What is the nature of law? Does our obligation to obey the law extend to unjust laws? From what source do lawmakers derive legitimate authority? What principles should guide us in the design of political institutions? If ever there were a time in which concerns about equality as a primary issue for social policy disappeared from public view, now is not that time. Recent work in economics on inequality has climbed to the top of best-sellers lists, and the issue was a major talking point in American midterm elections in 2014. The sheer bewildering volume of scholarship and discussion of equality makes it difficult to distinguish signal from noise. What, of all that we know about ways (...) in which we are equal and ways in which we are unequal, matters? If, as seems plausible, we neither are nor should desire to be equal in every respect that we could in theory be equal, in which ways ought we to care about being equal? Does the kind of equality of outcome — perhaps equality of income or wealth — that is frequently the focus of discussion matter most? Does opportunity matter more? What about less material forms of equality such as equality of status, or power, or authority? How do these various forms of equality interact with each other? The essays in this volume represent the work of a number of leading scholars from different disciplines on these questions. Drawing on sources in philosophical analysis, empirical science, and history, they sort through competing claims and counterclaims about the intuitions that drive our concern for equality. Their conclusions are not in unison, but nonetheless represent important advances in our attempts to grapple with this crucial social value. (shrink)

James Gustafson's "Ethics from a Theocentric Perspective" has been criticized very sharply by reviewers from both the theological and scholarly communities. This article examines the reception of this work, and analyzes two aspects of it that are responsible for the critical reaction: 1) its prophetic message and the strategies used to deliver that message; and 2) the understanding of tradition presented and embodied in the text. The author contends that the debate between the theological ethicists who champion an ethics of virtue and moral philosophers who support an ethics of duty is much more than a disagreement about normative ethics. He attempts to clarify the nature of this debate and to turn it in a more useful direction by constructing comprehensive outline of Frankena's view of the conditions of moral reasoning and indicating where the points in dispute most naturally arise.

Spirituality and storytelling can be resources in aging successfully and in dying well given the constraints of modern day Western culture. This paper explores the relationship of aging to time and the dynamic process of the life course and discusses issues related to confronting mortality, including suffering, finitude, spirituality, and spiritual closure in regard to death. And, finally, the role of narrative in this process is taken up.

ABSTRACT:This article presents a case for transforming traditional bioethics into "Bios-ethics." This exposition relies on three propositions: (1) the climate emergency is the "Bios emergency"; (2) in the Bios emergency, bioethics must be replaced by Bios-ethics; and (3) the top and overwhelming priority of Bios-ethics is to address the Bios emergency. Biocentrism, habitat, and environmental ethics are discussed in light of their contribution to the development of Bios-ethics, and potential lines of research in Bios-ethics are outlined. David Hamilton is a leader in the American institutionalist school of heterodox economics that emerged after WWII. This volume includes 25 articles written by Hamilton over a period of nearly half a century. In these articles he examines the philosophical foundations and practical problems of economics. The result of this is a unique institutionalist view of how economies evolve and how economics itself has evolved with them. Hamilton applies insight gained from his study of culture to send the message (...) that human actions situated in culture determine our economic situation. David Hamilton has advanced heterodox economics by replacing intellectual concepts from orthodox economics that hinder us with concepts that help us. In particular, Hamilton has helped replace equilibrium with evolution, make-believe with reality, ideological distortion of government with practical use of government, the economy as a product of natural law with the economy as a product of human law and, last, he has helped us replace the entrepreneur as a hero with the entrepreneur as a real person. These articles provide an alternative to the self-adjusting market. They provide an explanation of how the interaction of cultural patterns and technology determine the evolutionary path of the economic development of a nation. This is not a simple materialist depiction of economic history as some Marxists have advocated, instead Hamilton treats technology and culture as endogenous forces, embedded and inseparable from each other and therefore, economic development. This volume will be of most interest and value to professional economists and graduate students who are looking for an in-depth explanation of the origins and significance of institutional economics. Various philosophers discuss perlocutionary silencing, but none defend an account of perlocutionary silencing. This gap may exist because perlocutionary success depends on extralinguistic effects, whereas silencing interrupts speech, leaving theorists to rely on extemporary accounts when they discuss perlocutionary silencing. Consequently, scholars assume perlocutionary silencing occurs but neglect to explain how perlocutionary silencing harms speakers as speakers. In relation to that shortcoming, I defend a novel account of perlocutionary silencing. I argue that speakers experience perlocutionary silencing when they are illegitimately (...) deprived of perlocutionary influence on a conversation in which they are active participants, where perlocutionary influence on the conversation relates to speech-related perlocutionary goals meant to influence the conversation or conversational direction. Thus, this account grounds perlocutionary silencing in linguistic phenomena and characterizes perlocutionary silencing in a way that explains why those who experience perlocutionary silencing are harmed as speakers. Moreover, this account explains how perlocutionary silencing harms speakers as conversational participants in a way that cannot be captured by illocutionary or locutionary silencing, for a speaker may be perlocutionarily silenced despite illocutionary success. Consequently, the account explains why “All Lives Matter” silences Black Lives Matter and “Not All Men” silences women sharing experiences of sexual harassment. (shrink)

Reasoning about ulterior motives was investigated among children ages 6–10 years (total N = 119). In each of two studies, participants were told about children who offered gifts to peers who needed help. Each giver chose to present a gift in either a public setting, which is consistent with having an ulterior motive to enhance one's reputation, or in a private setting, which is not consistent with having an ulterior motive. In each study, the 6- to 7-year olds showed no (...) evidence of understanding that the public givers might have ulterior motives, but the 8- to 10-year olds rated the private givers more favorably. In , the older children were more likely than the younger children to refer to impression management when explaining their judgments of the givers. The younger children who mentioned impression management did so to justify a preference for public givers (e.g., by explaining that public givers are nicer because more of their peers will know that they are nice). Results from suggest that developmental change in children's reasoning about intentions and social outcomes contributes to their understanding of ulterior motives. (shrink)

In this article, we contribute to the ongoing investigation of the social significance of biomedicine by examining a very specific site: the activity of bio-containing in Nebraska during the recent Ebola outbreak. We do this by taking up key insights of Mary Douglas and Victor Turner concerning the essential meaning-making tasks of culture. We demonstrate how biocontaining as an activity contributed to the ongoing meaning-making work in U.S. society during the Ebola crisis in 2014. During the past decades several philosophers of science and social scientists have been interested in the problems of causation. Recently attention has been given to probabilistic causation in dichotomous causal systems. The paper uses the basic features of probabilistic causation to argue that the causal modeling approaches developed by such researchers as Blalock (1964) and Duncan (1975) can provide, when an additional assumption is added, adequate qualitative measures of one variableś causal influence upon another. Finally, some of the difficulties and (...) issues involved in developing adequate quantitative measures are discussed, and it is concluded that the causal modeling measures cannot provide adequate quantitative measures. The multiple emergencies of global heating require bioethicists to embrace the dormant, comprehensive bioethics legacy of Van Rensselaer Potter, moving beyond the current narrower focus of the field on medicine and health care. We recommend readings that expand the core literature of bioethics to address key environmental issues. These are Jessica Pierce and Andrew Jameton's The Ethics of Environmentally Responsible Health Care; Dale Jamieson's Reason in a Dark Time; and David Wallace‐Well's The Uninhabitable Earth. Because efforts to mitigate climate (...) disasters are likely to be only partially successful, we also recommend the teachings of late Roman Stoicism and core texts of Buddhism, which provide ethical wisdom likely to be needed in the multiple crises of the Anthropocene. Game theory provides a descriptive or a normative account of an important class of decisions. Given the cognitive sciences' emphasis on explanation, unification with the behavioral sciences under a descriptive model would constitute a step backwards in their development. I argue for the interdependence of the cognitive and behavioral sciences and suggest that meaningful integration is already occurring through problem-based interdisciplinary research programs. Often those attempting to resolve the answering machine paradox appeal to Kaplan's claim that the objects of semantic evaluation are expression-types evaluated with respect to indices, instead of utterances, as part of their solution. This article argues that Dylan Dodd and Paula Sweeney exemplify the kind of mistakes theorists make in applying such expression-based semantic theories in that they conflate what is asserted with semantic content, and they take their approach to utterance interpretation as having semantic significance. In light of (...) these mistakes, we learn two things. First, we learn how expression-based semantic theorists can avoid making these kinds of mistakes. Second, we learn how the limits of expression-based semantics can contribute to what we should expect a semantic theory to explain regarding how semantics fits into a more general theory of linguistic communication and linguistic understanding. We will argue here that after more than 30 years of talk, theory, and clinical practice, we bioethicists still know far too little about what patients, subjects, and healthcare professionals are up to, morally. Bioethics is still near the beginning in grasping what it means to understand, much less to honor fully, the moral power and perspicacity of those bioethics is designed to serve. This is, of course, a serious charge, but one we will endeavor to show has merit. However, (...) we want to be clear from the start that we do not gainsay the important work that has been done in and through the influence of bioethics, both as a field of practical engagement and as a cultural movement, in improving how healthcare is delivered and how human subjects are treated. Thirty or 40 years—depending on how one marks the beginning point—is a very short time, and it is hard to imagine that wholesale changes, all of them in the right direction, could be the outcome for a field this young. Hence, we do not intend the title, “One Cheer for Bioethics,” as a wholesale indictment, but as an indication that there is a great deal of work yet to be done, and that following the currently dominant direction of the field is not likely to get us there. Our aim is to indicate just where future work should be focused, and to do so we will need to be critical of some of the preoccupations of the last three decades. a. (shrink)

Two kinds of causal inference rules which are widely used by social scientists are investigated. Two conceptions of causation also widely used are explicated -- the INUS and probabilistic conceptions of causation. It is shown that the causal inference rules which link correlation, a kind of partial correlation, and a conception of causation are invalid. It is concluded a new methodology is required for causal inference.

Philosophers and scientists have maintained that causation, correlation, and "partial correlation" are essentially related. These views give rise to various rules of causal inference. This essay considers the "claims of several philosophers and social scientists for causal systems with dichotomous variables. In section 2 important commonalities and differences are explicated among four major conceptions of correlation. In section 3 it is argued that whether correlation can serve as a measure of A's causal influence on B depends upon the conception of (...) causation being used and upon certain background assumptions. In section 4 five major kinds of "partial correlation" are explicated, and some of the important relations are established among two conceptions of "partial correlation", the conception of "screening off", the conception of "partitioning", and the measures of causal influence which have been suggested by advocates of path analysis or structural equation methods. In section 5 it is argued that whether any of these five conceptions of "partial correlation" can serve as a measure of causal influence depends upon the conception of causation being used and upon certain background assumptions. The important conclusion is that each of the approaches (considered here) to causal inference for causal systems with dichotomous variables stands in need of important qualifications and revisions if they are to be justified.
