In this paper, I will try to show the ways in which Nietzsche prefigures the crucial moves made recently in postmodern" American philosophy. I will confine my remarks to two of Nietzsche's texts: Twilight of the Idols and The Will To Power. The postmodern American philosophers I will examine are W.V. Quine, Nelson Goodman, Wilfred Sellars, Thomas Kuhn and Richard Rorty. The three moves I shall portray are: the move toward anti-realism or conventionalism in ontology; the move toward the (...) demythologization of the Myth of the Given or anti-foundationalism in epistemology; and the move toward the detranscendentalization of the subject or the dismissal of the mind as a sphere of inquiry. I then shall claim that Nietzsche believed such moves lead to a paralyzing nihilism and ironic skepticism unless they are supplemented with a new world view, a new "countermovement" to overcome such nihilism and skepticism. Lastly, I will suggest that postmodern American philosophy has not provided such a "countermovement," settling instead for either updated versions of scientism (Quine and Sellars), an aristocratic resurrection of pluralistic stylism (Goodman), a glib ideology of professionalism (Kuhn), or a nostalgic appeal to enlightened conversation (Rorty). Such weak candidates for a "countermovement" seem to indicate the extent to which postmodern American philosophy—similar to much of postmodern thought in the West—constitutes a dead, impotent rhetoric of a declining and decaying civilization. The increasing interest in Hegel among legal scholars can be attributed to three recent developments. First, there is a slow but sure historicist turn in legal studies that is unsettling legal formalists and positivists. This turn—initiated by legal realists decades ago and deepened by the Critical Legal Studies movement in our own time—radically calls into question objectivist claims about procedure, due process, and the liberal view of law. Second, there are a growing number of serious reexaminations of the basic assumptions (...) and fundamental presuppositions of dominant forms of liberalism not only among critics but also by many prominent liberal thinkers themselves. These reexaminations take the form of immanent critiques of liberalism as well as creative revisions of liberalism. Third, a new emerging subject matter has seized the imagination of some legal theorists: the complex cultures of liberal societies (including the subcultures of the liberal legal academy). For the first time in American legal studies, the crucial roles of race and especially gender are receiving wide attention as legitimate spheres of legal inquiry into what constitutes the ways of life that circumscribe the operations of power in the legal systems of liberal societies. It is not surprising that in a time of intensified ecological awareness a new appreciation of nature and the inanimate world arises. Two examples are panpsychism and deep incarnation. Consciousness studies flourish and are related to nature, the animal world and inorganic nature. A metaphysics of consciousness emerges, of which panpsychism is a good example. Panpsychism or panconsciousness or speculative realism endows all matter with a form of consciousness, energy and experience. The consciousness question is increasingly linked to the (...) quantum world, which offers some option in bridging mind and reality, consciousness and matter. In this regard Kauffman's notion of 'triad' is referred to as well as the implied idea of cosmic mind. This is related to the notion of 'deep incarnation' as introduced by Gregersen. The claim that ordinary ethical discourse is typically true and that ethical facts are typically knowable seems in tension with the claim that ordinary ethical discourse is about features of reality friendly to a scientific worldview. Cornell Realism attempts to dispel this tension by claiming that ordinary ethical discourse is, in fact, discourse about the same kinds of things that scientific discourse is about: natural properties. We offer two novel arguments in reply. First, we identify a key assumption (...) that we find unlikely to be true. Second, we identify two features of typical natural properties that ethical properties lack. We conclude that Cornell Realism falls short of dispelling the tension between ethical conservativism and ethical naturalism. (shrink)

Cornell realists claim, among other things, that moral knowledge can be acquired in the same basic way that scientific knowledge is acquired. Recently in this journal Elizabeth Tropman has presented two arguments against this claim. In the present article, I attempt to show that the first argument attacks a straw man and the second mischaracterizes the Cornell realists' epistemology and ends up begging the question. I close by suggesting that, given Tropman's own apparent views, her objections are also (...) probably misplaced. (shrink)

Cornell realism (CR), a prominent meta-ethical position that has emerged since the last decades of the twentieth century, proposes a non-reductionist naturalistic account of moral properties and facts. This paper argues that the best version of CR’s chosen methodology for arriving at justified moral beliefs must be seen as a variant of reflective equilibrium. In comparison to the traditional versions, our proposal offers a ‘social’ reinterpretation of reflective equilibrium in delineating CR’s epistemology. We argue that it satisfactorily accounts (...) for objectivity and calls for the inclusion of the social nature of both moral and scientific inquiries. Emphasising the social dimension of their epistemological account also nudges debates in metaethics into incorporating the much-needed social dimension while dealing with questions of moral beliefs and facts that have been of CR’s concern. This thesis contains a critical discussion of two metaethical theories: expressivism, as developed in the works of Simon Blackburn, and Cornell realism, as presented by Richard Boyd and David Brink. In the introduction, a distinction is made between external and internal accommodation projects for moral discourse and it is argued that the external accommodation project should be guided by acceptance of methodological naturalism. Expressivism and Cornell realism are then subjected to an extended comparative evaluation, and an (...) answer is sought to the question of which of the two should be favoured. The main conclusion of the thesis is that Cornell realism is rationally preferable to expressivism. This conclusion is arrived at by looking at how well the two theories, respectively, explain various deeply embedded features of moral discourse. Explaining such features is what the internal accommodation project for moral discourse consists in. The assertoric surface-form of moral discourse and the supervenience of moral predicates on natural predicates receive special attention in the study. It is argued that expressivism and Cornell realism do equally well on the issue of moral supervenience. But whereas expressivism is still vulnerable to a particular argument from the philosophy of language, Cornell realism can fend off the criticism that most persistently has been directed at it from this area of philosophy. In a comparative evaluation involving the selected issues, Cornell realism therefore fares better than expressivism. (shrink)

If this is so, it would remove any special mystery that is supposed to attach to our knowledge of objective moral facts. After clarifying the ways in which moral knowledge is to be similar to scientific knowledge, I claim that the analogy fails, but for (...) little-noticed reasons. A preliminary conclusion of the article will be that this positive comparison to scientific knowledge hurts, rather than helps, the realist position. Yet, rather than spell trouble for moral realism altogether, I suggest that the apparent failure of Cornell realist moral epistemology points to a better way forward for moral realism. (shrink)

Richard Boyd and Nicholas Sturgeon develop distinctive naturalistic arguments for scientific realism and moral realism. Each defends a realist position by an inference to the best explanation. In this paper, I suggest that these arguments for realism should be reformulated, with the law of likelihood replacing inference to the best explanation. The resulting arguments for realism do not work.

This paper examines whether realists can explain co-reference without appealing to subjects’ ideal convergence in judgment. This question is particularly pressing in the normative domain, since deep disagreement about the applicability of normative predicates suggests that different speakers may not pick out the same property when they use normative terms. Normative realists, we believe, have not been sufficiently aware of the difficulties involved in providing a theory of reference-determination. Our aim in this paper is to clarify the nature of this (...) reference-fixing task and the challenges that arise for a non-convergentist normative realist. Our focal point will be Richard Boyd’s externalist account, which has been a model for non-convergentist theories of reference in metaethics. A close examination of Boyd’s account of reference and the ways it could be developed or supplemented, we’ll argue, suggests that explaining co-reference without convergence in the normative domain is a more challenging problem than many realists have supposed. There have been times in the history of ethical theory, especially in this century, when moral realism was down, but it was never out. The appeal of this doctrine for many moral philosophers is apparently so strong that there are always supporters in its corner who seek to resuscitate the view. The attraction is obvious: moral realism purports to provide a precious philosophical good, viz., objectivity and all that this involves, including right answers to (most) moral questions, and (...) the possibility of knowing those answers. In the last decade, moral realism has re-entered the philosophical ring in powerful-looking naturalistic form. ln this paper we provide a dialectical overview: we situate the new wave position itself, and also our objections to it, in the context of the evolving program of philosophical naturalism in 20th century analytic philosophy. We seek to show that although this new contender might initially look like championship material, it succumbs to punches surprisingly similar to those that knocked out the old-fashioned versions of naturalist moral realism. After all, the critique of objectivity and realism within progressive cultural criticism of the past several decades has taken for granted that claims to objectivity and realism are suspicious in part because of their pretense to value-neutrality. But Satya P. Mohanty’s ambitious and wide-ranging Literary Theory and the Claims of History joins with other recent attempts to lay claim to a refurbished realism that not only overcomes variously construed limitations of postmodernism but fully answers to the charges leveled against “traditional” objectivity or “naïve” realism [see Alcoff; Livingston]. Such a project can in part be analyzed against a broader critique of postmodernism and poststructuralism advanced through reconsideration of Enlightenment ideals, including, most prominently, the ideals of universalism and its less abstract cousin, cosmopolitanism [see Anderson]. The reconstructions of both universalism and realism have claimed a greater intellectual integrity and coherence than the forms of postmodernism that they challenge and a more promising ethico-political vision, one that more convincingly acknowledges the place and claims of marginalized others. These reconstructive projects thus fundamentally challenge the familiar postmodernist idea that claims to universalism or objectivity themselves enact forms of privilege or exclusion that inherently disable any properly egalitarian or nonviolent relation to others.Mohanty would appear to combine the universalist and realist ambitions, insofar as he asserts a moral position based on Kantian notions of autonomy and dignity at the same time that, in epistemological terms, he elaborates a “postpositivist realist alternative.” Maintaining that the critique of objectivity within postmodernism is propped up by an outdated understanding of scientific method and theory, he argues that the more sophisticated theories within current philosophy of science elaborate epistemological models that are fully compatible with a generalized hermeneutical method, precisely because they acknowledge both the theory-laden nature of all inquiry and the larger social and historical contexts of knowledge and experience. According to contemporary moral realism a moral property, like goodness or badness, is either a natural property or a non-natural property of actions or situations. Contemporary moral naturalists like Richard Boyd, Nicholas Sturgeon, and David Brink are a group of philosophers who are often referred to as Cornell realists because of their connection with Cornell University. Frank Jackson is another contemporary moral naturalist who is one of the leaders of The Canberra Planners at the Australian National University (...) with which he is connected. Jackson defends “the most extreme form of naturalism.” Jackson’s view is considered extremeby those who disagree with him because he believes that moral properties are reducible or identical to natural properties. This view of Jackson is opposed by contemporary non-naturalists like Jonathan Dancy, Derek Parfit, and Russ Shafer-Landau for reasons which in my view are not successful. Despite Jackson’s reductionism about the ethical, the Cornell realists, nevertheless, agree with him that moral properties are natural properties. (shrink)

The main aim of this thesis is to defend moral realism. In chapter 1, I argue that moral realism is best understood as the view that moral sentences have truth-value, there are moral properties that make some moral sentences true, and moral properties are not reducible to non- moral properties. Realism is contrasted with non-cognitivism, error-theory and reductionism, which, in brief, deny, and, respectively. In the introductory chapter, it is also argued that there are some prima facie (...) reasons to assume that non-cognitivism and error-theory are erroneous. In chapters 2 and 3, I suggest that the two main forms of reductionism, analytic and synthetic reductionism, are mistaken. In chapter 4, I argue that the considerations in the previous chapters in relation to non-cognitivism, error-theory and reductionism provide support to moral realism. It is also suggested that these considerations make it plausible to hypothesise that moral properties depend on non- moral properties in a way I refer to as ‘the realist formula’. The realist formula confirms moral realism since it implies that moral properties are not reducible to non- moral properties. In chapters 5, 6 and 7, I argue that moral realism, much owing to the realist formula, is able to explain significant meta-ethical issues regarding moral disagreement, moral reason and moral motivation. Among other things, externalism concerning moral motivation is defended. The explanatory value of moral realism in relation to these meta-ethical issues is taken to suggest that this view is preferable to non-cognitivism, error-theory and reductionism. Some of the meta-ethical issues discussed in these chapters, particularly moral disagreement and motivation, have been thought to provide support to non-cognitivism and error-theory. I maintain that since realism, unlike reductionism, is able to counter these arguments, it justifies us in upholding the view that moral sentences have truth-value and the view that there are moral properties. In chapter 8, various objections against realism with regard to the dependence of moral properties on non- moral properties are responded to. In chapter 9, I consider an influential argument to the effect that moral properties are not involved in causal explanations. I maintain that this argument fails and that it therefore is reasonable to assume that moral properties are natural properties. However, the discussions in chapters 8 and 9 also suggest that moral realism might face problems that cannot be thoroughly discussed in this thesis. (shrink)

The proofs of the existence of God in part 4 of Descartes’s Discourse on Method may yet surprise us. These arguments appear to be crafted with such ambiguity that their deeper import has rarely been suspected. This essay proposes that, in spite of the text’s conventional appearance, Descartes exposes the error of scholastic metaphysics, namely, that it mistakes the perfectibility of the human mind for a transcendent perfect being. Superficially, the thinker’s “idea of a more perfect being” serves to ground (...) the traditional theology; but surreptitiously, this idea refers to human possibility and supplies the metaphysical basis for scientific progress, freed from theology altogether. This ironic result is obtained not by speculating on Descartes’s irony directly, but by submitting the “idea of a more perfect being” itself to the Cartesian test of truth and falsehood. In that light, the text’s proofs of God reveal their skeptical, philanthropic intent. (shrink)

Cornell realists maintain that irreducible moral properties have earned a place in our ontology in virtue of the indispensable role they play in a variety of explanations. These explanations can be divided into two groups: those that employ thin ethical concepts and those that employ thick ethical concepts. Recent work on thick concepts suggests that they are not inherently evaluative in their meaning. If correct, this creates problems for the moral explanations of Cornell realists, since the most persuasive (...) moral explanations are those that employ thick concepts. If thick concepts are not inherently evaluative, then the most plausible explanations on offer cannot support Cornell realism. Moral explanations employing thin concepts, however, are too flimsy to support the view. Unless proponents can develop a compelling story about thick concepts or thin explanations, Cornell realism is in trouble. (shrink)

Deconstruction both by its friends and enemies has come to be associated with a set of cliches that completely misunderstands its ethical aspiration. It is particularly within the field of law that we can see the ethical force of deconstruction, and also illuminate its concrete and practical importance. In The Philosophy of the Limit Drucilla Cornell examines the relationship of deconstruction to questions of ethics, justice and legal interpretation. She argues that renaming deconstruction "the philosophy of the limit" will (...) allow us to be more precise about what deconstruction actually is philosophically and hence to articulate more clearly its significance for law. Cornell explores the ethical and juridical significance of the so-called postmodern rebellion against metaphysics. A shared ethical rebellion links philosophers as different as Theodor Adorno, Jacques Derrida, Jacques Lacan, and Emmanuel Levinas. Together they present a new ethical configuration, new in its difference from both the critical social theory of J$u$urgen Habermas and the analytic jurisprudence of Nagel and Rawls. A key aspect of this newness is the centrality given to the relationship between questions of ethics and sexual difference. Cornell argues that the appeal of Lacan's analysis to feminists is that it helps to explain the profound hold the gender hierarchy has over Western culture, including its theories of political transformation. Under a Lacanian analysis the law of gender identity will be replicated in the laws of an existing legal system. This means that we cannot hope to sustain legal reforms unless the gender hierarchy is challenged. Cornell examines Derrida's position on the significance of the gender hierarchy in philosophy and explores its ethical and political importance. Derrida's intervention against legal positivism has important implications for the legal reforms necessary to protect marginalized groups. His emphasis on the limit, she argues, is crucial to thosewhose well-being and very lives may depend on legal transformation, women and homosexuals, for example. In an important contribution to legal philosophy, Cornell explores the affinities of Derrida's writings with recent liberal analytic jurisprudence. She also explores the differences. Comparing Rawls's and Derrida's accounts of justice, she argues that Derrida gives greater attention to the necessary utopian moment in his insistence on maintaining the divide between law, established norms, and justice. Cornell's focus on the importance of the limit and the centrality of the gender hierarchy allows her to offer a view of jurisprudence different from both critical social theory and analytic jurisprudence. As we watch the long-fought-for civil rights of women systematically overturned, we have reason to think about how the connections she makes shed light on an underlying truth of our social, political, and legal reality. ABSTRACT The epistemological and methodological wars that bedevil social science often pit those who follow in the footsteps of natural science and those who favor a more holistic, interpretive approach. Into this war-torn landscape, Mark Bevir and Jason Blakley have dropped a plea for interpretive social science that will surely serve as a touchstone for years to come. However, their anti-naturalism is of the methodologically ecumenical kind, with the qualitative toolkit cohabiting with mass surveys, large-N statistics, and other quantitative methods (...) under well-specified conditions. This essay defends the possibility of preemptive forgiving, that is, forgiving before the offending action has taken place. This essay argues that our moral practices and emotions admit such a possibility, and it attempts to offer examples to illustrate this phenomenon. There are two main reasons why someone might doubt the possibility of preemptive forgiving. First, one might think that preemptive forgiving would amount to granting permission. Second, one might think that forgiving requires emotional content that is not available prior (...) to wrongdoing. If, however, preemptively forgiving is genuinely possible—as this essay hopes to illustrate—then this fact has implications for our understanding of both relational normativity and the nature of forgiveness.
