This article uses philosopher Miranda Fricker’s work on epistemic injustice to shed light on the legal concept of the fiduciary, alongside demonstrating the wider contribution Fricker’s work can make to business ethics. Fiduciary, from the Latin fīdūcia, meaning “trust,” plays a fundamental role in all financial and business organisations: it acts as a moral safeguard of the relationship between trustee and beneficiary. The article focuses on the ethics of the fiduciary, but from a unique historical perspective, referring back to the (...) original formulation of the fiduciary within a familial context to investigate presuppositions regarding agential capabilities, whilst also paying attention to the power mechanism embedded in the trustee–beneficiary relationship. Using Fricker’s theory of pre-emptive testimonial injustice, the analysis elucidates the impact of cumulative beneficiary silencing in contemporary contexts, and the article uncovers ethical issues of an epistemological kind at the core of the fiduciary—of epistemic injustice. This article examines a changing global reality that manifests itself in new forms of social activism. The struggle of the multitude challenges political representation and contemporary art seems to corroborate this observation. Becoming a form of social intervention, it turns into an active force and leaves behind the need to double action with representation, representational practices being the hallmark of classical art. A new theory of the image would have to incorporate this dynamic: it would have to treat and develop (...) the basic categories of action and relation. There are few philosophies of the act, and the existing semiotic models mostly deal with dual structures (signifier/signified; sign/meaning; image/referent, and so on). It is necessary to sketch out a dynamic theory of the image that would: (1) reveal the limitations of the concept of representation; (2) conceive of the image as a set of multiple changing relations. The image would thus be seen as a necessary part of the relations governing the world in its entirety, that is, as part of the movement of matter itself. In this paper, I explore the question what a continuant is, in the context of a very interesting suggestion recently made by Rowland Stout, as part of his attempt to develop a coherent ontology of processes. Stout claims that a continuant is best thought of as something that primarily has its properties at times, rather than atemporally—and that on this construal, processes should count as continuants. While accepting that Stout is onto something here, I reject his suggestion that we should (...) accept that processes are both occurrents and continuants; nothing, I argue, can truly occur or happen, which does not have temporal parts. I make an alternative suggestion as to how one might deal with the peculiar status of processes without jettisoning a very natural account of occurrence; and assess the consequences for the category of continuant. This 1999 book demonstrates a method for reading the texts of Aristotle by revealing a continuous line of argument running from the Physics to De Caelo. The author analyses a group of arguments that are almost always treated in isolation from one another, and reveals their elegance and coherence. She concludes by asking why these arguments remain interesting even though we now believe they are absolutely wrong and have been replaced by better ones. The book establishes the case that we (...) must rethink our approach to Aristotle's physical science and Aristotelian texts, and as such will provoke debate and stimulate new thinking amongst philosophers, classicists, and historians of science. In this paper I examine the temporal dimensions of racialised and colonised embodiment. I draw on the work of Alia Al-Saji, whose phenomenological reading of Frantz Fanon examines the multiple ways in which racism and colonialism affix the racialised and colonised body to that of the past; a temporalisation that serves not only to anachronise these bodies, but also to close off their projective possibilities for being or becoming otherwise. Such a move reflects the nature of racialisation itself, which following (...) Charles Mills, does not just exteriorise or ‘other’ racialised bodies, but relies equally on a forgetting, or a disavowal and leaving behind of this very process. The result, I argue, is to render whiteness and white bodies as temporally present and even futural in their orientation, free from the vestiges of racism's history and free to adopt any number of stances on its continuing legacy. It is against this that I argue that the familiar exhortation to ‘get over’ racism whenever the charge is levelled, is not only dangerous in its denial of racism, but also disingenuous in purporting to move beyond a racially divided world, when in fact this very gesture serves to reinscribe differential racialised temporalities. This essay warns of eroding accountability in computerized societies. It argues that assumptions about computing and features of situations in which computers are produced create barriers to accountability. Drawing on philosophical analyses of moral blame and responsibility, four barriers are identified: 1) the problem of many hands, 2) the problem of bugs, 3) blaming the computer, and 4) software ownership without liability. The paper concludes with ideas on how to reverse this trend.

This paper explores a number of recent proposals regarding "feminist science" and rejects a content-based approach in favor of a process-based approach to characterizing feminist science. Philosophy of science can yield models of scientific reasoning that illuminate the interaction between cultural values and ideology and scientific inquiry. While we can use these models to expose masculine and other forms of bias, we can also use them to defend the introduction of assumptions grounded in feminist political values.

The aim of this literature review was to compose a narrative review supported by a systematic approach to critically identify and examine concerns about accountability and the allocation of responsibility and legal liability as applied to the clinician and the technologist as applied the use of opaque AI-powered systems in clinical decision making. This review questions if it is permissible for a clinician to use an opaque AI system in clinical decision making and if a patient was harmed as a (...) result of using a clinician using an AIS’s suggestion, how would responsibility and legal liability be allocated? Literature was systematically searched, retrieved, and reviewed from nine databases, which also included items from three clinical professional regulators, as well as relevant grey literature from governmental and non-governmental organisations. This literature was subjected to inclusion/exclusion criteria; those items found relevant to this review underwent data extraction. This review found that there are multiple concerns about opacity, accountability, responsibility and liability when considering the stakeholders of technologists and clinicians in the creation and use of AIS in clinical decision making. Accountability is challenged when the AIS used is opaque, and allocation of responsibility is somewhat unclear. Legal analysis would help stakeholders to understand their obligations and prepare should an undesirable scenario of patient harm eventuate when AIS were used. (shrink)

In this paper, I present a new realist idealist account of perception, on which perception is not essentially representational. Perception, rather, involves an overlapping of two phenomenal unities: the perceiving subject, and the phenomenal tapestry of reality. This renders it intelligible that we can stand in precisely the same relation to distal objects of perception as we do to our own pains. The resulting view captures much that naïve realists take to be central to perception. But, I argue, such a (...) view is only intelligible if distal objects are themselves fundamentally mental. Idealism is thus uniquely posed to intelligibly capture the benefits of naïve realism. (shrink)

Union security has long been an industrial relations controversy. While compulsory unionism supporters say it benefits the working class, right-to-work advocates denounce it as an unethical infringement of individual rights and freedom. Unfortunately, neither side has adequately addressed the shortcomings of their viewpoint, nor the broader worker concerns about effective representation beyond just "unionism". In this paper, we examine the ethical and practical problems of compulsory and voluntary unionism and propose a new resolution, compulsory proportional representation, that has the advantages (...) of: ensuring workers' freedom to associate or not associate, promoting freedom to contract, allowing free competition in representation in line with anti-trust principles, improving industrial peace and efficiency, enhancing fairness and social justice, and addressing the employer-employee power imbalance. It is superior to either voluntary unionism, which often lead to management unilateralism, or compulsory unionism, where workers are compelled to join unions against their will. (shrink)

This paper considers a certain genre of anti-racist solidarity — what I call simulations of lived experience – in order to critically examine the premises and pitfalls of such efforts. Two primary examples are examined: (1) a 2014 smartphone app called Everyday Racism, where users are invited to ‘play’ a racialised character for a week in order to ‘better understand’ the experience of racism; and (2) various iterations of ‘Hijab Day’, where non-Muslim women are invited to wear a hijab for (...) a day. I argue that both examples, while well-intentioned, offer only a ‘thin’ version of the lived experience of veiled Muslim women and people of colour, failing to reckon with the epistemological and phenomenological complexity entailed in this embodied experience. Moreover, I argue that both proceed on the misguided idea that first-hand experience, rather than empathic listening, is generative of anti-racist solidarity, and in doing so, these efforts risk reproducing the very structures and habits of white privilege they set out to challenge. This paper identifies two conceptions of security in contemporary concerns over the vulnerability of computers and networks to hostile attack. One is derived from individual-focused conceptions of computer security developed in computer science and engineering. The other is informed by the concerns of national security agencies of government as well as those of corporate intellectual property owners. A comparative evaluation of these two conceptions utilizes the theoretical construct of “securitization,”developed by the Copenhagen School of International Relations.

James Tabery Helen Longino’s Studying Human Behavior is an overdue effort at a nonpartisan evaluation of the many scientific disciplines that study the nature and nurture of human behavior, arguing for the acceptance of the strengths and weaknesses of all approaches. After years of conflict, Longino makes the pluralist case for peaceful coexistence. Her analysis of the approaches raises the following question: how are we to understand the pluralistic relationship among the peacefully coexisting approaches? Longino is ironically rather unpluralistic (...) about her pluralism, forcing a choice between integrative pluralism and her preferred ineliminative pluralism. This article argues in defence of human–robot friendship. I begin by outlining the standard Aristotelian view of friendship, according to which there are certain necessary conditions which x must meet in order to ‘be a friend’. I explain how the current literature typically uses this Aristotelian view to object to human–robot friendships on theoretical and ethical grounds. Theoretically, a robot cannot be our friend because it cannot meet the requisite necessary conditions for friendship. Ethically, human–robot friendships are wrong because they (...) are deceptive, and could also make it more likely that we will favour ‘perfect’ robots, and disrespect, exploit, or exclude other human beings. To argue against the above position, I begin by outlining and assessing current attempts to reject the theoretical argument—that we cannot befriend robots. I argue that the current attempts are problematic, and do little to support the claim that we can be friends with robots now. I then use the standard Aristotelian view as a touchstone to develop a new degrees-of-friendship view. On my view, it is theoretically possible for humans to have some degree of friendship with social robots now. I explain how my view avoids ethical concerns about human–robot friendships being deceptive, and/or leading to the disrespect, exploitation, or exclusion of other human beings. (shrink)

Feminist standpoint theory has a troubled history that has limited its use and development as a core feminist epistemological project. This article revisits debates from its past, and re-examines an apparent central problem: that of the realism identifiable in FST. Looking closely at the criticism leveled against one particular standpoint theorist—Nancy Hartsock—I show the criticism not only to be unfounded, as has previously been argued, but also unnecessary. I demonstrate that the accusations of supposedly realist contradictions in Hartsock's work are (...) easily resolvable by engagement with critical realism. I argue that CR not only accommodates Hartsock's conception of realism, and so dissolves any contention, but that CR complements and shores up FST's central claim: that situated knowledge carries with it an epistemic privilege. Another contemporary conception of realism is being developed—New Materialism —that, it could be argued, would also be a suitable ontology with which to develop FST. I show how NM could present problems for FST as a fundamentally political project, and conclude that CR offers a more fruitful future collaboration for FST. (shrink)

What is the thesis of determinism? Though it is obvious that in principle there is more than one possible thesis that might be given this name, it seems to be the case that philosophers working on the free will problem have gradually gravitated towards a more-or-less standard definition, minor variations on which can now be found widely scattered through the free will literature. I call it the ‘entailment definition’ and it states, roughly, that determinism is the thesis that for any (...) given time, a complete statement of the facts about that time, together with a complete statement of the laws of nature, entails every truth as to what happens after that time. In this paper, I argue that acceptance of the entailment definition has been a mistake—and that we need a definition of determinism which, by contrast with the entailment definition, makes explicit mention of the notion of natural necessity. The paper argues that it is possible for an incompatibilist to accept John Martin Fischer's plausible insistence that the question whether we are morally responsible agents ought not to depend on whether the laws of physics turn out to be deterministic or merely probabilistic. The incompatibilist should do so by rejecting the fundamentalism which entails that the question whether determinism is true is a question merely about the nature of the basic physical laws. It is argued that this is a (...) better option for ensuring the irrelevance of physics than the embrace of semi-compatibilism, since there are reasons for supposing that alternate possibilities are necessary for moral responsibility, despite Fischer's claims to the contrary. There are two distinct reasons for supposing that alternate possibilities might be necessary for moral responsibility—one of which is to do with fairness, the other to do with agency itself. It is suggested that if one focuses on the second of these reasons, Fischer's arguments for supposing that alternate possibilities are unnecessary for moral responsibility can be met by the incompatibilist. Some possible reasons for denying that alternate possibilities are necessary for the existence of agency are then raised and rejected. (shrink)

With the introduction of artificial intelligence (AI) to healthcare, there is also a need for professional guidance to support its use. New (2022) reports from National Health Service AI Lab & Health Education England focus on healthcare workers’ understanding and confidence in AI clinical decision support systems (AI-CDDSs), and are concerned with developing trust in, and the trustworthiness of these systems. While they offer guidance to aid developers and purchasers of such systems, they offer little specific guidance for the clinical (...) users who will be required to use them in patient care. This paper argues that clinical, professional and reputational safety will be risked if this deficit of professional guidance for clinical users of AI-CDDSs is not redressed. We argue it is not enough to develop training for clinical users without first establishing professional guidance regarding the rights and expectations of clinical users. We conclude with a call to action for clinical regulators: to unite to draft guidance for users of AI-CDDS that helps manage clinical, professional and reputational risks. We further suggest that this exercise offers an opportunity to address fundamental issues in the use of AI-CDDSs; regarding, for example, the fair burden of responsibility for outcomes. (shrink)

Marjorie Grene was a philosophical naturalist avant la lettre. This essay surveys some problems with contemporary (late 20th century) naturalism, argues that Grene’s criticisms of ancient epistemologies are applicable to their contemporary versions, and finds an alternative, philosophically richer, naturalism in Grene’s appropriation of J.J. Gibson’s ideas on perception and in her insistence on treating humans as no less a part of nature than plants and other animals.

Many events that humans and other species experience contain regularities in which certain elements within an event predict certain others. While some of these regularities involve tracking the co‐occurrences between temporally adjacent stimuli, others involve tracking the co‐occurrences between temporally distant stimuli (i.e., nonadjacent dependencies, NADs). Prior research shows robust learning of adjacent dependencies in humans and other species, whereas learning NADs is more difficult, and often requires support from properties of the stimulus to help learners notice the NADs. Here, (...) we report on seven experiments that examined NAD learning from various types of visual stimuli, exploring the effects of dynamic motion on adults' NAD learning from visual sequences involving human and nonhuman agents. We tested adults' NAD learning from visual sequences of human actions, object transformations, static images of human postures, and static images of an object in different postures. We found that dynamic motion aids the acquisition of NADs. We also found that learning NADs in sequences involving human agents is more robust compared to sequences involving nonhuman objects. We propose that dynamic motion and human agents both independently result in richer representations that provide a stronger signal for NAD learning. (shrink)

Using a study with undocumented Chinese migrants in the UK, challenges involved in obtaining approval by a university research ethics committee are explored. General guidance about how to resolve potential research ethics issues, with particular reference to ‘hidden social groups’, prior to submission to a research ethics committee is presented.

This article considers the definition of nature as given by Aristotle in "Physics" II and the commentaries on it by Philoponus and Thomas Aquinas. Through Aristotle's definition and its treatment in two commentaries, we can see how each philosopher defines philosophy as an enterprise and the problems encompassed by it. I conclude that the conception of philosophy, and consequently its problems, is quite distinct in each case and should be considered as such; as a further consequence, the whole notion of (...) The paper attempts to explicate and justify the position I call `Agency Incompatibilism'- that is to say, the view that agency itself is incompatible with determinism. The most important part of this task is the characterisation of the conception of agency on which the position depends; for unless this is understood, the rationale for the position is likely to be missed. The paper accordingly proceeds by setting out the orthodox philosophical position concerning what it takes for agency to exist, before (...) going on to explain why and how that orthodoxy should be challenged. The relations between my own views and those of others writing on the issues of free will and moral responsibility, in three crucial and inter-connected areas are then explored. These are (1) the question how animals should figure in the philosophy of action; (2) the question what the lesson is of `Frankfurt-style' examples; and (3) the distinction between so-called `leeway' incompatibilism and `source' incompatibilism. The paper moves on to consider and respond to various objections to Agency Incompatibilism, including the claim that to embrace the conception of agency that makes incompatibilism plausible is to beg the question against the compatibilist, and also the worry that determinism is an empirical thesis which ought not to be straightforwardly falsifiable by such a priori reasoning as Agency Incompatibilism appears to involve. I also try to rebut the worry that Agency Incompatibilism is committed to the existence of an unintelligible and/or naturalistically impossible variety of irreducible agent causation. (shrink)
