The deontic model of justice and ethical behavior proposes that people care about justice simply for the sake of justice. This is an important consideration for business ethics because it implies that justice and ethical behavior are naturally occurring phenomenaindependent of system controls or individual self-interest. To date, research on the deontic model and third-party reactions to injustice has focused primarily on individuals’ tendency to punish transgressors. This research has revealed that witnesses to injustice will consider sacrificing their own resources (...) if it is the only way to sanction an observed transgressor. In this paper we seek to extend this model by arguing that punishment may not be the only “deontic” reaction, and that in fact, third-party observers of injustice may engage in moral self-regulation that would lead them to conclude that the most ethical response is to do nothing. We provide preliminary evidence for our propositions using voiced cognitions data collected during a resource allocation task. Results indicate that deonance may be more complex than originally thought, and previous tests of the model conservative in nature. (shrink)

The guiding principles are: clarification of the different research activities in the area, which have sometimes been undertaken independently of each other; and appreciation of the fact that these research activities often represent different means to the same ends, namely sound theoretical foundations and efficient computation. The book begins with a discussion of (...) the various types of nonmonotonic reasoning, their applications and their logics. Theorem proving techniques for these logics are also described. The following chapters deal with formulations of nonmonotonic inheritance, and nonmonotonic reasoning based on nonmonotonic rules. Die jetzt vorliegende ungekürzte Korrespondenz zwischen Sigmund Freud und Karl Abraham in originalem Deutsch erlaubt Einblicke in den wissenschaftlichen Austauschprozess bei der Entwicklung ihrer psychoanalytischen Konzepte. Abrahams einseitig-genetische Vorstellungen über die destruktiv-sadistischen Aspekte der Oralität und über die frühen Objektbeziehungen sind bei Freud auf Widerspruch gestoßen. Freud erweist sich einerseits als geduldiger Lehrer und Supervisor für Abraham. Andererseits ist er auch kritischer Mahner, der Abraham bis in die letzten Briefe daran erinnert, die Grundbedingungen der Neurosenentstehung zu beachten. Die Ergebnisse von (...) Abrahams klinischen Beobachtungen sind für Freud wiederum wertvolle Bestätigungen für seine eigenen Überlegungen zur Pathologie früher Störungen. Der Autor zeichnet die Entwicklung der unterschiedlichen Ansätze am wissenschaftlichen Briefwechsel nach. Der Akzent liegt auf dem ätiologischen Problem der Neurosengenese im kausalen Denken bzw. im Denken vor dem Hintergrund von Nachträglichkeit. Definition of the problem Using the example of the emergence of antibiotic resistance, we show in the first part of our article that there are specific sustainability problems in medicine, which can ultimately lead to an impairment of the ability of future patients to satisfy their basic health needs and realize a flourishing life. Methods After clarification of the concept of sustainability in the second part, we explain why the possibility of satisfying basic health needs, for example, is considered a (...) condition for a good life within the framework of a capability approach. The concept of sustainability, as promoted by the United Nations, requires one to adequately consider the demands for a good life of future patients. Conclusion In the last part of the paper, we show that the orientation towards an idea of sustainability can lead to “sustainability dilemma” and we discuss how this can be dealt with. (shrink)

Zusammenfassung In Deutschland verlangt das Transplantationsgesetz die Zuteilung von postmortal gespendeten Organen nach den Kriterien der Dringlichkeit und der Erfolgsaussicht. Der herrschenden Auffassung zufolge darf die Erfolgsaussicht hierbei jedoch lediglich den Charakter einer Minimalnutzenschwelle annehmen. Eine darüber hinausgehende Gewichtung von Erfolgsaussichten soll zudem nicht mit der Lebenswertindifferenzkonzeption des Bundesverfassungsgerichts zu vereinbaren sein, die aus dem Gleichheitsgrundsatz sowie aus der Menschenwürde abgeleitet wird. Gerhard Dannecker argumentiert, diese im juristischen Schrifttum überwiegend vertretene Auffassung sei weniger zwingend, als es auf den ersten (...) Blick scheinen mag. Seiner Auffassung zufolge lässt sich aus der Lebensschutzgarantie in Artikel 2 der Verfassung eine Pflicht ableiten, die vorhandenen Ressourcen möglichst effektiv einzusetzen. Zwar dürfe Effizienz hier tatsächlich nicht bedeuten, dass die Funktionsdauer der vorhandenen Organe über das Gesamtkollektiv aller Patienten hinweg utilitaristisch zu maximieren sei - eine Pflicht zur Rettung einer möglichst großen Anzahl an Menschen lässt sich ihres Erachtens jedoch durchaus rechtfertigen. Human beings need communication. During the development of mankind, a multitude of communication technologies have been invented and used. Some of them had a dramatic impact on society in general and on the way scientific knowledge was disseminated. In this article we discuss some of the effects of each of these changes to teaching as a way of disseminating scientific knowledge. We discuss some of the potential effects caused by the new revolution of communication due to the World Wide Web (...) and the potential of ubiquitous computing. We discuss the evolution of communication technology followed by a discussion of the achievements of each technology. Next, the effects of these achievements on teaching are discussed. Finally, we set these considerations into a broader context and discuss the effects on two important parameters: lead time of the teacher and verifiability of the teacher's claims. (shrink)

Wer hat sich nicht schon gefragt, was es mit unseren moralischen Überzeugungen auf sich hat: Spiegeln diese die Wahrheit in Sachen Moral wieder? Gibt es eine solche Wahrheit überhaupt? Oder sind moralische Überzeugungen eher das Produkt unserer Interessen und Neigungen, Ausdruck unserer Wünsche oder Mittel der Machtausübung, das bloße Ergebnis unserer Erziehung, unseres sozialen Umfelds oder gar eine List der Evolution? Ist es eine Illusion, wenn man glaubt, echte moralische Erkenntnisse gewinnen zu können? Kurzum: Kann die Moral Objektivität beanspruchen? Die (...) vorliegende Arbeit versucht, eine Antwort auf diese zentrale Frage der Metaethik zu geben. Dazu wird zunächst gezeigt, dass uns der Status der Moral ein Rätsel ist, weil wir dazu neigen, drei Thesen für wahr zu halten, die nicht zugleich wahr sein können. Die drei prinzipiell möglichen Strategien zur Auflösung dieses Trilemmas geraten jedoch in Schwierigkeiten, weil es bisher nicht gelungen ist, ein passendes Vergleichsobjekt für die Moral zu finden. In dieser Arbeit wird dafür argumentiert, dass die Moral in genau der gleichen Weise wie die Wissenschaft Objektivität beanspruchen kann. (shrink)

Nonmonotonic reasoning in its broadest sense is reasoning to conclusions on the basis of incomplete information. Given more information, previously drawn inferences may be retracted. Commonsense reasoning has a nonmonotonic component; it has been argued that almost all commonsense inferences are of this sort. From the end of the 1980s to the present there has been an explosion in research in nonmonotonic reasoning. It is now possible to understand more clearly the properties of the major formalisms from a metatheoretical point (...) of view, the relationships among the formalisms and their connection to independently developed proof methods. Pulling from theories of social exchange, deonance, and fairness heuristics, this study focuses on the relationship between overall justice climate and both the prosocial and deviant behaviors of groups. Specifically, it considers two contextual boundary conditions on this effect—corporate social responsibility and group moral identity. Results from a laboratory experiment are presented, which show a significant effect for overall justice climate and a two-way interaction between overall justice climate and CSR on group-level prosocial and deviant behaviors, and a marginally significant (...) interaction of group moral identity with overall justice climate on group deviance. The implications of contextual influences on workplace ethics and justice are discussed. (shrink)

The relationship between methods, statistics and models in the social sciences is discussed. New models generalizing commonly used linear models to deal with qualitative and ordinal data are introduced; their basic similarity to linear models is pointed out. Rate models and stochastic linear differential equations to model social processes in continuous time are mentioned. The implications of weak substantial theory and the correct use of statistical significance tests for any kind of model are demonstrated.

The article outlines the development and most important features of the religious constitutional law of the Federal Republic of Germany, as constituted in the Grundgesetz and the decisions of the Federal Constitutional Court. Under the basic principle of neutrality, it constitutes a system of separation with single aspects of cooperation of the state and religious communities. It is also a system of wide freedom and of kindness to religion. Non-religious worldviews are explicitly equated for individuals as well as for religious (...) and non-religious associations. This system is in theory exemplary, but holed by contradictory laws, church-state-treaties and one-sided financial subventions in a huge dimension. The indirect influence of the large Christian churches is remarkable. Christian institutions dominate the social services – with unpleasing consequences for over 1 million employees, who are subject to a special employment law. Meanwhile, low-level discrimination of small religious communities continues. (shrink)

In 1992 M.W. Evans proposed the O(3) symmetry of electromagnetic fields by adding a constant longitudinal magnetic field to the well-known transverse electric and magnetic fields of circularly polarized plane waves, such that certain cyclic relations of a so-called O(3) symmetry are fulfilled. Since then M.W. Evans has elevated this O(3) symmetry to the status of a new law of electromagnetics. As a law of physics must be invariant under admissible coordinate transforms, namely Lorentz transforms, in 2000 he published a (...) proof of the Lorentz invariance of O(3) symmetry of electromagnetic fields. As will be shown below this proof is incorrect; more, after simple correction it will turn out here that the O(3) symmetry cannot be Lorentz invariant. (shrink)

In this paper I ponder the moral status of conditional threats, in particular the extent to which a threatened party would be permitted to use (lethal) defensive force. I first investigate a mugger case before turning briefly to the more complicated issue of national defence in the face of an invading army. One should not exaggerate the level of protection people under threat owe their conditioned killers simply because what is extorted is of little value. After all, either the conditional (...) threat is willing to kill for something she has no claim on at all, or, if she has a just claim on it - or good reason to believe that she has - she is willing to kill to (re)acquire something of not much worth. In both cases the moral culpability of the conditional threat could be seen as reducing her claim on protection from harm. (shrink)

Although Walter Benjamin's writings are considered to be among the most powerful theoretical enterprises of the twentieth century, his ideas are resistant to cooptation by the doctrines of various critical programs. These essays engage this resistance by examining the ghostly in Benjamin's work. The contributors show that the haunting truths Benjamin offers point towards new forms of responsibility. These truths reside in a figurative elsewhere, a ghostly space that his texts delimit but never fully inhabit, and these essays seek to (...) do justice to the ghosts of Benjamin. Issues explored include: the status of the image in Benjamin's literary reflections and in his meditations on cinema and visual culture; abiding Benjaminian notions of messianism, aura, reproducibility, semblance, and melancholy; Benjamin's relation to Freud; his innovative rethinking of history, virtuality, and translation; and his reflections on tragedy and prophecy, the geometrical dimensions of writing, and the relation between eros and language. Much of the legal literature discusses regulation and regulatory forms with a seemingly implicit assumption that "those to be influenced" are inherently self-interested and thus motivated to comply with legal structures only when there are sufficient external incentives to do so. This view of the person is inconsistent with recent perspectives in the field of psychology. A law and morality perspective, coupled with insights from the field of psychology, asserts that influence, compliance, and motivation are far more complex than this (...) legal literature would suggest. In this Article, we map the varying influence structures, motives, psychological needs, emotional mechanisms, and levels of moral reasoning that various forms of regulation, from hard law to soft law, might appeal to. We provide examples from global banking and one soft law initiative, the Equator Principles, to illustrate reasons psychology would suggest why soft law may be more effective in some circumstances in influencing behavior within the firm than hard law, while recognizing important limits to such influence.
