The foundational conviction of contemporary liberal thought is that all persons possess equal moral worth and are entitled to equal concern and respect by others. At the same time, nation states, as the primary organs of our collective self-governance, frequently pursue policies that are strikingly partial towards the interests of compatriots over those of foreigners. A common strategy for justifying this national partiality is to view it as grounded in associative obligations that we incur by standing in special relationships with (...) our fellow citizens. For instance, according to familiar arguments from ‘fair play’, voluntarily partaking in and benefiting from cooperative relationships with our fellow citizens gives us reciprocal obligations to maintain these social institutions and care for needy compatriots. By contrast, we do not have corresponding associative obligations towards foreigners. I maintain that such arguments from associative obligations face an important stumbling block. I argue for the following “Boundary Principle”, according to which we cannot appeal to special relationships amongst members of a group to justify an attitude of partiality towards them unless the boundaries of this group, and the fact that they exclude other persons from membership, can also be justified. If this is right, arguments from associative obligations, by themselves, are necessarily incomplete. Most modern states severely limit the scope of economic migration, and thereby prevent many would-be contributors to the collective enterprises of affluent societies from entering into those special relationships with us that would give rise to associative obligations on our part. Not only are would-be immigrants excluded from the benefits that participation in the cooperative schemes of affluent nation-states would itself confer; in addition, the fact that they do not stand in such cooperative relationships with us is then appealed to in order to justify the fact that we assign significantly less weight to their interests in the formulation of state policy. The upshot of my discussion is not that a defense of national partiality in terms of associative obligations cannot succeed. It is rather that a successful defense of national partiality in these terms is more closely tied to the question whether principled restrictions can be placed on immigration than most political philosophers have hitherto assumed. This important new book by a major voice in the Social Imaginaries movement offers the most systematic attempt to establish conceptual and historical links between the idea of modernity as a new civilization and the notion of multiple modernities. Arnason demonstrates a theory of globalization that is still compatible with the emphasis on unity and diversity of modernity as a civilization.

This article responds to a critical research challenge in Medieval philosophy scholarship regarding the internal periodisation of the register. By arguing the case for ‘post-scholasticism’ as an internal period indicator (1349–1464, the era between the deaths of William of Ockham and Nicholas of Cusa), defined as ‘the transformation of high scholasticism on the basis of a selective departure thereof’, the article specifies a predisposition in the majority of introductions to and commentaries in Medieval philosophy to proceed straight from 1349 to (...) 1464, understating 115 years of pertinent Medieval philosophical discourse. It is argued that in the modern account of Medieval philosophy, this understatement is manifested in either a predating of Renaissance philosophy to close the gap between 1349 and 1464 as far as possible or in proceeding straight from 1349 to Renaissance philosophy. The article presents five unique philosophical themes from this delicate period, indicating that ‘post-scholasticism’ was indeed a productive period in late Medieval philosophy, which should not be bypassed as an inconsequential entrance to Renaissance philosophy. The period 1349–1464 should accordingly be appreciated for its idiosyncratic contributions to the history of ideas in the late-14th and early-15th centuries, with reference to the political intensification of the via moderna, the pivotal separation of philosophy and theology and the resulting independence of the natural sciences, in res critique of institutions, transforming pragmatics and the rise of philosophical materialism. Contribution: This article contributes to methodological development in Medieval philosophy by responding to a critical research challenge regarding the internal periodisation of the later Middle Ages. Arguing the case for ‘post-scholasticism’ as an internal period indicator (1349 to 1464 in Medieval philosophy, the article presents unique philosophical themes from the period, indicating that it was a productive stage in late Medieval philosophy which should not be bypassed as an inconsequential entrance to Renaissance philosophy. Si l’on connaît aujourd’hui le dialogue fructueux que Paul Ricœur a noué avec les penseurs structuralistes, on ignore largement son positionnement face à la mouvance poststructuraliste. Faut-il opposer la philosophie de Ricœur au poststructuralisme à la française ou au contraire doit-on montrer qu’elle en est une variante singulière? C’est la seconde option qui est ici défendue. Certes, le poststructuralisme ne doit pas être considéré comme une école de pensée mais comme une reconstruction qui relève de l’histoire de la philosophie. Dans (...) la mesure où les horizons de dépassement du structuralisme ont été posés de manière chaque fois particulière, il est préférable de parler de poststructuralismes au pluriel. This article provides an original reappraisal of the notion of Minnemystik in the work of the 13th-century Flemish beguine Hadewijch of Antwerp, with specific reference to its Trinitarian and Christological orientations. After an introduction to the nature and origins of Hadewijch’s work, relating to the discovery of four extant manuscripts in Belgium in 1838, followed by an elucidation of the experience-driven epistemology of the Victorians Richard of St Victor and Hugo of St Victor as her key early scholastic influences, Hadewijch’s (...) Minnemystik is distinguished from Wesenmystik, as encountered in the mystical work of her French contemporary and beguine counterpart, Marguerite Porete. From this discursive basis, Hadewijch’s Minnemystik is reassessed and represented as pertinently Trinitarian and Christological in orientation, and therefore as a theological presentation from the 13th century. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

Luck egalitarianism has come under a lot of criticism for its apparent harshness towards negligent victims of voluntary actions (the harshness objection) and its inability to respond to morally-acceptable voluntary acts that lead to disadvantage (the discrimination objection). This paper surveys a series of responses in the luck egalitarian literature, showing that for the most part each one is unable to respond, on its own, to the crux of the objections. These responses often face a dilemma: Either they must bite (...) the bullet on the objections to retain their luck egalitarian commitments, or they must propose a reply to the objection that diverges from their core luck egalitarian principles. In this paper, I advance a preliminary framework for grounding luck egalitarian theories of justice based upon a two-level model and what I shall call the Fact of Inherent Normativity. Two-level luck egalitarianism makes fundamental rights and basic needs de facto insensitive to responsibility at the first level, while retaining the scope for responsibility for the distribution of second-level goods. The account remains distinctly luck egalitarian, while leaving scope for the consideration of rights, respect, and a host of other morally relevant considerations within the luck egalitarian framework. Luck egalitarianism, properly understood as a two-level theory, can successfully respond to objections against its harshness and propensity to discriminate. (shrink)

The recognition of capitalism as a core component of modernity has often led to conflation of the two categories; this happens to critics as well as defenders of capitalism, and it reflects their shared but only partly acknowledged premises. A tendency to interpret capitalism as a self-contained system has strongly affected the debate on its historical significance; this reductionistic approach could be adapted to different ideological stances as well as to changing views of capitalism's long-term trajectory. The notion of a (...) `spirit of capitalism', in the sense of cultural sources essential to the constitution (and arguably also to the continuity) of the capitalist order, has been one of the most important correctives to economic determinism and reductionism, but it has proved difficult to link this dimension to other aspects of the problematic. The article surveys the contributions of Weber, Sombart, Castoriadis and - most recently - Luc Boltanski and Eve Chiapello to this debate. The last section then discusses the work of Fernand Braudel and suggests that it could serve to reformulate the problematic of capitalism in more multidimensional terms. (shrink)

Both, bioconservatives and bioliberals, should seek a discussion about ideas of human perfection, making explicit their underlying assumptions about what makes for a good human life. This is relevant, because these basic, and often implicit ideas, inform and influence judgements and choices about human enhancement interventions. Both neglect, and polemical but inconsistent use of the complex ideas of perfection are leading to confusion within the ethical debate about human enhancement interventions, that can be avoided by tackling the notion of perfection (...) directly. In the recent debates, bioconservatives have prominently argued against the ‘pursuit of perfection’ by biotechnological means. In the first part of this paper, we show that—paradoxically—bioconservatives themselves explicitly embrace specific conceptions of human perfection and perfectionist assumptions about the good human life in order to argue against the use of enhancement technologies. Yet, we argue that the bioconservative position contains an untenable ambiguity between criticising and endorsing ideas of human perfection. Hence, they stand in need of clarifying their stance on human perfection. In the second part of the paper, we ask whether bioliberals in fact (implicitly) advocate a particular conception of perfection, or whether they are right in holding that they do not, and that discussing perfection is obsolete anyway. We show that bioliberals also rely on a specific idea of human perfection, based on the idea of autonomy. Hence, their denial of the relevance of perfection in the debate is unconvincing and has to be revised. (shrink)

Like biological species, languages change over time. As noted by Darwin, there are many parallels between language evolution and biological evolution. Insights into these parallels have also undergone change in the past 150 years. Just like genes, words change over time, and language evolution can be likened to genome evolution accordingly, but what kind of evolution? There are fundamental differences between eukaryotic and prokaryotic evolution. In the former, natural variation entails the gradual accumulation of minor mutations in alleles. In the (...) latter, lateral gene transfer is an integral mechanism of natural variation. The study of language evolution using biological methods has attracted much interest of late, most approaches focusing on language tree construction. These approaches may underestimate the important role that borrowing plays in language evolution. Foucault’s sodomite’: Damian’s Liber gomorrhianus (1049) reopened. Taking Michel Foucault’s famous statement about the difference between the ‘Medieval sodomite’ and the heteronormative ‘19th century homosexual’ as its cue, this article surveys the discursive source of that statement in the work of Peter Damian (1007–1072) with regard to his obscure, yet consequential text, Liber gomorrhianus (presented in 1049 to Pope Leo IX, preceding the Council of Reims). Drawing on the recent research by Ranft and because Damian is such an understated figure (...) in the corpus of Medieval philosophy, an overview of Damian’s life and work is presented, especially in terms of Damian’s 11th century reforming labour ethics. Only then the article proceeds to reopen Damian’s text, indicating that the ‘Medieval sodomite’ is far removed from an elementary precursor to the modern scientia sexualis homosexual, but is indeed presented by Damian as a complex and gender-inclusive licentious person, within the context of the disintegration of sexual morality (especially within the domains of celibacy and confession) in the middle to late 11th century church and monasteries. Cross-referencing the own translation of the Latin text with the translation of Payer, the article disseminates and critiques the key concepts in Damian’s argument for the summarily deposition of lapsi [fallen priests] and the expulsion of promiscuous monks (and nuns) from the orders, especially with regard to Damian’s concepts of contra-natural and irrational fornication. Pope Leo’s deeply pastoral and insightful answer to Damian ( Ad splendidum nitentis ) is presented in the last part of the article, including his sanctioning of Damian’s complex concept of sodomy, which on that ground, became the conceptual source for the council of Reims (1049), and subsequent Medieval councils dealing with the ‘problem of sodomy’ in the church and monasteries. The canons of those councils were indeed the source of Foucault’s analysis of Medieval sexuality – yet the more fundamental source was Damian’s obscure text. (shrink)

Johann Christoph Gottsched is considered to be one of the greatest scholars of the Early German Enlightenment. As a professor for poetics in Leipzig, he worked towards a reformation of the German language and a renaissance in German drama. His extensive correspondence and social contacts made him a ‚European event‘ and his papers are being presented here in a standard edition: 25 volumes, approx. 6,000 letters to and from Gottsched, predominantly in German, are being published with a critical apparatus (...) and an academic commentary. This edition is being published in co-operation with the Saxonian Academy of Sciences and edited by members of the academy. The edition is scheduled to be published over 25 years and offers an ideal addition to the multi-volume edition of Gottsched's works, already published by de Gruyter. (shrink)

The objective of this article is to present an overview, based on the most recent specialist research, of Neoplatonist developments in the Cologne tradition of the later Middle Ages, with specific reference to a unique Proclian commentary presented by the German Albertist Dominican, Berthold of Moosburg (ca. 1300–1361). Situating Berthold in the post-Eckhart Dominican crisis of the 1340s and 1350s, his rehabilitating initiative of presenting this extensive (nine-volume) commentary on the Neoplatonist Proclus Lycaeus’ (412–485) Elements of Theology in his Expositio (...) super Elementationem theologicam Procli, the only of its kind from the Middle Ages, is contextualised with reference to Berthold’s discursive indebtedness to his Dominican predecessors, Albert the Great (ca. 1200–1280), Ulrich of Strasbourg (ca. 1220–1277) and Dietrich of Freiberg (ca.1250 – ca.1310), as well as two Dutch-Cologne successors, the Albertist Heymeric of Camp (1395–1460) and the Carthusian Thomist Denys de Leeuwis (1402–1471). Berthold’s unique contribution to the philosophical discourse of the Middle Ages is indicated therein that the Expositio provided a synthesis of the late Medieval version of Neoplatonism and contemporaneous German–Dominican theories. By contextualising the work of his Cologne predecessors and successors in the broad idea-historical landscape of antiquity and Neoplatonism, the article argues that Berthold succeeded in linking the Neoplatonic legacy with Cologne Albertism and provided an impetus for the overall consolidating ability of the Cologne tradition. By juxtaposing Berthold and his Expositio with the more conventional legacies of Ulrich, Dietrich, Heymeric and Denys, this exceptional Latin-Western intellectual tradition from Cologne is expanded and enriched with regard to its notable Neoplatonic contributions to philosophy in the later Middle Ages. The process of applying the law tends to oscillate between two modes: the subsumption under “clear” rules on the one hand and the interpretative concretisation of vague and abstract blanket clauses on the other. Legal arguments therefore refer both to the semantic content of rules and to legal self-evidence. Consequently the application of law can effectively be influenced not only through new legislation, but also through the introduction of new inter-preters bringing with them a different set of preconceptions, and thus (...) differing interpretations of the law. The traditional balance between these two models of control is endangered in mul-ticultural societies since these societies are characterised by conflicting concepts of justice. An automated application of law, aspired to by many legal scholars, could dispense legal practice from such conflicting prejudices. The price for that gain, however, would likely be a loss of the rule of law in the general understanding. (shrink)

In Scepticism and Naturalism Strawson characterized his position as a form of naturalism. Not even in that work, however, did he subscribe to any standardly recognized types of naturalism (ontological, epistemological, meta-philosophical). Strawson’s naturalism, as far as it goes, is anthropological instead of scientific, and descriptive rather than revisionary. It insists that central features of our common-sense conceptual scheme are part of our human nature and therefore immune to naturalization by either reduction or elimination. My contribution explores both strengths and (...) weaknesses of this position. It discusses the ‘relativizing move’ that insists on the legitimacy of both the ‘participant’ or ‘involved’ perspective of everyday life vs. the ‘objective’ or ‘detached’ of science as well as Strawson’s ‘relaxed realism’. It ends with a defence of the general idea of anthropological naturalism. In spite of problems concerning details of execution, this approach is more sober, realistic and illuminating than mainstream naturalisms. (shrink)

This article is part of a research project, Conversations after God. The focus of this article is to reflect on the theory and methodology of practical theology in a post-metaphysical context. It will be suggested that practical theology can redefine itself as public theology, but specifically as Christology by engaging the public texts within their contexts, but from a Christ-science hermeneutical approach. The proposed approach is a hermeneutical approach where the Christ-Ereignis guides the inner- and inter-textual reading of texts within (...) contexts. This Christ-Ereignis cannot be translated into a science or even a definable philosophy and therefore the logos is crossed out. Christology, as public theology is done from the margins of the dominant discourses and therefore it could be seen as a Christology from the margins of the market to create spaces of kingdom life: life in fullness. Ibn KhaldØun’s theory of history has been extensively discussed and interpreted in widely divergent ways by Western scholars. In the context of present debates, it seems most appropriate to read his work as an original and comprehensive version of civilizational analysis (the key concept of ‘umran is crucial to this line of interpretation), and to reconstruct his model in terms of relations between religious, political and economic dimensions of the human condition. A specific relationship between state formation and the broader (...) context of civilizational processes appears as the most central theme. This civilizational approach is then contrasted with the most influential recent Western interpretation, put forward by Ernest Gellner. Gellner translates Ibn KhaldØun’s analysis into functionalist terms and thus tones down its historical and civilizational specificity. The consequences are most obvious when it comes to discussing the unity and diversity of the Islamic world, especially with regard to the Ottoman Empire. (shrink)

Die Intentionalität des Psychischen charakterisiert Meinong als Erfassen eines Gegenstandes durch das erfassende Erlebnis, wobei der erfaßte Gegenstand weder zu existieren noch zu bestehen braucht. Ein Gegenstand ist geradezu bestimmt als das, was erfaßt werden kann; der erfaßte Gegenstand ist aber nicht Teil des erfassenden Erlebnisses. Gleichsam als subjektives, psychisches Korrelat stellt Meinong dem erfaßten Gegenstand (Objekt, Objektiv etc.) den entsprechenden Erlebnisinhalt (Vorstellungsinhalt, Urteils- bzw. Annahmeinhalt etc.) gegenüber, der zu dem betreffenden Gegenstand in einer Adäquatheitsrelation steht. Ziel des Aufsatzes ist (...) es, einige der Schwierigkeiten zu besprechen, die die Einführung von derartigen psychischen Inhalten mit sich bringen. M.E. gibt es keinen brauchbaren Anhaltspunkt, herauszufinden, wie die psychischen Inhalte ihre Aufgabe, auf die Gegenstände zu referieren, sie dem Erfassen darzubieten, zu erfüllen vermögen. Weitere schwerwiegende Probleme ergeben sich aus der Frage, welche Gegenstände hinweisendem Denken entsprechen und wie es gelingen kann, durch einen Hilfsgegenstand den Zielgegenstand zu erfassen. Predictive interventions and practices are becoming a defining feature of medicine. The author points out that according to the inner logic and external supporters of modern medicine, participating in healthcare increasingly means participating in knowing, sharing, and using of predictive information. At the same time, the author addresses the issue that predictive information may also have problematic side effects like overdiagnosis, health-related anxiety, and worry as well as impacts on personal life plans. The question is raised: Should we resort to (...) stigmatization if doing so would increase participation in predictive interventions, and thereby save healthcare costs and reduce morbidity and premature death?
