El Contextualismo ofrece una novedosa forma de acercamiento a la obra arquitectónica, dado que la pone en relación íntima con el "habitar" humano. Ello le exige al intérprete poner de presente no sólo la contingencia e historicidad de la obra, sino también las relaciones que ésta establece con el entorno. Para mostrar la peculiaridad de esta propuesta -que se vale de tipologías visuales y táctiles-, la autora la compara, en primer lugar, con aquellos métodos que se valen solamente de parámetros (...) formales o preestablecidos. En segundo lugar, reconoce como punto de partida de su trabajo el aporte de Henri Bergson, quien al ser un exponente del pensamiento contextual, ofrece, no sólo un análisis de la imagen como elemento que posibilita nuevas aperturas y modificaciones de sentido, sino además, múltiples caminos para la interpretación. Por último, la autora analiza dos obras del arquitecto Osear Niemeyer, en las cuales se percibe de manera más concreta el sentido de esta propuesta. (shrink)

In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. Since 2002, legislation in Spain has allowed for the creation and documentation of end-of-life decisionmaking. Over the intervening years, the actual implementation of such documents is very low. Through extensive analysis of the literature, this article explores the current status of the use of and attitudes toward advance directives in Spain and then proposes strategies for improvement in their implementation.

Psychological flexibility is a key concept of acceptation and commitment therapy. This factor has been linked with psychological wellbeing and associated factors, such as quality of life, in cancer patients. These and other positive results of acceptation and commitment therapy in cancer patients found in previous research could be enhanced by using mhealth tools. A three-arm randomized superiority clinical trial, with a pre-post-follow-up repeated measures intergroup design with a 1:1:1 allocation ratio is proposed. A hundred and twenty cancer patients will (...) be randomly assigned to one of the following interventions: face-to-face ACT + mobile application, face-to-face ACT, and Waitlist control group. The primary expected outcome is to observe significant improvements in psychological flexibility acceptance and action questionnaire- II in the face-to-face ACT + app group, after comparing baseline and post-treatment scores, and the scores will remain stable in the two assessment points, 3 and 6 months after the intervention. Secondary expected outcomes are significant increasing scores in quality of life and post-traumatic-growth, and significant decreasing scores in anxiety and depression, insomnia and fatigue at the same assessment points. Also, it is expected that the scores of this group will be higher than the scores of the face-to-face ACT group and the waitlist control group. This study aims to assess the efficacy of a combined intervention for psychological flexibility and associated symptoms in cancer patients. The results of this protocol may help to consider the use of acceptation and commitment therapy and mhealth applications in cancer settings as a valid therapeutic choice.Clinical Trial Registration[www.ClinicalTrials.gov], identifier [NCT05126823]. Over the past few decades, scholars have conducted research (...) that increasingly explores children’s involvement with music in contexts outside of formal learning settings, utilizing methods and models from ethnomusicology, sociology, social psychology, and/or cultural psychology. Nine individually authored chapters in the volume, Children’s Home Musical Experiences Across the World, edited by Beatriz Ilari and Susan Young, convey results, applications, and extensions of one such project that reaches beyond the conventional ethnographic music education study.The bulk of this collection contains findings and interpretations from a collaborative project called MyPlace, MyMusic, followed by several additional chapters that provide descriptions and narratives from subsequent related projects. The original project included fourteen scholars from the International Society of Music Education-Early Childhood Commission, who conducted in-home observations and interviews with parents and children in order to examine the nature of, influences on, and meaning of musical activities that took place in the homes of middle-class seven-year-olds in diverse locations, including Brazil, Denmark, [End Page 105] Greece, Israel, Kenya, the Netherlands, Singapore, Spain, South Africa, Taiwan, the U.K., and the United States.Importantly, the project’s designers attempted to avoid complications of transcultural developments by asking each researcher to select children whose families had not recently migrated to their country/locality. The seventeen participating children from twelve countries were also of the same ethnicity and lived in the same “locality” as each researcher in order to ease communication during in-home observations and interviews. Results shed light on issues of children’s family life, schooling, identity, gender, and social class.This project presents a unique contribution to the field of music education in a number of ways. First, most previous studies of music in the homes of children have centered around preschoolers, toddlers, and infants, whereas the present project focuses on seven-year-old children, whose age places them on the cusp of crossing from early to middle childhood. Second, most previous music education researchers have considered issues of social class, ethnicity, and race as independent variables, but the methodology for this project calls for observation and description of each child in his or her home first, followed by comparison of the “cases” to each other. Third, the researchers utilize a Wiki platform to share and collaboratively interpret data collected from home lives of children (photographs, video and audio recordings, texts, and pdf files) among researchers from different countries.The volume is organized into three major sections. Susan Young and Jèssica Pérez-Moreno set the scene in the first two chapters by describing the theoretical underpinnings and methodology for the MyPlace, MyMusic project. Ela propõe que a vítima seja trazida para o centro da discussão e questiona até mesmo a ideia de que a ignorância moral do agente impede a atribuição de culpa em alguns casos. Esse desafio à condição epistêmica pode dar origem a objeções. Por isso, proponho explicar por que essa condição não é importante se levarmos a proposta de Ciurria (...) a sério, e como a influência dos esquemas de gênero na sensação de agência ajuda a mostrar isso. The role of consciousness in the production of actions has received much attention from philosophy and neuroscience. Wegner claims that what he calls the conscious will plays no role in the causal production of human actions, and that it is just an illusion. I will argue that Wegner’s claim is mistaken, because his defense of the alleged illusion rests on how he conceives of what the Readiness Potential represents in a key experiment—Libet’s experiment—and this conception is mistaken. Therefore, Wegner has (...) not offered a convincing reason to believe that humans are deluded about the way they produce their actions. (shrink)

O papel da vontade consciente na produção de ações tem recebido bastante atenção tanto da filosofia como da neurociência. Wegner afirma que o que ele chama de vontade consciente não desempenha nenhum papel na produção causal das ações humanas, e que a mesma é apenas uma ilusão. Será argumentado no presente artigo que a afirmação de Wegner está equivocada, porque a sua defesa da suposta ilusão está fundamentada em como ele concebe o que o Potencial de Prontidão representa em um (...) experimento crucial – o experimento de Libet – e essa concepção está errada. Portanto, Wegner não oferece uma razão convincente para se crer que os seres humanos estão iludidos a respeito de como produzem suas ações. (shrink)

Functional language is ubiquitous in ecology, mainly in the researches about biodiversity and ecosystem function. However, it has not been adequately investigated by ecologists or philosophers of ecology. In the contemporary philosophy of ecology we can recognize a kind of implicit consensus about this issue: while the etiological approaches cannot offer a good concept of function in ecology, Cummins’ systemic approach can. Here we propose to go beyond this implicit consensus, because we think these approaches are not adequate for ecology. (...) We argue that a sound epistemological framework to function in ecology is to be found in organizational approaches. In this line, we define function in ecology as a precise effect of a given constraint on the ecosystem flow of matter and energy performed by a given item of biodiversity, within a closure of constraints. Western society today is less unified by a set of core values than ever before. Undoubtedly, the concept of moral consensus is a difficult one in a liberal, democratic and pluralistic society. But it is imperative to avoid a rigid majoritarianism where sensitive personal values are at stake, as in bioethics. Bioethics has become an influential part of public and professional discussions of health care. It has helped frame issues of moral values and medicine as part of a more general (...) effort to find consensus about some of the most perplexing questions of our time. But why is it thought that a moral consensus is important or that it deserves respect? How does moral consensus acquire legitimacy in a society that includes diverse value systems? How is moral consensus possible and how do small groups help create or distort consensus processes? Written by a medical school professor trained in philosophy, this timely work tackles these questions from philosophical, historical, and social scientific standpoints. It begins by describing the traditional ambivalence about consensus in Western culture as well as the uncertain relationship in modernity between consensus and expertise. After outlining the current bioethical consensus, the book gives philosophical and political analyses of the idea of consensus, then assesses the role of consensus in national ethics commissions and in the ethics committee movement. Moreno constructs an original, naturalistic philosophy of moral consensus, referred to as "bioethical naturalism", and then applies sociology and social psychology to actual consensus processes. The book concludes with an account of bioethics as a consensus-oriented social reform movement. This insightful volume will be essential reading for bioethicists, philosophers, physicians, members of ethics committees, and all those concerned with ethical and social issues in health care. Moral judgments can occur either in settings that call for impartiality or in settings that allow for partiality. How effective are impartiality settings such as hospitals in suppressing personal biases? Portrayed as decision-makers in an emergency department, 431 college students made judgments on which of two victims of a mass shooting should receive immediate, life-saving care. Patients differed in ways that could reveal biases, e.g., age, kinship, gender, and villain/hero. Participants rated each patient’s moral deservingness to receive immediate care and (...) the likelihood they would choose the patient. Both scales showed young favored over old, cousin over stranger, and policeman over shooter. In a hospital-room scenario with high risk of injury from falling, age bias disappeared. With moderate fall risk, age bias reversed and kinship deservingness bias disappeared. Bias decreases when there is a decrease in severity of potential harm to the preferred stakeholder. Settings that call for impartiality are not reliable “boundary conditions” against expressions of bias. In the absence of explicit guidelines for allocating scarce resources, a systematic, objective method of random selection offers a potentially useful strategy. (shrink)

El contexto de crisis y restricciones presupuestarias sirve de pretexto para promover en la Comunidad de Madrid la implantación de un modelo dual de gestión de los centros y servicios sanitarios, ampliamente contestado en la calle por profesionales sanitarios, asociaciones, pacientes y usuarios. Este proceso se inicia sin evidencia científico-técnica que avale las presuntas ventajas del modelo de concesión y carece de una evaluación solvente de impacto sanitario, conforme a estándares de transparencia, rendición de cuentas y calidad democrática. Entre los (...) aspectos éticos y jurídicos involucrados en este debate analizo los relacionados con el conflicto de intereses y las evidencias recientes que desaconsejan adoptar en España modelos similares. Tras analizar el desafío que supone el nuevo marco institucional para el ejercicio de la responsabilidad profesional conforme a criterios de equidad y buenas prácticas, se concluye aportando elementos para generar un marco más equilibrado de reformas. Los autores conversan sobre la distinta relación que tienen con la filosofía las lenguas española y francesa, encontrando la explicación de esa diferencia principalmente en los “espíritus” que nos separan, no obstante nuestra considerable cercanía lingüística. Mientras que la Reforma y la Contrarreforma exigieron de Francia un “humanismo del saber objetivo, del individuo y del progreso”, la cultura española dio de sí “un paradójico humanismo de la fe, de la expansión y de los juegos de la apariencia”. El “espíritu de (...) la filosofía” (Descartes, el ancestro de Hegel) se desarrolló en el norte de Europa, y en la Europa mediterránea floreció más bien “el espíritu de la ficción” (el Cervantes de Unamuno, de Ortega, de Borges y de Kundera). La inquietud de un mundo que bien podría no ser sino sueño, o incluso locura –de la que terminará por resurgir, al lado del cervantino y del calderoniano, el cogito cartesiano–, es sin embargo una inquietud española en primer lugar, y eso es algo que amerita ser estudiado, y sobre todo pensado. Una clave muy importante para dicho estudio es la constatación, subrayada por Nancy en respuesta al problema de la calificación de nuestra filosofía como “mera literatura”, de la “pérdida de confianza en las aventuras del sentido” que ha caracterizado a la Modernidad (o al Occidente en su versión nórdica, ese “espíritu de la filosofía alemana” que tras el efecto del nazismo se mudó a Francia y a Estados Unidos). Ahí donde Unamuno señalaba la necesidad, antes que de europeizar a España, de “españolizar a Europa”, Jean-Luc Nancy reconoce que Occidente necesita atreverse, una vez más, a abrirse a la aventura, y al riesgo del pensamiento. In the 1960s, the growing strategic importance of ocean exploration led the French government to develop greater capacity in marine scientific research, aiming to promote cooperative and diplomatic relations with the leading states in ocean exploration. Devised during Charles de Gaulle's government (1958–1969), the restructuring of French oceanography culminated, in 1967, in the establishment of the state‐led Centre National pour l'Exploitation des Océans (CNEXO). Beyond being intended to control the orientation of marine research at a national level, the CNEXO's mission (...) was to use scientific diplomacy to balance a desire for enhancing international cooperative relations in oceanography with French ambitions to equal the USA's leading capacity to explore the oceans. Its director, the naval officer Yves la Prairie, played a crucial role in articulating scientific, national, and diplomatic interests for France in the oceans. (shrink)

This chapter examines Bunge’s distinction between the logical concept of existence and the ontological one. We introduce a new conceptual existence predicate in an intensional environment that depends on the evaluation world. So that we can investigate restricted areas where the different kinds of concepts might exist. We hope this new predicate would encompass Bunge’s philosophical position which he designates as conceptualist and fictional materialism. The basic hybridization acts as a bridge between intensions and extensions because @ works as a (...) useful rigidifier. In hybrid logic, the accessibility relation and many properties this relation might have can be easily expressed in the formal language. The initial hypothesis is that hybridization and intensionality can serve as unifying tools in the areas involved in this research; namely, Logic, Philosophy of Science and Linguistics. (shrink)

El presente texto se preguntará por el modo en que Marx introduce el deseo en el estudio de la producción según Deleuze y Guattari. Partiendo de la segunda nota al pie de El Capital y sus implicaciones entre deseo y necesidad, emprenderemos una relectura del primer capítulo de esta obra en la que buscaremos dar cuenta de las formas de reconocimiento (en tanto que deseo del deseo del otro) que se establecen en la producción capitalista. Posteriormente, en la segunda parte, (...) nos trasladaremos al tercer capítulo de El anti-Edipo. El objetivo será mostrar las distintas relaciones entre reconocimiento y producción que podemos encontrar en las tres formas de socius que allí establecen Deleuze y Guattari. Con ello trataremos de ampliar las conclusiones establecidas en la primera parte de nuestra exposición con el fin de conducir la problemática hacia las formas en las que el deseo mismo (y con ello el reconocimiento) se produce en el socius capitalista para ver la relación que mantiene con lo expuesto en el primer apartado. Most of current theoretical analyses on biological functions can be classified as etiological or dispositional, depending on how they deal with the teleological dimension. In this paper, we propose a critical survey of these two perspectives, and we argue that some recent studies have set the basis of a new approach which grounds the teleological dimension of functional attributions in the organizational properties of living systems. Después de varias décadas de discusiones, críticas y revisiones, muchos autores han cuestionado hoy la vigencia de los planteamientos del constructivismo científico. Este texto muestra que sus principales planteamientos y legados siguen vigentes, aunque se han transformado en varias perspectivas que afirman la contingencia de la ciencia y la tecnología, en un sentido compatible con algunos puntos de vista realistas, y en las que se valora la acción conjunta, la co-construcción o el ensamble mutuo entre varios elementos y factores heterogéneos. (...) De esta manera, sigue siendo una de las principales perspectivas epistemológicas y metafísicas en las ciencias sociales y naturales. Las transformaciones que se han producido en relación con el constructivismo tienen que ver fundamentalmente con algunos cambios en la forma de entender la construcción: se han colocado límites a las intenciones políticas críticas, deconstructivas de la construcción, y al sentido monista, y sustancialista social; y se ha producido un giro ontológico hacia un sentido plural, relacional, y positivo de construcción. En este texto se hace una detallada revisión crítica del origen, el sentido, los aportes, los malentendidos y los problemas del constructivismo científico tecnológico, con el propósito de analizar su evolución, o la manera cómo ha devenido y se ha transformado en otros puntos punto de vista, como lo sugiere el título. Este artículo es una primera revisión histórica del desarrollo académico de la Filosofía de la Ciencia en Colombia, y pretende servir de base para otros posibles análisis más amplios sobre esta área flosófca en el país. Muestra que el desarrollo académico regular de esta área se propició fundamentalmente a partir de la década de los años setenta, y que su normalización se ha comenzado a consolidar a partir de la década de los años noventa, en las principales universidades del país. En general, la historia académica de esta área en Colombia es joven, se ha concentrado especialmente en la divulgación y en el trabajo interpretativo, y se encuentra actualmente en un proceso de consolidación, que se puede fortalecer si se logran articular y ampliar muchos de los esfuerzos que se vienen realizando en los últimos años. Desde una perspectiva transnacional y comparada, que incorpora la experiencia del exilio, este trabajo analiza las tensiones identitarias que afectaron a la juventud militante de la izquierda revolucionaria española y argentina durante los años setenta. A través de las relaciones familiares y de género, estudia las formas públicas y privadas del compromiso y la transgresión. Aborda cómo la politización de lo privado marcó a hombres y mujeres dentro de un proceso global contestatario, heredero del 68, para destacar las contradicciones que (...) afloraron entre la teoría y la práctica, el deseo y la realidad, que llevaron a los jóvenes militantes a asumir un régimen emocional en constante debate entre el ser y el deber ser. This book deals with the main promoters of the causal and descriptivist reference theories on natural kind terms. It alleges that the ostensive reference fixing and reference borrowing theories should be descriptive-causal and adduces that the relation of kind-identity depends on the views on kind-identity and thus involves descriptive elements.

Tarski's theory of truth brings out the question of whether he intended his theory to be a correspondence theory of truth and whether, whatever his intentions, his theory is, in fact, a correspondence theory. The aim of this paper is to answer both questions. The answer to the first question depends on Tarski's relevant assertions on semantics and his conception of truth. In order to answer the second question Popper's and Davidson's interpretations of Tarski's truth theory are examined; to this (...) end both Tarski's definition of truth in terms of satisfaction and the T-sentences are taken into account. Esta obra colectiva expone diversas concepciones teóricas, ontológicas, epistemológicas, axiológicas y prácticas sobre el origen, sentido, problemáticas, ventajas, detrimentos, alternativas y desafías de la filosofía de la innovación y su incidencia en la educación; reflexiona sobre las contribuciones de la tecnología y responde a interrogantes como: ¿Cuáles son los aporte de la tradición filosófica, del pensamiento ilustrado, de la postmodernidad y de la teoría crítica para la filosofía de la innovación educativa?; ¿Cuál es la función de la filosofía para la (...) comprensión de la innovación?; ¿Cómo se explica el progreso tecno-científico desde la epistemología contemporánea?; ¿Cuál es el componente pedagógico de la innovación?; ¿Cuáles son las aportaciones del Laudato Si para la innovación educativa?. Además, plantea la necesidad de repensar algunos aspectos relacionados con la educación, el Estado y la identidad latinoamericana para determinar las posibilidades, las limitaciones y los retos de la innovación, entendida como un fenómeno en permanente construcción. Este tomo se encuentra conformado por ocho capítulos en los que los autores formulan un conjunto de contribuciones para la generación de nuevas investigaciones. Además, evidencia a la innovación como un procesos que exige reformulaciones. La innovación sigue siendo una de las tareas pendientes de la filosofía. (shrink)

El objetivo de este proyecto es implementar una metodología de aprendizaje cooperativo en el entorno universitario con una estrategia de gamificación que promueva cambios conductuales en los estudiantes. La herramienta de estímulo es una innovada práctica de doble corrección que incorpora el concepto de diversión. A los datos obtenidos se les aplicó el estadístico Chi-cuadrado. Además, se realizó a los estudiantes un cuestionario, sobre las competencias adquiridas, al que se aplicó el test U de Mann Whitney. Tras el análisis de (...) los datos resultantes se corrobora que la estrategia implementada mejora las habilidades interpersonales y el rendimiento académico. (shrink)

En contraste d’avec la pensée de Spinoza, pour qui la foi n’est qu’un phénomène extérieur et étrange, une notable exception à sa théorie du salut par le control des passions et l’amour intellectuelle à Dieu et par Dieu que l’homme de connaissance peut atteindre seulement grâce à la véritable philosophie, on analyse ici très brièvement la compréhension que de la foi nous proposent, en ayant l’expérience intérieure, surtout Descartes mais aussi Pascal. Pour le premier la foi relève de la volonté, (...) à qui la grâce incline d’embrasser le message révélé à peu près comme la perception claire et distincte incline au jugement dans l’acte deconnaissance. Pour Pascal la foi et la connaissance sont de l’ordre, toutes deux, du coeur, qui comme on sait a des raisons que la raison ne connait pas. (shrink)

Si a cierta doxa filosófico-ideológica en plena promoción le parece válido el caracterizar a todo Occidente como a esa civilización racionalista que arraiga en la revolución científica, filosófica y aun política que Descartes emblematizaría mejor que nadie, por poco que profundicemos en el análisis ..

Si lo mismo piensa el centro que la periferia, acaso el centro mismo sea mejor conocido desde el arrabal —que va hasta él y vuelve a sí mismo, y los conoce a ambos— que la periferia desde esos grandes centros cada vez más provincianos que de ella —que desde un punto de vista superior también es centro, pues el centro está en ninguna, y en todas partes— no ven ya sino sus propias, y las más de las veces no poco (...) narcisistas construcciones. Y es que el centro no alcanza su más profunda y auténtica centralidad sino cuando cobra consciencia de su condición periférica, lo mismo que la periferia no se alcanza a sí misma sino en la medida en la que se sabe, a pesar de su condición de periferia, un verdadero centro. Unos y otros, aquí y allá, debemos aprender a ver en el otro a nuestro semejante, de verdad, y en éste a un ser cuya mirada es capaz de encontrarse en la nuestra, y no a ese espejo duro e impenetrable que no hace más que devolvernos el complejo —de superioridad o de inferioridad, lo mismo da— que acaso tengamos con respecto a nosotros mismos. Most of current theoretical analyses on biological functions can be classified as etiological or dispositional, depending on how they deal with the teleological dimension. In this paper, we propose a critical survey of these two perspectives, and we argue that some recent studies have set the basis of a new approach which grounds the teleological dimension of functional attributions in the organizational properties of living systems. We outline a new proposal within this new approach, based on an interpretation of living (...) systems as organized self-maintaining systems. (shrink)

Moreno (bio)The spring and summer of 1998 were seasons in the sun for institutional review board (IRB) aficionados. Rarely have the arcana of the local human subjects review panels been treated to so much attention in both the executive and the legislative branches of government, not only at the federal but also at the state level. And it looks as if the attention (...) will continue for some time. The spate of interest is due to a series of coincidences: a powerful House of Representatives subcommittee held hearings after its chairman learned about the IRB system during a previous session on research in underdeveloped communities; the Department of Health and Human Services’s Inspector General (DHHS-IG) released a report on IRBs; the National Institutes of Health (NIH) Office of Extramural Research completed a report on clinical trial monitoring; the National Bioethics Advisory Commission (NBAC) readied a report on research involving persons with mental disorders; the states of Maryland and New York completed studies of research with subjects who lack decision-making capacity; and advocacy groups protested a psychiatric research project involving inner city children.Underlying these proximate causes for the IRB blitz is a growing realization that the already considerable clinical trial enterprise will expand significantly over the next few years. Congress is talking about giving the politically popular NIH half again the budget it currently receives, which in turn will stimulate more commercially supported research. The director of the National Cancer Institute is considering a five-fold increase in the number of subjects enrolled in oncology studies over the next several years. Phase I cancer studies are among the most ethically sensitive, so IRBs will have more work cut out for them if this goal is reached. Adding to the rush of interest in IRBs are the government’s recent apology to the survivors of the syphilis study in Tuskegee, continuing congressional dissatisfaction with the way the Pentagon handled its vaccine distribution during the Gulf War, and the controversy about AZT trials in developing countries.On the HillCongressman Christopher Shays, the moderate Connecticut Republican who has developed an interest in human research issues, convened hearings on human [End Page 329] subjects research and the IRB system on 11 June 1998. Shays chairs the House Government Reform/Human Resources Subcommittee. The committee’s ranking minority member is Edolphus Towns of Brooklyn, NY, who shares Shays’s interest in this area.The immediate rationale for the hearings was the release that day of the DHHS-IG report, Institutional Review Boards: A Time for Reform. The subtitle was changed from A System in Jeopardy apparently after some people in DHHS expressed reservations about its seemingly alarmist tone, but the IG staffers who testified before Shays’s subcommittee insisted that they stood behind the message that the IRB system is in trouble if considerable reforms are not undertaken. Among the factors in the research environment cited as support for the bleak forecast: managed care, commercialization, multi-site trials, high IRB workloads, minimal IRB oversight of approved studies, conflicts of interest, insufficient training of IRB members and investigators, and lack of IRB self-studies (DHHS-IG 1998).As is normally the case for congressional oversight hearings, the first panel of witnesses consisted of executive branch officials, including Eric Meslin, Executive Director of the National Bioethics Advisory Commission, and Gary Ellis, Director of the Office for Protection from Research Risks (OPRR). Shays pressed Ellis on the extent to which OPRR conducts on-site investigations of complaints about abuse of human subjects. Admitting that on-site investigations are rare, Ellis suggested that the agency is inadequately staffed to follow up on complaints as quickly as it might wish. The members of Congress who were present at the hearings generally expressed concern about the DHHS-IG’s findings.The second panel that day, which Shays was unable to attend, set a different tone.
