Dietmar Wetzel unternimmt eine diskurskritisch-vergleichenden Lektüre zweier Theorielinien der neueren Sozialphilosophie: identitäts- versus alteritätsorientierte Konzepte. Das Denken des Ethischen und des Politischen wird dabei anhand einer Beschäftigung mit Schlüsselbegriffen, Konstellationen und Figuren der Gegenwartsgesellschaft thematisch an Gerechtigkeit, Geschlecht, Dritte(m) und Gemeinschaft ausgerichtet. Soziologische Essays, dem Intellektuellen, der Hausfrau, dem Grenzpolizisten und dem Flüchtling gewidmet sind, komplementieren die Analysen. So kann gezeigt werden, daß differenztheoretische Positionen (Lévinas/Derrida) den Begriff der Gerechtigkeit um Aspekte der Fürsorge und der moralischen Gefühle erweitern müssen (...) Da im Übergang der Ich-Anderer-Beziehung zu "ordentlichen Bezügen" das Dritte eine grundlegende Rolle spielt, läßt sich Gemeinschaftsbildung nicht mehr im Sinne natural bzw. religiös begründeter Nachbarschaft (Kommunitarismus), sondern nur als stets neu zu legitimierende und variierende Kultivierung von Andersheit begreifen. The prospective introduction of autonomous cars into public traffic raises the question of how such systems should behave when an accident is inevitable. Due to concerns with self-interest and liberal legitimacy that have become paramount in the emerging debate, a contractarian framework seems to provide a particularly attractive means of approaching this problem. We examine one such attempt, which derives a harm minimisation rule from the assumptions of rational self-interest and ignorance of one’s position in a future accident. We contend, (...) however, that both contractarian approaches and harm minimisation standards are flawed, due to a failure to account for the fundamental difference between those ‘involved’ and ‘uninvolved’ in an impending crash. Drawing from classical works on the trolley problem, we show how this notion can be substantiated by reference to either the distinction between negative and positive rights, or to differences in people’s claims. By supplementing harm minimisation with corresponding constraints, we can develop crash algorithms for autonomous cars which are both ethically adequate and promise to overcome certain significant practical barriers to implementation. Recent developments in neuroscience have inspired proposals to perform deep brain stimulation on psychopathic detainees. We contend that these proposals cannot meet important ethical requirements that hold for both medical research and therapy. After providing a rough overview of key aspects of psychopathy and the prospects of tackling this condition via deep brain stimulation, we proceed to an ethical assessment of such measures, referring closely to the distinctive features of psychopathic personality, particularly the absence of subjective suffering and a lack (...) of moral motivation. Scrutiny of these factors reveals that two essential bioethical criteria, individual medical benefit and voluntary informed consent, cannot be met in performing neurosurgical experiments or treatments on psychopathic inmates. By contrast, non-conceptualism is the view that mental representations of the world do not necessarily presuppose concepts by means of which the content of these representations can be specified, thus cognizers can have mental representations of the world that are non-conceptual. Consequently, if conceptualism is true then non-conceptualism must be false, (...) and vice versa. This incompatibility makes the current debate over conceptualism and non-conceptualism a fundamental controversy since the range of conceptual capacities that cognizers have certainly has an impact on their mental representations of the world, on how sense perception is structured, and how external world beliefs are justified. Conceptualists and non-conceptualists alike refer to Kant as the major authoritative reference point from which they start and develop their arguments. The appeal to Kant attempts to pave the way for a robust answer to the question of whether or not there is non-conceptual content. Since the incompatibility of the conceptualist and non-conceptualist readings of Kant indicate a paradigm case, hopes have risen that the answer to the question of whether Kant is a conceptualist or a non-conceptualist might settle the contemporary controversy across the board. In addition to its two world wars, the rapid decolonization after 1947 has been the most important phenomenon of the 20th century. The two wars led to the decline of the European colonial empires and speeded up decolonization. This process has spawned more than one hundred new nations which in many cases did not exist in this way before. It also fixed territorial boundaries, most of which have remained unaltered ever since. In the course of decolonization constitutions have been made (...) which have also survived unless they have been suspended by military coups. Many of these constitutions bear the stamp of the process of decolonization because they were framed with a view to facilitating the transfer of power. Usually the grant of independence was preceded by various steps in the devolution of power which left their traces in the constitutional documents. Since this devolution implied the prescription of administrative procedures, these constitutional documents often contain a great deal of contingent detail, whereas ‘normal’ constitutions are restricted to statements of fundamental rights and basic principles. This led to ironies of fate such that the Independence of India Act, which subsequently formed the basis of the Indian constitution, is the longest act ever passed by the British Parliament, which is itself based on an unwritten constitution. We investigate the expressive power of Parikh's Game Logic interpreted in Kripke structures, and show that the syntactical alternation hierarchy of this logic is strict. This is done by encoding the winning condition for parity games of rank n. It follows that Game Logic is not captured by any finite level of the modal -calculus alternation hierarchy. Moreover, we can conclude that model checking for the -calculus is efficiently solvable iff this is possible for Game Logic.

The inclusion of the history and philosophy of science in science teaching is widely accepted, but the actual state of implementation in schools is still poor. This article investigates possible reasons for this discrepancy. The demands science teachers associate with HPS-based teaching play an important role, since these determine teachers’ decisions towards implementing its practices and ideas. We therefore investigate the perceptions of 8 HPS-experienced German middle school physics teachers within and beyond an HPS implementation project. Within focused interviews these (...) teachers describe and evaluate the challenges of planning and conducting HPS-based physics lessons using collaboratively developed HPS teaching materials. The teachers highlight a number of obstacles to the implementation of HPS specific to this approach: finding and adapting HPS teaching material, knowing and using instructional design principles for HPS lessons, presenting history in a motivating way, dealing with students’ problematic ideas about the history of science, conducting open-ended historical classroom investigations in the light of known historical outcomes, using historical investigations to teach modern science concepts, designing assessments to target HPS-specific learning outcomes, and justifying the HPS-approach against curriculum and colleagues. Teachers' perceived demands point out critical aspects of pedagogical content knowledge necessary for confident, comfortable and effective teaching of HPS-based science. They also indicate how HPS teacher education and the design of curricular materials can be improved to make implementing HPS into everyday teaching less demanding. (shrink)

When seeking to coordinate in a game with imperfect information, it is often relevant for a player to know what other players know. Keeping track of the information acquired in a play of infinite duration may, however, lead to infinite hierarchies of higher-order knowledge. We present a construction that makes explicit which higher-order knowledge is relevant in a game and allows us to describe a class of games that admit coordinated winning strategies with finite memory.

This article improves our understanding of the reasons underlying the intellectual migration of scientists from existing cognitive domains to nascent scientific fields. To that purpose we present, first, a number of findings from the sociology of science that give different insights about scientific migration. We then attempt to bring some of these insights together under the conceptual roof of an actor-based approach linking expected utility and diffusion theory. Intellectual migration is seen as the choice of scientists who decide under uncertainty (...) and on the base of estimations about probabilities, costs, and benefits of the migration. The resulting choice model can be used as a heuristic base for further exploration of the subject. (shrink)

Die vorliegende Untersuchung stellt die Frage nach der Gerechtigkeit des Rechts, wobei sich das Wort "Recht" sowohl auf das Ganze der Rechtsordnung als auch auf einzelne Rechtsnormen beziehen kann. Dabei wird ausgelotet, was eine rechtsethische Rechtfertigung des Rechts überhaupt zu leisten vermag und welches ihre Grenzen sind. Die Untersuchung geht systematisch vor. Es erfolgt in erster Linie eine Auseinandersetzung mit problembezogenen Lösungsvorschlägen. Historische Positionen sowie philosophiegeschichtliche Betrachtungen dienen der Abrundung. Der Aufbau des Werkes erfolgt in Form einer Stufenpyramide, wobei auf (...) jeder Stufe die Problembehandlung immer weiter konkretisiert wird. So wird die Bandbreite möglicher Antworten auf die Frage nach der Gerechtigkeit des Rechts Schritt für Schritt eingegrenzt. Der Lösungsvorschlag des Autors geht am Ende dieser Stufenpyramide hin zu einer materialen Gerechtigkeitstheorie. Diese sogenannte "Dreizonentheorie politischer Gerechtigkeit" wird im zentralen Teil der Untersuchung ausführlich behandelt und dargestellt. Since J. McTaggart’s paper on “The Unreality of Time” the opposition of “A-theorists” and “B-theorists” establishes a focal point in the modern debate on the metaphysics of time: While “A-theorists” claim the existence of an objective present, moving along time positions, “B-theorists” maintain that time is just a set of ontologically equivalent coordinates, “now” being merely the indexical of the speaker’s position. Contemporary attempts to resolve the issue by resorting to the analysis of language or to the theory of science (...) seem to deliver no definite results. By contrast, practical and existential aspects of the two models promise to be more univocal guides in deciding between them. Particularly, C. D. Broad’s hybrid conception of a “growing block theory” attains special attractiveness in this regard. (shrink)

John Rawls’ “reflective equilibrium” ranges amongst the most popular conceptions in contemporary ethics when it comes to the basic methodological question of how to justify and trade off different normative positions and attitudes. Even where Rawls’ specific contractualist account is not adhered to, “reflective equilibrium” is readily adopted as the guiding idea of coherentist approaches, seeking moral justification not in a purely deductive or inductive manner, but in some balancing procedure that will eventually procure a stable adjustment of relevant doctrines (...) and standpoints. However, it appears that the widespread use of this idea has led to some considerable deviations from its meaning within Rawls’ original framework and to a critical loss of conceptual cogency as an ethico-hermeneutical tool. This contribution identifies three kinds of “balancing” constellations that are frequently, but inadequately brought forth under the heading of Rawlsian “reflective equilibrium”: (a) balancing theoretical accounts against intuitive convictions; (b) balancing general principles against particular judgements; (c) balancing opposite ethical conceptions or divergent moral statements, respectively. It is argued that each of these applications departs from Rawls’ original construction of “reflective equilibrium” and also deprives the idea of its reliability in clarifying and weighing moral stances. The debate about Kantian conceptualism and non-conceptualism has completely overlooked the importance of Kant’s aesthetics. I show how this debate can be significantly advanced by exploring Kant’s aesthetics, that is, the theory of judgments of taste and the doctrine of the aesthetic genius of the third Critique. The analysis of judgments of taste demonstrates that non-conceptual mental content is a condition of the possibility of aesthetic experience. The subsequent discussion of the doctrine of the aesthetic genius reveals that aesthetic ideas (...) must also be conceived in terms of non-conceptual mental content. I finally restrict Kant’s aesthetic non-conceptualism to the way aesthetic perceivers cognitively evaluate artwork, while the doctrine of the genius cannot count as a viable form of aesthetic non-conceptualism. I present the arguments Hegel puts forward in favor of this rather challenging account of skepticism. In Section 2, I discuss the celebrated conception of “self-fulfilling skepticism” of the Phenomenology of Spirit that is supposed to overcome untrue types of cognition in order to promote “absolute knowing.” In Section 3, I debate Hegel’s more advanced view according to which genuine skepticism must be construed as dialectic.

While video games have blossomed into the foremost expression of contemporary popular culture over the past decades, their critical study occupies a fringe position in American Studies. In its engagement with video games, this book contributes to their study but with a thematic focus on a particularly important subject matter in American Studies: spatiality. The volume explores the production, representation, and experience of places in video games from the perspective of American Studies. Contributions critically interrogate the use of spatial myths (...) ("wilderness," "frontier," or "city upon a hill"), explore games as digital borderlands and contact zones, and offer novel approaches to geographical literacy. The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms and values can only (...) be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals’ concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. I argue that in his aesthetics, Kant puts forward arguments that help to answer the question of whether he is a conceptualist or a non-conceptualist. The current debate on Kantian conceptualism and non-conceptualism has completely overlooked the importance of Kant’s aesthetics. There are two candidates for non-conceptuality in Kant’s aesthetics. First, non-conceptual content plays a crucial role in aesthetic evaluation. Second, non-conceptual content has a systematic explanatory function in the theory of aesthetic creation of the genius of art. Accordingly, my (...) argument proceeds in two steps: In first analyse the role of non-conceptual content in aesthetic evaluation, i.e., Kant’s claim that aesthetic experience is cognition of a special kind that does not bear on conceptual activities. In then look at the role of non-conceptual content in the genius’s creation of artwork. I argue that art production does not imply conceptual activity and therefore seems to count as a second systematic instance of Kantian non-conceptualism. If my argument is correct, then Kant’s aesthetics implies non-conceptualism with respect to aesthetic evaluation but does not in any objective sense with respect to aesthetic creation. (shrink)

The constitutions of the decolonized new nations were marked by the process of the devolution of power. This process had an impact on the agenda setting and arena setting embedded in these constitutions. ‘Agenda’ refers to the conduct of political affairs and ‘arena’ to the delimitation of the powers of Parliament, the design of constituencies, etc. As a special feature, federalism was introduced by several constitutions. It emerged as a device for the gradual devolution of power. In some instances it (...) proved to be a permanent asset (India), in others it was contested (Nigeria) or rejected (Rhodesia). None of the new constitutions contained adequate provisions for the civilian control of the armed forces. The armed forces were simply taken for granted and their potential political role disregarded. But in many new nations political power was soon usurped by the armed forces and constitutional government was suspended. (shrink)

First published in 1989, Looking Back on the End of the World raises provocative questions about the possibilities of critical knowledge in social systems that seem to have "surpassed history." Unlike recent works that make history end with the consumer, or project the conflict between the capitalist and the oppressed into the future, the writers in these essays perform a much more basic task: they argue that we can now think through the "end of the world." The idea of a (...) "unified world," they claim, has given way to new sensibilities about history. The essays evaluate current negative obsessions such as apocalypse and the elimination of difference, and offer positive approaches to the "gamble of thinking" required in a society without traditional subjects and institutions. Capitalism, the book argues, has changed all the rules of the game, and any nostalgia for "starting" from the familiar in terms of intellectual critique is doomed. Collectively, the authors sketch the unfamiliarity of the new, those moments when our categories dissolve in the face of connections and relations that announce all sorts of "ends."
