The commentaries on the Ethica nova and the Ethica vetus written by some masters of the arts – presumably operating in the Paris faculty – in the first half of the thirteenth century expound in an original way the doctrine of the virtutes consuetudinales which Aristotle, at the end of the first book of his Ethica (I 13), distinguishes into the two main classes of the “moral virtues” and the “intellectual virtues”. The present paper aims at highlighting the particularly important (...) task which is assigned to the intellectual virtues in these early commentaries: joining man to God directly, through a contemplation which becomes love. The masters of the arts maintain that the moral virtues, in spite of the definition given by Aristotle (habitus a quo quis bonus est et opus eius bene reddit), are not sufficient alone to bring man to perfection, but that other more perfect virtues, namely the intellectual ones, are needed in order to make him know and love the supreme good. Having no knowledge of the sixth book of the Ethica, in which Aristotle deals in particular with the intellectual virtues, our masters know only their general description and are concerned with clarifying their relationships with the moral virtues, compared to which they appear to be sometimes really distinct and sometimes united to them in sharing the recta ratio, so much that they may constitute a double virtue. Although the masters of the arts seem to be well-informed about the teaching of the theologians – which they often cite without opposing to it, albeit stressing their own philosophical point of view –, it is significant that no reference whatsoever is made by them to the theological virtues and that they have recourse to the themes of Avicennian mysticism such as the doctrine of the two faces of the soul. Besides presenting the commentaries on the Ethica vetus from a general point of view, I will focus on the Paris commentary in Ethicam veterem (Paris BN lat. 3804A, ff. 152ra-159vb, 241ra-247vb; Paris BN lat. 3572, ff. 226ra-235ra), of which I am preparing a critical edition. The Paris commentary contains in fact a special and original discussion of the doctrine of the virtutes intellectuales. (shrink)

Lately, a number of referee decisions appear to have reignited the debate over the need to bring more in-game officiating technology into soccer. The fallacies behind the arguments for the inclusion of technology to aid game officials can be narrowed down to those behind current arguments for or against goal-line technology. Both the proponents and opponents of these arguments appear to overemphasise the role of referees to the point of claiming that if refereeing errors could be eliminated in goal-line situations, (...) then the most deserving team would most of the time be expected to win the contest. While we firmly believe that the game of soccer would benefit immensely from infallible officiating, we intend to show that these arguments are founded upon a number of inconspicuous assumptions. First, they assume that goal-line situations can be shown to affect the outcomes of games more than all other game situations. This can easily be shown to be a myth, since goals can be scored from all areas of the playing field. In addition, winning a soccer game, obviously, involves more than just scoring goals. Second, these arguments seem to support the view that referee decisions affect the outcomes of games more than decisions made by players, coaches and managers. This is merely a myth, since one can show that, in light of Cesar Torres's insights, referee involvement in game is limited to regulating situations that demand that the game be restored to its constitutive actualisation. Third, most arguments for goal-line technology tend to support the erroneous view that technology can actually eliminate most ?crucial? human mistakes from sport and, thus, ensure fairness of game outcomes. Such a myth can easily be refuted by reference to numerous cases of inconclusive slow-motion video replays in soccer. Therefore, this paper aims at arguing that, instead of reinforcing the scapegoating of referees and overemphasising the importance of isolated referee decisions to the point of attributing victory or defeat to these ?crucial? decisions, both sides of the goal-line technology debate need to put forth compelling arguments which go beyond the current misguided search for referee infallibility. The notion of competition depicted in sport literature appears to be inconsistent with the goals of current European soccer competitions. This paper examines two misconceptions of fair competition which are prevalent in these competitions. First, it aims at refuting the view that professional soccer only requires some basic equality of chances beyond the differences in players’ skills and managers’ knowledge of game strategy. In other words, it refutes the view that professional soccer only demands a notion of fair competition understood (...) as fair play. Second, the paper also aims at refuting the view that fair competition, in professional soccer, is simply a matter of financial viability. Hence, it calls for both genuine legal and ethical reforms, since professional soccer competition requires a notion of equality as both a goal and a right. Such a notion, we argue, must conceive of the differences in players’ skills and managers’ knowledge of game strategy as one of the primary factors in establishing a platform founded in fair competition. Therefore, this paper calls for a radical change of attitude toward or a radical approach to fair competition among European sport fans, policy-makers, and administrators. (shrink)

Indigenous peoples struggle to survive the policies of the colonial states and their ability to annihilate, make invisible, destroy and re-construct our ancient identities. This is my story. I am an Indigenous women to the country known now as Australia. I write from the inside, about our law and life ways which hare buried alive by a dominant colonizing culture. The tale of terra nullius, its capacity to bury us and its own capacity to survive and go on burying us (...) is told. It is a story which has a resonance beyond Australia, one that can be found throughout the world wherever there is struggle for the future of the planet, wherever there is struggle for diversity, and resistance to being consumed by corporate greed and complicit states. It is finally a story about hope for a way forward, and moving in a clear direction. A direction without illusion, one that braves the truth as to our future as diverse peoples of colour, laws and cultures, the bearers of generations to come. (shrink)

This paper discusses what it means to be a good sport. It offers an account of sportsmanship rooted in the proper understanding of the limited role each participant plays during a specific sporting contest. It aims at showing that, from a fallibilist perspective, although it may perhaps be logically possible for a single play to win or lose a sporting event, it makes epistemologically no sense to single out a particular game action, moment or decision as the crucial one which (...) determined victory or defeat. Our view, we shall argue, is consistent with the empirical nature of sporting activities. Since there can be no such a thing as a perfect game, and because no single known human mind is in a position to know with any degree of certainty how each act of game-playing relates to the outcome of a whole game, it makes almost no sense to assign whole-game success or failure to single acts of brilliance or failure. AimTo examine the views of Guinean lay people and healthcare providers regarding the acceptability of HCPs’ refusal to provide care to Ebola patients.MethodFrom October to December 2015, lay people and HCPs in Conakry, Guinea, were presented with 54 sample case scenarios depicting a HCP who refuses to provide care to Ebola patients and were instructed to rate the extent to which this HCP’s decision is morally acceptable. The scenarios were composed by systematically varying the levels of four factors: the risk (...) of getting infected, the HCP’s working conditions, the HCP’s family responsibilities and the HCP’s professional status.ResultsFive clusters were identified: 18% of the participants expressed the view that HCPs have an unlimited obligation to provide care to Ebola patients; 38% held that HCPs’ duty to care is a function of HCPs’ working conditions; 9% based their judgments on a combination of risk level, family responsibilities and working conditions; 23% considered that HCPs do not have an obligation to provide care and 12% did not take a position.ConclusionOnly a small minority of Guinean lay people and HCPs consider that HCPs’ refusal to provide care to Ebola patients is always unacceptable. The most commonly endorsed position is that HCPs’ duty to provide care to Ebola patients is linked to society’s reciprocal duty to provide them with the working conditions needed to fulfil their professional duty. This essay is a critical review of two recent collections, Feminism and Foucault: Reflections on Resistance, edited by Irene Diamond and Lee Quinby and Feminism as Critique: On the Politics of Gender, edited by Seyla Benhabib and Drucilla Cornell. While the collections differ in their manner of addressing the critical sources that have inspired them-the former relying upon a single theorist, the latter attempting to move through some of the philosophical history that constitutes our present theoretical terrain-both attempt to think (...) through and thus revisualize some of the categories of difference which we have inherited. Though the best essays from these collections are celebrated for demonstrating how "feminism as critique" can work to move us toward a clearer and more inclusive feminist theory, questions are raised about what the inattention to race in these volumes suggests about our own role in the construction of power and knowledge, and the erasures that help to secure them both. With the increased use of Artificial Intelligence (AI) in wildlife conservation, issues around whether AI-based monitoring tools in wildlife conservation comply with standards regarding AI Ethics are on the rise. This review aims to summarise current debates and identify gaps as well as suggest future research by investigating (1) current AI Ethics and AI Ethics issues in wildlife conservation, (2) Initiatives Stakeholders in AI for wildlife conservation should consider integrating AI Ethics in wildlife conservation. We find that the existing literature (...) weakly focuses on AI Ethics and AI Ethics in wildlife conservation while at the same time ignores AI Ethics integration in AI systems for wildlife conservation. This paper formulates an ethically aligned AI system framework and discusses pre-eminent on-demand AI systems in wildlife conservation. The proposed framework uses agile software life cycle methodology to implement guidelines towards the ethical upgrade of any existing AI system or the development of any new ethically aligned AI system. The guidelines enforce, among others, the minimisation of intentional harm and bias, diversity in data collection, design compliance, auditing of all activities in the framework and ease of code inspection. This framework will inform AI developers, users, conservationists, and policymakers on what to consider when integrating AI Ethics into AI-based systems for wildlife conservation. (shrink)

This paper explores whether MacIntyrean virtue ethics concepts are applicable in non-Western business contexts, specifically in SMEs in Taiwan, a country strongly influenced by the Confucian tradition. It also explores what differences exist between different polities in this respect, and specifically interprets observed differences between the Taiwanese study and previous studies conducted in Europe and Asia. Based on case study research, the findings support the generalizability of the MacIntyrean framework. Drawing on the institutional logics perspective and synthesizing this with MacIntyrean (...) concepts, the paper explains the differences between the studies largely by reference to the Confucian tradition operating at both the micro-level within firms and at the macro-level as a means of harmonizing the potentially competing institutional logics to which firms are subject. The recent weakening of this tradition, however, suggests that increased conflict may characterize the future. (shrink)

Known throughout East Asia as Mengzi, or "Master Meng," Mencius was a Chinese philosopher of the late Zhou dynasty, an instrumental figure in the spread of the Confucian tradition, and a brilliant illuminator of its ideas. Mencius was active during the Warring States Period, in which competing powers sought to control the declining Zhou empire. Like Confucius, Mencius journeyed to one feudal court after another, searching for a proper lord who could put his teachings into practice. Only a leader who (...) possessed the moral qualities of a true king could unify China, Mencius believed, and in his defense of Zhou rule and Confucian philosophy, he developed an innovative and highly nuanced approach to understanding politics, self-cultivation, and human nature, profoundly influencing the course of Confucian thought and East Asian culture. _Mencius_ is a record of the philosopher's conversations with warring lords, disciples, and adversaries of the Way, as well as a collection of pronouncements on government, human nature, and a variety of other philosophical and political subjects. Mencius is largely concerned with the motivations of human actors and their capacity for mutual respect. He builds on the Confucian idea of _ren_, or humaneness, and places it alongside the complementary principle of _yi_, or rightness, advancing a complex notion of what is right for certain individuals as they perform distinct roles in specific situations. Very few parts of the world have legislation that prohibits the operation or the promotion of contract cheating services. This means that commercial companies providing such services can formally register and operate in most countries. If a student enters into an agreement with a contract cheating provider, what rights do they have to change their mind and what are the risks if they choose to do so? This paper examines the question through legal, institutional and societal lenses, showing that although (...) a student has the consumer rights to withdraw from a contract with an essay mill, they may also be putting their future at risk by doing so. Contract cheating providers are now embedded within many institutions, using sharp practices to connect with vulnerable customers, but are also perfectly placed to blackmail students or threaten to report them to their institution if they ask to cancel their order. The paper argues that, while not condoning the practice of contract cheating, supportive processes need to be in place to help students at risk as part of standard institutional duty of care. This must be backed up by institutional policy that considers academic integrity as a core value for all. (shrink)

For decades, African senior club and national soccer teams, involved in world competitions, have failed to perform beyond mere honorable appearances. In this paper, we explore two of the fundamental causes underlying these disappointing performances. First, we examine the dilemma which forces almost all the African federations to overlook the Africa-based players in favor of those based outside the continent. Second, we show that the roots of the poor performances of the African teams go far beyond this crippling dilemma. Indeed, (...) we argue, the persistent underperformances of African teams appear to be rather consistent with the fate of postcolonial Africa itself, a continent marred in an acute identity crisis. In fact, this crisis essentially stems from the relentless brain drain inflicted on the African soccer world which has so far dispersed its best talents all across Europe and beyond through the naturalization of its soccer diaspora. In addition, Africa has shown no ability to offer any type of attractive alternatives to the talented sons and daughters of its diaspora as well as to any other world class players. This ineptitude, coupled with Africa’s inability to leave behind its nostalgic Senghorian soccer essentialism, condemns the continent to perpetual poor performances. Therefore, we suggest that the African national federations and their respective governments move away from their deeply held soccer essentialism in order to begin to move toward some kind of soccer existentialism alongside such European countries as France, Germany, Switzerland, and The Netherlands which appear to acknowledge, perhaps reluctantly, the invaluable contributions made by the African diaspora to the success of not only their local and national leagues but also their national teams. This study examines the relationships between a company''s emphasis on discretionary social responsibility, environment, and firm performance. It tests the proposition that environmental munificence and dynamism moderate the relationship between discretionary social responsibility and financial performance. Social responsibility was measured with a three-item scale in a sample of 62 firms using a questionnaire. Environmental munificence and dynamism were measured using archival sources as was financial performance (return on assets and return on sales). The results of moderated regression analyses and subgroup (...) analyses found a significant moderating effect of environment on the social responsibility-firm performance relationship. Discretionary social responsibility contributes to firm performance in environments that are dynamic and munificent. (shrink)

The “nature” of an artifact is often equated with its function. Clearly, an artifactual function must be an extrinsic property. This feature of functions has important implications on the semantics of artifactual kind terms: it enables us to vindicate that artifactual kind terms have an externalist semantics. Any alleged externalist theory, indeed, must show that the referents of the considered terms share a common nature (i.e., an extrinsic property), whether we know or could possibly ever know what that nature is. (...) However, the state of the art shows that function is not enough to represent such “nature”: function does not exhaustively account for important phenomena that characterize artifacts and artifactual kinds, nor does it thoroughly define what they are. Thus, extending the scope of externalism to artifactual kind terms seems doomed to fail. Pace opposite views, it could even be argued that artifacts are a sub-class of social kinds. If so, not only social but also artifactual kind terms cannot refer externalistically, since their referents constitutively depend on human intentions and norms. Either way, externalism fails to apply to those kinds of terms. (shrink)

This article uses a conversation analytic framework to describe a type of wh-question used to challenge a prior utterance, specifically to challenge the basis for or right to do an action done by the prior utterance. These wh-questions are able to do challenging because, rather than asking for new information, they are used to convey a strong epistemic stance of the questioner, a negative assertion. The utterances are designed as requests for an account for a prior claim or action, but (...) by conveying a negative assertion, they suggest that there is no adequate account available and, thus, that there are no grounds for the prior claim or action. The use of these questions in institutional settings can display participants' orientation to institutional goals, norms and roles, showing that institutional roles can thus be enacted, and goals accomplished, by means of practices of talk which are not, themselves, institutionally specific. ‘‘Post-normal science’’ has received much attention in recent years, but like many iconic concepts, it has attracted differing conceptualizations, applications, and implications, ranging from being a ‘‘cure-all’’ for democratic deficit to the key to achieving more sustainable futures. This editorial article introduces a Special Issue that takes stock of research on PNS and critically explores how such research may develop. Through reviewing the history and evolution of PNS, the authors seek to clarify the extant definitions, conceptualizations, and uses of PNS. (...) The authors identify five broad areas of research on, or using, PNS which have developed over four decades. Their analysis suggests that the 1990s represent a symbolic watershed in the use of PNS terminology, when the concept was further developed and applied to highly complicated issues such as climate change. The authors particularly distinguish between uses of PNS as a normative prescription and as a practical method. Through this classification, they set out gaps and research questions arising. They then briefly summarize the Special Issue articles and consider their relationship to each other and the research questions raised by their analysis. They conclude by considering what the articles in this issue suggest for future theory building in PNS and related scholarship. (shrink)

There are several conceptions of truth, such as the classical correspondence conception, the coherence conception and the pragmatic conception. The classical correspondence conception, or Aristotelian conception, received a mathematical treatment in the hands of Tarski (cf. Tarski [1935] and [1944]), which was the starting point of a great progress in logic and in mathematics. In effect, Tarski's semantic ideas, especially his semantic characterization of truth, have exerted a major influence on various disciplines, besides logic and mathematics; for instance, linguistics, the (...) philosophy of science, and the theory of knowledge. The importance of the Tarskian investigations derives, among other things, from the fact that they constitute a mathematical, formal mark to serve as a reference for the philosophical (informal) conceptions of truth. Today the philosopher knows that the classical conception can be developed and that it is free from paradoxes and other difficulties, if certain precautions are taken. We believe that is not an exaggeration if we assert that Tarski's theory should be considered as one of the greatest accomplishments of logic and mathematics of our time, an accomplishment which is also of extraordinary relevance to philosophy, as we have already remarked. In this paper we show that the pragmatic conception of truth, at least in one of its possible interpretations, has also a mathematical formulation, similar in spirit to that given by Tarski to the classical correspondence conception. What kind of reference (if any) do terms such as “pencil,” “chair,” “television,” and so on have? On the matter, a de-bate between directly referential theorists and descriptiv-ist theorists is open. It is largely acknowledged that natural kind terms (such as “water,” “gold,” “tiger,” etc.) are directly referential expressions (cf. Putnam,1975). That is, they are expressions whose reference is determined by their refer-ents' nature, independent of whether we know or will ever know what this nature is. However, it does not (...) seem like-wise convincing that all artifactual kind terms (like “pen-cil,” “chair,” “television,” etc.) semantically behave the same. Terms for artifactual kinds seem more likely to be subjected to a descriptivist view, that is, definable not by links to their extensions' nature but in terms of conjunctions or clusters of properties. In his celebrated “The Meaning of ‘Meaning’” (1975), Hilary Putnam originated the mentioned debate by arguing that artifactual kind terms also refer directly. Thus, the discussion ultimately revolves around establishing whether artifactual and natural kind terms are both directly referential expressions. The authors engaged in this debate have tried to argue in favor of (or against) Putnam's proposal by highlighting the similarities (or differences) between nat-ural vis-à-vis artifactual kind words and their respective ref-erents. This paper aims to provide a thorough and reasoned overview of the debate at stake, pointing out trends and problems associated with each proposed account. (shrink)

It is potentially deleterious in terms of patient experience and clinical outcomes. Much of what is known about delirium is through positivist research, which forms the evidence base for disease‐based classification systems and clinical guidelines. There is little (...) systematic study of nurses’ day‐to‐day practice of nursing patients with delirium. The aim was to uncover the kinds of knowledge that informs nurses’ care and to explicate the basis of that knowledge. Critical Discourse Analysis is underpinned by the premise that powerful interests within society mediate how social practices are constructed. Links were made between the grammatical and lexical features of nurses’ language about care in interviews and naturalistic settings, and the healthcare context. Care focused on the continuous surveillance of patients with delirium by nurses themselves or vicariously through other patients, and containment. Nurses influenced by major discourses of risk reduction and safety, constructed patients with delirium as risk objects. The philosophy of person‐centred and dignified care advocated in nursing literature and government policy is an emerging discourse, though little evident in the data. The current dominant discourses on safety must give space to discourses of dignity and compassion. (shrink)

With the turning of wilderness areas into wildlife parks and the returning of developed areas of land to the forces of nature, intermediate hybrid realms surface in which wild and managed nature become increasingly entangled. A partitioning of environmental philosophy into ecoethics and animal welfare ethics leaves these mixed territories relatively uncharted—the first dealing with wild (animals), the second with the welfare of captive or domestic animals. In this article, we explore an environmental philosophy that considers explicitly these mixed situations. (...) We examine a recent Dutch policy of introducing domesticated and semi-wild large herbivores in newly developed nature areas. Larger issues are at stake, such as the intertwinement of nature and culture, the dynamic character of de-domestication processes, and the relation between concepts of authenticity and the wild. We sketch a pluralistic, dynamic, and pragmatic environmental philosophy that is capable of dealing with the complicated ethicalproblems concerning creatures and land caught between domestication and the wild. Ce modèle a été suggéré à partir d’un type spécifique de sagas mythiques du haut Moyen Âge, les Origines gentium qui, s’appuyant sur différentes sources anciennes, présentaient l’échiquier complexe des déplacements, des guerres et des alliances entre les barbares et l’Empire comme des exodes linéaires de tribus (...) cohérentes vers une terre promise. Les archéologues et les ostéologues ont appliqué littéralement ce modèle : les biens funéraires et les types de squelettes permettaient à leurs yeux d’identifier les membres des différentes tribus et de suivre leurs routes migratoires. How is the tension between conflict and deliberation resolved in shareholder engagement? We address this question by studying shareholder engagement as a deliberative process with three stages: establishing dialogue, solution development, and solution implementation. We theorize that two interactionist mechanisms, deliberative interaction and the voicing of disagreement, play different roles at different stages of the process. We test our hypotheses with a proprietary database of 169 environmental, social, and governance engagements with US public companies over 2007–12. We find that while (...) deliberative interaction does not help advance the engagement process, it positively moderates the effect of disagreement in the solution development stage. By contrast, in the solution implementation stage, deliberative interaction amplifies the negative effect of disagreement, thus hindering progress in the engagement. Our article contributes to shareholder engagement, deliberation theory, and interactionist organization theory by establishing that engagement effectiveness is an interactional achievement shaped by both deliberation and disagreement. Research from behavioural sciences shows that people reach decisions in a much less rational and well-considered way than was often assumed. The doctrine of informed consent, which is an important ethical principle and legal requirement in medical practice, is being challenged by these insights into decision-making and real-world choice behaviour. This article discusses the implications of recent insights of research on decision-making behaviour for the informed consent doctrine. It concludes that there is a significant tension between the often non-rational choice (...) behaviour and the traditional theory of informed consent. Responsible ways of dealing with or solving these problems are considered. To this end, patient decisions aids are discussed as suitable interventions to support autonomous decision-making. However, current PDAs demand certain improvements in order to protect and promote autonomous decision-making. Based on a conception of autonomy, we will argue which type of improvements are needed.
