In his classic paper, The Serpent Beguiled Me And I Did Eat, Gerald Dworkin makes the case that, without probable cause, the useof Proactive Law Enforcement Techniques (PALETs) is morally impermissible. Call this prohibition Dworkin’s Rule (DR). Here we argue that there are two reasonable exceptions to DR—the use of PALETs, without probable cause, is justifi ed when employed against High Level Government Officials (HLGOs) and High Level Business Officials (HLBOs). Moreover, these exceptions are consistent with Dworkin’s notion of Ideal (...) Criminal Sanctioning. Finally, if society were to endorse the use of PALETs on HLBOs, we might be able to dispose of the current bane of American business, the Sarbanes-Oxley Act of 2002, and let business get back to the business of business. By a fragment of a natural language we mean a subset of thatlanguage equipped with semantics which translate its sentences intosome formal system such as first-order logic. The familiar conceptsof satisfiability and entailment can be defined for anysuch fragment in a natural way. The question therefore arises, for anygiven fragment of a natural language, as to the computational complexityof determining satisfiability and entailment within that fragment. Wepresent a series of fragments of English for which the satisfiabilityproblem is polynomial, NP-complete, EXPTIME-complete,NEXPTIME-complete (...) and undecidable. Thus, this paper represents a casestudy in how to approach the problem of determining the logicalcomplexity of various natural language constructions. We extend the language of the classical syllogisms with the sentence-forms “At most 1 p is a q” and “More than 1 p is a q”. We show that the resulting logic does not admit a finite set of syllogism-like rules whose associated derivation relation is sound and complete, even when reductio ad absurdum is allowed.

By a fragment of a natural language, we understand a collection of sentences forming a naturally delineated subset of that language and equipped with a semantics commanding the general assent of its native speakers. By the semantic complexity of such a fragment, we understand the computational complexity of deciding whether any given set of sentences in that fragment represents a logically possible situation. In earlier papers by the first author, the semantic complexity of various fragments of English involving at most (...) transitive verbs was investigated. Wherever a government or state is concerned with the welfare of its citizens, there will probably also exist policies which compel the individual citizen to undertake or abstain from activities which affect that citizen alone. The set of theories behind such policies is collectively known as ‘paternalism’. It is not hard to understand why this term has developed strong pejorative overtones. Policies of this type appear to offend a fundamental tenet of liberal societies: namely, that the individual is best placed (...) to know what is in his or her interests. Paternalistic policies imply, and are concerned with correcting, failures of precisely this kind of judgement. And yet, at the same time, there is a popular consensus that compelling people to wear a seat belt when driving a car is a reasonable restriction of personal liberty. Paternalism may be difficult to accept in principle, but it is equally difficult to avoid in practice. Not surprisingly, the literature reveals a long heritage of debate in a wide range of academic disciplines. This debate reveals a failure to make progress in two areas in particular. First, analyses of paternalism often confuse policies which are actually concerned with correcting failures of market exchange — in particular, those concerned with insufficient or imperfect information — with those which are genuinely paternalistic. One objective of this paper will be to clarify the difference between these two kinds of policy. (shrink)

This paper reports an experimental investigation of presuppositions and scalar implicatures in language acquisition. Recent proposals posit the same mechanisms for generating both types of inferences, in contrast to the traditional view. We used a Covered Box picture selection task to compare the interpretations assigned by two groups of children and by adults, in response to sentences with presuppositions and ones with either ‘direct’ or ‘indirect’ scalar implicatures. The main finding was that the behavior of children and adults differed across (...) inference types. This asymmetry is consistent with the traditional perspective, but poses a challenge for the more recent uniform accounts. We discuss how the latter could be amended to account for these findings, and also relate the findings to previous results on presupposition processing. Finally, we discuss an unexpected difference found between direct and indirect scalar implicatures. (shrink)

Zusammenfassung Im internationalen Diskurs sind feministische Perspektiven auf die Medizinethik bereits etabliert. Demgegenüber scheinen diese bislang nur vereinzelt in den deutschsprachigen medizinethischen Diskurs eingebracht zu werden. In diesem Artikel untersuchen wir, welche feministischen Perspektiven im deutschsprachigen medizinethischen Diskurs vertreten sind, und schlagen weitere Ansätze für eine feministische Medizinethik vor. Zu diesem Zweck zeichnen wir mittels einer systematisierten Literaturrecherche feministische Perspektiven im deutschsprachigen medizinethischen Diskurs seit der Etablierung der Medizinethik als eigenständiger institutionalisierter Disziplin nach. Wir analysieren, welche Themen bereits innerhalb der (...) Medizinethik aus einer feministischen Perspektive untersucht worden sind, und identifizieren Leerstellen. Basierend auf der Literaturrecherche, unseren eigenen Vorarbeiten sowie der Zusammenarbeit in der Arbeitsgruppe in der Akademie für Ethik in der Medizin „Feministische Perspektiven in der Bio- und Medizinethik“ stellen wir drei Thesen vor, die aus unserer Sicht einer Weiterentwicklung des deutschsprachigen medizinethischen Diskurses dienen können. Die erste These bezieht sich auf die Ziele feministischer Medizinethiken und besagt, dass diese (epistemische) Gerechtigkeit anstreben. Die zweite These stellt zentrale Eigenschaften von feministischen Medizinethiken als kritisch und kontext-sensibel heraus. In der dritten These diskutieren wir Intersektionalität und Postkolonialismus als theoretische Ansätze, die zu einer epistemisch gerechten, kritischen und kontext-sensiblen Medizinethik beitragen können. Wir argumentieren, dass feministische Perspektiven grundständig verankert werden sollten. Ambivalence—where we experience two conflicting emotional responses to the same object, person or state of affairs—is sometimes thought to pose a problem for cognitive theories of emotion. Drawing on the ideas of the Stoic Chrysippus, I argue that a cognitivist can account for ambivalence without retreating from the view that emotions involve fully-fledged evaluative judgments. It is central to the account I offer that emotions involve two kinds of judgment: one about the object of emotion, and one about the subject's (...) response. (shrink)

Corroborating Testimony, Probability and Surprise’, Erik J. Olsson ascribes to L. Jonathan Cohen the claims that if two witnesses provide us with the same information, then the less probable the information is, the more confident we may be that the information is true (C), and the stronger the information is corroborated (C*). We question whether Cohen intends anything like claims (C) and (C*). Furthermore, he discusses the concurrence of witness reports within a context of independent witnesses, whereas the witnesses in (...) Olsson's model are not independent in the standard sense. We argue that there is much more than, in Olsson's words, ‘a grain of truth’ to claim (C), both on his own characterization as well as on Cohen's characterization of the witnesses. We present an analysis for independent witnesses in the contexts of decision-making under risk and decision-making under uncertainty and generalize the model for n witnesses. As to claim (C*), Olsson's argument is contingent on the choice of a particular measure of corroboration and is not robust in the face of alternative measures. In this paper I attempt to show how an appeal to a particular kind of collective obligation - a collective obligation falling on an unstructured collective consisting of the world’s population as a whole – can be used to undermine recently influential objections to the idea that there is a human right to health which have been put forward by Gopal Sreenivasan and Onora O’Neill. -/- I take this result to be significant both for its own sake and because it (...) helps to answer a challenge often put to Those who argue for the existence of collective obligations: namely, to explain why the question of whether there are any such obligations might matter from a practical point of view. One way of introducing the objection is to focus on questions of agency. Here I'll argue both that there can be obligations on groups that are not themselves collective agents, and that these can play an important explanatory and clarifcatory role in accounting for obligations which fall on individuals. I shall argue that advocates of denunciatory forms of expressivism can make a good case for restricting the range of measures that can be an appropriate form of punishment. They can do so by focusing not on the conditions of uptake of the message conveyed by punishment, but by the content of that message. For it is plausible that part of that message should be that the offender is a responsible agent and a member of the political community. Forms of (...) punishment which do not treat the offender as such are, for that reason unacceptable. Among the forms of punishment which are thereby ruled out are the extended use of solitary confinement, since this undermines the capacity for moral agency – and permanent felon disenfranchisement. -/- I also address two objections to this line of argument. One focuses on penal practices involving those who are not members of the political community: resident aliens and minors. These two cases raise different issues, but they both appear to show that justifiable punishment does not need to communicate a message which has components affirming agency and membership of a political community. I argue that in both cases the justifiability of punishment piggy-backs on the kind of justification available in the standard case. A second objection suggests that the offender has excluded themselves from the political community, and that measures that recognize this are therefore acceptable: I argue that very few offences, if any, have this character. ---. It indicates differing points of view concerning the nature of philosophy and what one might or might not expect from it. It tries to synthesise these points of view into a position that sees philosophy as continuous with that attitude of mind that was epitomised by Socrates, an attitude of mind which is directed to every aspect or dimension (...) of human life. The notion of the enquiring activist is borrowed to encapsulate this attitude as a valuable goal of ‘applied philosophy’. (shrink)

Abstract This short reply to criticism of an original paper demonstrates how the critics themselves reflect the limitations originally pointed to. Public dialogue in science is about form not content. Nervous officials, and sadly a few scientists themselves, feel that they need to be seen to consult on such matters with ordinary people. They are creating a new system of patronage in the process. An army of self?appointed communications experts also go so far as to suggest that this makes for (...) better science. This projects a narrow utilitarian or instrumentalist model whereby science should serve certain pre?determined social goals. This debases science, discrediting its institutions and accentuating the very problem they seek to solve. (shrink)

There is a long philosophical tradition of addressing questions in philosophy of science and epistemology by means of the tools of Bayesian probability theory (see Earman (1992) and Howson and Urbach (1993)). In the late '70s, an axiomatic approach to conditional independence was developed within a Bayesian framework. This approach in conjunction with developments in graph theory are the two pillars of the theory of Bayesian Networks, which is a theory of probabilistic reasoning in artificial intelligence. The theory has been (...) very successful over the last two decades and has found a wide array of applications ranging from medical diagnosis to safety systems for hazardous industries. Aside from some excellent work in the theory of causation (see Pearl (2000) and Spirtes et al. (2001)), philosophers have been sadly absent in reaping the fruits from these new developments in artificial intelligence. This is unfortunate, since there are some long-standing questions in philosophy of science and epistemology in which the route to progress has been blocked by a type of complexity that is precisely the type of complexity that Bayesian Networks are designed to deal with: questions in which there are multiple variables in play and the conditional independences between these variables can be clearly identified. Integrating Bayesian Networks into philosophical research leads to theoretical advances on long-standing questions in philosophy and has a potential for practical applications. (shrink)

This essay addresses the methodology of philosophy of science and illustrates how formal and empirical methods can be fruitfully combined. Special emphasis is given to the application of experimental methods to confirmation theory and to recent work on the conjunction fallacy, a key topic in the rationality debate arising from research in cognitive psychology. Several other issue can be studied in this way. In the concluding section, a brief outline is provided of three further examples.

This article examines ancient depictions of the death of Troilus in art and literature and challenges the widespread belief that the Iliad implies an alternative version of the myth in which Troilus dies in battle. In particular, it argues that the death-in-battle interpretation is both insufficiently supported by the internal evidence and incompatible with the external evidence. Given the evident popularity of the story of Achilles’ ambush of Troilus in the Archaic period, it is hard to avoid the conclusion that (...) the poet of the Iliad knew the story of Troilus’ death by ambush. That the poem's only reference to Troilus does not contradict this story, and possibly even alludes to it, should persuade critics of the strong likelihood that the popular story of Troilus’ ambush at the fountain was also the one in the poet's mind. Science presents us with a variety of accounts of the world. While some of these accounts posit deep theoretical structure and fundamental entities, others do not. But which of these approaches is the right one? How should science conceptualize the world? And what is the relation between the various accounts? Opinions on these issues diverge wildly in philosophy of science. At one extreme are reductionists who argue that higher-level theories should, in principle, be incorporated in, or eliminated by, the basic-level (...) theory. According to this view, higher-level theories do not ultimately exhibit conceptual integrity or provide genuine explanations. At the other extreme are pluralists who take higher levels of description and explanation seriously and argue for their independence and indispensability. It was the aim of the first Sydney–Tilburg conference on “Reduction and the Special Sciences”, which took place at the Tilburg Center for Logic and Philosophy of Science (TiLPS) in Tilburg, The Netherlands, over the 10–12th April 2008, to bring researchers working on these questions together and provide a platform to discuss them in a focused way. The papers in this special issue were presented at this conference. We would like to thank the Royal Netherlands Academy of Art and Sciences (KNAW), the Sydney Centre for the Foundations of Science at the University of Sydney and TiLPS for financial and institutional support. We develop a probabilistic criterion for belief expansion that is sensitive to the degree of contextual fit of the new information to our belief set as well as to the reliability of our information source. We contrast our approach with the success postulate in AGM-style belief revision and show how the idealizations in our approach can be relaxed by invoking Bayesian-Network models.

A federal assembly consists of a number of representatives for each of the nations (states, Länder, cantons,...) that make up the federation. How many representatives should each nation receive? What makes this issue worth quibbling about is that the model of representation that is instituted will have an impact on the welfare distribution over the nations in the federation that will ensue over due course. We will investigate what models of representation yield welfare distributions that score higher on a utilitarian (...) measure. First, we construct a continuum of models of representation ranging from equal to proportional representation. In between these extremes are models of degressive proportionality. We run a Monte-Carlo simulation in which a large number of motions are voted up or down within different contexts of evaluation and investigate how well the resulting welfare distributions score on the utilitarian measure. Subsequently, we will provide matching analytical results for a slightly idealized case. We conclude with a discussion of the significance of our results and of the role of simulations and analytical results and point to further work. (shrink)

The vicissitudes of the concept of original choice illustrate the change, and yet the continuity, of Sartre's existentialist thought as he gradually changed the focus of his attentions from psychological to sociological aspects of "the human condition." The relationship of the doctrine to Sartre's own "existential psychoanalysis" is described. The point at which Sartre explicitly repudiated the earlier doctrine of original choice and the general characteristics of his revised doctrine are explicated. In general, Sartre's current position is that the goal- (...) directed structure of human endeavor is a freely-created variation upon the conditioning imposed by society, aiming at liberation from such external determinism. Sartre continues to reject the notion of a causal determinism, psychological or social, which makes the person a product—a "thing"—and which reduces human freedom to the status of illusion. (shrink)

Chr., der traditionelle biographische, hagiographische und philosophische Themen und Motive mit aktuellen zeitgenossischen Diskursen der Spatantike amalgamiert. Das langjahrige Oberhaupt der Neuplatoniker in Athen, der Philosoph Proklos, wird als Leitfigur und paganer Heiliger in einer zunehmend christianisierten Gesellschaft inszeniert. Marinos illustriert anhand seiner Proklos-Figur die Tugenden und Ideale der neuplatonischen Philosophen und schildert dabei programmatisch die (neu-)platonische (...) Ethik und Gluckskonzeption. Abstract:The dominant interpretation of Zeus' words at Iliad 20.21, which regards μέλουσί μοι ὀλλύμενοί περ as an expression of sympathy for dying warriors, poses a number of serious contextual and lexical problems. This article argues that Il. 20.21 is not an expression of compassion, but attention. Zeus is not concerned for dying warriors, but attentive to them, as indeed his deadly βουλή (Il. 20.20) requires him to be. The interpretation of Il. 20.21 has relevance to questions of great significance for (...) the interpretation of the Iliad, including Zeus' relationship to humans and the meaning of the Διὸς βουλή.
