the institution is designed to serve, such that it plays a useful and indispensible role in how it should operate, i.e. in the ethics and governance of biobanking. Finally the ethical scope and limitations of such a theory is clarified by a discussion of some theoretical objections and suggested practical examples of its application. (shrink)
