The act of iudicare hostes (‘declare public enemy’) was a formal pronouncement of the Roman Senate, voted for the first time in 88 BCE following a proposal by L. Cornelius Sulla after his first march on Rome. Legal historians have generally interpreted it as an emergency measure intended to preserve legality in a situation of civil strife and viewed it as a consistently defined institutional framework throughout the final decades of the Republic. Through an analysis of Sulla’s performative political communication, (...) before, during and in the immediate aftermath of the march, this paper argues that the act of judging (iudicare) someone a public enemy (hostis publicus) was first deployed as a political action, void of legal effects. Later instances of iudicare suggest that this act underwent a process of institutionalization after 63 BCE. (shrink)

In this paper I attempt to bring together (at least) two very different debates: one on justice, mercy and particularity, the other on the play of exclusionary reasons. My aim is to show how the discussion of the uneasy co-existence of justice and mercy pivots on the question of particularity. And, secondly, that the debate on exclusionary reasons can show us why law may fail to do justice in this context.

According to a popular aphorism, biometrics are turning the human body into a passport or a password. As usual, aphorisms say more than they intend. Taking the dictum seriously, we would be two: ourself and our body. Who are we, if we are not our body? And what is our body without us? The endless history of identification systems teaches that identification is not a trivial fact but always involves a web of economic interests, political relations, symbolic networks, narratives and (...) meanings. Certainly there are reasons for the ethical and political concerns surrounding biometrics but these reasons are probably quite different from those usually alleged. (shrink)

The ageing society poses significant challenges to Europe’s economy and society. In coming to grips with these issues, we must be aware of their ethical dimensions. Values are the heart of the European Union, as Article 1a of the Lisbon Treaty makes clear: “The Union is founded on the values of respect for human dignity…”. The notion of Europe as a community of values has various important implications, including the development of inclusion policies. A special case of exclusion concerns the (...) gap between those people with effective access to digital and information technology and those without access to it, the “digital divide”, which in Europe is chiefly age-related. Policies to overcome the digital divide and, more generally speaking, e-inclusion policies addressing the ageing population raise some ethical problems. Among younger senior citizens, say those between 65 and 80 years old, the main issues are likely to be universal access to ICT and e-participation. Among the older senior citizens, say those more than 80 years old, the main issues are mental and physical deterioration and assistive technology. An approach geared towards the protection of human rights could match the different needs of senior citizens and provide concrete guidance to evaluate information technologies for them. (shrink)

This chapter looks closely at the reception of Hume's ideas in the 18th-century ‘coterie de Milan’: Alessandro and Pietro Verri and Cesare Beccaria. Alessandro, a traveller to Paris and London in 1766–8, sees his own dispute with Beccaria reflected in Hume's dispute with Rousseau, and champions Hume's ‘meek’ (religious) thought against the radical views of the French ‘philosophes’ supported by his brother. Alessandro's interpretation of Hume's philosophical stance and of the Natural history of religion are used here to cast a (...) new light on Hume's alleged denial of ever having met an atheist and on his refusal to write an Ecclesiastical History. The way Alessandro was ‘cutting off the noble parts’ of Hume's work in order to make it religiously mild reminds us of some present-day appropriations and mis-readings. (shrink)

Information entities are used in ontologies to represent engineering technical specifications, health records, pictures or librarian data about, e.g., narrative fictions, among others. The literature in applied ontology lacks a comparison of the state of the art, and foundational questions on the nature of information entities remain open for research. The purpose of the paper is twofold. First, to compare existing ontologies with both each other and theories proposed in philosophy, semiotics, librarianship, and literary studies in order to understand how (...) the ontologies conceive and model information entities. Second, to discuss some open research challenges that can lead to principled approaches for the treatment of information entities, possibly by getting into account the variety of information entity types found in the literature. The topic of the present reflection is Christian religious belief. Specifically, we will use Husserlian tools in order to examine the positional nature of this particular type of belief. We will be less interested in the question concerning the success conditions of this experience and more in its noetic structure. According to our proposal, to believe by faith supposes (although it is not exhausted by) accepting the existence of mundane evidence speaking against this fundamental belief. The believer acknowledges the existence (...) of this contradicting en-doxical basis and nevertheless believes what she believes. We will refer to this simultaneous movement of accepting and cancelling as the concessive structure of the religious attitude. The para-doxical movement of experiencing conflicting evidence as being subjectively ineffective is a key component of this attitude. At least some inchoative conflict with the world is required in order for the religious belief to be religious. Lastly, we will try to show that, with a distinctive terminology, the idea that the Christian religious attitude involves a conflict between subjectivity and world is present not only in Kierkegaard but also in phenomenological figures like Scheler and even Husserl. Conclusions As my paper draws to a close, it may seem quite clear that by posing such questions about the organisation of work and labour, one opens up more problems than are actually solved. There is one question in particular that has to be answered. I shall ask that question rhetorically: Can there be a world in which group activities are not started up?

In its broadest sense, cohesion is an ultimate goal for Europe. In a study about long term future scenarios for Europe it appears that deepening of the integration process may induce decreasing cohesion, unless measures are taken to promote regional diversity as a vector of development. The widening of Europe also raises threats to cohesion, but a well prepared scenario for a Development Belt surrounding the EC may positively enhance the cohesion process.

Nuclear warfare threat has been one of the main driver for cultural, political, economical and social changes in the late twentieth century, biological warfare threat is about to take it over. However, while nuclear warfare was a concrete possibility, biological warfare is just an elusive risk. This paper will explore some reasons for this apparent inconsistency by discussing biowarfare from a symbolic point of view, looking for its inner meanings and philosophical implications.

Ethical questions about information and communications technologies have been debated since World War II. Western democracies have had more than 50 years of experience in addressing and organising the ethical, social and legal aspects of scientific and technological developments. However, this expertise, tradition and experience are not enough to manage the most urgent ethical and social issues and contemporary challenges involving ICT. A systematic and institutional organisation of social values in the context of modern ICT tools is needed.This paper focuses (...) on four major areas: developing a specific approach to ethical issues raised by ICT; describing in more detail the age-related digital divide in Europe; identifying technology trends and emerging challenges; and defining the legal framework for inclusion of senior citizens in the digital society. The paper then concludes with a summary of its key points on the basis of which it makes three proposals as a contribution to efforts aimed at overcoming the exclusion of senior citizens from today's Information Society. The anticipation of the typical under the assumption of the non-occurrence of the atypical is the experiential schema governing the individuation of ordinary enduring objects and their properties. Against this background, a primitive form of “if-and-only-if” consciousness is implicit in our everyday perceptual intentions. The thematization of the fact that perception operates under this proto-tentative structure occurs at the level of reflection and is expressed by defeasible judgments of the form “if p, then q, unless r,” or “if p, then (...) q provided that not-r”. Here I will argue that what is made thematic by judgments containing such restrictive clauses is the structure of unpredictability inherent in what Husserl calls the horizon of latency and, indirectly, the world as background of normality. Tracing the notion of 'the gift' in Nietzsche's Thus Spoke Zarathustra Emilio Corriero provides a new interpretation of this essential text, alongside 'the gift's' evolution as a key concept in the history of western philosophy and Christianity. The last phase of Nietzsche's thought, including his writings on the death of God, The Will to Power, the Overman, and eternal recurrence are analysed anew in Corriero's reading of Thus Spoke Zarathustra. From Nietzsche's Prologue, in which Zarathustra presents the idea of (...) the Overman as a gift of love and wisdom, up to the fourth and final book, in which the theme of hospitality and sacrifice are inextricably linked to the concept of donation, highlighting the novelty and exceptionality of Zarathustra's gift. Building on these ideas, this book reveals how the gift of Zarathustra put forward by Nietzsche rethinks the relationships between individuals based on Christian doctrine, enabling new forms of coexistence and sociality to thrive. Using key 20th century writings on 'the gift' from Derrida, Benveniste, and Esposito, Corriero traverses themes of sacrifice and hospitality, the idea of friend and foe, compassionate love and affirmative love, to present Zarathustra as Nietzsche's ultimate gift, as well as cementing the centrality of 'the gift' to the history of sociality and philosophy. To think a Deleuzian politics requires to understand the philosophical markleft in his work by Spinoza. Both philosophers’ paths crisscross in their problems, questions and consequences. In this paper three concepts will be put in relation: critique, right and crowd. The aim is to elucidate how man can open new ways of political experience from the conjunction of two philosophies articulated upon a common ground: immanence and life.

Within the current theoretical and methodological conceptions that approach the educational processes and phenomena there are several levels that, with a systemic character, offer coherence and unity from their more general argumentation to the description of how they should be studied. However, this reality, that is implicit in the different theories, is unnoticed by the researchers and thus it brings about theoretical and methodological in-consequences in the investigation which damage the strictness of the research process. The aim of this article (...) is to analyse each level in the theoretical foundation of investigations about the educational process. A deep analysis of the various ways in which the state of the art has been approached by different authors from the theoretical and methodological points of view is made and the importance of each of one is analysed with new elements that can be enrich according to criterion of the author of this article. Dentro de las concepciones teóricas y metodológicas actuales que abordan los procesos y fenómenos educativos, existen varios niveles que con carácter de sistema les brindan coherencia y unidad, desde su argumentación más general hasta la prescripción de cómo deben ser estudiados. Sin embargo, esta realidad implícita en las teorías con frecuencia es inadvertida por los investigadores, provocando inconsecuencias teóricas y metodológicas en las investigaciones que lesionan la severidad del proceso investigativo. El objetivo de este artículo es analizar los niveles en la fundamentación teórica de las investigaciones sobre el proceso educativo. Se valora el estado del arte acerca de cómo han sido abordados los niveles teóricos y metodológicos por parte de diferentes autores y posteriormente, se precisa cada uno, destacando nuevos elementos que, a juicio del autor, pueden enriquecerlos. La noción de emergencia acompaña a la Filosofía de la Biología desde finales del siglo XIX, afirmando que las propiedades de los sistemas biológicos no pueden deducirse de las de sus componentes. In this paper we suggest that differing approaches to the science of social cognition mirror the arguments between radical embodied and traditional approaches to cognition. We contrast the use in social cognition of theoretical inference and mental simulation mechanisms with approaches emphasizing a direct perception of others’ mental states. We build from a recent integrative framework unifying these divergent perspectives through the use of dual-process theory and supporting social neuroscience research. Our elaboration considers two complementary notions of direct perception: one (...) primarily stemming from ecological psychology and the other from enactive cognition theory. We use this as the foundation from which to offer an account of the informational basis for social information and assert a set of research propositions to further the science of social cognition. In doing so, we point out how perception of the minds of others can be supported in some cases by lawful information, supporting direct perception of social affordances and perhaps, mental states, and in other cases by cues that support indirect perceptual inference. Our goal is to extend accounts of social cognition by integrating advances across disciplines to provide a multi-level and multi-theoretic description that can advance this field and offer a means through which to reconcile radical embodied and traditional approaches to cognitive neuroscience.
