Corporate engagements with pressing environmental challenges focus on expanding the role of the market, seeking opportunities for growth and developing technologies to manage better environmental resources. Such approaches have proved ineffective. I suggest that a lack of meaningful response to ecological degradation and climate change is inevitable within a capitalist system underpinned by a logics of appropriation and an instrumental rationality that views the planet as a means to achieve economic ends. For ecofeminism, these logics are promulgated through sets of (...) hierarchical and interrelated dualisms which define the human in opposition to the realm of “nature”. This has led to the resilience of ecosystems, social reciprocity and care being unvalued or undervalued. An ecofeminist, care-sensitive ethics is proposed that focuses on the interconnections between human and nonhuman nature and on affective engagements with the living world. A practical morality is developed that sees the self not as atomized nor as self-optimizing, but as a self in relationship. Such an ethics is necessary to motivate action to contest capitalism’s binary thinking, evident within corporate environmentalism, which has re-made the web of life in ways that are not conducive to planetary flourishing. The debate over corporate moral responsibility has become a fixture in business ethics research and teaching. Only rarely, however, does the sizable literature on that question consider whether the debate has important practical implications. This article examines that question from a corporate control perspective. After assuming corporate moral responsibility’s existence for purposes of argument, the article concludes that such responsibility makes a difference in cases where it is present but personal responsibility is absent. Then the article tries to identify the (...) forces that diminish personal responsibility when corporate responsibility exists. The most important such forces, it concludes, spring from the socialization processes people undergo when they enter groups. One example is the well-known phenomenon of groupthink, which can exculpate individuals by rendering them justifiably ignorant of foreseeable risks of harm. (shrink)

Despite some exceptions, the business ethics literature on the moral responsibility of corporations does not emphasize a subject critical to that inquiry: the general nature of corporations. This article attempts to lessen the imbalance by describing three conceptions of the corporation that have been prominent in twentieth century legal theorizing, and by sketching their implications for the moral responsibility of corporations. These three conceptions, at least two of which have counterparts in the philosophical and organizational theory literature, are the concession, (...) aggregate, and real entity theories. The article concludes that the real entity theory is the most plausible of the lot. At least under prevailing tests of moral responsibility, it then contends, corporations-as-real-entities are morally responsible for most of their members' actions. (shrink)

Open science has recently gained traction as establishment institutions have come on-side and thrown their weight behind the movement and initiatives aimed at creation of information commons. At the same time, the movement's traditional insistence on unrestricted dissemination and reuse of all information of scientific value has been challenged by the movement to strengthen protection of personal data. This article assesses tensions between open science and data protection, with a focus on the GDPR.

This article presents narratives from 13 Indigenous early career academics (ECAs) at one university in Auckland, New Zealand. These experiences are likely to represent those of Indigenous Māori and Pasifika ECAs nationally, given the small, centralised nature of the national academy of Aotearoa New Zealand. The narratives contain testimony, fictionalised vignettes of experience, and poetic expressions. Meeting the demands of an academic role in one’s first years of working at a university is a big deal for anyone; the extra pressures (...) and challenges for Indigenous Māori and Pacific staff are immense, yet little understood by White ‘others.’ A writing workshop was the initial catalyst of this collective writing project. The collapse of confidence in anonymization as a robust approach for preserving the privacy of personal data has incited an outpouring of new approaches that aim to fill the resulting trifecta of technical, organizational, and regulatory privacy gaps left in its wake. In the latter category, and in large part due to the growth of Big Data–driven biomedical research, falls a growing chorus of calls for criminal and penal offences to sanction wrongful re-identification of “anonymized” data. This chorus cuts across (...) the fault lines of polarized privacy law scholarship that at times seems to advocate privacy protection at the expense of Big Data research or vice versa. Focusing on Big Data in the context of biomedicine, this article surveys the approaches that criminal or penal law might take toward wrongful re-identification of health data. It contextualizes the strategies within their respective legal regimes as well as in relation to emerging privacy debates focusing on personal data use and data linkage and assesses the relative merit of criminalization. We conclude that this approach suffers from several flaws and that alternative social and legal strategies to deter wrongful re-identification may be preferable. (shrink)

Historically, treatment for pain relief has varied according to the social status of the sufferer. A similar tendency to make arbitrary distinctions affecting pain relief was found in an ethnographic study of animal research laboratories. The administration of pain-relieving drugs for animals in laboratories differed from standard practice for humans and, perhaps, for companion animals. Although anesthesia was used routinely for surgical procedures, its administration was sometimes haphazard. Analgesics, however, were rarely used. Most researchers had never thought about using analgesics (...) and did not consider the subject worthy of serious attention. Scientists interviewed for this study agreed readily that animals are capable offeeling pain, but such assertions were muted by an overriding view of lab animals as creatures existing solely for the purposes of research. As a result, it was the exceptional scientist who was able to focus on anything about the animal's subjective experience that might lie outside the boundaries of the research protocol. (shrink)

Fundamental to this continuity, as Momigliano saw it, was the revival in the Renaissance of the classical division of history into two distinct genres. The first (often called, without further qualification, “history”) is the narrative of public events organized in linear [End Page 297] and causal fashion; the second, antiquities, is a more diverse body of writing that neglects political narrative for philosophical, literary, topographical, and other concerns. After the Reformation antiquarianism took on new tasks in response to the religious controversies of the age, but it remained distinct from the narrative tradition. Only in the eighteenth century did a convergence begin that has finally been completed in the historical methods of our own time. 1This identification of the eighteenth century as the time when historical narrative and antiquarian research converged gives Momigliano’s views their particular interest to students of this period. His terms, however, are always far wider than any single century. In fact his argument constitutes a genealogy of modern historical method, since the merging of the two traditions—first witnessed in the erudite historiography of Edward Gibbon—was a precondition of modern practice. On these foundations, a modern historical discipline has grown up in which systematic research has become indivisible from the task of representing the past in narrative, with the consequence that the ancient separation of history and antiquities has at last been transcended.This essay is intended as a sketch of an alternative approach to the study of historical thought and writing in eighteenth-century Britain. In my view an essential point of departure is the interest of eighteenth-century writers in the structures and experiences of private life, their desire to explore the inward lives of individuals and the everyday life of societies. This article argues that the moral right to be discharged only for good cause and like rights can be contracted away by employees in appropriate circumstances. It maintains that the rights in question are not inalienable, and that there is nothing irrational about an employee''s wishing to deal them away. It also maintains that inequalities in bargaining power between employers and employees are insufficiently pervasive to justify a flat ban on the alienation of these rights. For a waiver of such (...) rights to be valid, however, employees must have full knowledge of its terms.The question addressed here bears on several legal and policy issues affecting termination of the employment relation. If employees can contract away their right to a goodcause discharge, the American doctrine of employment at willmight find justification in the face of that right. In addition, the alienability of such discharge rights may be necessary to justify express disclaimers of wrongful discharge liability and the waiver provision of the new U.S. Draft Uniform Employment-Termination Act. ABSTRACTIn common usage, historical distance refers to a position of detached observation made possible by the passage of time. Understood in these terms, distance has long been regarded as essential to modern historical practice, but this conception narrows the idea of distance and burdens it with a regulatory purpose. I argue that distance needs to be re‐conceived in terms of the wider set of engagements that mediate our relations to the past, as well as the full spectrum of distance‐positions from (...) near to far. Re‐imagined in these terms, distance sheds its prescriptiveness and becomes a valuable heuristic for examining the history of historical representation. When distance is studied in relation to the range of mediations entailed in historical representation, it becomes evident that the plasticities of distance/proximity are by no means limited to gradients of time; rather, temporality is bound up with other distances that come from our need to engage with the historical past as a realm of making, of feeling, of doing, and of understanding. Thus for every historical work, we need to consider at least four basic dimensions of representation as they relate to the problem of mediating distance: 1. the genres, media, and vocabularies that shape the history's formal structures of representation; 2. the affective claims made by the historical account, including the emotional experiences it promises or withholds; 3. the work's implications for action, whether of a political or moral nature; and 4. the modes of understanding on which the history's intelligibility depends. These overlapping, but distinctive, distances—formal, affective, ideological, and conceptual—provide an analytic framework for examining changing modes of historical representation. (shrink)

Others, inevitably, belong to more local traditions and are apt to puzzle a stranger. This essay considers biotrophic cyst and root‐knot nematodes in relation to their biology, host–parasite interactions and molecular genetics. These nematodes have to face the biological consequences of the physical constraints imposed by the soil environment in which they live while their hosts inhabit both above and below ground environments. The two groups of nematodes appear to have adopted radically different solutions to these problems with the result that one group is a host specialist and reproduces sexually while the other has (...) an enormous host range and reproduces by mitotic parthenogenesis. We consider what is known about the modes of parasitism used by these nematodes and how it relates to their host range, including the surprising finding that parasitism genes in both nematode groups have been recruited from bacteria. The nuclear and mitochondrial genomes of these two nematode groups are very different and we consider how these findings relate to the biology of the organisms. This multi-disciplinary collection interrogates the role of human rights in addressing past injustices. The volume draws on legal scholars, political scientists, anthropologists and political philosophers grappling with the weight of the memory of historical injustices arising from conflicts in Europe, the Middle East and Australasia. It examines the role of human rights as legal doctrine, rhetoric and policy as developed by states, international organizations, regional organizations, and non-governmental organizations. The authors question whether faith in human rights is justified as balm (...) to heal the past injustice or whether such faith nourishes both victimhood and self-justification. These issues are explored through three discrete sections: moments of memory and injustice, addressing injustice and questions of faith. In each of these sections authors address the manner in which memory of past conflicts and injustice haunt our contemporary understanding of human rights. The volume questions whether the expectations that human rights law can deal with the past injustice has undermined the development of an emancipatory politics of human rights for our current world. This article contextualizes digital practices within architectural spaces, and explores the opportunities of experiencing and perceiving domestic environments with the use of media and computing technologies. It suggests methods for the design of reflexive and intimate interiors that provide informational, communicational, affective, emotional and supportive properties according to embedded sensorial interfaces and processing systems. To properly investigate these concepts, a fundamental criterion is magnified and dissected: dwelling, as an important ingredient in this relationship entails the magical power to merge physical (...) environment with the psyche of inhabitants. For this reason, a number of views are presented and discussed, providing necessary conditions to include matters of affectivity, ubiquity and layering complexity of interior space. Moreover, specific processes of the possibilities of the digital are mentioned, and examples are presented of the infusion and diffusion of ubiquitous computing technologies within domestic spaces. To briefly conclude, this article is an attempt to discuss the relationship of human-architecture-computer symbiosis and the design process of creative and innovative spaces that affect states of memory, perception, experience, as well as mood and emotion. BackgroundThe Patient-Centered Outcomes Research Institute is obligated to peer review and to post publicly “Final Research Reports” of all funded projects. PCORI peer review emphasizes adherence to PCORI’s Methodology Standards and principles of ethical scientific communication. During the peer review process, reviewers and editors seek to ensure that results are presented objectively and interpreted appropriately, e.g., free of spin.MethodsTwo independent raters assessed PCORI peer review feedback sent to authors. We calculated the proportion of reports in which spin was identified during (...) peer review, and the types of spin identified. We included reports submitted by April 2018 with at least one associated journal article. The same raters then assessed whether authors addressed reviewers’ comments about spin. The raters also assessed whether spin identified during PCORI peer review was present in related journal articles.ResultsWe included 64 PCORI-funded projects. Peer reviewers or editors identified spin in 55/64 submitted research reports. Types of spin included reporting bias, inappropriate interpretation, inappropriate extrapolation of results, and inappropriate attribution of causality. Authors addressed comments about spin related to 47/55 of the reports.Of 110 associated journal articles, PCORI comments about spin were potentially applicable to 44/110 articles, of which 27/44 contained the same spin that was identified in the PCORI research report. The proportion of articles with spin was similar for articles accepted before and after PCORI peer review.DiscussionJust as spin is common in journal articles and press releases, we found that most reports submitted to PCORI included spin. While most spin was mitigated during the funder’s peer review process, we found no evidence that review of PCORI reports influenced spin in journal articles. Funders could explore interventions aimed at reducing spin in published articles of studies they support. (shrink)

The Adagia of Erasmus was first published in 1500. It went through numerous impressions and ten major revisions in the course of Erasmus's life. Its influence was incalculable. It disseminated humanist learning and humanist attitudes among the new reading public to such an extent that it can be claimed as one of the books that contributed most to form the European mind. The adages were proverbs or popular sayings taken from classical literature. Many are part of the common stock of (...) our speech today. A necessary evil, cupboard love, a rare bird, an iron in the fire, are all to be found in the Adagia. Erasmus refers each to its source; then follows with a commentary on the meaning and with whatever ideas and personal observations arose from it. The book's influence waned after his death. (shrink)
