BackgroundClinical ethics consultations can be complex interventions, involving multiple methods, stakeholders, and competing ethical values. Despite longstanding calls for rigorous evaluation in the field, progress has been limited. The Medical Research Council proposed guidelines for evaluating the effectiveness of complex interventions. The evaluation of CEC may benefit from application of the MRC framework to advance the transparency and methodological rigor of this field. A first step is to understand the outcomes measured in evaluations of CEC in healthcare settings. ObjectiveThe primary (...) objective of this review was to identify and map the outcomes reported in primary studies of CEC. The secondary objective was to provide a comprehensive overview of CEC structures, processes, and roles to enhance understanding and to inform standardization.MethodsWe searched electronic databases to identify primary studies of CEC involving patients, substitute decision-makers and/or family members, clinicians, healthcare staff and leaders. Outcomes were mapped across five conceptual domains as identified a priori based on our clinical ethics experience and preliminary literature searches and revised based on our emerging interpretation of the data. These domains included personal factors, process factors, clinical factors, quality, and resource factors. ResultsForty-eight studies were included in the review. Studies were highly heterogeneous and varied considerably regarding format and process of ethical intervention, credentials of interventionist, population of study, outcomes reported, and measures employed. In addition, few studies used validated measurement tools. The top three outcome domains that studies reported on were quality, process factors, and clinical factors. The majority of studies examined multiple outcome domains. All five outcome domains were multidimensional and included a variety of subthemes.ConclusionsThis scoping review represents the initial phase of mapping the outcomes reported in primary studies of CEC and identifying gaps in the evidence. The confirmed lack of standardization represents a hindrance to the provision of high quality intervention and CEC scientific progress. Insights gained can inform the development of a core outcome set to standardize outcome measures in CEC evaluation research and enable scientifically rigorous efficacy trials of CEC. (shrink)

This paper offers an interpretation of and introduction to the philosophical anthropology of Roger Scruton through an examination of the aesthetic dimension of human rationality. We argue that attending to our aesthetic experience as individuated subjects capable of intersubjective communion offers a helpful corrective to the deracinated and disembodied view of human rationality prevalent in much of our contemporary ethical and scientific discourse. Through a consideration of how embodied rationality is at work in four different forms of art – painting, (...) music, dance, and architecture – our paper develops the rudiments of a more concrete philosophical anthropology, and on the basis of first principles advances a normative claim about the importance of art and beauty to human life. In this paper I examine the epistemology and ethics of consensus, focusing on the ways in which decision makers use/misuse ethical expertise. The major questions I raise and tentative answers I give are the following: First, are the ‘experts’ really experts? My tentative answer is that they are bona fide experts who often represent specific interest groups. Second, is the experts' authority merely epistemological or is it also ethical? My tentative answer is that the experts' authority consists not only in (...) their command over specific matters of fact and/or value, but also in their ability to achieve ‘consensus’ about what is ‘true’/‘false’, or ‘right’/‘wrong’. Third, should the authority of expertise be limited? My tentative answer is that it should be limited in the area of facts but especially in the area of values. Persons who are ethics ‘experts’ must be particularly careful to practice an ethics of persuasion rather than an ethics of compulsion . Their role is not to force their group consensus upon decision makers' individual moral perceptions and deliberations; rather it is to help decision makers come to their own conclusions about what they ought to do. It is still hard to ascertain when the landlord economy (in the exploitation form of a tenancy system) in China got started. At least, however, it was during the middle of the Warring States period, that is, the time of Mencius, that the earliest land issue in China was brought up. Raising the issue was a reflection of how the phenomenon of uneven distribution of wealth surfaced and developed in ancient times. The landlord economy based on the exploitation form of (...) a tenancy system came into existence in the wake of the widening of the uneven distribution of wealth in society. Therefore, we can presume that the landlord economy began to emerge during the middle of the Warring States period at the latest. It seems certain that the landlord economy was already an established fact toward the end of that period. For example, Han Fei noted in his representative writing "On Outstanding Schools": "When discussing the problem how to rule, most of the contemporary scholars propose: ‘Divide the land among the poor to provide resources for the have-nots.’" This shows the problem of uneven distribution of wealth, and the issue of land grew quite serious by that time. This was the first instance that the ruling class advanced the policy of "even distribution of land" in order to mitigate class contradiction. (In the time of Mencius, it seemed the system of "granting land" had not been totally abolished in the eastern states. Therefore Mencius proposed the land policy, aside from maintaining the system of "nine squares," of "restricting the people's property." From this phenomenon we can presume that the landlord economy had, it seemed, already begun to gain ground.) In consequence, out of the Confucians representing the reformists among the patriarchal nobilities emerged such intellectuals as Xun Zi who basically represented the interests of the landlord class. From that time onward, the Confucians gradually integrated themselves with the landlord class. Following the emergence and growth of the landlord economy, it became increasingly evident for China to move toward a unified country. There was the necessity for the small-sized centralized feudal states which arose during the early years of the Warring States period to merge toward the end of the period into a centralized feudal monarchy which stood for the landlords' interest. Han Fei's doctrine was precisely a set of ideas that fitted in with the situation toward the end of the Warring States period and served the autocratic feudal country. (shrink)

Globalizing Feminist Bioethics is a collection of new essays on the topic of international bioethics that developed out of the Third World Congress of the International Association of Bioethics in 1996. Rosemarie Tong is the primary editor of this collection, in which she, Gwen Anderson, and Aida Santos look at such international issues as female genital cutting, fatal daughter syndrome, use of reproductive technologies, male responsibility, pediatrics, breast cancer, pregnancy, and drug testing.

This research examined how strongly appraisals can differentiate positive emotions and how they differentiate positive emotions. Thirteen positive emotions were examined, namely, amusement, awe, challenge, compassion, contentment, gratitude, hope, interest, joy, pride, relief, romantic love and serenity. Participants from Singapore and the USA recalled an experience of each emotion and thereafter rated their appraisals of the experience. In general, the appraisals accurately classified the positive emotions at rates above chance levels, and the appraisal–emotion relationships conformed to predictions. Also, the appraisals (...) were largely judged by participants as relevant to their positive emotion experiences, and the appraisal–emotion relationships were largely consistent across the two countries. Many people show great interest in the idea of “overlapping consensus” proposed by John Rawls. On the basis of a careful reading of different understandings of this idea, or the “overlapping consensus” on the idea of “overlapping consensus,” we can say that there are three levels of “overlapping consensus.” At the first level, people with different positions treat each other in the same reasonable attitude. At the second level, people holding different values support the same norms on the basis of (...) their respective values or by taking each other’s perspectives in the moral discourse. At the third level, people who currently hold different “moral sources” of the shared norms are never-the-less ready to be engaged in a common learning process that aims for a “fusion of horizons” in the future. Overlapping consensuses at all these levels should not only be discussed in political philosophy, or discovered in political culture, but also constructed in political practice. (shrink)

Richard, a sixty‐seven‐year‐old man, has been admitted to Midtown University Center for difficulty breathing. He has a significant medical history that includes pulmonary fibrosis and subsequent heart failure, and he depends on supplemental oxygen to breathe. Upon admission and after discussing his prognosis with his family and doctors, Richard decided to sign a do‐not‐resuscitate order stating that if his heart stops or he stops breathing, he does not want to undergo cardiopulmonary resuscitation or other life‐sustaining measures. On his third day (...) in the hospital, the nurse practitioner who is caring for Richard notices that his breathing is becoming more labored and that his blood pressure is steadily dropping. She thinks he requires closer observation and treatment in the cardiac intensive care unit. Dr. P, the physician in the intensive care unit at the time, Dr. P does not want to accept Richard into the CICU because of his prognosis and his DNR order. He believes that Richard should be cared for on a regular hospital floor, and that the last bed in the CICU should be held for its intended user—a patient suffering a life‐threatening heart attack who requires intensive care.
