The article critically analyzes the conservative conception of passive or static human dignity in accordance with which human’s value is seen as value coming from the exterior (from God or from a biological human’s nature), or value seen as existing per se. In opposition to this conception, a conception of active or created dignity is being developed, which aims at treating human’s dignity not like a social relationship, but rather like a person’s individual ability to live properly in the society (...) (participate in barter relations on the ground of equivalence) and using this propriety to create own individual social value (dignity), as a personal contribution towards maintenance of concord and collaboration in the society. In this paper we investigate whether and to what extent scientists (e.g. inquirers such as epidemiologists or virologists) can have rational and fruitful disagreement with what we call post-enquirers (e.g. conspiratorial anti-vaxxers) on topics of scientific relevance such as the safety and efficacy of vaccines. In order to accomplish this aim, we will rely and expand on the epistemological framework developed in detail in Ferrari & Moruzzi (2021) to study the underlying normative profile of enquiry and post-enquiry. We take (...) it that our analysis provides an effective explanation of why standard argumentative strategies such as fact-checking and debunking cannot work in the context of disagreement between scientists and denialists unless they are coupled with a discussion of the values that are endorsed by the scientific community. Documediality indicates the allegiance between the constitutive power of documents and the mobilizing power of the media. The chapter proposes to treat documediality as the ending point of a great historical transformation whose previous phases have been capitalism and mediality. Capitalism in the strict sense corresponds to the economic era of production, and to the political era of liberalism. When populism prevails over liberalism, and communication has the upper hand over production, we enter the phase of mediality. Finally, documediality corresponds (...) to a third phase, characterized by recording: that is, by the use of a huge apparatus, namely the Web, which has the essential feature of keeping track of any interaction. In the West, the Estate Rights originated in the eleventh century, whereas in Lithuania they started to evolve only after the Wallachian Land Reform in 1557. The then state conventional rules and manners were gradually transformed into registered Country – seat rights. In the present rather concise paper an attempt has been made to present a picture of the development of Country – seat rights as a relatively independent law system and define its concept. The author has attempted to prove (...) that the rules of behaviour, introduced and observed in estates should be recognised as legal regulations for the following three reasons: (1) the publicly recognised exclusive Land property right and the right of the ownership of the people living on this land; (2) the rights were publicly registered in the Land, Castle (City) Law or Court books or in the books of the Tribunal. Thus they acquired official status; (3) the above-mentioned established estate rules were to be legally and obligatorily executed. Their realisation was guaranteed either with the help of the local power apparatus or, if needed, state compulsory measures could be applied. The Estate Rights in Lithuania in the sixteenth to nineteenth centuries comprised the following legal acts: (1) the act of inventory; (2) urban regulations and directions; (3) privileges granted to the owners by the rulers and special ordinances for the realisation of the given privileges; (4) the so-called “release papers/cards” (horty wolnosci) ; (5) the verdicts of the local Courts of Law; (6) the ownership of different objects on the estate ( the estate lands, mills, pubs, tar boiling pits, etc., including the people who could not act freely, rent treaties, foundations, wills with foundation forms legally included, by applying which the estates realised their constitutive cultural initiatives. The Estate Rights were defined as a system embracing the relations of obligatory conduct designed by the estate owner or his authorised institutions or officials. They were meant to maintain the order within the estate, to guarantee and realise the norms of different cultural initiatives as well. Being mostly ad hoc in their form, the Estate Regulations served both the private and public interest. The Estate Rights in the sixteenth to eighteenth centuries in Lithuania were practiced alongside with other existing legal systems, i.e. the Statute Law, Towns and Canon laws, etc. They all reflected the autonomous state of different law subjects and regulated their relations emerging within. At the same time, the estate rules emphasised their relationship with the Statute Law and importance of legality when formulating their own local regulations. The author presumes that the historical mission of the Estate Rules was more important than the Statute Law for the following two reasons: (1) the estate rules regulated the conduct of the majority of the population (in 1971, 64% of the population lived on estates) and (2) estate rules were carried into effect more consistently and accurately. It was guaranteed by a huge number of estate administration personnel who had the right to immediately apply the local force apparatus measures in respect of the violator. The Statute Law was applied to a rather limited layer of the population (the nobility amounted to only 5 or 6% of the country’s population) . Due to the widespread lawlessness of the nobility and the weak administrative power the State Law was seldom applied. Thanks to its daily labor and obedience, the majority of the population absorbed the destructive effect of the nobility on the state. (shrink)

According to the form of logical pluralism elaborated by Beall and Restall there is more than one relation of logical consequence. Since they take the relation of logical consequence to reside at the very heart of a logical system, different relations of logical consequence yield different logics. In this paper, we are especially interested in understanding what are the consequences of endorsing Beall and Restall’s version of logical pluralism vis-à-vis the normative guidance that logic is taken to provide to reasoners. (...) In particular, the aim of this paper is threefold. First, in Sections 2 and 3, we offer an exegesis of Beall and Restall’s logical pluralism as a thesis of semantic indeterminacy of our concept of logical consequence – i.e. understood as indeterminacy logical pluralism. Second, in Sections 4 and 5, we elaborate and critically scrutinize three models of semantic indeterminacy that we think are fit to capture Beall and Restall’s indeterminacy logical pluralism. Third, in Section 6, following Beall and Restall’s assumption that the notion of logical consequence has normative significance for deductive reasoning, we raise a series of normative problems for indeterminacy logical pluralism. The overall conclusion that we aim to establish is that Beall and Restall’s indeterminate logical pluralism cannot offer an adequate account of the normative guidance that logic is taken to provide us with in ordinary contexts of reasoning. In order to understand the system wherein human resource management practices are determined by the interactions of a complex system of actors, it is necessary to have a conceptual framework of analysis. In this respect, the works of scholars concerning stakeholder theory opened new perspectives in management theory. An organisation is understood as being part of a politico-economic system of stakeholders who interact and influence management practices. Each stakeholder tries to optimise and protect his interests, 61-75). The framework of stakeholder (...) analysis enables escape from a purely instrumental approach to HRM, and avoids reducing our understanding of conflicts within companies to mere antagonism between employees and their employers. It enables us to point out the existence of other stakeholders in the relationship. Notably, it allows for the incorporation into management theory of actors from the sphere of politics as well as their dependent administrations. All these actors are considered to be stakeholders who define the legal framework of firm management and guarantee the application of these laws. (shrink)

In this article, I illustrate ways in which the concepts of the norm and normativity, as well as discourses about normality and the good life, are implicated in relations of power that inform individuals’ values. By analyzing the separation of conjoined twins as a paradigmatic example of practices of overmedicalization, I consider the implications of taking the “goodness” of normality for granted. I argue that overmedicalization procedures establish an interpretative framework that does not leave room for recognizing the contingency of (...) societal suppositions about normality and the good life. It is this kind of ethical reflection (or lack thereof) that I problematize as being symptomatic of individuals’ “normalized” ethical reflection. (shrink)

In the 80's Pierangelo Miglioli, starting from motivations in the framework of Abstract Data Types and Program Synthesis, introduced semiconstructive theories, a family of “large subsystems” of classical theories that guarantee the computability of functions and predicates represented by suitable formulas. In general, the above computability results are guaranteed by algorithms based on a recursive enumeration of the theorems of the whole system. In this paper we present a family of semiconstructive systems, we call uniformly semiconstructive, that provide computational procedures (...) only involving formulas with bounded complexity. We present several examples of uniformly semiconstructive systems containing Harrop theories, induction principles and some well-known predicate intermediate principles. Among these, we give an account of semiconstructive and uniformly semiconstructive systems which lie between Intuitionistic and Classical Arithmetic and we discuss their constructive incompatibility. Infatti nessun realista negherebbe che l’IVA dipenda da schemi concettuali . Quello che il realista si chiede è, appunto, fin dove si spinge l’azione degli schemi concettuali, ed è qui che si manifesta il dissidio tra realisti e postmodernisti. Questi ultimi sono molto più generosi nella lista (...) delle parti di realtà che sono socialmente costruite, al punto da affermare, in taluni casi, che noi non abbiamo mai accesso a un mondo "là fuori”, ma solo con ciò che viene costruito dai nostri schemi concettuali.The actual issue at stake, in the confrontation between realists and postmodernists, is not whether you should accept or deny the existence of the external world, but the scope of constructionism: how far conceptual schemes bear on the construction of natural and social reality? Indeed, no realist would deny that the VAT depends on our conceptual schemes, which does not mean that it is purely subjective: you don’t decide whether you have to pay the VAT, it depends on where the purchase takes places. The realist just asks where the sphere of influence of conceptual schemes stops, and here the disagreement with the postmodernists begins. The latter are much more generous in listing the parts of reality that they consider socially constructed, up to maintaining that we do not have any access to the world “out there”, but only to what our conceptual schemes construct. In this series of dialogues, Derrida discusses and elaborates on some of the central themes of his work, such as the problems of genesis, justice, authorship and death. Combining autobiographical reflection with philosophical enquiry, Derrida illuminates the ideas that have characterized his thought from its beginning to the present day. If there is one feature that links these contributions, it is the theme of singularity - the uniqueness of the individual, the resistance of existence to philosophy, the temporality of the (...) singular and exceptional moment, and the problem of exemplarity. The second half of this book contains an essay by Maurizio Ferraris, in which he explores the questions of indication, time and the inscription of the transcendental in the empirical. A work of outstanding philosophy and scholarship, the essay is developed in close proximity to Derrida and in dialogue with figures such as Plato, Aristotle, Plotinus, Kant, Hegel and Heidegger. It thereby provides a useful introduction to the philosophy of one of Italy's most prominent philosophers as well as an excellent complement to Derrida's own ideas. A Taste for the Secret consists of material that has never before appeared in English. Against the consensus that Aristotle in the "Poetics" sets out to give tragedy a role in exercising or improving the mature citizen's moral sensibilities, I argue that his aim is rather to analyse what makes a work of literature successful in its own terms, and in particular how a tragic drama can achieve the effect of suspense. The proper pleasure of tragedy is produced by the plotting and eventual dispelling of the play's suspense. Aristotle claims that poetry 'says what is (...) universal' not in order to suggest that poetry achieves anything of the effect of philosophy, but to explain how in creating his plots the poet takes into consideration what, in general, could be expected to happen. Chapter 4 of the "Poetics" is not a theory of mimesis but an analysis of the lowest common denominator of the pleasure we take in fictions. The inevitability or likelihood by which events in the tragic plot are to be connected has an aesthetic rather than a moral function. Doing away with the irrationality of chance and increasing the human intelligibility of the action is not its point; the point is to furnish the plot with the second half of the formula for successful suspense: that events in the plot should happen 'against expectation because of one another'. The first half of the formula is examined under the rubric of peripety or reversal. The formula as a whole describes the pivotal moment when the pieces of the plot suddenly fit with a configuration that only in retrospect can we see to have been falling into place all along. Pity and fear are the emotions on which Aristotle focusses because they are the emotions engaged by the tightening-towards-release of literary suspense. And the pleasure of catharsis is the pleasure of that release. (shrink)

On the basis of a critique of the notion of collective intentionality employed by John Searle to explain social reality, the article argues Searle’s constitutive rule that, for social objects “X counts as Y in C” raises more problems than it solves. Searle was perfectly right to say that Derrida’s formula “there is nothing outside the text” is false. But we can vindicate (and emend) Derrida by saying “ there is nothing social outside the text”: social objects are identified with (...) the inscrbed acts that give rise to them. (shrink)

In the proem that precedes the account of the generation of the world, Timaeus provides very important elements for understanding the discourse he is about to delivery. It is a complex text that displays at least three different levels: dialectical, analogical (or metaphorical) and epistemological. In the dialectical section, Timaeus establishes that the sensible universe is a generated reality and as such has a cause; in the metaphorical section, he indicates the analogical schemes he will use to explain the genesis (...) of the cosmos (technical and biological) and the causes on which it depends. Finally, in the epistemological section he explains the reason why this exposition cannot achieve truth but must be content with likeness. (shrink)

This note examines Fulvio Tessitore’s objections formulated in his critical review of Massimo Ferrari’s paper Non solo sentieri interrotti . According to the author, Tessitore has misunderstood his interpretation of historicism, as well as his interpretation of the German philosophy within the Italian philosophical culture after the Second World War. Moreover, Tessitore suggests that the author’s position is the consequence of a sort of prejudice towards the history of philosophy practised in Napoli. The author shows the incorrectness of this (...) opinion, trying to sketch another view of this philosophical enterprise beyond any geographic boundary and local patriotism. (shrink)

The ignorance about Otto Neurath’s thought and action within the Vienna Circle as well as within the “scientific philosophy” definitely belongs to the past. In the last two decades the rediscovery of Neurath’s legacy represents one of the most significant aspects of the historical and theoretical studies on logical empiricism. As Friedrich Stadler has recently pointed out, “the rediscovery of Neurath [is] not merely a phenomenon of academic nostalgia, but itself constitutes research into the conditions and possibilities of changing a (...) paradigm in the philosophy of science”1. Particulary in the last ten years this re-evaluation has been the subject of numerous books and contributions, which offer a radically new view of the life, the philosophy of science and knowledge, the political and economical thought of Otto Neurath, and, last but not least, of his enthusiastic activity for the Encyclopedia-project. It is sufficient for the readers of this Yearbook to recall the enlightening reconstruction of the emergence of Neurath’s naturalism within the Vienna Circle offered in 1992 by Thomas E. Uebel and the extensive, critical description of Neurath’s work and life which was published in 1996 by Nancy Cartwright, Jordi Cat, Lola Fleck and Thomas E. Uebel. (shrink)

In this article I wish to illustrate realism’s position with regard to modern and contemporary philosophy and its transcendental turn. I will posit that new realism, while being very well aware of this turn , rejects it: in fact, from a realist perspective, the existence of ancestral beings, existing long before humans, proves that reality cannot be regarded as a correlate of human thought. I will therefore respectively refute the theories positing the dependency of reality on thought, arguing that the (...) main problem with anti-realism stems from a twofold confusion: between ontology and epistemology on one side, and between natural objects and social objects on the other. Finally, I will dwell on the perspectives which today lie in the proposal of a positive realism. (shrink)
