This paper situates the problem of defeaters in a larger debate about the source of normative authority. It argues in favour of a constructivist account of defeasibility, which appeals to the justificatory role of moral principles. The argument builds upon the critique of two recent attempts to deal with defeasibility: first, a particularist account, which disposes of moral principles on the ground that reasons are holistic; and second, a proceduralist view, which addresses the problem of defeaters by distinguishing between provisional (...) and strictly universal principles. The particularist view fails to establish that moral principles have no epistemological import, but it raises important questions about their role in practical reasoning. The proceduralist view fails to distinguish between reasoning by default and reasoning by principles, but it shows that moral principles have a structural justificatory role. The constructivist view recognizes that the moral valence of normative claims vary across contexts, but denies that this is because of holism about reasons. Rather, it defends defeasibility within a constructivist account of reasoning where universality serves as the matrix of judgment. The constructivist view vindicates the justificatory role of universal moral principles, and makes room for some ordinary sources of defeasibility. (shrink)

According to Carl Schmitt, the phenomenon of the political has different forms. These forms can be distinguished based on different possible relationships between political action and the state. This article presents the history of what Schmitt refers to as the phenomenon of partisanship. Partisanship is a specific form of politics, established in the early ninetieth century, which has gradually expanded its presence. Partisan activity is characterized by totality, which has evolved to become the dominant component of political action over time, (...) particularly in the twentieth century. This totality affects not only the size and range of political activity, but it is also – and perhaps first of all – ruthless in its use of terror and violence, which is considered entirely justified by total partisans/terrorists. The paper is devoted to the analysis of the evolution of the basic political figures of Carl Schmitt’s philosophical discourse from the 1920s to the early 1940s. It emphasized the importance of the transition from a statist perspective of an ordered, territorially closed state understood as the basic area of political implementation to a dynamic formation based on the category of Volk – the Great Space, which is devoid of defining characteristics in the form of territorial borders and stable legal (...) rules. The analysis of this process is based on the analogy between the Schmittian concept of the Grossraum formation and Klaus Theweleit’s concept of fascist subject – fundamentally indefinite, broken and boundless. It is the transition from the category of the closed state to the category of Volk as a concrete and dynamic essence of the political that not only inscribes Schmitt’s thought in the broadly understood fascist discourse, but also makes Schmitt’s concept of the international political entity structurally and essentially similar to the borderless and fluid fascist subject described by Theweleit. In the proposed interpretation, the concept of the Great Space, contrary to what Schmitt claims, is not an objective description of the processes taking place in the international relations of that time, but the postulate of a new, expansive, fascist nomos of the Earth. Rozšiřuje východiska teorie s pozorností k fenomenologické kritice moderní vědy na základě prohloubení distinkce mezi galileovskou vědou a konjekturální metodou. Studie obhajuje vědeckost historie na základě širší diskuse o východiscích teorie, v konfrontaci s Popperovou kritikou její prediktivní hodnoty. Článek argumentuje, že historie jako věda je možná pouze tehdy, je-li opuštěn teoretický univerzalismus.

The article analyzes the dependence of the phenomenon of education on the type of civilization in space of which the life of the world community takes place. It is based on the interaction of social institutions of the market, science and education. It “proceeds” on the surface by the division of social labor, which generates a specific form of social system of education in dependence on the social division of labor in specific socio-economic conditions. To reproduce effectively its structural and (...) functional parameters, the author suggests resorting to the paradigm of the «life cycle of educational systems in the context of a civilizational approach» based on the use of cognitive analysis. Its advantage is only that the concept «grasps» the phenomenon of education as a whole. This means that the phenomenon of civilization education is studied as a social institution and social system of the industrial society. To analyze the dynamics of knowledge change, two methodological conditions must be used: to apply the civilizational approach and the paradigm of the life cycle of social systems, since this phenomenon has a long-lasting dimension in space and time; the meaning of educational content at each stage of industrial civilization life is distinguished: natural knowledge prevailed at the stage of its origin; at the stage of growth - technical knowledge that corresponded to the essence of civilization itself; at the stage of maturity - scientific knowledge turned into ideologues of social development, which led to the emergence of technocratism and “drove” the planetary community into a dead end; at the stage of decline - technological knowledge led to the loss of mainstream guide of social development and began the catastrophic destruction of the social organism of the planet, which entails a change in the type of civilizational development; the solution is seen in the rise of the planetary community into the space of informational civilization, the transition of education to mastering methodological knowledge corresponds to it. What do we know about Hegel? What do we know about Marx? What do we know about democracy and totalitarianism? Communism and psychoanalysis? What do we know that isn't a platitude that we've heard a thousand times - or a self-satisfied certainty? Through his brilliant reading of Hegel, Slavoj Zizek - one of the most provocative and widely-read thinkers of our time - upends our traditional understanding, dynamites every cliché and undermines every conviction in order to clear the ground for (...) new ways of answering these questions. When Lacan described Hegel as the ‘most sublime hysteric’, he was referring to the way that the hysteric asks questions because he experiences his own desire as if it were the Other's desire. In the dialectical process, the question asked of the Other is resolved through a reflexive turn in which the question begins to function as its own answer. We had made Hegel into the theorist of abstraction and reaction, but by reading Hegel with Lacan, Zizek unveils a Hegel of the concrete and of revolution - his own, and the one to come. This early and dazzlingly original work by Zizek offers a unique insight into the ideas which have since become hallmarks of his mature thought. Objectives: To explore how subjects in a placebo-controlled vitamin A supplementation trial among Ghanaian women aged 15–45 years perceive the trial and whether they know that not all trial capsules are the same, and to identify factors associated with this knowledge.Methods: 60 semistructured interviews and 12 focus groups were conducted to explore subjects’ perceptions of the trial. Steps were taken to address areas of low comprehension, including retraining fieldworkers. 1971 trial subjects were randomly selected for a survey measuring their knowledge (...) that not all trial capsules are the same. The subjects’ fieldworkers were also interviewed about their characteristics and trial knowledge. Factors associated with knowledge were explored using multi-level modeling.Results: Although subjects knew they were taking part in research, most thought they were receiving an active and beneficial medication. Variables associated with knowledge were education and district of residence. Radio broadcasts benefited those with some schooling. Fieldworkers’ characteristics were not associated with subjects’ knowledge.Conclusions: Research and debate on new or improved consent procedures are urgently required, particularly for subjects with little education. The need for continuing provision of beneficial experimental interventions after research is concluded remains a controversial topic in bioethics for research. Based on the principle of beneficence, justice as reciprocity, concerns about exploitation and fair benefits, participants should be able to have continuing access to benefits beyond the research period. However, there is no consensus about whether or not post-trial provision of beneficial interventions should be mandatory for participants from developing countries. This paper summarises recommendations from international and national guidelines. (...) Ethical principles and practical issues relating to post-trial provision are also discussed. In conclusion, post-trial provision is not necessary in all situations and a set of criteria are proposed to identify the situations that beneficial interventions should be provided beyond the research period. However, mandatory post-trial supply of beneficial experimental interventions should be assured for those who still need and are able to benefit from them but have no alternative access. Mandatory provision is based on universal bioethical principles such as beneficence and justice. Furthermore, difficulties associated with implementation of post-trial provision are not unmanageable. Careful advanced planning and a comprehensive partnership among relevant parties would be very helpful in solving these difficulties in practice, which therefore should not be taken as an excuse to escape post-trial responsibility. Niniejszy tekst podejmuje kwestię bogów i bohaterów mitów greckich, odnosząc ją do obecnej w psychologii głębi koncepcji archetypów i nieświadomości zbiorowej. Główny cel badań sprowadza się tym samym do bacznego przyjrzenia się potencjalnej korelacji pomiędzy zewnętrznymi w rozumieniu starożytnego Greka postaciami bogów i bogiń, a wewnętrznymi przejawami nieświadomości zbiorowej, które mogą stanowić – według Carla Gustava Junga – istotę antycznych bóstw. Ponadto został poddany namysłowi problem wpływu „wewnętrznych bogów” na sposób myślenia, odczuwania i działania jednostki, wpływu zarówno pozytywnego, jak (...) i negatywnego. Článek se zabývá třemi fyzikálními teoriemi, jež popírají realitu času, konkrétně koncepcí Kurta Gödela, Juliana Barboura a Carla Rovelliho. Tvrzení, že čas neexistuje, totiž přesahuje rámec fyziky a nemalou měrou spadá také do oblasti filozofie, čímž zde otevírá prostor pro jeho filozofickou reflexi. Co tedy z hlediska filozofie znamená, že čas neexistuje? Je například možné, aby změna existovala bez času? Abych mohla odpovědět na zmíněné otázky, nejprve se zaměřím na samotný pojem existence. Dále představím jednotlivé autory a jejich koncepce, (...) které se pokusím kriticky zhodnotit, a na závěr upozorním na související epistemologické a ontologické problémy. (shrink)

The necessity of the study of mistakes of bilingual students in the use of nominal parts of speech is grounded in the article, it provides valuable material for scientific and methodological conclusions, as these mistakes reflect linguistic, psychological and pedagogical aspects that affect the ability of schoolchildren to learn peculiarities of using nominal parts of speech of Russian language. In this regard, ascertaining experiment with pupils of schools with native teaching language was held. Students were offered the tasks based on (...) formation of the four types of competence: language, linguistic, communicative and cultural. The results of the experiment made possible to reveal numerous mistakes in using nominal parts of speech in oral speech and in writing of students. These mistakes are a consequence of the complexity of semantic and grammatical nature of the names in the Russian language, of interfering influence of the native language and as well are explained by the imperfection of the content and methods of teaching nominal parts of speech at school. Thomas Hobbes of Malmesbury, one of the greatest philosophers of law and state, died 250 years ago, on December 4, 1679. His name was so frequently associated with a certain unfortunate conception of his moral and political philosophy, that the public's lack of interest in this centenary is not to be wondered at. So far, even amongst the scholars who admitted his merits, few tried to penetrate into the depths of his thought, and only at the end of the last (...) century, thanks to the writings of Ferdinand Tönnies and George Croom Robertson, was a new impulse given to research into Hobbes’ spiritual heritage. A series of monographies was published, and the personality of Hobbes appeared in a new light. His theories, when better known, proved to be less crude and more human than they had seemed, for they are a reaction from the revolutionary tendencies of his time. (shrink)

Split preorders are preordering relations on a domain whose composition is defined in a particular way by splitting the domain into two disjoint subsets. These relations and the associated composition arise in categorial proof theory in connection with coherence theorems. Here split preorders are represented isomorphically in the category whose arrows are binary relations and whose composition is defined in the usual way. This representation is related to a classical result of representation theory due to Richard Brauer.

Since their introduction as ‘no code’ in the 1980s and their later formalisation to ‘do not resuscitate’ orders, such directions to withhold potentially life-extending treatments have been accompanied by multiple ethical issues. The arguments for when and why to instigate such orders are explored, including a consideration of the concept of futility, allocation of healthcare resources, and reaching a balance between quality of life and quality of death. The merits and perils of discussing such decisions with patients and/or their relatives (...) are reviewed and the unintended implications of ‘do not attempt resuscitation’ orders are examined. Finally, the paper explores some alternative methods to approaching the resuscitation decision, and calls for empirical evaluation of such methods that may reduce the ethical dilemmas physicians currently face.
