The nineteenth century was a time of great economic, social, and political change. The population of a modernizing Europe began demanding more freedom, which in turn propelled the ongoing discussion on the philosophy of nature. This spurred on Central European sheep breeders to debate the deepest secrets of nature: the transmission of traits from one generation to another. Scholarly questions of heredity were profoundly entwined with philosophy and politics when particular awareness of “the genetic laws of nature” claimed natural (...) equality. The realization that the same rules of inheritance may apply to all living beings frightened both the absolutist political power and the divided society of the day. Many were not prepared to separate religious questions from novel natural phenomena. Open-minded breeders put their knowledge into practice right away to create sheep with better wool traits through inbreeding and artificial selection. This was viewed, however, as the artificial modification of nature operating against the cultural and religious norms of the day. Liberal attempts caught the attention of the secret police and, consequently, the aspirations of scholars were suppressed by political will during approximately 1820–1850. (shrink)

The upheavals of late eighteenth century Europe encouraged people to demand greater liberties, including the freedom to explore the natural world, individually or as part of investigative associations. The Moravian Agricultural and Natural Science Society, organized by Christian Carl André, was one such group of keen practitioners of theoretical and applied scientific disciplines. Headquartered in the “Moravian Manchester” Brünn, the centre of the textile industry, society members debated the improvement of sheep wool to fulfil the needs of the Habsburg (...) armies fighting in the Napoleonic Wars. Wool, as the raw material of soldiers' clothing, could influence the war’s outcome. During the early nineteenth century, wool united politics, economics, and science in Brno, where breeders and natural scientists investigated the possibilities of increasing wool production. They regularly discussed how “climate” or “seed” characteristics influenced wool quality and quantity. Breeders and academics put their knowledge into immediate practice to create sheep with better wool traits through consanguineous matching of animals and artificial selection. This apparent disregard for the incest taboo, however, was viewed as violating natural laws and cultural norms. The debate intensified between 1817 and 1820, when a Hungarian veteran soldier, sheep breeder, and self-taught natural scientist, Imre Festetics, displayed his inbred Mimush sheep, which yielded wool extremely well suited for the fabrication of light but strong garments. Members of the Society questioned whether such “bastard sheep” would be prone to climatic degeneration, should be regarded as freaks of nature, or could be explained by natural laws. The exploration of inbreeding in sheep began to be distilled into hereditary principles that culminated in 1819 with Festetics’s “laws of organic functions” and “genetic laws of nature,” four decades before Gregor Johann Mendel’s seminal work on heredity in peas. People from all over the world could now hire Indian women to give birth to babies for them, for a fraction of the cost of surrogacy elsewhere and with no government regulations. After some digging (...) around, I quickly realized that there was scarcely any objective, academic research about this new industry, and so began my ethnographic journey to the first clinic in not just India but in fact in the entire Global South to have a flourishing trade in both national and transnational surrogacy.1Academic inquiry into surrogacy arrangements is adequately interdisciplinary and has generated feminist, ethical, legal, and social debates for more than three decades (see, for example, Andrews 1987; Anderson 1990; Bailey 2011; Brennan and Noggle 1997; Hochschild 2012; Markens 2007; Oliver 1989; Ragoné 1994; Pande 2011; and Teman 2010). While defenders of surrogacy advocate it as a manifestation of women’s freedom and choice, much of the scholarship has displayed intense anxiety about this practice (Corea 1986; Dworkin 1983; Harding 1991; Neuhaus 1988; Raymond 1993; Roberts 1998b; and Rothman 1988). One view is that surrogacy reduces women to a mere breeder class, to the class of prostitutes, and another is that it is just another form of baby selling. Others consider the development of such reproductive technologies as a form of class and gender-based exploitation of women’s bodies. Two additional trends in this scholarship are worth emphasizing. First, [End Page 50] much of the debating takes place in abstraction and is rarely based on the actual experience of surrogates.2 Second,much of this work is about surrogacy in the Global North. This is not altogether surprising, since commercial surrogacy is a very recent phenomenon outside of the Global North.In this essay, I address these two gaps in the literature by analyzing the birthing narratives of surrogates in a clinic in India. As the surrogates compare their experiences of giving birth as a surrogate mother to their previous pregnancies, they underscore the paradox of an industry based on pro-natal technology in an otherwise anti-natal state. As importantly, these narratives are a clear manifestation of a global trend of “stratified motherhood”—“the hierarchical organization of reproductive fecundity and birth experiences that supports and rewards the maternity of some women while despising or outlawing the mother-work of others” (Rapp 2001, 469).Surrogacy in IndiaThe moral and ethical ambiguity surrounding surrogacy has made many countries, including China, the Czech Republic, France, Germany, Italy, Mexico, Saudi Arabia, Spain, Sweden, Switzerland, Taiwan, Turkey, and some U.S. states ban surrogacy altogether. Some countries have imposed partial bans, for instance Australia (Victoria), Brazil, Hong Kong, Hungary, Israel, South Africa, and the UK. Canada, Greece, South Africa, Israel, and the UK permit gestational surrogacy, subject to regulations. Then there are other countries with no regulations at all, such as Belgium, Finland, and India (Markens 2007; Teman 2010). Apart from the recent spurt of surrogacy in India, commercial surrogacy is most prevalent in California, USA, and Israel, where surrogacy is tightly controlled by the state and restricted to Israeli citizens. The Indian structure is closer to the liberal market model of surrogacy in California, where surrogacy births are primarily managed by private, commercial agencies that screen, match, and regulate agreements according to their own criteria (Pande 2009).India is not the only country to experience a rise in transnational surrogacy. Couples from countries such as the UK, Japan, Australia, and Kuwait, where surrogacy is either illegal or restricted, have hired surrogates in the United States to bear babies for them. However, while the total cost of such transnational packages is roughly between $100,000 and $120,000, in India the package costs one-third of that amount. Another factor that explains the popularity of India as a destination for transnational surrogacy is the informality of the market. Hillel Steiner’s left-libertarian theory of justice is the most serious recent attempt to reconcile the ideals of (luck-egalitarian) equality and freedom. This attempt consists in an argument that a universal right to equal freedom, which in Steiner’s view means also a universal right to maximal freedom, implies a universal right to self-ownership and to an egalitarian share of the world’s natural resources. In this article, I argue that this argument fails on Steiner’s own terms. This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to (...) heart that the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. ABSTRACT: Sellars once remarked on the “astonishing extent to which in ethics as well as in epistemology and metaphysics the fundamental themes of Kant’s philosophy contain the truth of the variations we now hear on every side” (SM x). Also astonishing was Sellars’ 1970 Presidential Address to the American Philosophical Association (APA), which borrowed its title from the phrase in Kant’s Paralogisms, “...this I or he or it (the thing) which thinks...” (B404). In its compact twenty-five pages Sellars managed to (...) sketch novel yet plausible reconstructions of central aspects of Kant’s views on self-knowledge, persons, freedom, and morality, along the way suggesting how all of those Kantian views could plausibly be rendered consistent with a naturalistic ontology. In this chapter I focus on Sellars’ APA address as an occasion for reflection on how both Kant and Sellars offer insights into how we ought best to conceive the nature of and the relationships between our thinking selves, our practical agency, and our entirely natural, material embodiment. Human life in contemporary society is extremely complex and there are various external factors that directly affect the realization in the individual ends. In this work I analyze the effects of the global market economy, manifested by a mode of production and distribution of goods and services in the form of a global network of economic relations, which involve people, transnational corporations and political and social institutions in moral sphere of people, affecting their choices and the realization of these choices. Individual freedom can be understand as a freedom to realize our choices in the environment of a global economic market, but it is still problematic in the sense that the choices of goods and services available in this market do not reflect individual choices, but a set of preferences standardized according to the market itself. In this paper I will reflect about the individual freedom in economic globalization pointing from the debate between Pettit and Berlin that social freedom advocated by Republican Petit can be satisfactory for a start. While moral arguments for vegetarianism have been explored in great depth, the arguments for veganism seem less clear. Although many animals used for milk and eggs are forced to live miserable lives on factory farms, it’s possible to raise animals as food resources on farms where the animals are treated more humanely and never slaughtered. Under more humane conditions, do we harm animals to use them for food? I argue that, even under humane conditions, using animals for food typically harms (...) animals by restricting their freedom. My argument raises an important question about the extent to which animals are harmed when their freedom is restricted. On one view, it is possible to restrict animals’ freedom without harming them so long as we don’t make them suffer. This view underestimates the value of freedom for animals. Even if animals aren’t made to suffer, restricting their freedom can harm them insofar as it deprives them of freely pursuing their enjoyments in life. My argument has implications for not only the ethics of using animals as food resources but also the ethics of using animals in zoos and circuses. I examine these implications and also consider what we should do with farm animals if we cease using them for food. (shrink)

Race and ethnicity are well-established epidemiological categories that relate to the patients’ risk of exposure and their susceptibility/resistance to disease. However, this association creates the notion that factors other than a personal identity need not be held responsible for patients’ health problems. This work deconstructs the notion of race and ethnicity as risk factors for immigrant ill health, which is prevalent in current medical research and practice, by tracing its roots in Canadian history. The understanding that medical knowledge is subject (...) to diverse historical, social, cultural and political influences can change the way health professionals perceive their patients as a health threat. The keeping of captive animals in zoos and aquariums has long been controversial. Many take freedom to be a crucial part of animal welfare and, on these grounds, criticise all forms of animal captivity as harmful to animal welfare, regardless of their provisions. Here, we analyse what it might mean for freedom to matter to welfare, distinguishing between the role of freedom as an intrinsic good, valued for its own sake and an instrumental good, its value arising (...) from the increased ability to provide other important resources. Too often, this debate is conducted through trading intuitions about what matters for animals. We argue for the need for the collection of comparative welfare data about wild and captive animals in order to settle the issue. Discovering more about the links between freedom and animal welfare will then allow for more empirically informed ethical decisions regarding captive animals. (shrink)

The essays present the main ancient theories on these subjects, ranging historically from Aristotle followed by the Epicureans, the early Stoics, several later Stoics, and up to Alexander of Aphrodisias in the third century CE. -/- The author discusses questions about rational and autonomous human agency and their compatibility with a large range of important philosophical issues, including (...) their compatibility with divine predetermination and other theological questions; with atomism and continuum theory and with the physical sciences more generally; with the determination of character and its development from childhood through nature and nurture; with epistemic features such as ignorance of circumstances; with theories of necessity, possibility and contingency; with external or internal preceding causes and impediments; and with folk theories of fatalism. Room is also given to the questions of how human autonomous agency is related to moral development, to virtue and wisdom, and to blame and praise. -/- Historically unified, philosophically profound, and methodologically rigorous, Bobzien’s essays show that in Classical and Hellenistic philosophy these topics were all debated without reference to freedom to do otherwise or to a free will, and that the latter two notions were fully developed only later. While Nietzsche's rejection of metaphysical free will and moral desert has been widely recognised, the sense in which Nietzsche continues to use the term freedom affirmatively remains largely unnoticed. The aim of this article is to show that freedom and agency are among Nietzsche’s central concerns, that his much-discussed interest in power in fact originates in a first-person account of freedom, and that his understanding of the phenomenology of freedom informs his theory of agency. He develops (...) a non-reductive drive-psychological motivational theory: reflective judgement and reasons can motivate by means of affective orientations agents have due to their drives. In particular, due to a standing desire or 'instinct for freedom' agents can generate, in mental simulations, the necessary motivational affects to unify their drives in view of certain long-term goals. In Freedom: An Impossible Reality (FAIR), Raymond Tallis finds room in a law-abiding universe for a uniquely human form of agency, capable of envisioning and pursuing genuinely open possibilities, thereby deflecting rather than merely inflecting the course of events, in accordance with self-owned intentions, reasons and goals. He argues that the genuinely free human pursuit of such propositional attitudes depends on our acting from a “virtual outside”, at an epistemic distance from the physical world that reveals not only what (...) is the case, but that it is the case. The enactive approach in cognitive science and philosophy of mind aims to supersede the cognitivist traditional that has long dominated the field, by reframing cognition as an agentʼs immediate, embodied engagement with its environment. In an appendix of FAIR, Tallis argues that this approach risks both eliminating propositional attitudes, and collapsing the epistemic distance between agent and world. He concludes that if enactive theorists are to distinguish between genuinely pursuing an intention and merely responding to a stimulus, their corrective to cognitivism is in need of a correction of its own. This paper argues that such a correction is already to be found within the enactive literature, and furthermore, that it bears striking similarities to Tallis own account of what makes human agency unique. It is therefore concluded that the case for freedom set out in FAIR is compatible with the enactive approach. (shrink)

Can we reconcile the idea that we are free and responsible agents with the idea that what we do is determined according to natural laws? For centuries, philosophers have tried in different ways to show that we can. Hilary Bok takes a fresh approach here, as she seeks to show that the two ideas are compatible by drawing on the distinction between practical and theoretical reasoning.Bok argues that when we engage in practical reasoning--the kind that involves asking "what should I (...) do?" and sifting through alternatives to find the most justifiable course of action--we have reason to hold ourselves responsible for what we do. But when we engage in theoretical reasoning--searching for causal explanations of events--we have no reason to apply concepts like freedom and responsibility. Bok contends that libertarians' arguments against "compatibilist" justifications of moral responsibility fail because they describe human actions only from the standpoint of theoretical reasoning. To establish this claim, she examines which conceptions of freedom of the will and moral responsibility are relevant to practical reasoning and shows that these conceptions are not vulnerable to many objections that libertarians have directed against compatibilists. Bok concludes that the truth or falsity of the claim that we are free and responsible agents in the sense those conceptions spell out is ultimately independent of deterministic accounts of the causes of human actions.Clearly written and powerfully argued, Freedom and Responsibility is a major addition to current debate about some of philosophy's oldest and deepest questions. In discussing the effects of grandparents on child survival in natural fertility populations, Coall & Hertwig (C&H) rely extensively on the review by Sear and Mace (2008). We conducted a more detailed summary of the same literature and found that the evidence in favor of beneficial associations between grandparenting and child survival is generally weak or absent. The present state of the data on human alloparenting supports a more restricted use of the term Human stem family situations with celibate helpers-at-the-nest (...) can be described as cooperatively breeding, but the term is a poor fit to many human family systems. Would suppressing deepfakes violate freedom of expression norms? The question is pressing because the deepfake phenomenon in its more poisonous manifestations appears to call for a response, and automated targeting of some kind looks to be the most practically viable. Two simple answers are rejected: that deepfakes do not deserve protection under freedom of expression legislation because they are fake by definition; and that deepfakes can be targeted if but only if they are misleadingly presented as authentic. To (...) make progress, following a discussion of why freedom of expression deserves protection in a democracy, the question is reframed. At issue is not whether the arrival of deepfakes brings new and potentially serious dangers (it does), nor whether these dangers call for measures that potentially limit freedom of expression (they do), but whether the need for such measures raises any new and unfamiliar freedom-of-expression challenges. The answer to that question, surprisingly, is no. The balancing act needed to cope with the arrival of deepfakes brings plenty of difficulties, certainly, but none of the measures likely to be effective in tackling deepfake harms raises freedom-of-expression concerns that aren’t familiar from consideration of non-deepfake harms. In that respect, at least, the arrival of deepfakes makes no difference. (shrink)

The purpose of the present work is twofold. On the one hand, it attempts to provide a critical exposition of the ethical theory of Jean-Paul Sartre. On the other hand, it strives to explain, and in a limited way to defend, the central thesis of that theory, namely, that freedom is the "highest," or most important, value. ;The study begins with an extensive discussion of Sartre's theory of freedom. Sartre's arguments for the freedom of consciousness are identified (...) and presented, and a number of widespread misunderstandings of Sartre's conception of the nature of freedom are corrected. Specifically, it is argued that, contrary to prevailing opinion, Sartre distinguishes between different senses of freedom, insists that freedom is always limited, and remains substantially consistent, throughout his intellectual career, in his understanding of the nature of freedom. ;The study next takes up Sartre's theory of values. Here the well-known strain of ethical subjectivism in Sartre's thought is presented and criticized, with the main instrument of criticism being a distinction, overlooked by Sartre, between subjectivism as a meta-ethical theory about the status of moral judgments, and subjectivism as an ontological doctrine regarding the existence of moral values. ;The study concludes with an explanation and defense of the theory that freedom is the highest value. Here the presentation of Sartre's ethical theory is brought to completion through a discussion of its neglected objectivist elements, and through a development in regard to ethics of Sartre's general theory of knowledge. It is then shown that the notion of freedom as a value underlies both the subjectivist and the objectivist phases of Sartre's ethical thought, and it is suggested that these two phases can be reconciled in a conception of ethics as a dialectic of invention and discovery. This conception is defended by way of a brief discussion of its advantages over rival ethical theories, which neglect one or the other of the stages of this dialectic. (shrink)

Freedom of Religion, Institution of Conscientious Objection and Political Practice in Post-Communist Slovakia1 The example of Slovakia is used to show how one of the post-socialist countries failed in fulfilling the demanding task of securing freedom of religious belief (including the right to conscientious objection) and, at the same time, securing all other human rights. An analysis of the methods used for changing the policies of pluralism and neutrality of the state into a policy of discrimination (e.g. concerning (...) the registration duty for churches) was carried out, followed by an analysis of a mechanism used for guaranteeing freedom of conscience of the members of the Catholic Church (the so-called Vatican Treaty). The treaty violates the prohibition of discrimination against women, because it makes it more difficult for them to have access to some health care services. Our hypothesis states that the hurriedly introduced right to conscientious objection is misused in this context as a means of regulating the politics of reproduction. In general, the re-Catholisation of the Slovak Republic follows two aims—to help in the fight for votes in the elections (because 70 % of Slovaks declare their religion to be Catholic), and to improve demographic development in the Slovak Republic (declared to be catastrophic by the Catholic Church), through hindering free access to abortions. In this book, Russell examines Hume's notion of free will and moral responsibility. It is widely held that Hume presents us with a classic statement of a compatibilist position--that freedom and responsibility can be reconciled with causation and, indeed, actually require it. Russell argues that this is a distortion of Hume's view, because it overlooks the crucial role of moral sentiment in Hume's picture of human nature. Hume was concerned to describe the regular mechanisms which generate moral sentiments such (...) as responsibility, and Russell argues that his conception of free will must be interprted within this naturalistic framework. He goes on to discuss Hume's views about the nature and character of moral sentiment; the extent to which we have control over our moral character; and the justification of punishment. Throughout, Russell argues that the naturalistic avenue of interpretation of Hume's thought, far from draining it of its contemporary interest and significance, reveals it to be of great relevance to the ongoing contemporary debate - particuarly in relation to the views of P.F. Strawson and his influential paper "Freedom and Resentment". (shrink)
