Patient Confidentiality: Hospital’s Release of Alcohol Treatment Data Does Not Violate Regs.Hassen A. Sayeed - 2002 - Journal of Law, Medicine and Ethics 30 (2):319-321.
In M.A.K. v. Rush-Presbyterian-St. Luke's Medical Center, the Illinois Supreme Court reversed the appellate court and held that the phrase any physician, medical practitioner, hospital, clinic, health care facility or other medical or medically related facility, in a patient's signed consent form met the general designation requirement of the Code of Federal Regulations for the release of alcohol and drug abuse treatment records. Thus, the Illinois Supreme Court held that the medical center's release of a patient's records did not violate (...)

Parental manual ventilation in resource-limited settings: an ethical controversy.Emily Barsky & Sadath Sayeed - 2020 - Journal of Medical Ethics 46 (7):459-464.
Lower respiratory tract infections are a leading cause of paediatric morbidity and mortality worldwide. Children in low-income countries are disproportionately affected. This is in large part due to limitations in healthcare resources and medical technologies. Mechanical ventilation can be a life-saving therapy for many children with acute respiratory failure. The scarcity of functioning ventilators in low-income countries results in countless preventable deaths. Some hospitals have attempted to adapt to this scarcity by using hand-bag ventilation, as either a bridge to a (...)

The Marginally Viable Newborn: Legal Challenges, Conceptual Inadequacies, and Reasonableness.Sadath A. Sayeed - 2006 - Journal of Law, Medicine and Ethics 34 (3):600-610.
Decisions to provide life-sustaining medical care for marginally viable newborns present a unique set of morally complex challenges for providers and parents in the United States. This article examines recent legal trends that restrict discretionary decision-making, and critiques commonly employed ethical justifications offered to support permitting such discretion.

The Marginally Viable Newborn: Legal Challenges, Conceptual Inadequacies, and Reasonableness.Sadath A. Sayeed - 2006 - Journal of Law, Medicine and Ethics 34 (3):600-610.
In the past few years, medical practices surrounding the decision to resuscitate marginally viable newborns have received a fair amount of attention. Baroness Warnock, of the UK Nuffield Council on Bioethics, has recently suggested that Britain follow the recommended practice in Holland of setting a gestational age limit below which marginally viable newborns should not be routinely resuscitated, despite reported statistical probabilities of raw survival approaching twenty percent. In the US, a highly publicized case from Texas came to a controversial (...)

The Defining Characteristics of Ethics Papers on Social Media Research: A Systematic Review of the Literature.Md Sayeed Al-Zaman, Ayushi Khemka, Andy Zhang & Geoffrey Rockwell - 2024 - Journal of Academic Ethics 22 (1):163-189.
The growing significance of social media in research demands new ethical standards and practices. Although a substantial body of literature on social media ethics exists, studies on the ethics of conducting research using social media are scarce. The emergence of new evidence sources, like social media, requires innovative methods and renewed consideration of research ethics. Therefore, we pose the following question: What are the defining characteristics of ethics papers on social media research? Following a modified version of the Preferred Reporting (...)

On April 13, 2010, Nebraska enacted a new state ban on abortion in the Pain-Capable Unborn Child Protection Act that ha caught the attention of many on both sides of the abortion debate, and has inspired other states to attempt similar measures. The statute requires the referring or abortion-providing physician to make a “determination of the probable postfertilization age of the unborn child” and makes it illegal to induce or attempt to perform or induce an abortion upon a woman when (...)

  13. Shadows or Forgeries? Explaining Legal Normativity.Alma Diamond - 2024 - Canadian Journal of Law and Jurisprudence 37 (1):47-78.
Legal norms serve as practical standards for individuals and officials. While this ‘normative aspect’ of law is widely acknowledged, its significance for theories of law remains contested. In this paper, I examine three views on the matter. First, that we should explain legal norms as reason-giving. Second, that we should explain legal discourse as being about reasons for action. Third, that we should explain law as capable of being reason-giving. I survey some challenges associated with each of these views. What (...)

But I accepted these disadvantages! Can you be discriminated against by holding a right?Alma K. Barner - 2024 - Journal of Medical Ethics 50 (2):120-121.
To show that discrimination against the terminally ill is a real and worrisome phenomenon Reed presents four examples1. Here, I focus on the final two: right-to-try and right-to-die laws. I argue that they are not instances of discrimination, because they grant rights. Reed appears to have overlooked that rights differ from obligations in ways that leave his argumentation unsuccessful. According to the most prominent theory of rights, rights function to protect the personal interests of their holders.2 For that reason, strengthening (...)

Salvaging Incommensurability.Syed Sayeed - 2019 - Journal of the Indian Council of Philosophical Research 36 (1):97-124.
This article argues that the concept of incommensurability (of conceptual frameworks) is not as incoherent as has been sometimes argued, and that it is possible to formulate this notion in such a way that it can be meaningful. The article suggests that it is worthwhile to salvage the concept of incommensurability because it is a very useful concept, almost indispensable in explaining certain situations.

Johnsonism and crisis management: a critical narrative analysis of the UK Prime Minister’s response to the COVID-19 pandemic.Alma-Pierre Bonnet - forthcoming - Critical Discourse Studies.
As the official UK COVID Inquiry is investigating the response by the government to the 2020 global pandemic, revealing the difficulties that the Johnson administration had to face and the overall lack of adequate preparedness at the top of the UK executive, people are becoming growingly aware of the many challenges that such situations pose in terms of crisis management and public governance. Beyond the somewhat sterile blame game played by leading political actors, this formal accountability forum has also revealed (...)

The integration of personalism into business ethics has been recently studied. Research has also been conducted on humanistic management approaches. The conceptual relationship between personalism and humanism , however, has not been fully addressed. This article furthers that research by arguing that a true humanistic management is personalistic. Moreover, it claims that personalism is promising as a sound philosophical foundation for business ethics. Insights from Jacques Maritain’s work are discussed in support of these conclusions. Of particular interest is his distinction (...)

Humanitarian aid in Central Europe after World War I repositioned both food and food research on a global scale. This essay follows the British scientific delegation that worked in Vienna as part of the food aid program and shows how the city became a “lab” for international nutrition. Assuming a political role, British nutrition experts were motivated to collaborate with local experts. To examine what internationalism looked like in the lab, the essay reconstructs the forgotten Viennese NEM system, a scientific (...)

Improving schools in difficult contexts: Towards a differentiated approach.Alma Harris & Christopher Chapman - 2004 - British Journal of Educational Studies 52 (4):417-431.
This article focuses on 'improving' schools in difficult or disadvantaged contexts. It explores the contemporary policy discourse and intervention strategies aimed at improving schools in such circumstances. It argues that contemporary approaches to improvement are unlikely to succeed because the approaches adopted are not sufficiently differentiated or context specific. Drawing on two recent empirical studies, the article offers an alternative perspective on school improvement within this group of schools. It argues against standardised solutions in favour of a differentiated approach to (...)

Fetal Pain, Abortion, Viability, and the Constitution.I. Glenn Cohen & Sadath Sayeed - 2011 - Journal of Law, Medicine and Ethics 39 (2):235-242.
In early 2010, the Nebraska state legislature passed a new abortion restricting law asserting a new, compelling state interest in preventing fetal pain. In this article, we review existing constitutional abortion doctrine and note difficulties presented by persistent legal attention to a socially derived viability construct. We then offer a substantive biological, ethical, and legal critique of the new fetal pain rationale.

Abraham Maslow’s needs theory is one of the most influential motivation theories in management and organizational behavior. What are its anthropological and ethical presuppositions? Are they consistent with sound business philosophy and ethics? This paper analyzes and assesses the anthropological and ethical underpinnings of Maslow’s needs theory from a personalistic framework, and concludes that they are flawed. Built on materialistic naturalism, the theory’s “humanistic” claims are subverted by its reductionist, individualistic approach to the human being, which ends up in a (...)

Para el análisis hemos creado un modelo ad hoc de nueve variables y 44 categorías. The constitution of the identity through the relationship with ghosts.Alma López - 2016 - Cinta de Moebio 56:197-213.
The problem of identity is one of the milestones of philosophical thinking. It is a complex question, a prism with multiple vertices. In this paper I will focus on two key-concepts related to identity, namely, death and community. Death stands as end of life, but as a possibility of it. The ghost "appears", then, in a privileged position for the dialogue and the understanding of this phenomenon. Moreover, as social beings, neither individuals can be separated from the community in which (...)

Binary judgement on under-informative utterances is the most widely used methodology to test children’s ability to generate implicatures. Accepting under-informative utterances is considered a failure to generate implicatures. We present off-line and reaction time evidence for the Pragmatic Tolerance Hypothesis, according to which some children who accept under-informative utterances are in fact competent with implicature but do not consider pragmatic violations grave enough to reject the critical utterance. Seventy-five Dutch-speaking four to nine-year-olds completed a binary and a ternary judgement task. (...)
