Much of this scholarship has operated within a U.S.-centered paradigm to chart interethnic relations, laboring as it does to unpack, complicate, theorize, and otherwise come to understand the changing texture of black-Jewish relations and, in Sundquist's wods, its "intermixture of empathy, anxiety, and Hostility' (3)." Ethical dilemmas involving tax issues were identified by members of the American Institute of Certified Public Accountants as posing the most difficult ethical problem for them (Finn et al., Journal of Business Ethics 7(8), pp. 607–609, 1988). The KPMG tax shelter fraud case proves that the tax profession has not gone untainted in the age of numerous accounting and corporate scandals, such as the Enron débâcle (Sikka and Hampton, Accounting Forum 29(3), 325–343, 2005). High-profile scandals serve to highlight the problems (...) caused by differences in ethical judgement among accountants and tax practitioners and the issue of ethics has been brought publicly to the forefront of the profession. Nevertheless, the nature and dimension of ethical issues in tax practice have been largely unexplored (Erard, Journal of Public Economics 52(2), 163–197, 1993; Marshall et al., Journal of Business Ethics 17(12), 1265–1279, 1998; Frecknall Hughes, Unpublished PhD Thesis, The University of Leeds, 2002). Boys, Boyz, Bois concerns questions of ethics, gender and race in popular American images, national discourse and cultural production by and about black men. The book proposes an ethics of masculinity, as ethnics refers to a system of morality and valuation and as ethics refers to a care of the self and ethical subject formation. The texts of analysis include recent films by black/African American filmmakers, gansta rap and hip-hop and black star persona: texts ranging from Blaxploitation and New Black (...) Cinema to contemporary music video to autobiography and the public image of Sidney Poitier. The book is a significant contribution to cultural studies and gender studies and critical race theory. Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

This chapter discusses the nature of software maintenance in light of software’s ontological status. A realist view of software need not commit us to the otiose position that software maintenance is impossible. Many philosophers and computer scientists have been concerned with drawing attention to software’s dual nature, its being both symbolic and physical, abstract and concrete. There are strong connections to be found between this topic and recent investigations in the philosophy of linguistics, particularly the metaphysics of words. It is (...) shown, contra Irmak, that software can be best understood through a realist type-token distinction employing an ontology of composite objects that was put forward by Katz. This approach employs both non-spatiotemporal abstract types and tokens of those types. Further developing Katz’s realist approach can help to make better sense of the dual nature of computational artefacts and their maintenance than the alternatives outlined. Young claims that a prevalent imbalanced view of maintenance as solely conservative is due to a misunderstanding of the nature of artefacts as being realisations of their producers’ intentions. This is a problem for theories of artefacts that employ intentions, such as the one involved with the realist view of software and software maintenance. Software maintenance on this view is not solely conservative but also adaptive and enhancive, constituting a source of counterexamples to Young’s claim. An alternative explanation of the imbalanced view is provided, based on observations by software engineers, especially Sommerville. (shrink)

Considered the most original thinker in the Italian philosophical tradition, Giambattista Vico has been the object of much scholarly attention but little consensus. In this new interpretation, David L. Marshall examines the entirety of Vico's oeuvre and situates him in the political context of early modern Naples. He demonstrates Vico's significance as a theorist who adapted the discipline of rhetoric to modern conditions. Marshall presents Vico's work as an effort to resolve a contradiction. As a professor of rhetoric (...) at the University of Naples, Vico had a deep investment in the explanatory power of classical rhetorical thought, especially that of Aristotle, Cicero, and Quintilian. Yet as a historian of the failure of Naples as a self-determining political community, he had no illusions about the possibility or worth of democratic and republican systems of government in the post-classical world. As Marshall demonstrates, by jettisoning the assumption that rhetoric only illuminates direct, face-to-face interactions between orator and auditor, Vico reinvented rhetoric for a modern world in which the Greek polis and the Roman res publica are no longer paradigmatic for political thought. A Naive Realist Theory of Colour defends the view that colours are mind-independent properties of things in the environment, that are distinct from properties identified by the physical sciences. This view stands in contrast to the long-standing and wide-spread view amongst philosophers and scientists that colours don't really exist - or at any rate, that if they do exist, then they are radically different from the way that they appear. It is argued that a naive realist theory of colour best (...) explains how colours appear to perceiving subjects, and that this view is not undermined either by reflecting on variations in colour perception between perceivers and across perceptual conditions, or by our modern scientific understanding of the world. A Naive Realist Theory of Colour also illustrates how our understanding of what colours are has far-reaching implications for wider questions about the nature of perceptual experience, the relationship between mind and world, the problem of consciousness, the apparent tension between common sense and scientific representations of the world, and even the very nature and possibility of philosophical inquiry. This article presents the case for an approach to consciousness that I call illusionism. This is the view that phenomenal consciousness, as usually conceived, is illusory. According to illusionists, our sense that it is like something to undergo conscious experiences is due to the fact that we systematically misrepresent them as having phenomenal properties. Thus, the task for a theory of consciousness is to explain our illusory representations of phenomenality, not phenomenality itself, and the hard problem is replaced by the (...) illusion problem. Although it has had powerful defenders, illusionism remains a minority position, and it is often dismissed as failing to take consciousness seriously. This article seeks to rebut this accusation. It defines the illusionist programme, outlines its attractions, and defends it against some common objections. It concludes that illusionism is a coherent and attractive approach, which deserves serious consideration. (shrink)

This paper applies social-relational models of moral standing of robots to cases where the encounters between the robot and humans are relatively brief. Our analysis spans the spectrum of non-social robots to fully-social robots. We consider cases where the encounters are between a stranger and the robot and do not include its owner or operator. We conclude that the developers of robots that might be encountered by other people when the owner is not present cannot wash their hands of responsibility. (...) They must take care with how they develop the robot’s interface with people and take into account how that interface influences the social relationship between it and people, and, thus, the moral standing of the robot with each person it encounters. What a person is doing often depends on that person’s thought about what they are doing, or about the wider circumstances of their action. For example, whether my killing is murder or manslaughter depends, in part, on whether I understand that what I am doing is killing you, and on whether I understand that my killing is unjustified. Similarly, if I know that the backpack I am taking is yours, then my taking it may be an act of theft; but (...) it is not theft if I simply mistook your backpack for my own. And if I don’t know that in signing a document I’m promising to do some thing, then in signing it I’m not promising to do this at all. -/- According to Elizabeth Anscombe, a central task of philosophical psychology is to articulate this dependency of action on thought. And in a range of papers published during the 1960s, Anscombe sought to elucidate various aspects of this dependency. In this paper we give a systematic overview of how Anscombe understands this dependency, and in the process reveal the conceptual framework underlying Anscombe’s thinking about perception, desire, intention, voluntariness, responsibility, guilt, and sin. Dan Marshall and Josh Parsons note, correctly. that the property of being either a cube or accompanied by a cube is incorrectly classified as intrinsic under the definition we have given unless it turns out to be disjunctive. Whether it is disjunctive, under the definition we gave, turns on certain judgements of the relative naturalness of properties. They doubt the judgements of relative naturalness that would classify their property as disjunctive. We disagree. They also suggest that the whole idea (...) of judging relative naturalness is a dubious business. We reply that, like them or not, such judgements cannot easily be avoided. (shrink)

My focus will be on Richard Feldman’s claim that what we epistemically ought to believe is what fits our evidence. I will propose some potential counter-examples to test this evidentialist thesis. My main intention in presenting the “counter-examples” is to better understand Feldman’s evidentialism, and evidentialism in general. How are we to understand what our evidence is, how it works, and how are we to understand the phrase “epistemically ought to believe” such that evidentialism might make sense as a plausible (...) thesis in light of the examples? Of course, we may decide that there’s no such way to understand evidentialism—that it just isn’t a plausible thesis. I must admit that my suspicions lean in that direction. But the potential counter-examples are put forward, not in a refutational spirit, but as an invitation to evidentialists and potential evidentialists to refine and/or explain their thesis in light of the at least apparent problems that the examples highlight. Addressing Merleau-Ponty's work Phenomenology of Perception, in dialogue with The Visible and the Invisible, his lectures at the Collège de France, and his reading of Proust, this book argues that at play in his thought is a philosophy of “ontological lateness”. This describes the manner in which philosophical reflection is fated to lag behind its objects; therefore an absolute grasp on being remains beyond its reach. Merleau-Ponty articulates this philosophy against the backdrop of what he calls “cruel thought”, a style (...) of reflecting that seeks resolution by limiting, circumscribing, and arresting its object. By contrast, the philosophy of ontological lateness seeks no such finality-no apocalypsis or unveiling-but is characterized by its ability to accept the veiling of being and its own constitutive lack of punctuality. To this extent, his thinking inaugurates a new relation to the becoming of sense that overcomes cruel thought. Merleau-Ponty's work gives voice to a wisdom of dispossession that allows for the withdrawal of being. Never before has anyone engaged with the theme of Merleau-Ponty's own understanding of philosophy in such a sustained way as Whitmoyer does in this volume. (shrink)

This book examines the politics of diversity, and explores potential sources of support for an inclusive solidarity, in particular political sources of solidarity.

Organisms' environments are thought to play a fundamental role in determining their fitness and hence in natural selection. Existing intuitive conceptions of environment are sufficient for biological practice. I argue, however, that attempts to produce a general characterization of fitness and natural selection are incomplete without the help of general conceptions of what conditions are included in the environment. Thus there is a "problem of the reference environment"—more particularly, problems of specifying principles which pick out those environmental conditions which determine (...) fitness. I distinguish various reference environment problems and propose solutions to some of them. While there has been a limited amount of work on problems concerning what I call "subenvironments", there appears to be no earlier work on problems of what I call the "whole environment". The first solution I propose for a whole environment problem specifies the overall environment for natural selection on a set of biological types present in a population over a specified period of time. The second specifies an environment relevant to extinction of types in a population; this kind of environment is especially relevant to certain kinds of long-term evolution. (shrink)

I describe a realist, ontologically objective interpretation of probability, "far-flung frequency (FFF) mechanistic probability". FFF mechanistic probability is defined in terms of facts about the causal structure of devices and certain sets of frequencies in the actual world. Though defined partly in terms of frequencies, FFF mechanistic probability avoids many drawbacks of well-known frequency theories and helps causally explain stable frequencies, which will usually be close to the values of mechanistic probabilities. I also argue that it's a virtue rather than (...) a failing of FFF mechanistic probability that it does not define single-case chances, and compare some aspects of my interpretation to a recent interpretation proposed by Strevens.
