BackgroundIn its 2015 decision in Montgomery v. Lanarkshire Health Board, the Supreme Court of the United Kingdom overruled the long-standing, paternalistic prudent doctor standard of care in favour of a new reasonable patient standard which obligates doctors to make their patients aware of all material risks of the recommended treatment and of any reasonable alternative treatment. This landmark judgment has been of interest to the rest of the common law world. A judicial trend of invoking Montgomery to impose more stringent (...) requirements on doctors is discernible in subsequent decisions since then.Main bodyIn this narrative review, without questioning the idea that properly informed patients should play a more active role in procedures affecting their own health in furtherance of their autonomy, safety, and consumer rights, we identify and analyse, with the aid of realistic clinical thought experiments, three practical conundrums that the Montgomery standard may inflict on the daily work of doctors, unfairly exposing them to arbitrary legal risks.ConclusionsThese conundrums pertain to the ascertainment of the risks that must be disclosed to the patient under the test of ‘materiality’; the legal uncertainty as to the scope of the exceptions; and the actual ability of doctors to cope with the pressures of time. These conundrums offer ripe opportunities to rethink the proper role of judicially developed medical law in modern health care practice. (shrink)

In 1884 Sir William Thomson (later Lord Kelvin) delivered a significant series of lectures on physics at the Johns Hopkins University in Baltimore. This book presents the twenty lectures in their original form for the first time.

This article examines some recent theoretical objects of feminism with a view towards a reinvigorated dialogue with psychoanalysis. Against the backdrop of debates on essentialism, universalism, social constructionism and historical change, it aims to reintroduce the value of psychoanalytic ideas to feminism by unfolding a dimension of history in the divided subject and adding a positive value to psychoanalytic universalism. Thomson, Kelvin You might be surprised to learn that China, home of the much derided one-child policy, has a higher birth rate than Italy, home of the Vatican. This suggests Chinese families are quietly defying their political leaders and Italian families are quietly defying their religious ones. But the overall global picture is one of rapid population growth.

We defend the many-worlds interpretation of quantum mechanics against the objection that it cannot explain why measurement outcomes are predicted by the Born probability rule. We understand quantum probabilities in terms of an observer's self-location probabilities. We formulate a probability postulate for the MWI: the probability of self-location in a world with a given set of outcomes is the absolute square of that world's amplitude. We provide a proof of this postulate, which assumes the quantum formalism and two principles concerning (...) symmetry and locality. We also show how a structurally similar proof of the Born rule is available for collapse theories. We conclude by comparing our account to the recent account offered by Sebens and Carroll. (shrink)

Does consciousness collapse the quantum wave function? This idea was taken seriously by John von Neumann and Eugene Wigner but is now widely dismissed. We develop the idea by combining a mathematical theory of consciousness (integrated information theory) with an account of quantum collapse dynamics (continuous spontaneous localization). Simple versions of the theory are falsified by the quantum Zeno effect, but more complex versions remain compatible with empirical evidence. In principle, versions of the theory can be tested by experiments with (...) quantum computers. The upshot is not that consciousness-collapse interpretations are clearly correct, but that there is a research program here worth exploring. (shrink)

Integrated information theory is a theory of consciousness that was originally formulated, and is standardly still expressed, in terms of controversial interpretations of its own ontological and epistemological basis. These form the orthodox interpretation of IIT. The orthodox epistemological interpretation is the axiomatic method, whereby IIT is ultimately derived from, justified by, and beholden to a set of phenomenological axioms. The orthodox ontological interpretation is panpsychism, according to which consciousness is fundamental, intrinsic, and pervasive. In this paper it is argued (...) that both components of the orthodox interpretation should be rejected. But IIT should not be rejected since an interpretation-neutral formulation is available. After explaining the neutral formulation, more plausible non-axiomatic epistemologies are defended. The neutral formulation is then shown to be consistent with various contemporary physicalist ontologies of consciousness, including the phenomenal concept strategy, representationalism, and even illusionism. Along the way, instructive connections between interpretations of IIT and interpretations of quantum mechanics are noted. (shrink)

The convergence-divergence debate on whether business cultures are growing alike or not has become an important part of studies of the influence of national cultures on the operation of firms. This article intends to formulate a third way, a third model, by creating synergy between the model of cultural hybridization and Social Integration Theory. We contend that cultural hybridization takes place in multicultural joint ventures but this process happens unevenly and in different parts of the venture. In this essay, I investigate the origins of Chinese migrant transnationalism and its personal and social consequences. I propose a theoretical perspective that turns on a synthesis that I shall call “cultural functionalism,” a synthesis that attempts to reconcile functionalism and postmodernism. My argument is that Chinese transmigrants overcome modern alienation through a two-way approach: first, a strong participation in and full commitment to community development and connectivity within the Chinese diaspora ; and, second, a religio-cultural renaissance—both being conceived of (...) as constituting a putative “cultural contract” and “social capital” nexus. The primary quantum mechanical equation of motion entails that measurements typically do not have determinate outcomes, but result in superpositions of all possible outcomes. Dynamical collapse theories (e.g. GRW) supplement this equation with a stochastic Gaussian collapse function, intended to collapse the superposition of outcomes into one outcome. But the Gaussian collapses are imperfect in a way that leaves the superpositions intact. This is the tails problem. There are several ways of making this problem more precise. But many authors dismiss (...) the problem without considering the more severe formulations. Here I distinguish four distinct tails problems. The first (bare tails problem) and second (structured tails problem) exist in the literature. I argue that while the first is a pseudo-problem, the second has not been adequately addressed. The third (multiverse tails problem) reformulates the second to account for recently discovered dynamical consequences of collapse. Finally the fourth (tails problem dilemma) shows that solving the third by replacing the Gaussian with a non-Gaussian collapse function introduces new conflict with relativity theory. (shrink)

The many worlds interpretation of quantum mechanics (MWI) states that the world we live in is just one among many parallel worlds. It is widely believed that because of this commitment to parallel worlds, the MWI violates common sense. Some go so far as to reject the MWI on this basis. This is despite its myriad of advantages to physics (e.g. consistency with relativity theory, mathematical simplicity, realism, determinism, etc.). Here, we make the case that common sense in fact favors (...) the MWI. We argue that causal explanations are commonsensical only when they are local causal explanations. We present several quantum mechanical experiments that seem to exhibit nonlocal “action at a distance”. Under the assumption that only one world exists, these experiments seem immune to local causal explanation. However, we show that the MWI, by taking all worlds together, can provide local causal explanations of the experiments. The MWI therefore restores common sense to physical explanation. (shrink)

This article examines Schelling’s understanding of Laozi 老子. It begins with Schelling’s reception of Laozi’s text and its translation. The main part of this article focuses on Schelling’s discussion of Laozi in his Philosophy of Mythology. It then compares some of the key concepts mentioned in Schelling’s comments and their respective counterparts in Laozi: nothingness and wu 無, portal and abyss, reason and dao 道, name and concept, nature and ziran 自然, and so on, and analyzes the possible reasons for (...) his sympathetic understanding of Laozi as against his own philosophical system. The main argument is that Schelling’s romantic tendency means that he can have an alternative understanding of Laozi. Finally it concludes with a few remarks on the differences between Schelling and Laozi in terms of their philosophical systems and methods. (shrink)

This book approaches the topic of intercultural understanding in philosophy from a phenomenological perspective. It provides a bridge between Western and Eastern philosophy through in-depth discussion of concepts and doctrines of phenomenology and ancient and contemporary Chinese philosophy. This thesis presents an interpretation of David Hume’s essay ‘Of the Standard of Taste’. The most distinguishing feature of this interpretation is the emphasis placed on the significance of Hume’s general philosophical position in a faithful reading of this philosophical classic. The success of this interpretation will show that Hume’s essay should be read as an integral part of his system of philosophy. There are three parts in this thesis. The first part is an overview of some key aspects of (...) Hume’s philosophy which are relevant to my interpretation. Unlike many contemporary philosophers in the analytic tradition, Hume is a systematic thinker. A faithful reading of his works should take his general philosophical framework seriously. Therefore, this overview of his system serves as the general background of the next two parts. The second part is a discussion of Hume’s aesthetic thought. More specifically, it provides an exposition of his view on beauty and judgements of beauty. This part completes the stage-setting for the development of my interpretation, by helping the reader form a more specific conceptual framework for understanding Hume’s essay. The third part develops an interpretation of ‘Of the Standard of Taste’ according to what has been provided in the previous two parts. It starts with an outline of the essay, which indicates Hume’s aim in writing it. After that, a few sections are devoted to some central elements of the essay. The last section of this part discusses four controversies concerning Hume’s essay. These discussions establish the strength of this interpretation, or at least, the fruitful prospect of an interpretative project that integrates Hume’s essay into his whole system. (shrink)

William C. Frederick proposes a naturalistic business ethics. Many commentators focus on the issues of naturalistic fallacy, deprivation of freedom of the will, and possibility of important and universal moral values in business ethics. I argue that an ethics being naturalistic is not a worry. The issue of deprivation of free will is irrelevant. Yet there are urgent questions regarding the possibility of important and universal moral values, which may prevent Frederick’s view from getting off the ground.

Alasdair MacIntyre is one of the most controversial philosophers and social theorists of our time. The propositions that the senses are separate and that the global array may be sufficient for adequate perception are questioned. There is evidence that certain tasks may be primarily but these are a special case along the behavioral continuum. Many tasks involve sensory information that is ambiguous, and other sources of information may be required for adequate perception.

Children who grow up with a life‐threatening illness live and face death in a way that is foreign to those of us who have reached adulthood in relative health. The experiences that form their identities create a range of knowledge, and processes for acquiring that knowledge, quite apart from the mainstream. In the pace of its acquisition, and the depth of its content, this knowledge is hard for the rest of us to comprehend. Indeed, the primary symptom of this alternate (...) cognizance is that it sets these children apart from their families, peers, and greater communities. The child as a whole is marginalized in interpersonal relations by essentializing the child as the illness. The experience of the illness itself further isolates the child.Through firsthand observation, we find that the Hole in the Wall Gang summer camps provide a nearly unique environment for the normalization of this alternate cognizance. At camp, all those things that set them apart from the rest of the world mark them as normal members of a society. Other children share their physical qualities, have similar experiences and immediately understand their perspective on life. Small adjustments to social and physical environments have a lasting effect. A warm pool to swim in, a caring touch, an open smile—the children take the memory of these with them when they leave. They begin to understand that they are a desired part of a large and varied community. A new definition of normal is created and they are included. (shrink)

In this volume, some of the world's greatest thinkers in philosophy, music, religion, and the arts share their insights on the future shape of human civilization. Aristotle is the most influential philosopher of practice, and Knight's new book explores the continuing importance of Aristotelian philosophy. First, it examines the theoretical bases of what Aristotle said about ethical, political and productive activity. It then traces ideas of practice through such figures as St Paul, Luther, Hegel, Heidegger and recent Aristotelian philosophers, and evaluates Alasdair MacIntyre's contribution. Knight argues that, whereas Aristotle's own thought legitimated oppression, MacIntyre's revision of Aristotelianism separates ethical excellence from social elitism and justifies resistance. (...) With MacIntyre, Aristotelianism becomes revolutionary. MacIntyre's case for the Thomistic Aristotelian tradition originates in his attempt to elaborate a Marxist ethics informed by analytic philosophy. He analyses social practices in teleological terms, opposing them to capitalist institutions and arguing for the cooperative defence of our moral agency. In condensing these ideas, Knight advances a theoretical argument for the reformation of Aristotelianism and an ethical argument for social change. (shrink)

John Dewey adopted a child-centered point of view to illuminate aspects of education he believed teacher-centered educators were neglecting, but he did so self-consciously and self-critically, because he also believed that ‘a new order of conceptions leading to new modes of practice’ was needed. Dewey introduced his new conceptions in The Child and the Curriculum and later and more fully in Democracy and Education. Teachers at his Laboratory School in Chicago developed the new modes of practice. In this article, I (...) explore Dewey’s new conception of education and compare it with the apparently opposed views of R. S. Peters and Paulo Freire. In doing so, I show that, despite their criticisms of Dewey, whether explicit or implicit, these influential philosophers, representing quite different traditions in philosophy of education were in substantial agreement with him. I also show that, despite our own differences, as important as they are, seeing teachers and learners at work in a rapidly changing society, now on a global scale, in classrooms which are also changing, driven largely by new technologies, the conception of education Dewey, Peters, and Freire developed can provide us with the foundation we need to understand the changing teacher–learner relationship and the purposes their shared activities serve. Various tests have been proposed as helps to identify intrinsic properties. This paper compares three prominent tests and shows that they fail to pass adequate verdicts on a set of three properties. The paper examines whether improved versions of the tests can reduce or remove these negative outcomes. We reach the sceptical conclusion that whereas some of the tests must be discarded as inadequate because they don’t yield definite results, the remaining tests depend for their application on the details of (...) fundamental particle physics so much so that they cannot be relied upon. In this essay Kelvin Beckett argues that Richard Peters's major work on education, Ethics and Education, belongs on a short list of important texts we can all share. He argues this not because of the place it has in the history of philosophy of education, as important as that is, but because of the contribution it can still make to the future of the discipline. The limitations of Peters's analysis of the concept of education in his chapter on “Criteria (...) of Education” are well known. In the chapter on “Education as Initiation,” however, Peters offered a synthetic sketch of education that, Beckett argues, points us toward a more comprehensive definition of education, one which, he maintains, can be accepted by all philosophers, regardless of the tradition they work in. Under what conditions are material objects, such as particles, parts of a whole object? This is the composition question and is a longstanding open question in philosophy. Existing attempts to specify a non-trivial restriction on composition tend to be vague and face serious counterexamples. Consequently, two extreme answers have become mainstream: composition (the forming of a whole by its parts) happens under no or all conditions. In this paper, we provide a self-contained introduction to the integrated information theory of consciousness (...) (IIT). We show that IIT specifies a non-trivial restriction on composition: composition happens when integrated information is maximized. We compare the IIT-restriction to existing proposals and argue that the IIT-restriction has significant advantages, especially in response to the problems of vagueness and counterexamples. By his critical reflections on the crisis of modern civilization, Jan Patočka, phenomenologist of the Other Europe, incarnates the critical consciousness of the phenomenological movement. He was in fact one of the first European philosophers to have emphasized the necessity of abandoning the hitherto Eurocentric propositions of solution to the crisis when he explicitly raised the problems of a “Post-European humanity”. In advocating an understanding of the history of European humanity different from those of Husserl and Heidegger, Patočka directs his (...) philosophical reflections back to sketch a more profound phenomenology of the natural world insufficiently thematized in Husserl and absent in Heidegger’s Sein und Zeit. By virtue of its emphasis on the structural characteristics of movement, of praxis, and of the disclosure of the abyssal nature of human existence and of the original nothingness as the (non-)foundation of the phenomenal world, Patočka’s phenomenology of the natural world constitutes an opening towards the reception of Others and other cultures, in particular that of Chinese Taoist philosophy.
