‘Rights and Territories: A Reply to Nine, Miller, and Stilz’ defends the Lockean theory of states’ territorial rights (as this theory was presented in Boundaries of Authority) against the critiques of Nine, Miller, and Stilz. In response to Nine’s concern that such a Lockean theory cannot justify the right of legitimate states to exclude aliens, it is argued that a consent-based theory like the Lockean one is flexible enough to justify a wide range of possible incidents of territorial rights – (...) importantly including, though not necessarily including, the sort of right to exclude aliens that is familiar from actual political practice. Miller’s criticisms are more wide-ranging. In response, the article argues that Lockean labor-based property rights are both stronger and more enduring than Miller suggests and that nationalism’s resources for dealing with concerns about rights-supersession and trapped minorities are importantly overstated by Miller. Against Stilz’s Kantian, ‘presentist’ account of states’ authority over persons and territories, it is argued that the rectification of past (historical) wrongs remains morally crucial even in the context of otherwise-just societies and that Stilz’s Kantian/rawlsian position unconvincingly privileges the rights to autonomy of territorially concentrated groups over those of dissenting individuals or wrongfully dispersed groups. Descartes’ mind-body dualism and his quest for objective knowledge can appear de-humanizing. My aim in this paper is to re-humanize Descartes. When we take a closer look at what Descartes actually says about human beings, it casts his entire thought in a much different light.

National and international guidelines outlining ethical conduct in research involving humans and animals have evolved into large and complex documents making the process of gaining ethics approval a complicated task for researchers in the area. Researchers, in particular those who are relatively new to the ethics approval process, can struggle to understand the parts of an ethics guideline that apply to their research and the nature of their ethical obligations to trial participants. With the scope of medical research likely to (...) continue to expand in the future, it is clear that ethics guidelines will only increase in complexity and number. This paper describes one possible solution to the problem: the use of an internet-based expert system to intelligently and interactively distribute the information stored in ethics guidelines to individual researchers. This paper also details how one such system was designed and tested with respect to Australian medical research ethics guidelines. (shrink)

In this essay I consider the possible impact of thinking phenomenologically about faith in a postmodern/post-secular age. Following Merold Westphal’s encouragement that philosophy of religion should be more ‘personal’, I offer a phenomenological reflection on my own experience of the difficulties and complexities that accompany being a postmodern phenomenologist and a Pentecostal Christian. Working through the possible conflicts that can arise when these two identities are brought together, I propose an account of Kierkegaardian postmodernism that resolves the conflict without, thereby, (...) eliminating the existential and theological difficulties that accompany religious existence in a postmodern/post-secular world. Ultimately, then, I show that personal engagement with religious existence is not excluded by postmodern phenomenology, but is in fact crucial for an appropriately postmodern/post-secular approach to phenomenological philosophy of religion itself. I conclude by proposing a possible account of God that reflects both phenomenological rigor and existential awareness. (shrink)

This paper problematises the official discourse of economic competitiveness and social inclusion used by the 2007 Education and Skills Bill to justify the proposal to extend compulsory participation in education and training in England to the age of 18. Comparisons are drawn between this attempt to raise the age of compulsion and previous attempts, which took place in a significantly different socio-economic context. It is argued that the needs of those most likely to be affected by the current proposal -- (...) young people not in education, employment or training (NEET) -- are subordinated to the needs of an English economy that is increasingly based upon low-skill, low-pay work relations. This volume of fourteen essays commemorating the 350th anniversary of the publication of Descartes’s Meditations represents several current trends in Descartes scholarship. Among the essays there are close textual analyses, discussions of the scholastic Aristotelian influence on Descartes, and an emphasis on metaphysical topics rather than the epistemological ones that dominated the Anglo-American literature twenty years ago. The volume bears the mark of being a collection of conference papers in its breadth of topics and methodological styles, but it serves well (...) as a measure of the times for the history of philosophy, as I will explain below. This paper focuses on independent training providers (ITPs) – in other words, private companies – as suppliers of vocational education and training in post-war England. Whilst acknowledging the central role of further education (FE) colleges in delivering vocational learning, it draws attention to a large, diverse sector of ITPs operating alongside FE colleges, particularly during the 1960s and 1970s. Data suggest that around 15–20% of vocational learners were enrolled as fee-paying customers with private providers at that time – a figure (...) broadly similar to today. There are, it is argued, three related reasons for this. First, the post-war policy environment, and the varied and uneven nature of colleges at that time, allowed significant room for ITPs to operate as alternative providers of vocational education. Second, the far-reaching ‘efficiency’ gains required since FE colleges left local authority control have largely attenuated the space in which ITPs previously operated. Third, neoliberal assumptions about the superiority of private enterprise mean that ITPs now receive significant funding from the state, largely to deliver Apprenticeships and other programmes of work-related learning – which has, somewhat perversely, reduced the incentive for them to act as bone fide commercial providers of a broader range of vocational learning. Does metacognition--the capacity to self-evaluate one's cognitive performance--derive from a mindreading capacity, or does it rely on informational processes? Joëlle Proust draws on psychology and neuroscience to defend the second claim. She argues that metacognition need not involve metarepresentations, and is essentially related to mental agency.

In this paper, I examine a solution to the Liar paradox found in the work of Ockham, Burley, and Pseudo-Sherwood. I reject the accounts of this solution offered by modern commentators. I argue that this medieval line suggests a non-hierarchical solution to the Liar, according to which ?true? is analysed as an indexical term, and paradox is avoided by minimal restrictions on tokens of ?true?. In certain respects, this solution resembles the recent approaches of Charles Parsons and Tyler Burge; in (...) other respects, it is related to a suggestion of Gödel. But, as a whole, it suggests an original solution to the Liar paradox, quite unlike any current proposals. (shrink)

One of the central issues dividing proponents of metaphysical interpretations of transcendental idealism concerns Kant’s views on the distinctness of things in themselves and appearances. Proponents of metaphysical one-object interpretations claim that things in themselves and appearances are related by some kind of one-object grounding relation, through which the grounding and grounded relata are different aspects of the same object. Proponents of metaphysical two-object interpretations, by contrast, claim that things in themselves and appearances are related by some kind of two-object (...) grounding relation, through which the grounding and grounded relata involve distinct objects. By way of investigating Kant’s overarching account of grounding, I will argue that the most plausible metaphysical interpretation of transcendental idealism is one on which we can know that there are things in themselves grounding appearances, but not which specific kind of one- or two-object grounding relation obtain between them. Our ignorance of things in themselves therefore extends to their distinctness from appearances — pace both metaphysical one-object interpretations and metaphysical two-object interpretations. In 1905, Richard discovered his paradox of definability, and in a letter written that year he presented both the paradox and a solution to it.Soon afterwards, Poincaré endorsed a variant of Richard?s solution.In this paper, I critically examine Richard?s and Poincaré?s ways out.I draw on an objection of Peano?s, and argue that their stated solutions do not work.But I also claim that their writings suggest another way out, different from their stated solutions, and different from the orthodox Tarskian approach.I argue (...) that this second solution does not prevent the return of the paradox. De La Torre offers a critique of “Euroamerican” Christian ethicists whose works have greatly influenced contemporary Christian moral discourse. He addresses the writings of Walter Rauschenbusch, Reinhold Niebuhr, Stanley Hauerwas, Anthony Campolo, Ron Sider, and Jim Wallis. De La Torre faults these theologians for the ways in which their moral thinking participates in the oppression and marginalization of Latina/os, either through their silence or through their endorsement of specific polices. De La Torre concludes that the legacy of cultural and economic privilege and the oppression of Latinas/os are so [End Page 199] deeply embedded in the Eurocentric thinking that has dominated the field of Christian ethics that it cannot be the foundation for Latino social ethics.De La Torre’s aim is to “move beyond” Eurocentric modes of thinking rather than dwell on critique. This eagerness to move forward to the creative and constructive aspects of Latina/o ethics, however, limits the forcefulness of his critique of Euroamerican ethicists. De La Torre’s reading of Euroamerican ethics—and even the application of that term—is highly selective, both in terms of the thinkers chosen and the writings examined. While De La Torre’s criticisms of these thinkers are generally insightful and serve to illustrate his basic criticism of Eurocentric ethics, these criticisms are limited in their depth of analysis. De La Torre is less concerned with the broader historical and theological considerations at work in these Euroamerican ethicists than with their failures to adequately address issues of concern to Latinas/os.The second half of Latina/o Social Ethics moves to his constructive, or “reconstructive,” project. De La Torre reviews central concepts in the methodology of Latina/o social ethics, including lo cotidiano, nepantla, la lucha, en conjunto, and acompañamiento. De La Torre’s explanation of these terms is brief and accessible. Moving beyond these concepts, the fourth chapter of Latina/o Social Ethics offers a creative approach to a liberative ethics that draws on Christian tradition as well as broader Hispanic cultural resources, including folk characters and themes of the trickster found in Afro-Caribbean religious traditions. De La Torre addresses the concern for how to imagine a Christian ethics with a role for the trickster, including identifying trickster characters and themes in the Bible. His “disruptive ethics” challenges the preference for order over justice that has characterized Eurocentric ethics, for which he provides helpful examples. De La Torre is clearly concerned with imperialism, immigration, and free trade, yet it is unclear what justice means in those contexts. Perhaps due to the powerlessness of marginalized Latina/os, criticisms of injustice weigh far more heavily than visions of justice.The concise length of this book broadens its appeal. Academics unfamiliar with some of the concepts and methodologies of Latina/o theologians will find this short introduction a useful starting point. This provocative book would also be a welcome addition to the classroom, either in part or in its entirety.In contrast to De La Torre’s short work, Rubén Rosario Rodríguez sets a broader and more ambitious task in his Racism and God-Talk. There are many cases in which, by making some great sacrifice, you could bring about either a good outcome or a very good outcome. In some of these cases, it seems wrong for you to bring about the good outcome, since you could bring about the very good outcome with no additional sacrifice. It also seems permissible for you not to make the sacrifice, and bring about neither outcome. But together, these claims seem to imply that you ought to bring (...) about neither outcome rather than the good outcome. And that seems very counterintuitive. In this paper, I develop this problem, propose a solution, and then draw out some implications both for how we should understand supererogation and for how we should approach charitable giving. Judgments concerning animals have arisen across a variety of established practice areas. There is, however, no publicly available repository of judgments concerning the emerging practice area of animal protection law. This has hindered the identification of individual animal protection law judgments and comprehension of the scale of animal protection law made by courts. Thus, we detail the creation of an initial animal protection law repository using natural language processing and machine learning techniques. This involved domain expert classification of 500 judgments (...) according to whether or not they were concerned with animal protection law. 400 of these judgments were used to train various models, each of which was used to predict the classification of the remaining 100 judgments. The predictions of each model were superior to a baseline measure intended to mimic current searching practice, with the best performing model being a support vector machine (SVM) approach that classified judgments according to term frequency—inverse document frequency (TF-IDF) values. Investigation of this model consisted of considering its most influential features and conducting an error analysis of all incorrectly predicted judgments. This showed the features indicative of animal protection law judgments to include terms such as ‘welfare’, ‘hunt’ and ‘cull’, and that incorrectly predicted judgments were often deemed marginal decisions by the domain expert. The TF-IDF SVM was then used to classify non-labelled judgments, resulting in an initial animal protection law repository. Inspection of this repository suggested that there were 175 animal protection judgments between January 2000 and December 2020 from the Privy Council, House of Lords, Supreme Court and upper England and Wales courts. Brian Calvert has offered us a clear and careful analysis of Locke′s views on punishment and capital punishment. 1 The primary goal of his paper–that of correcting the misperception of Locke as a wholehearted proponent of capital punishment for a wide range of offences–must be allowed to be both laudable and largely achieved in his discussion. But Calvert′s analysis also encourages, I think, a number of serious misunderstandings of Locke′s true position.

A longstanding criticism of Lenin is that his epistemological contributions to the theory of scientific socialism prompted the decline of Marxism in dogmatism and despotism in the twentieth century. According to this narrative, Lenin claimed to possess the objective truth, and he therefore refused to tolerate alternative perspectives. This article subjects these claims to a textual analysis, and it argues that they are erroneous. Lenin defends a fallibilist account of science that affirms the uncertainty of knowledge in the natural, philosophical (...) and social sciences. This fallibilism pervades the text that supposedly showcases his intolerance, Materialism and Empirio-Criticism. Lenin’s scientific socialism opposes rigid conceptions of socialism, and it encourages an atmosphere of democratic debate. Whilst Lenin’s writings have their flaws, they are not the founding documents of Marxist dogmatism that they are often portrayed as being. Lenin is not the narrow-minded vulgariser of Marxism that he is routinely taken to be. (shrink)

I then extend my initial response to cover Shagrir’s argument, thus demonstrating that it is possible to individuate digits in non-representational computing mechanisms. John Locke's political theory has been the subject of many detailed treatments by philosophers and political scientists. But The Lockean Theory of Rights is the first systematic, full-length study of Locke's theory of rights and of its potential for making genuine contributions to contemporary debates about rights and their place in political philosophy. Given that the rights of persons are the central moral concept at work in Locke's and Lockean political philosophy, such a study is long overdue.

Content note: This paper discusses rape throughout.Abstract. In this paper, I consider arguments in favor of jury trials. While I find these generally persuasive, I argue that there can be cases where juries are not fit for purpose. In those cases, I argue that they should be replaced by judge-only trials. In doing so, I propose a framework for determining whether a type of case is unsuitable for jury trials. Partly in response to low conviction rates, there have been recent (...) suggestions that rape trials should be conducted without juries. I suggest that there is strong evidence that these offences qualify under the criteria I have described. As a result, I argue that judge-only trials should be adopted for trying rape cases. (shrink)

Is there any number of people you should save from paralysis rather than saving one person from death? Is there any number of people you should save from a headache rather than saving one person from death? Many people answer ‘yes’ and ‘no’, respectively. They therefore accept a partially aggregative moral view. Patrick Tomlin has recently argued that the most promising partially aggregative views in the literature have implausible implications in certain cases in which there are additions or subtractions to (...) the groups of people that we can save. Several philosophers have begun responding to this argument by developing partially aggregative views that avoid the relevant implications. In this paper, I extend Tomlin’s argument to create a dilemma that no partially aggregative view can avoid. I conclude that we should accept a fully aggregative moral view. (shrink)

The aim of this paper is to begin developing a version of Gualtiero Piccinini’s mechanistic account of computation that does not need to appeal to any notion of proper functions. The motivation for doing so is a general concern about the role played by proper functions in Piccinini’s account, which will be evaluated in the first part of the paper. I will then propose a potential alternative approach, where computing mechanisms are understood in terms of Carl Craver’s perspectival account of (...) mechanistic functions. According to this approach, the mechanistic function of ‘performing a computation’ can only be attributed relative to an explanatory perspective, but such attributions are nonetheless constrained by the underlying physical structure of the system in question, thus avoiding unlimited pancomputationalism. If successful, this approach would carry with it fewer controversial assumptions than Piccinini’s original account, which requires a robust understanding of proper functions. Insofar as there are outstanding concerns about the status of proper functions, this approach would therefore be more generally acceptable. (shrink)

According to weak utilitarianism, at least when other things are equal, you should maximize the sum of well-being. This view has considerable explanatory power, but it also has two implications that seem to me implausible. First, it implies that, other things equal, it is wrong to harm yourself, or even to deny yourself benefits. Second, it implies that, other things equal, given the opportunity to create new happy people, it is wrong not to. These implications can be avoided by accepting (...) a complaints-based alternative to weak utilitarianism. However, complaints-based views face two decisive problems, originally noticed by Jacob Ross. I here develop a view that avoids these problems while retaining the advantages of complaints-based views. (shrink)

Microbes in the gastrointestinal tract are under selective pressure to manipulate host eating behavior to increase their fitness, sometimes at the expense of host fitness. Microbes may do this through two potential strategies: (i) generating cravings for foods that they specialize on or foods that suppress their competitors, or (ii) inducing dysphoria until we eat foods that enhance their fitness. We review several potential mechanisms for microbial control over eating behavior including microbial influence on reward and satiety pathways, production of (...) toxins that alter mood, changes to receptors including taste receptors, and hijacking of the vagus nerve, the neural axis between the gut and the brain. We also review the evidence for alternative explanations for cravings and unhealthy eating behavior. Because microbiota are easily manipulatable by prebiotics, probiotics, antibiotics, fecal transplants, and dietary changes, altering our microbiota offers a tractable approach to otherwise intractable problems of obesity and unhealthy eating.
