From “Informed” to “Engaged” Consent: Risks and Obligations in Consent for Participation in a Health Data Repository.Elizabeth Bromley, Alexandra Mendoza-Graf, Sandra Berry, Camille Nebeker & Dmitry Khodyakov - 2020 - Journal of Law, Medicine and Ethics 48 (1):172-182.
The development and use of large and dynamic health data repositories designed to support research pose challenges to traditional informed consent models. We used semi-structured interviewing to elicit diverse research stakeholders' views of a model of consent appropriate to participation in initiatives that entail collection, long-term storage, and undetermined future research use of multiple types of health data. We demonstrate that, when considering health data repositories, research stakeholders replace a concept of consent as informed with one in which consent is (...)

Introduction—Up, down, round and round: Verticalities in the history of science.Wilko Graf von Hardenberg & Martin Mahony - 2020 - Centaurus 62 (4):595-611.
History of science's spatial turn has focused on the horizontal dimension, leaving the role of the vertical mostly unexplored as both a condition and object of scientific knowledge production. This special issue seeks to contribute to a burgeoning discussion on the role of verticality in modern sciences, building upon a wider interdisciplinary debate about the importance of the vertical and the volumetric in the making of modern lifeworlds. In this essay and in the contributions that follow, verticality appears as a (...)

From Anti-Biotech to Nano-Watch: Early Risers and Spin-Off Campaigners in Germany, the UK and Internationally.Franz Seifert & Alexandra Plows - 2014 - NanoEthics 8 (1):73-89.
In this article we explore the emergence of a cluster of social movement organisations that have critically taken issue with nanotechnology in Germany, the UK and internationally. By applying concepts borrowed from Social Movement Research we demonstrate that this cluster is a ‘spin-off’ from the preceding movement against agrofood biotechnology, however, never succeeds in mobilizing a comparable ‘antinanotechnology movement’. We argue that the turn toward participatory and deliberative practices that is characteristic of nanotechnology policy and, to a major extent, is (...)

    Factive islands and meaning-driven unacceptability.Bernhard Schwarz & Alexandra Simonenko - 2018 - Natural Language Semantics 26 (3):253-279.
It is often proposed that the unacceptability of a semantically interpretable sentence can be rooted in its meaning. Elaborating on Oshima New frontiers in artificial intelligence, Springer, Berlin, 2007), we argue that the meaning-driven unacceptability of factive islands must make reference to felicity conditions, and cannot be reduced to the triviality of propositional content. We also observe, again elaborating on Oshima, that the triviality of factive islands need not be logical, but can be relative to a listener’s background assumptions. These (...)

  15. Introduction: Justice and Disadvantages during Childhood: What Does the Capability Approach Have to Offer?Gottfried Schweiger, Gunter Graf & Mar Cabezas - 2016 - Ethical Perspectives 23 (1):73 - 99.
Justice for children and during childhood and the particular political, social and moral status of children has long been a neglected issue in ethics, and in social and political philosophy. The application of general, adult-oriented theories of justice to children can be regarded as particularly problematic. Philosophers have only recently begun to explore what it means to consider children as equals, what goods are especially valuable to them, and what are the obligations of justice different agents have toward children. In (...)

The capability approach, which is closely connected to the works of Amartya Sen and Martha Nussbaum, is one possible theoretical framework that could be used to answer the question as to why poverty is a problem from a moral point of view. In this paper we will focus on the normative philosophical capability approach rather than the social scientific and descriptive perspective. We will show that the approach characterizes poverty mainly as a limitation of freedom and that it is precisely (...)

The strict distinction and separation of mind and body is a particularly modern Western point of view that is routinely also applied to other cultures. Arguing against this dichotomy, the following contribution builds upon research on "implicit knowledge" and "knowing how" that allow us to view body and mind in their interaction. The focus is on Simeon Stylites the Elder, the most prominent representative of the Syrian ascetic movement, who, in a spectacular way and after incessant exercise, was able to (...)

As a form of functional diversity, spinal cord injury expressed by tetraplegia is one of the most serious events that can impact people, affecting their family and socioeconomic life. The type of care relationship established in these cases will be essential for preserving autonomy. The objective of this study was to understand how care relationships influence the autonomy of people with tetraplegia and the dynamics that trigger practices of autonomy violation, maintenance and promotion. This research is inspired by problematization as (...)

Empirical evidence clearly shows that child poverty is a growing concern in the industrialized world and that the well-being of children is deeply affected by growing up in poverty in at least two ways. On the one hand, a low socioeconomic status jeopardizes the access to goods and services that are necessary for the current well-being of children. On the other hand, growing up in poverty also, in various ways, negatively affects the well-being in later life. On the basis of (...)

Purpose: To show that the idea of non-dualistic thinking is of great value for some of the core problems of media philosophy (which often lacks the radical approach of Josef Mitterer's concept). Method: Non-dualistic philosophy, introduced by Mitterer, has a lot in common with other thinkers' discontent with the traditional way of describing the subject-object relation. Their differences and the impasses of phenomenological, structuralist and psychoanalytic media theory shall be examined to show whether and to what extent non-dualism could do (...)

“A Trespass against the Whole Species”: Universal Crime and Sovereign Founding in John Locke’s Second Treatise of Government.Sinja Graf - 2018 - Political Theory 46 (4):560-585.
This essay theorizes how the enforcement of universal norms contributes to the solidification of sovereign rule. It does so by analyzing John Locke’s argument for the founding of the commonwealth as it emerges from his notion of universal crime in the Second Treatise of Government. Previous studies of punishment in the state of nature have not accounted for Locke’s notion of universal crime which pivots on the role of mankind as the subject of natural law. I argue that the dilemmas (...)

On 9 August 1994 the German legislature revised the German Drug Law (AMG). Included in the revision is a passage requiring, for the first time, that the sponsors and investigators of clinical studies involving human subjects first obtain the approval of an ethics committee before carrying out such studies. According to the legislation, which takes effect on 17 August 1995, approval is to come from 'an independent ethics committee, set up and administered according to state law [emphasis added]' (1). Structural descriptions in HIT – a problematic commitment.Markus Graf & Werner X. Schneider - 2001 - Behavioral and Brain Sciences 24 (3):483-484.
Humphreys and Forde conceptualize object representations as structural descriptions, without discussing the implications of structural description models. We argue that structural description models entail two major assumptions – a part-structure assumption and an invariance assumption. The invariance assumption is highly problematic because it contradicts a large body of findings which indicate that recognition performance depends on orientation and size. We will delineate relevant findings and outline an alternative conception.
