This essay lays the groundwork for a novel conception of autonomy that may be called “effective autonomy”—a conception designed to be genuinely action guiding in bioethics. As empirical psychology research on the heuristics and biases approach shows, decision making commonly fails to correspond to people’s desires because of the biases arising from bounded cognition. People who are classified as autonomous on contemporary philosophical accounts may fail to be effectively autonomous because their decisions are uncoupled from their autonomous desires. Accordingly, continuing (...) attempts to value patient autonomy must go beyond existing philosophical conceptions of autonomy to consider the background conditions of human decision making. Epistemic trust is an unacknowledged feature of medical knowledge. Claims of medical knowledge made by physicians, patients, and others require epistemic trust. And yet, it would be foolish to define all epistemic trust as epistemically responsible. Accordingly, I use a routine example in medical practice to illustrate how epistemically responsible trust in medicine is trust in epistemically responsible individuals. I go on to illustrate how certain areas of current medical practice of medicine fall short of adequately distinguishing reliable and unreliable (...) processes because of a failure to systematically evaluate health outcomes. I conclude by articulating the devastating obstacles to the consilience assumption, which takes intellectual character as the standard for epistemic responsibility. (shrink)

“Women and the Law in Irigarayan Theory” by Gail Schwab is a reading of French feminist philosopher Luce Irigaray's writings on law together with texts of American feminist jurisprudence. The first part of the article summarizes many of the conflicts surrounding the concept of equality in American feminist legal thought and attempts to move beyond them with the Irigarayan principle of equivalence or equivalent rights. The second part of the article deals more generally with the symbolic changes that will (...) be necessary in order to change the law, and with the cultural evolution that changes in the law can bring about, and more specifically with two areas of Irigarayan legal theory that are central to cultural change and evolution: the concept of female identity or virginity, and the relationship to the mother. In the conclusion, a new utopian vision of what law might be‐the cultural mediation for an evolved intersubjectivity‐is developed through Irigaray's most recent texts. (shrink)

Beyond simple verbal or technical strategies aimed at extending man’s physical capacities and range of action, our modern times provide unusual means of emancipating ourselves from the limitations and imperfections of the body. Science and the arts inspire each other when they discuss the new possibilities offered by chemistry, genetics, devices, cybertechnologies (A.I.), scientific achievements in the field of transsexuality, developments in digital imaging and immersive 3D virtual experiences, and speculation on the potential of so-called quantum therapies, which most scientists (...) scoff at—while other therapeutic avenues based on the use of certain frequencies are being opened up by neuroscience. Some performances are veritable medical experiments, turning the strangely metamorphosed body into an object of art, another mutant. Recent discoveries are multiplying ordinary capacities tenfold, sometimes raising the question of the unity of mind and body, undermined by the cybernetic development of the human being. The arts seek to be pioneers in addressing these issues, as does speculative science fiction, which attempts to anticipate the risks created by these innovations. (shrink)

Much of this interest has been tied to efforts to draw up national and international plans to deal with a global pandemic. It is common for these plans to state the importance of drawing upon a well-developed (...) ethics framework and we argue that this framework should reflect the values and insights of feminist relational theory. More specifically, we argue that pandemic planning must be squarely situated in the larger realm of public health and that an ethics framework for public health will be one that recognizes the need to pay particular attention to the vulnerability of subpopulations lacking in social and economic power. We propose an ethics framework for public health that builds on the notions of relational personhood (including relational autonomy and social justice) and relational solidarity. Françoise Thébaud, en posant la question de savoir comment le genre structure les politiques de guerre, présente une intervention qui fait le point sur la « barbarisation » de la guerre dans le cadre de l’histoire du genre, à partir de la mise en évidence du passage du problème de l’émancipation, ou de l’autonomisation (cf. travaux des années 1960-1970), des femmes à celui de la réflexion plus récente sur la violence de guerre (depuis les années 1980) qui conteste la (...) thèse de la guerre « émancipatrice » (si provisoire et superficielle qu’ait été cette émancipation). Dans ce cadre-là, la guerre en ex-Yougoslavie a pu jouer un rôle d’accélérateur de la prise de conscience du caractère très relatif de l’émancipation des femmes par la guerre des hommes. Certains historiens récents de la Première Guerre mondiale en viennent à travailler sur la culture de guerre qui serait le fondement d’une « brutalisation » du conflit au nom d’une « ethnicisation » de l’ennemi. Leurs thèses sont contestées par ceux qui rejettent l’idée d’un simple consentement à la guerre au profit d’un mélange complexe de contraintes, fraternité, patriotisme et refusent que la « culture de guerre » prenne le pas sur les autres cultures pré-existantes. La place des femmes et du genre dans la guerre est d’abord abordée par F. Thébaud à la lumière d’une double mythologie sexualisée (l’équation pureté nationale/pureté sexuelle et la féminisation de l’ennemi comme décadent) et de l’autre mythe de la femme « naturellement » pacifiste en tant que mère potentielle. Or, les féministes ont adhéré massivement à l’effort de guerre et l’internationalisme « féministe » s’est effondré. Par ailleurs, la relative « humanisation » du conflit dont sont porteuses les femmes aux armées se fait toujours au service exclusif de la patrie. Dans un dernier volet de son intervention, F. Thébaud s’attarde sur la réalité des violences faites aux femmes et les réactions qu’elles ont pu susciter. Les viols ont eu lieu pendant l’invasion plus que pendant l’occupation et le débat sur l’« enfant de l’ennemi » s’il a été animé d’un point de vue discursif ne permet pas d’en savoir beaucoup plus sur la réalité. Les déportations de femmes hors des villes occupées suscitèrent, quant à elles, suffisamment de réactions violentes pour que les Allemands mettent fin à cette pratique dès 1916. Certaines interventions féministes visèrent à modifier les lois de la guerre mais on en sait peu sur la place des femmes dans l’humanisation de la guerre. Par ailleurs, une comparaison s’avérerait nécessaire entre les histoires respectives de la guerre dans les pays dits occidentaux et dans les pays de l’Est. (shrink)

Plutôt que de commencer par expliquer ce qu’il faut entendre par cette dernière, Helmholtz expose devant ses auditeurs la représentation que l’on se fait désormais de la formation des corps célestes et de leur devenir probable, en s’appuyant sur les progrès des connaissances, la découverte de nouvelles lois, (...) l’usage d’instruments de plus en plus perfectionnés. C’est ainsi que la validité de l’hypothèse de Kant et de Laplace se trouve confirmée a posteriori et leur audace légitimée. Aussi, la démarche adoptée par Helmholtz relativise-t-elle implicitement, et peut-être à son insu, la rigueur postulée de la bonne méthode scientifique. La cosmogonie esquissée par Helmholtz ressemble à un spectacle bien étudié dont les auditeurs sont les spectateurs, les savants, les acteurs, et la science épurée, l’enjeu. L’analyse de ce texte a donc pour objectif principal d’identifier et de rappeler les éléments contextuels qui lui confèrent son épaisseur, depuis la guerre franco-prussienne jusqu’aux tensions idéologiques, philosophiques, scientifiques qui en sont l’arrière-plan. This paper examines an ancient debate over the rationality of perception. What leads the Stoics to affirm, and the Epicureans to deny, that to form a sense-impression is an activity of reason? The answer, we argue, lies in a disagreement over what is required for epistemic success. For the Stoics, epistemic success consists in believing the right propositions, and only rational states, in virtue of their predicational structure, put us in touch with propositions. Since they identify some sense-impressions as criteria (...) of truth and thus as the basis for epistemic success, the Stoics maintain that sense-impressions must be rational. The Epicureans agree with the Stoics that sense-impressions function as criteria of truth, and also agree broadly on what it means for a state to be rational, but deny that sense-impressions are rational because (1) they think that epistemic success must be supported by a state that is necessarily error-free and (2) accept that rational states can be false. In reconstructing this debate, we refine the standard interpretation of the fundamental difference between Epicurean and Stoic epistemology and also develop parallels with epistemological debates today. One upshot is a more nuanced appreciation of the merits of Epicurean epistemology vis-à-vis the Stoics. (shrink)

In this book, Françoise Mirguet traces the appropriation and reinterpretation of pity by Greek-speaking Jewish communities of Late Antiquity. Pity and compassion, in this corpus, comprised a hybrid of Hebrew, Greek, and Roman constructions; depending on the texts, they were a spontaneous feeling, a practice, a virtue, or a precept of the Mosaic law. The requirement to feel for those who suffer sustained the identity of the Jewish minority, both creating continuity with its traditions and emulating dominant discourses. Mirguet's (...) book will be of interest to scholars of early Judaism and Christianity for its sensitivity to the role of feelings and imagination in the shaping of identity. An important contribution to the history of emotions, it explores the role of the emotional imagination within the context of Roman imperialism. It also contributes to understanding how compassion has come to be so highly valued in Western cultures. (shrink)

À partir de l'étude de la constitution et de l'histoire des archives du parlement de Paris et de leur traitement archivistique, ainsi que des multiples collections de copies et d'extraits dont elles ont été l'objet, cet article propose une réflexion sur la manière dont ce fonds d'archives, qui allie une exceptionnelle importance matérielle et historique et une particulière complexité, a pu être traité par les archivistes et utilisé par les chercheurs, ainsi que sur les perspectives qu'il peut ouvrir à la (...) recherche. Ces archives du Parlement illustrent en effet toute la gamme des problèmes de conservation, de traitement, de communication au public et d'exploitation et rendent particulièrement manifeste la complémentarité et l'interpénétration nécessaires, voire la confusion, des approches historique et archivistique ; elles démontrent que la connaissance par les chercheurs de l'histoire du fonds d'archives va bien au-delà de la simple pratique archivistique et contribue à la perception de la documentation comme« source» d'histoire. Physicians and other medical practitioners make untold numbers of judgments about patient care on a daily, weekly, and monthly basis. These judgments fall along a number of spectrums, from the mundane to the tragic, from the obvious to the challenging. Under the rubric of evidence-based medicine, these judgments will be informed by the robust conclusions of medical research. In the ideal circumstance, medical research makes the best decision obvious to the trained professional. Even when practice approximates this ideal, it does (...) so unevenly. Judgments in medical practice are always accompanied by uncertainty, and this uncertainty is a fickle companion—constant in its presence but inconstant in its expression. This feature of medical judgments gives rise to the moral responsibility of medical practitioners to be epistemically humble. This requires the recognition and communication of the uncertainty that accompanies their judgment as well as a commitment to avoiding intuitive innovations. (shrink)

The prominence and peculiarity of color in French symbolist verse have often been noted. Yet the dominance of color in symbolism is not the result of aesthetic preference or mere poetic technique, as has been previously argued; rather, color functions, with the synaesthetic poetic context of which it is an integral part, as the direct manifestation of a particular metaphysical stance. Color leads to the heart of what symbolism is, for it is the paradigmatic literary expression of a general spiritual (...) crisis—a crisis in epistemology. The nineteenth century extended seventeenth-century empiricism—an empiricism which had invented mathematical measurement as the gauge of reality and which resulted in a predilection to see most authentic knowledge as quantifiable. The logical corollary of such a predilection is that all sensory experience is regarded as suspect. Newtonian physics had rationalized the laws of the universe in reducing its properties to atomical structures and laws of motion. Nothing, it seemed, was left unexplained. Those areas of perception which remained unquantifiable were dispelled as illusion or attributed to the necessary limitations of the human mind. The theories of John Locke act as a kind of historical watershed in this regard: they are the classic philosophic expression of the disjunction between sensory experience and knowledge which, in its nineteenth-century versions, would lead to the symbolist revolt. The role of the reader is central to the epistolary genre because the letters anticipate a reader within the novel's framework. There is the letter's intended recipient , the occasional interceptor, the invented publisher and/or editor who organize the collected correspondence, and the extrafictional reader who reads the collection in its entirety, including the disclaiming or condemning prefaces which precede it. The epistolary form, however, with so many layers of readers, considerably complicates the issue of reader response. If we share, (...) for example, Stanley Fish's assumption that "literature is in the reader," the epistolary novel apparently reverses the formula: the reader is in the literature.And yet it is in the novel of letters that the reader, the fictional reader, most clearly creates the text. Let us return to Merteuil's admonishment to Cécile: "Voyez donc à soigner davantage votre style…. Vous voyez bien que, quand vous écrivez à quelqu'un, c'est pur lui et non pas pour vous: vous devez donc moins chercher à lui dire ce que vous pensez, que ce qui lui plaît davantage."2 If a reader's response to a given sentence is colored by the previous one, the epistolary novel achieves the same effect within a larger unit: each letter is determined by the one which precedes it. In this sense the letter is a grammatical unit, a larger sentence. Moreover, a letter-novel presents the possibility of an architectural as well as conceptual interruption. That is, whereas insufficiencies in a first-or third-person narrative must consist of circumlocutions, repetitions, and exclusions of information, the letter-novel can create a concrete insufficiency by a lost, suppressed, stolen, or interrupted letter. In such cases the letter must function without its precedent since the destinataire remains empty-handed. Thus, the epistolary novel has a great capacity for mise en abîme.Both inside and outside the narrative, there always is a destinataire; and even if he is the wrong one in the context of the récit he is the intended one for the histoire.3 In any case, the extrafictional reader is the final destinataire and holds a privileged position. And yet, he too is subject to interruptions: here the editor rears his head by claiming in footnotes that a letter is lost, too damaged to decipher, or so boring or obscene that he has seen fit to exclude it; these footnotes are the only "letters" addressed to and meant for us. At this point the editor removes his mask but remains on stage. Apart from such tricks, however, we do read every letter available, each of which is addressed to another reader, a system of the once removed or of the "letter in suffrance." Or, loosely interpreting Jacques Lacan, a purloined letter means that a letter always arrives at its destination.42. Kant’s philosophy is often treated as a closed system, without reference to how it was written or how Kant arrived at its familiar form, the critique. In fact, the style of the critique seems so artless that readers think of it as an unfortunate by-product—a style of stylelessness. In _Constituting Critique_, Willi Goetschel shows how this apparent gracelessness was deliberately achieved by Kant through a series of writing experiments. By providing an account of the process that culminated in his three (...) _Critiques_, this book offers a new perspective on Kant’s philosophical thought and practice. _Constituting Critique_ traces the stages in Kant’s development to reveal how he redefined philosophy as a critical task. Following the philosopher through the experiments of his early essays, Goetschel demonstrates how Kant tests, challenges, and transforms the philosophical essay in his pursuit of a new self-reflective literary genre. From these experiments, critique emerges as the philosophical form for the critical project of the Enlightenment. The imperatives of its transcendental style, Goetschel contends, not only constitute and inform the critical moment of Kant’s philosophical praxis, but also have an enduring place in post-Kantian philosophy and literature. By situating the _Critiques_ within the context of Kant’s early essays, this work will redirect the attention of Kant scholars to the origins of their form. It will also encourage contemporary critical theorists to reconsider their own practice through an engagement with its source in Kant. (shrink)

In this article the authors reflect on regulations which have been developed to protect research subjects and data in research which uses human subjects. They suggest that regulations related to informed consent and privacy protection are burdensome in research which uses human subjects. They argue that a new category of research risk must be established which informs research subjects of the level of risk that they will be exposed to by participating in the research.

The heterosexual couple seemed to have taken on a new, and somehow inappropriately central, importance in Irigaray’s thought in the early eighties; however, the projected mutations in (...) language and love theorized in Éthique did not exclusively concern the heterosexual relationship, even though many readers of Irigaray expressed just such reservations about the book. Éthique foregrounded the couple in the love relationship in order to rethink the philosophical basis of ethics in general, to develop new paradigms, beyond or outside of Western totalizing phallo- and logocentrism, for human relations—not only relations between women and men, but also, and perhaps even more importantly, relations among women and relations among men. Irigaray carried on this project in subsequent works, in Sexes et parentés (1987), which as the title explicitly indicates, opens up the ethical debate to familial and genealogical issues and broadens her focus to include children and the ethical basis of their relationships to parents and more generally to adults of both sexes, and in Sexes et genres à travers les langues (1990), a cross-cultural report on her empirical studies of gender differences in language usage, which sheds new light on the linguistic and communicational issues she had presented in Éthique and even before, in several seldom read and even more rarely analyzed works of the late seventies and early eighties. J’aime à toi (I Love to You) (1992) returns specifically to the more traditionally philosophical approach to the problems of language and love and their intertwining, and carries on the work projected in Éthique, but it goes much further in both the theoretical and the practical development of the concept of sexual difference as the foundation for a new ethics, a new culture of universal validity. J’aime à toi can be read as a follow-up to Éthique and as a founding text for the construction of an ethics of difference modeled on sexual difference, an ethics for the future of humanity in all of its diversity.Western Feminism and the Global FutureIrigaray is very much aware of the limits of the various Western political and academic feminisms, of the need to broaden their scope, both horizontally across cultures and vertically within specific cultures, before they can serve as the basis for a new ethics. Irigaray expresses the concern that Western feminists, rather than represent the exploited women of the world, may exploit them ideologically for their own personal or political purposes, at the risk of preventing them from coming to a feminism of their own making, appropriate to their own cultures and historical moments. “Certain women do implement power strategies—including the power of the media—but not solely for the benefit of the exploited women they use as an alibi. They thus run the risk of clouding the issues and [End Page 76] preventing their consciousness from being raised” [Irigaray, J’aime à toi 15]. 1 Irigaray calls this “egological” feminism (Dare I invent a new term here? Now we have “egofeminists” as well as “ecofeminists”...) and demonstrates its totally undemocratic orientation, despite its representative claims.Certain militants..., practicing direct democracy or an egological feminism, based on their own real, or imagined, needs and desires, rather than on those of all women, leave women subject to existing legislation. Indifferent to the rights necessary for all women—including the little girls of the present and the future, and the women of other cultures—they make decisions that perpetuate, and even aggravate, through unnecessary misunderstandings, the injustices done the female gender.[J’aime à toi 13]As a feminist, in general, it always pains me to read criticisms of feminism, even cogent and theoretically valid criticisms, and I am even now painfully aware of the political dangers of criticizing feminism myself in a public forum such as this one.
