The development and use of large and dynamic health data repositories designed to support research pose challenges to traditional informed consent models. We used semi-structured interviewing to elicit diverse research stakeholders' views of a model of consent appropriate to participation in initiatives that entail collection, long-term storage, and undetermined future research use of multiple types of health data. We demonstrate that, when considering health data repositories, research stakeholders replace a concept of consent as informed with one in which consent is (...) engaged. In engaged consent, a participant's ongoing relationship with a repository serves as a substitute or adjunct to information exchange at enrollment. We detail research stakeholders' views of the risks of engaged consent and suggest questions for further study about engagement and consent procedures in initiatives that aim to store data for future unspecified research purposes. History of science's spatial turn has focused on the horizontal dimension, leaving the role of the vertical mostly unexplored as both a condition and object of scientific knowledge production. This special issue seeks to contribute to a burgeoning discussion on the role of verticality in modern sciences, building upon a wider interdisciplinary debate about the importance of the vertical and the volumetric in the making of modern lifeworlds. In this essay and in the contributions that follow, verticality appears as a (...) condition of knowledge production—a set of movements and mobilities, technical challenges, political negotiations, and bodily hardships—and an object of scientific inquiry, requiring new techniques of mapping and visualisation and generative of new insights into physical processes and temporal change. By foregrounding the vertical, historians of science can gain new insights and tell new stories about how science is done in the field, the observatory, and the laboratory, and about how those sciences have helped build a modern, three-dimensional world. In this article we explore the emergence of a cluster of social movement organisations that have critically taken issue with nanotechnology in Germany, the UK and internationally. By applying concepts borrowed from Social Movement Research we demonstrate that this cluster is a ‘spin-off’ from the preceding movement against agrofood biotechnology, however, never succeeds in mobilizing a comparable ‘antinanotechnology movement’. We argue that the turn toward participatory and deliberative practices that is characteristic of nanotechnology policy and, to a major extent, is (...) based on the perceived threat of a ‘public backlash’ against nanotechnology, while being of little political impact, reinforces the activity of these critical organisations through the provision of political opportunities. We further argue that the stagnation of these organisations can be explained by low policy impact and low public responsiveness respectively and conclude that their trajectories hinge to a major extent on policy impact and the responsiveness of the mass-public. We end by making a concluding remark about the limits to the project of democratizing social contention through public engagement. (shrink)

It is often proposed that the unacceptability of a semantically interpretable sentence can be rooted in its meaning. Elaborating on Oshima New frontiers in artificial intelligence, Springer, Berlin, 2007), we argue that the meaning-driven unacceptability of factive islands must make reference to felicity conditions, and cannot be reduced to the triviality of propositional content. We also observe, again elaborating on Oshima, that the triviality of factive islands need not be logical, but can be relative to a listener’s background assumptions. These (...) findings call for a revision of a prevalent view about meaning-driven unacceptability, according to which unacceptability results from triviality that is both propositional and logical. Justice for children and during childhood and the particular political, social and moral status of children has long been a neglected issue in ethics, and in social and political philosophy. The application of general, adult-oriented theories of justice to children can be regarded as particularly problematic. Philosophers have only recently begun to explore what it means to consider children as equals, what goods are especially valuable to them, and what are the obligations of justice different agents have toward children. In (...) addition, while philosophers have extensively written about global poverty and inequality, the issue of disadvantages during childhood, especially child poverty, has only been superficially addressed. This also applies to the Capability Approach (CA) as a normative theory. Although the socio-scientific and economic literature on how to conceptualize capabilities and functionings of children and how to measure them in the context of poverty and wellbeing is steadily growing, the normative aspects of these issues are still under-theorized. The CA offers a unique framework to engage with both the topic of justice for children and questions concerning what justice implies and demands with regard to children living and growing up in disadvantaged circumstances. Furthermore, justice and disadvantage during childhood is a compellingly interdisciplinary topic that invites the combination of ethical and philosophical reasoning together with socio-scientific theories and empirical knowledge. In this special issue of Ethical Perspectives we bring together theoretical and empirically informed discussions that explore the CA in relation to children and the many disadvantages they can face in their lives. The capability approach, which is closely connected to the works of Amartya Sen and Martha Nussbaum, is one possible theoretical framework that could be used to answer the question as to why poverty is a problem from a moral point of view. In this paper we will focus on the normative philosophical capability approach rather than the social scientific and descriptive perspective. We will show that the approach characterizes poverty mainly as a limitation of freedom and that it is precisely (...) this aspect, from its point of view, that makes poverty morally significant. This insight shifts the discussion away from questions regarding specific capabilities or lists of them-questions treated extensively in the literature-to the more general level of what constitutes the normative core of the capability approach. But as we will also discuss and argue, the role of freedom alone does not give us a complete picture of poverty but only presents us with one aspect relevant to evaluating it. A further aspect which we consider has not been adequately recognized and taken into account by most capability theorists is the experience of disrespect and humiliation, or to put it differently, a lack of recognition. The strict distinction and separation of mind and body is a particularly modern Western point of view that is routinely also applied to other cultures. Arguing against this dichotomy, the following contribution builds upon research on "implicit knowledge" and "knowing how" that allow us to view body and mind in their interaction. The focus is on Simeon Stylites the Elder, the most prominent representative of the Syrian ascetic movement, who, in a spectacular way and after incessant exercise, was able to (...) act from a sphere of internalized body-knowledge. Selected texts on him dating from Late Antiquity will illustrate how the ascetic body was represented as a body of knowledge with which the idea of Christian perfection was to be fulfilled. (shrink)

As a form of functional diversity, spinal cord injury expressed by tetraplegia is one of the most serious events that can impact people, affecting their family and socioeconomic life. The type of care relationship established in these cases will be essential for preserving autonomy. The objective of this study was to understand how care relationships influence the autonomy of people with tetraplegia and the dynamics that trigger practices of autonomy violation, maintenance and promotion. This research is inspired by problematization as (...) a methodology using the Arch of Maguerez as an analytical approach strategy that enables an engagement between empirical and theoretical data. Some models of care relationships identified in this study either promote or violate autonomy: the protectionist model, based on the biomedical interpretation model of disability and the bodily impediments caused by spinal cord injury; the participatory model, involving the patient's interest in adapting to their new condition of family and community life, seeking to understand the practical aspects of daily life; the sharing model, in which the complicity and understanding of new forms of bodily expression allow the caregiver to be almost an extension of the tetraplegic person's body; the delegate model, which occurs in relationships with professional caregivers; and the emancipatory model, which seeks to empower the patient, highlight potentialities, and encourage autonomy. The key components of these conceptual care models guided the elaboration of hypotheses for intervention with the objective of maintaining and promoting the autonomy of people with tetraplegia through supported care. Empirical evidence clearly shows that child poverty is a growing concern in the industrialized world and that the well-being of children is deeply affected by growing up in poverty in at least two ways. On the one hand, a low socioeconomic status jeopardizes the access to goods and services that are necessary for the current well-being of children. On the other hand, growing up in poverty also, in various ways, negatively affects the well-being in later life. On the basis of (...) the capability approach, we will show that the systematic protection and advancement of the wellbeing of children, and hence the reduction of child poverty, is a key task of social justice, which should therefore guide policy design and implementation. However, we will also discuss the special composition of the well-being of children and point out how it poses difficulties for state action in this regard. In particular, we will argue that the importance of love and affection for a child’s well-being limits considerably the possible political measures to provide fair life chances to all children. This again reflects the insight that poverty should not be reduced to economic inequality. (shrink)

Purpose: To show that the idea of non-dualistic thinking is of great value for some of the core problems of media philosophy (which often lacks the radical approach of Josef Mitterer's concept). Method: Non-dualistic philosophy, introduced by Mitterer, has a lot in common with other thinkers' discontent with the traditional way of describing the subject-object relation. Their differences and the impasses of phenomenological, structuralist and psychoanalytic media theory shall be examined to show whether and to what extent non-dualism could do (...) better. Findings: As sociologists and some media-philosophers are already adopting some principles of non-dualism without a real framework, non-dualistic thinking offers a new insight into the way that consent/dissent is manufactured in a world where most descriptions are given in a mediated (i.e., non-interpersonal) form. Implications: If we re-establish the personal freedom of gathering knowledge individually instead of "getting nearer to the truth," the way of looking at the escapist power of media also has to be reinterpreted. The early distinction between Lumiére-like "documentation" (= truth) and Méliès-like "fiction" (= perception open to alternatives) could be another dualism, which should be expurgated by the application of Mitterer's concepts. This essay theorizes how the enforcement of universal norms contributes to the solidification of sovereign rule. It does so by analyzing John Locke’s argument for the founding of the commonwealth as it emerges from his notion of universal crime in the Second Treatise of Government. Previous studies of punishment in the state of nature have not accounted for Locke’s notion of universal crime which pivots on the role of mankind as the subject of natural law. I argue that the dilemmas (...) specific to enforcing the natural law against “trespasses against the whole species” drive the founding of sovereign government. Reconstructing Locke’s argument on private property in light of universal criminality, the essay shows how the introduction of money in the state of nature destabilizes the normative relationship between the self and humanity. Accordingly, the failures of enforcing the natural law require the partitioning of mankind into separate peoples under distinct sovereign governments. This analysis theorizes the creation of sovereign rule as part of the political productivity of Locke’s notion of universal crime and reflects on an explicitly political, rather than normative, theory of “humanity.”. Der gefeierte Berliner Kulturphilosoph verarbeitete hier die traumatischen Erfahrungen des Ersten Weltkriegs und suchte durch sein Konzept der „europäischen Kultursynthese“ ethische Potentiale europäischer Integration und die Aussöhnung der Deutschen mit der westlichen Demokratie zu fundieren. Dazu verarbeitete er weit über 1000 Titel aus dem zeitgenössischen geschichtsphilosophischen Diskurs. On 9 August 1994 the German legislature revised the German Drug Law (AMG). Included in the revision is a passage requiring, for the first time, that the sponsors and investigators of clinical studies involving human subjects first obtain the approval of an ethics committee before carrying out such studies. According to the legislation, which takes effect on 17 August 1995, approval is to come from 'an independent ethics committee, set up and administered according to state law [emphasis added]' (1). Although (...) it is clear according to the text that the 16 federal states have been empowered to establish ethics committees within their jurisdictions, this does not mean that the state governments are free to transfer exclusive authority in the matter to their respective medical associations, a step that would effectively abolish Germany's private ethics committees. First, the legislation does not rule out the authorization of private ethics committees. Second, as legal scholars attest, the exclusive control of ethics committees by the medical associations would constitute an illegal monopoly. Third, it is arguable that medical-association ethics committees fail to meet the one prior federal requirement, that of independence. There is a great deal of confusion in Germany today about which kinds of ethics committees (public and/or private) the states will sanction before 17 August 1995. In an attempt to sort things out we present a brief explanation of how ther came to be two kinds of ethics committees in Germany, review the legal battle between the two over the issue of authorization, point out how the German legislature, in passing the recent bill, has missed an opportunity to clarify the issue and, finally suggest why the administration of ethics committees by the medical associations may be incompatible with the requirement that ethics committees be independent. Georg Lukac's most recent work of literary criticism, on the Nobel Prize winner Alexander Solzhenitsyn, hails the Russian author as a major force in redirecting socialist realism toward the level it once occupied in the 1920s when Soviet writers portrayed the turbulent transition to socialist society.In the first essay Lukacs compares the novella One Day in the Life of Ivan Denisovich to short pieces by "bourgeois" writers Conrad and Hemingway and explains the nature of Solzhenitsyn's criticism of the Stalinist period (...) implied in the situation, characters, and their interaction. He also briefly describes Matriona's House, An Incident at the Kretchetovka Station, and For the Good of the Cause -- stories that depict various aspects of life in Stalinist Russia.In the second, longer section, Lukacs greets Solzhenitsyn's novels The First Circle and Cancer Ward, which were published outside Russia, as representing "a new high point in contemporary world literature." These books mark Solzhenitsyn as heir to the best tendencies in postrevolutionary socialist realism and to the literary tradition of Tolstoy and Dostoevsky. Moreover, from the point of view of the development of the novel, Lukacs finds the Russian author to be a successful exponent of innovative methods originating in Thomas Mann's The Magic Mountain.The central problem of contemporary socialist realism is a predominant theme in the book: how to come to critical terms with the legacy of Stalin. The enthusiasm with which Lukacs acclaims Solzhenitsyn will not surprise those who have followed his persistent refusal to endorse the so-called socialist realist writers of the Stalinist era. He outlines the aspects of Solzhenitsyn's creative method that allows him to cross the ideological boudaries of the Stalinist tradition, yet he finds a basic pessimism in Solzhenitsyn's work that makes him a "plebeian" rather than a socialist writer.Of Ivan Denisovich and the future of socialist realist literature, Lukacs urges: "If socialist writers were to reflect upon their task, if they were again to feel an artistic responsibiliity towards the great problems of the present, powerful forces could be unleashed leading in the direction of relevant socialist literature. In this process of transformation and renewal, which signifies an abrupt departure from the socialist realism of the Stalin era, the role of landmark on the road to the future falls to Solzhenitsyn's story.". Humphreys and Forde conceptualize object representations as structural descriptions, without discussing the implications of structural description models. We argue that structural description models entail two major assumptions – a part-structure assumption and an invariance assumption. The invariance assumption is highly problematic because it contradicts a large body of findings which indicate that recognition performance depends on orientation and size. We will delineate relevant findings and outline an alternative conception.
