In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. Since 2002, legislation in Spain has allowed for the creation and documentation of end-of-life decisionmaking. Over the intervening years, the actual implementation of such documents is very low. Through extensive analysis of the literature, this article explores the current status of the use of and attitudes toward advance directives in Spain and then proposes strategies for improvement in their implementation.

Background In Spain, there has been great effort by lawmakers to put Advance Directives into practice since 2002. At the same time, the field of bioethics has been on the rise, a discipline that has spurred debate on the right of patients to exercise their autonomy. Despite all this, the implementation of ADs can be said to have failed in Spain, because its prevalence is very low, there is a great lack of knowledge about them and they have very little (...) impact on clinical decisions. The purpose of this article is to analyze and discuss the main reasons for the failure of ADs in Spain. Main body The main reasons why ADs have no impact on clinical practice in Spain have been fundamentally four: the training of health professionals about the end of life and AD is lacking; there has been no public process to increase awareness about AD, and therefore people know little about them; the bureaucratic procedure to document and implement ADs is excessively complex and cumbersome, creating a significant barrier to their application; in Spain, the remnants of a paternalistic medical culture continue to exist, which causes shared decision-making to be difficult. Conclusion Due to the four reasons mentioned above, AD have not been a useful tool to help honor patients’ autonomous decisions about their future care and, therefore, they have not achieved their objective. However, despite the difficulties and problems identified, it has also been observed that health care professionals and the Spanish public have a very positive view of AD. Having identified the problems which have kept AD from being successful, strategies must be developed to help improve their implementation into the future. (shrink)

We present the dossier “Studies of Childhood: movements, limits and frontiers”, a theme discussed in the III Brazilian Congress Childhood Studies (CEI). The Congress was organized by members of the Department of Childhood Studies (DEDI) and the Graduate Program in Education (ProPEd) of the State University of Rio de Janeiro. The articles that compose the dossier review the debates that took place during the event in the fields of education, international relations, and ethno-racial issues. In this presentation, inspired by Mario (...) Benedetti's poem “The Bridge”, we explore the power of three words to think about childhood and the relationship we establish with children: borders, strangeness and movements. How many borders do childhood and children cross into the political, cultural, social, and biological order of life? Which movements or changes do they produce, reproduce, and spread? How to destrange childhood, in the sense of challenging the actions and discursive productions that promote exclusions of various forms? Which movements – in the field of research and in society in general – are instituted to encourage the agency of childhood? Starting from the idea that both our culture and our subjectivity are constituted in the relationship between an interior and an exterior that are placed in tension, we draw on philosophy, literature, psychoanalysis, and cultural studies to explore these questions. In this dossier, the texts compose a set that dialogues with the philosophy of childhood and goes beyond conceptual and methodological limits, in the sense of making moves to understand children and childhood through their perspectives, actions, languages and positions, in an objective and subjective form. This paper analyses the role played by members of the Curie family in the visual diplomacy of cancer treatments. This relationship started in 1921, when Marie Curie travelled to the US, accompanied by her two daughters, Ève and Irène, to receive a gram of radium at the White House from President Warren Harding. In the years that followed, Ève Curie, as the biographer and natural heir of radium discoverers Marie and Pierre Curie, continued to contribute to the visual diplomacy of (...) cancer campaigning. Two events will be analysed through an interdisciplinary lens, merging history of science and visual-diplomacy studies, to show how the legacy of the Curies played out in the international consolidation of pre-war transnational alliances in the fight against cancer. One involves the picture of the chargé d'affaires of the France Republic, Jules Henry, receiving the biography authored by Ève,Madame Curie, at the French embassy in Washington. The other concerns the photograph of Ève visiting the Portuguese Oncology Institute (IPO) in 1940, which was immediately reproduced in the Institute's bulletin in order to raise awareness of cancer prevention strategies, and also captured in film as a propaganda tool for the Estado Novo regime (1933–74). The purpose of this paper is to trace the American Society for the Control of Cancer's (ASCC) influence on the Portuguese Institute of Oncology's (IPO) Bulletin. The time period featured is from 1934 to 1940, which spans the first two decades of the newly formed Portuguese dictatorship, known as the Estado Novo (1933–1974). The analysis of the ASCC's “imprint” on the IPO's Bulletin aims to shed new light on how American culture influenced Portugal, from its first appearance at the beginning (...) of the 20th century. It brings together the disciplines of history of science and history of art and visual studies, in order to analyse these campaigns' strategic relationship with their “patients and contributors to be.” The public is encouraged by this means not only to seek timely assistance, but also to participate financially in the “cancer cause.” This is achieved by means of international consumer culture media in everyday forms, such as film, adverts in written form, and exhibitions publicising the cause. Lastly, this analysis approaches transnationalism, modernism, and the scientific nature of the Estado Novo's nationalism from new and innovative angles, allowing for a “rethinking” of said nationalism. This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the (...) conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

The objective of this paper is to reflect on the proper way for Christians to do philosophy, in respect of which I have been inspired by a phrase attributed to Cardinal Newman: “We do not need Christian philosophy. We need Christians making good philosophy.” This sentence can appear controversial, but I believe it is not, if its content is made explicit in an appropriate way. To better develop what I understand Newman to be proposing here, I have added another category (...) to his statement, with the consequence that my own text falls into three sections: 1) on Christian philosophy; 2) on Christian philosophers; 3) on Christians who do philosophy. This is the scheme that we will use to position ourselves as regards the complex issue of the relationship between philosophy and Christianity. (shrink)

Trabajar en las aulas la memoria histórica, como temática controvertida y que suscita debate social, es un reto de la enseñanza de las ciencias sociales. A nivel global han sido innumerables las acciones desarrolladas para que se recupere la memoria de aquellas personas silenciadas durante décadas, unidas a conflictos sociales y políticos. Sin embargo, existen pocas investigaciones que analicen los recursos didácticos que ofrecen las tecnologías digitales sobre la temática. En este trabajo se identifican cinco apps que tienen como eje (...) el Holocausto y se analizan sus posibilidades educativas y su tratamiento de la memoria histórica. El resultado apunta a que estas apps no presentan una arquitectura didáctica adecuada y proponen una función principalmente informativa, aunque poseen características específicas que permiten su uso en contextos educativos si se hace un buen uso de sus funcionalidades a través de una mediación adecuada. Respecto a la memoria, aunque presentan un tratamiento basado en testimonios y recuerdos individuales, obvian la necesidad de una metodología deliberativa que permita confrontar ideas y fomentar una actitud crítica ante la historia institucionalizada. New technologies could facilitate new ways of cheating. This emerging scenario places academic integrity policy in higher education institutions as critical. Academic integrity scholars have designed conceptual frameworks to analyze academic integrity policy. The body of the literature on academic integrity policy analysis includes studies developed in North America, Europe, and Australia. However, insight into several regions of the world is lacking. This pioneering study in the Chilean context analyzes documents addressing academic integrity at forty-three accredited universities. Using a qualitative (...) research design, we framed this policy analysis in the five core elements of exemplary academic integrity policy: access, approach, responsibility, detail, and support. The findings revealed challenges with accessing documents online, a strong presence of legal language that might not be understandable to all students, and a scarcity of information about review cycles. The punitive approach was prevalent, with a significant focus on students’ conduct. Signs of collaboration and mechanisms for promoting academic integrity cultures were nearly absent. The documents primarily targeted students and the roles of other stakeholders concentrated on the enforcement of sanctions and misconduct investigations. The analysis also showed the use of general definitions to describe academic integrity breaches, inconsistency across the system in defining plagiarism and a lack of guidance to address contract cheating and unauthorized use of generative artificial intelligence. The findings also highlighted the unavailability of institutional support to teach, learn, and research with integrity or references to research-based practices. We propose twelve practical recommendations for policymakers and academic integrity advocates. (shrink)

RESUMO Segundo Mikhail Bakhtin, a 'palavra monológica' não é realizada no diálogo; dela se depreende a 'palavra autoritária' que, como seu próprio nome indica, provém da autoridade, legal ou eclesiástica, do professor ou dos pais. Sua característica, como se escuta no discurso religioso, é a de não permitir a discussão; pede ser reconhecida e assimilada por nós. Entretanto, é possível que tal palavra, ainda que 'de outrem', seja convincente, incorporando-se ao nosso discurso com plena consciência; sendo assim, pode inclusive ser (...) considerada 'palavra dialógica'. Para explicá-la melhor, a 'palavra autoritária' será vinculada a enunciados dogmáticos próprios das religiões, como o judaísmo e o islã, e, sobretudo, do cristianismo católico.ABSTRACT According to Mihail Bakhtin, a 'monologic word' is not realized in dialogue; related to it, an 'authoritative word,' as its name implies, comes from authority, be it legal or ecclesiastical, from teachers or parents. As in religious discourse, it does not allow discussion; it asks to be recognized and assimilated. However, it may be that this word, coming from the 'discourse of the other,' is convincing, being incorporated into our discourse in full consciousness. Being so, it can even be considered a 'dialogical word.' To better explain it, the 'authoritative word' will be connected to dogmatic utterances of religions, such as Judaism or Islam, and especially the Catholic Christianity.RESUMEN Según Mijaíl Bajtín, la 'palabra monológica' es una que no está en diálogo; a ella se vincula la 'palabra autoritaria' que, como su nombre lo indica, proviene de la autoridad, sea legal o eclesial, del maestro, de los padres. Su característica, como se escucha en el discurso religioso, es que no permite la discusión; pide ser reconocida y asimilada por nosotros. Sin embargo, puede ser que dicha palabra, aunque sea 'ajena', resulte convincente y se incorpore a nuestro discurso con plena conciencia; siendo así, puede, incluso, ser considerada 'palabra dialógica'. Para explicarla mejor, la 'palabra autoritaria' será analizada con algunos enunciados dogmáticos, propios de las religiones, como el judaísmo o el islam y, sobre todo, del cristianismo católico.
