This paper examines the strategies for the legitimisation of power in courtroom encounters. It focuses on how discourse becomes the instrument for power and control during the judicial process of witness examination in a Nigerian courtroom context. Legitimisation, as used in this study, therefore, provides more insight into how language use within an institutionalised setting becomes the locus of social interactions designed to achieve specific social goals. Critical Discourse Analysis (CDA) was adopted as the theoretical framework to undergird the description (...) and discussion of the data. The data for this study was drawn from the proceedings of two regional Election Petition Tribunals in South-western and North-eastern Nigeria in 2007 and 2011 respectively. The legal contexts provide the adversarial space for the use of discourse as power and control. The findings reveal that various legitimisation strategies such as confrontational move, circumlocution and pleading forgetfulness along with such traditional strategies as authorisation, moralisation and rationalisation are deployed by the discourse participants to legitimise and delegitimise power in this institutional setting. The paper shows that language is crucial in the judicial process and should be carefully handled so that litigants can have sufficient confidence in the process and be reassured of effective resolution to their legal matters. Is the “act itself” of separating a pregnant woman and her previable child neither good nor bad morally, considered in the abstract? Recently, Maureen Condic and Donna Harrison have argued that such separation is justified to protect the mother’s life and that it does not constitute an abortion as the aim is not to kill the child. In our article on maternal–fetal conflicts, we agree there need be no such aim to kill (supplementing aims such as to remove). However, we (...) argue that to understand “abortion” as performed only where the death of the child is intended is to define the term too narrowly. Respect for the mother, the fetus, and the bond between them goes well beyond avoiding any such aim. We distinguish between legitimate maternal treatments simply aimed at treating or removing a damaged part of the woman and illegitimate treatments that focus harmfully on the fetal body and its presence within the mother’s body. In obstetrics as elsewhere, not all side effects for one subject of intervention can be outweighed by intended benefits for another. Certain side effects of certain intended interventions are morally conclusive. (shrink)

There is no doubt that the model presented here is incomplete. Many important categories, particularly negation and the adverbials, have been entirely ignored, and the treatment of Tense and the affixes is certainly inadequate. It also remains to be seen how the many constructions that have been ignored here are to be accommodated within the framework that has been outlined. However, the fact that a standard categorial lexicon, plus the four rule schemata, seems to come close to exhaustively specifying the (...) main clause constructions of English, and also seems to explain a number of major constraints on transformations, encourages us to compare the theory with certain alternatives, and to examine its broader implications. Contemporary biologists are not agreed on the question of whether there are any human races, despite the widespread scientific consensus on the underlying genetics. For most purposes, however, we can reasonably treat this issue as terminological. What most people in most cultures ordinarily believe about the significance of “racial” difference is quite remote, I think, from what the biologists are agreed on. Every reputable biologist will agree that human genetic variability between the populations of Africa or Europe or Asia is (...) not much greater than that within those populations; though how much greater depends, in part, on the measure of genetic variability the biologist chooses. If biologists want to make interracial difference seem relatively large, they can say that “the proportion of genic variation attributable to racial differences is … 9 – 11%.”1 If they want to make it seem small, they can say that, for two people who are both Caucasoid, the chances of difference in genetic constitution at one site on a given chromosome are currently estimated at about 14.3 percent, while for any two people taken at random from the human population, they are estimated at about 14.8 percent. The statistical facts about the distribution of variant characteristics in human populations and subpopulations are the same, whichever way the matter is expressed. Apart from the visible morphological characteristics of skin, hair, and bone, by which we are inclined to assign people to the broadest racial categories—black, white, yellow—there are few genetic characteristics to be found in the population of England that are not found in similar proportions in Zaire or in China; and few too which are found in Zaire but not in similar proportions in China or in England. All this, I repeat, is part of the consensus . A more familiar part of the consensus is that the differences between peoples in language, moral affections, aesthetic attitudes, or political ideology—those differences which most deeply affect us in our dealings with each other—are not biologically determined to any significant degree.[…]In this essay, I want to discuss the way in which W. E. B. Du Bois—who called his life story the “autobiography of a race concept”—came gradually, though never completely, to assimilate the unbiological nature of races. I have made these few prefatory remarks partly because it is my experience that the biological evidence about race is not sufficiently known and appreciated but also because they are important in discussing Du Bois. Throughout his life, Du Bois was concerned not just with the meaning of race but with the truth about it. We are more inclined at present, however, not to express our understanding of the intellectual development of people and cultures as a movement toward the truth; I shall sketch some of the reasons for this at the end of the essay. I will begin, therefore, by saying what I think the rough truth is about race, because, against the stream, I am disposed to argue that this struggle toward the truth is exactly what we find in the life of Du Bois, who can claim, in my view, to have thought longer, more engagedly, and more publicly about race than any other social theorist of our century. 1. These are among the many racially-charged images that have burst across our television screens in the last year alone, images that show that for all our complacent beliefs in a melting-pot society, race is as much of a problem as ever in America. In (...) this vastly important, widely-acclaimed volume, Kwame Anthony Appiah, a Ghanaian philosopher who now teaches at Harvard, explores, in his words, "the possibilities and pitfalls of an African identity in the late twentieth century." In the process he sheds new light on what it means to be an African-American, on the many preconceptions that have muddled discussions of race, Africa, and Afrocentrism since the end of the nineteenth century, and, in the end, to move beyond the idea of race. In a 2020 article published in volume 9, number 1 of [Filosofia Theoretica]_, _Martin F. Asiegbu and Anthony Chinaemerem Ajah questioned the continued relevance of Afro-communalism. They argued that nothing about communalism makes it African. They also demonstrated how the brand of communalism presented as ‘African’, is too reductive, emphasizes conformism and therefore is against the individual and counter-productive for entire societies in Africa. For the above reasons, they summed that communalism with ‘Afro-’ is irrelevant and needs to end. (...) In a 2021 article published in the same journal in response to the initial submission by Asiegbu and Ajah, Enweh held that their take on Afro-communalism was too harsh. He marshalled out five “issues and difficulties” regarding their critique of the concept. Although Enweh’s critique is a worthwhile invitation to a conversation, which clarifies and complements, his proposal for an interpretative rehabilitation of Afro-communalism in the 21 st century is surely wrongheaded. To respond to Enweh, a review of his critique of Asiegbu and Ajah will foreground the attempt to clarify some parts of Asiegbu and Ajah’s initial position. We will assess Enweh’s arguments in terms of the relevance of the rehabilitation he suggested and question the meaning of what Enweh termed the “amity of ethnic nationalities.” We will argue that Enweh was unable to provide sufficient grounds to show that Asiegbu and Ajah’s critique of Afro-communalism was “uninformed… [and] harsh.” We will also demonstrate that his critique of their views was indefensible just as he was unable to explain what he meant by the alternative model he claimed to introduce in the discussion. What does it mean to forgive? The answer is widely assumed to be self-evident but critical analysis quickly reveals the complexities of the subject. Forgiveness has traditionally been the preserve of Christian theology, though in the last half century - and at an accelerating pace - psychologists, lawyers, politicians and moral philosophers have all been making an important contribution to questions about and our understanding of the subject. Anthony Bash offers a vigorous restatement of the Christian view of forgiveness (...) in critical dialogue with those both within and without the Christian tradition. Forgiveness is a much more complicated subject than many theologians recognize. Bash explores the relevance of the theoretical discussion of the topic to recent events such as the Truth and Reconciliation Commission in South Africa, post-Holocaust trials, the aftermath of 9/11 and July 7 and various high-profile criminal cases. In early 1927, Pascual Jordan published his version of what came to be known as the Dirac-Jordan statistical transformation theory. Later that year and partly in response to Jordan, John von Neumann published the modern Hilbert space formalism of quantum mechanics. Central to both formalisms are expressions for conditional probabilities of finding some value for one quantity given the value of another. Beyond that Jordan and von Neumann had very different views about the appropriate formulation of problems in the new (...) theory. For Jordan, unable to let go of the analogy to classical mechanics, the solution of such problems required the identification of sets of canonically conjugate variables, i.e., p’s and q’s. Jordan ran into serious difficulties when he tried to extend his approach from quantities with fully continuous spectra to those with wholly or partly discrete spectra. For von Neumann, not constrained by the analogy to classical physics and aware of the daunting mathematical difficulties facing the approach of Jordan ), the solution of a problem in the new quantum mechanics required only the identification of a maximal set of commuting operators with simultaneous eigenstates. He had no need for p’s and q’s. Related to their disagreement about the appropriate general formalism for the new theory, Jordan and von Neumann stated the characteristic new rules for probabilities in quantum mechanics somewhat differently. Jordan was the first to state those rules in full generality, von Neumann rephrased them and then sought to derive them from more basic considerations. In this paper we reconstruct the central arguments of these 1927 papers by Jordan and von Neumann and of a paper on Jordan’s approach by Hilbert, von Neumann, and Nordheim. We highlight those elements in these papers that bring out the gradual loosening of the ties between the new quantum formalism and classical mechanics. (shrink)

My text is written to answer the questions asked at the APA Meeting's presentation of the book Moral Textures: Feminist Narratives in the Public Sphere by professors María Lugones and Eduardo Mendieta. The answer seeks to clarify that Lugones's infrapolitics position is not so distant from mine. I also address Mendieta's question directed more to the aesthetic domain. There, I seek to show how my position could be taken as a creative effort to extend some of Habermas's early work on (...) the public sphere, and to develop the thesis of the important relations between the aesthetic and the moral realms. A critical engagement with Black Skin, White Masks in the wake of social construction theory and controversies over critical race theory.

The Sustainable Development Goals are an opportunity to address major social and environmental challenges. As a widely agreed framework they offer a potential way to mobilise stakeholders on a global scale. The manner in which the goals, with time-based targets and specific metrics, are set out within a voluntary reporting process adopted by both governments and business, provides a fascinating and important case for organisational studies. It is both about advancing performance measurement and evidence-based policy-making for sustainable development, and also (...) participation and consultation at a wider, more global scale, than has ever been possible before. This paper contributes to the notion of SDGs as a wicked problem, answering calls for deeper theorisation, via synthesis with core ideas in the management field of decision theory. A case study on the wicked problem of deforestation and its links to supply chains, multi-stakeholder initiatives and SDG reporting, provides an illustration of the relevance of the application of decision theory to wicked problems, presented using a novel conceptual framework. This helps to illustrate new avenues for research and practical application regarding the balance of technocratic and participative approaches for sustainable development. (shrink)

This research work examines Heidegger's (1889-1976) contention that phenomenology can inspire, illuminate, motivate, reinforce and guide (human) individual's actions. It achieves this by adapting Heidegger's phenomenological approach to analyze and interpret representative everyday factical experiences of nepotism, selfishness and mass mentality in the (Nigerian) society. Doing this helps to ascertain whether these experiences have any phenomenological link with inauthenticity. Also, it provides a close reading and interpretation of Heidegger's treatment of authentic existence, and explores the possibility of complimenting it with (...) the phenomenology of Commensality, as a mode of care and a way to authenticity. In this manner, it strategically explores possible ways of inspiring individual Daseins to authenticity, and with it engendering a positive transformation of the (Nigerian) society. Presenting and elaborating the phenomenology of Commensality, the work highlights the relationship and the differences between the phenomenology of Commensality and the ontical or sociological understanding of commensality as obtained in African traditional societies. Phenomenology of Commensality argues for the 'renaissance' of Commensality, concretely expressed as Onyenkeanyi, and not just for its 'revival'. The research work further develops the phenomenology of education for Commensality, discussing the possible content and focus of its curriculum, while differentiating it from ethics. The proper implementation of phenomenology of education for Commensality could inspire and illuminate individual Daseins to authenticity, and thereby becomes an improvement strategy for the positive transformation of the (Nigerian) society. As a phenomenology, it is appropriate that the people and places analyzed take on a definite character, which is why the Nigerian society is used. However, it is expected that the implications of the findings presented here will be general and accurate enough to allow application to any number of similar situations. (shrink)

Two types of interleukin 1 (IL‐1α and IL‐1β) have been defined by purifying the molecules from activated human peripheral blood cells, followed by cloning and expressing the molecules in Escherichia coli. Both types of IL‐1 stimulate proliferation and differentiation of T‐ and B‐lymphocytes and induce cartilage proteoglycan degradation but differ in other properties. For example, demineralization and appears to be a major mediator in the pathogenesis of joint erosion in rheumatoid arthritis. Synthetic adjuvants elicit the production of IL‐1 separate from (...) endogenous pyrogen, and this property is required for the new generation of vaccines based on antigens produced by recombinant DNA technology. It is often argued that associations are intelligent organisms with minds and intentional states of their own. It is also argued that groups are merely a plurality of individuals who are related or associated only in a specific and limited sense. This paper draws on both classical and contemporary scholarship to develop an ontological account of persons which has real-world legal and ethical implications.

In recent years there has been a significant growth in interest of the so-called 'law in context' extending legal studies beyond black letter law. This book looks at the relationship between statute law and legal practice. It examines how law is applied in reality and more precisely how law is perceived by the general public in contrast to the legal profession. The authors look at a number of themes that are central to examining ways in which myths about law are (...) formed, and how there is inevitably a constitutive power aspect to this myth making. At the same time they explore to what extent law itself creates and sustains myths. While the academic separation of policing and regulation is still largely operative, points of convergence are more significant than ever in the digital age, starting with concomitant debates about algorithms as a new figure of power. From the policing of illegal activities to the regulation of legal ones, the algorithmization of such critical social ordering practices has been the subject of growing attention. These burgeoning discussions are focused on one common element: big data surveillance. In accordance with such similarities and (...) paralleled developments in policing and regulation, the article aims to further bridge the gap between literatures to respond to the calls for studying big data surveillance across institutional domains and social fields. To do so, it is focused on one case study that articulates algorithmic policing and regulation domains, in-between security and economic fields. This is the fight against illicit finance, i.e. ‘the global action against the financial flows that fuel crime and terrorism’. To what extent does big data surveillance make a difference in the main global policy of crime-fighting and financial regulation? Drawing on a fieldwork in a large North American bank, the present article takes stock of the algorithmic overlap between policing and regulation. It argues that the final result is policing and regulation of neither too much nor too little, which gives rise to automated and everyday mass surveillance while remaining as far removed from regulatory and crime-fighting ambitions as it is from dystopian visions of big data and algorithmic drama. Critiquing any practice, theory, or law, requires understanding the characteristics of the environment which created a need for this law. There are hundreds of different cultures in the world, and each one has its own set of norms, characteristics, and values. What in one country is perceived normal, ethical or unethical, right or wrong, may not be the same somewhere else in the world. The first civilizations begun in Africa and Europe many thousands of years ago when people were hunters (...) and nomads, it is not unreasonable to suspect that many of those traits and characteristics have been socially transferred and/or inherited by future generations. Collective action occurs when people voluntarily join with one another for obtaining collective goods, such as rights and equality, that institutions fail to provide or bloc them from getting. Collective action has to overcome obstacles due to free riding, recruitment, participation, costs of organizing, and social control by the opposition. Collective actions range from episodic protests and hostile crowds to sustained social movements and civil strife.Collective action theory in the tradition of methodological individualism assumes that individuals make adaptive decisions under (...) uncertainty, contingent on expectations about the decisions of peers, opponents and bystanders. The four key variables of participation are number of participants, costs of participation, the value of the collective good, and the production function for different tactics and modes of contestation.The reduction of uncertainty is achieved by strategies of resource mobilization, selective incentives, solidarity, bloc mobilization, political opportunity, shared culture, mass media effects, signaling of information, and pace setter-follower diffusion dynamics. The theory explains unconventional political and social advocacy in democratic and autocratic regimes, from routine politics, strikes, demonstrations, hostile crowds to social movements and other modes of confrontation. Since the 1990s, political theorists studied the impact of digital media on the public sphere. These debates extensively employ Arendt’s theory of the public sphere to evaluate whether social media meets the expectations and criteria set forth in her account. This common approach rests on a methodological assumption that is itself not critically examined: it asserts that one should start with a clear understanding of what political action ‘truly’ is and only then attend to its potential relation with technology. However, (...) this article identifies two issues with this approach: it overlooks the complex interplay between technology and political action, and struggles to adapt Arendt’s pre-digital era theory to digital environments. Nonetheless, I argue that Arendt’s phenomenological methodology (i.e., how she develops her political theory) does offer an effective starting point to explore the changing relationship between politics and technology in the contemporary public sphere. This approach begins with an exploration of the technological conditions shaping political action rather than with a pre-established notion of political action. I demonstrate how this methodological blueprint can be expanded with a postphenomenological framework to bring Arendt’s political theory into the digital age, revealing how digital technologies continuously re-stabilize the intentional structure of political action. Providing in-utero treatments to target specific conditions in the fetus is a relatively new approach in perinatal care, with the vast majority of these treatments being used off-label. The high degree of off-label medication use in the perinatal and neonatal settings raises concern for the safety of both the fetuses and expectant mothers. This report presents two examples of intra-amniotic drug administration based on reported clinical cases. From the ethical framework of medical principlism, we examine the competing ethical duties of (...) autonomy, beneficence, and non-maleficence in this setting. We then lay out three fundamental ethical principles for obtaining informed consent and maximizing clinical benefit. (shrink)

Foundations of Economic Personalism is a series of three book-length monographs, each closely examining a significant dimension of the Center for Economic Personalism's unique synthesis of Christian personalism and free-economic market theory. In the aftermath of the momentous geo-political and economic changes of the late 1980s, a small group of Christian social ethicists began to converse with free-market economists over the morality of market activity. This interdisciplinary exchange eventually led to the founding of a new academic subdiscipline under the rubric (...) of economic personalism. These scholars attempt to integrate economic theory, history, and methodology with Christian personalism's stress upon human dignity, humane social structures, and social justice. This final volume in the series systematically applies the praxeological and theoretical foundations of the personalist tradition to free-market economic theory. Unlike the previous two, this work defends economic liberty in theologically sensitive terms that reference the personalist tradition, without compromising the disciplinary integrity of either economics or social ethics. It is argued that there is a reciprocal relationship between Durkheim’s substantive discussion of the development of individualism and his abstract formulations of sociological methods. Durkheim is often regarded as being fervently “anti-individualist”. But in fact, his works contain a vigorous defence of individualism—understood in a specific way. In other words, Durkheim’s writings represent an attempt to detach “liberal individualism”, regarded as a conception of the characteristics of the modern social order, from “methodological individualism”.
