Each subsequent chapter discusses topics such as: Origin of Laws, Inherited Education, Rulers & Leaders, Evolution, Tyranny, Taxation, & many others. A very readable text, which invokes additional thought on a variety of topics.

Guidelines recommend a ‘do-not-resuscitate’ code status for inpatients in which cardiopulmonary resuscitation attempts are considered futile because of low probability of survival with good neurological outcome. We retrospectively assessed the prevalence of DNR code status and its association with presumed CPR futility defined by the Good Outcome Following Attempted Resuscitation score and the Clinical Frailty Scale in patients hospitalised in the Divisions of Internal Medicine and Traumatology/Orthopedics at the University Hospital of Basel between September 2018 and June 2019. The definition (...) of presumed CPR futility was met in 467 of 2889 patients. 866 patients had a DNR code status. In a regression model adjusted for age, gender, main diagnosis, nationality, language and religion, presumed CPR futility was associated with a higher likelihood of a DNR code status. In the subgroup of patients with presumed futile CPR, 144 of 467 had a full code status, which was independently associated with younger age, male gender, non-Christian religion and non-Swiss citizenship. We found a significant proportion of hospitalised patients to have a full code status despite the fact that CPR had to be considered futile according to an established definition. Whether these decisions were based on patient preferences or whether there was a lack of patient involvement in decision-making needs further investigation. (shrink)

The current research investigates a combination of two instructional approaches, tutored problem solving and worked examples. Tutored problem solving with automated tutors has proven to be an effective instructional method. Worked‐out examples have been shown to be an effective complement to untutored problem solving, but it is largely unknown whether they are an effective complement to tutored problem solving. Further, while computer‐based learning environments offer the possibility of adaptively transitioning from examples to problems while tailoring to an individual learner, the (...) effectiveness of such machine‐adapted example fading is largely unstudied. To address these research questions, one lab and one classroom experiment were conducted. Both studies compared a standard Cognitive Tutor with two example‐enhanced Cognitive Tutors, in which the fading of worked‐out examples occurred either in a fixed way or adaptively. Results indicate that the adaptive fading of worked‐out examples leads to higher transfer performance on delayed posttests than the other two methods. (shrink)

While many philosophers of law spend their careers exploring the warrens of a single neighbourhood within the sprawling cities of the philosophy of law, Larry Alexander has rambled widely, exploring obscure alleyways and dense downtowns, making significant and influential contributions along the way. The volume under review, a Festschrift in his honour, draws from a correspondingly wide range of areas of scholarship, from the philosophy of criminal law and punishment to constitutional law, from analytic jurisprudence to moral philosophy. Thus, (...) given the breadth and depth of Alexander’s influence, this volume provides a partial snapshot of some of the major preoccupations of American legal theory over the last few decades. In light of the breadth of topics considered, as well as its substantial length—the book includes twenty‐two papers, an introduction by Heidi Hurd, the editor, and a substantial reply by Alexander—my discussion is selective and evocative, rather than comprehensive and detailed. All the more so, as many of the papers are important contributions in their own right that merit close scrutiny. (shrink)

Apart from his Consolation of Philosophy, perhaps the most well known text of Boethius is his discussion of universals in the Second Commentary on Porphyry’s Isagoge.1 In that passage, he first reviews the arguments for and against the existence of universal entities, and then offers a theory he attributes to Alexander of Aphrodisias, a kind of theory called in recent times “moderate realism,” according to which there are no universal entities in the ontology of the world, but nevertheless there (...) is an objective, non-arbitrary basis for the formation of our universal or general concepts about that world. At the very end of the passage, Boethius adds the intriguing comment that he has presented this view not necessarily because it is his own, but because it is the one that fits Aristotle’s.. (shrink)

This article, prompted by an extended essay published in the Journal of Medical Ethics by Charles Foster, and the current controversy surrounding the case of Vincent Lambert, analyses the legal and ethical arguments in relation to the withdrawal of life-sustaining treatment from patients with prolonged disorders of consciousness. The article analyses the legal framework through the prism of domestic law, case-law of the European Court of Human Rights and the Convention on the Rights of Persons with Disabilities, and examines (...) the challenge to the ethical consensus made by Foster. It concludes that the right approach remains a version of the approach that has prevailed for the last 25 years since the decision in Airedale NHS Trust v Bland[1993] AC 789, refined to reflect that that there is now, and rightly, a much more limited place for judgments made about the ‘burden’ of treatment or the quality of life enjoyed by the person made on the basis of assumptions about that person as a category as opposed to investigation of that person as an individual human being. This book closely examines our commonly held beliefs about human suffering, and offers unique insights into God's role in why we suffer. Dr. Perri critically examines what it means to be human from a Judeo-Christian perspective, and extrapolates from the work of Carl Gustav Jung showing a deeply complex development of human transcendence in human suffering. On an interpersonal level, Dr. Perri elaborates on the work of Martin Buber and Emanuel Levinas and shows how our suffering can be shared and (...) lessened by our unconditionality and presence for the other. Scriptural passages are quoted from both the Hebrew and New Testament texts, and are used to depict the suffering of humankind as seen in the face of Job. It was this face, according to Perri, that Jesus saw in the faces of those He came to redeem, and that ultimately brought Him to the crucifix of redemption. Dr. Perri challenges Sartre's position that our existence precedes our essence, and draws on the work of Abraham Joshua Heschel and Christian theology in this regard. He further elaborates a neurodevelopmental paradigm that creates essence as the basis of our freedom to choose. This book can be read and studied by both professionals in the helping and healing professions, and lay persons seeking to better understand our suffering, and how to better help those who suffer. While it might seem prima facie plausible that divine foreknowledge is all that is needed for prophecy, this seems incorrect. To issue a prophecy, God hasto know not just how someone will act, but how someone would act were the prophecy issued. This makes some think that Middle Knowledge is required.I argue that Thomas Flint’s two Middle Knowledge based accounts of prophecy are unsatisfactory, but one of them can be repaired. Recent studies have shown that self‐explanation is an effective metacognitive strategy, but how can it be leveraged to improve students' learning in actual classrooms? How do instructional treatments that emphasizes self‐explanation affect students' learning, as compared to other instructional treatments? We investigated whether self‐explanation can be scaffolded effectively in a classroom environment using a Cognitive Tutor, which is intelligent instructional software that supports guided learning by doing. In two classroom experiments, we found that students who explained their steps during problem‐solving (...) practice with a Cognitive Tutor learned with greater understanding compared to students who did not explain steps. The explainers better explained their solutions steps and were more successful on transfer problems. We interpret these results as follows: By engaging in explanation, students acquired better‐integrated visual and verbal declarative knowledge and acquired less shallow procedural knowledge. The research demonstrates that the benefits of self‐explanation can be achieved in a relatively simple computer‐based approach that scales well for classroom use. (shrink)

The present study investigated whether individual differences between psychologists in thinking styles are associated with accuracy in diagnostic classification. We asked novice and experienced clinicians to classify two clinical cases of clients with two co-occurring psychological disorders. No significant difference in diagnostic accuracy was found between the two groups, but when combining the data from novices and experienced psychologists accuracy was found to be negatively associated with certain decision making strategies and with a higher self-assessed ability and preference for a (...) rational thinking style. Our results underscore the idea that it might be fruitful to look for explanations of differences in the accuracy of diagnostic judgments in individual differences between psychologists (such as in thinking styles or decision making strategies used), rather than in experience level. An important task in mathematical sciences is to make quantitative predictions, which is often done via the solution of differential equations. In this paper, we investigate why, to perform this task, scientists sometimes choose to use numerical methods instead of analytical solutions. Via several examples, we argue that the choice for numerical methods can be explained by the fact that, while making quantitative predictions seems at first glance to be facilitated by analytical solutions, this is actually often much easier with (...) numerical methods. Investigating Girard's new propositionnal calculus which aims at a large scale study of computation, we stumble quickly on that question: What is a multiplicative connective? We give here a detailed answer together with our motivations and expectations.

The transference theory reduces causation to the transmission of physical conserved quantities, like energy or momenta. Although this theory aims at applying to all felds of physics, we claim that it fails to account for a quantum electrodynamic effect, viz. the Aharonov-Bohm effect. After having argued that the Aharonov-Bohm effect is a genuine counter-example for the transference theory, we offer a new physicalist approach of causation, ontic and modal, in which this effect is embedded.

Theories of quantum gravity generically presuppose or predict that the reality underlying relativistic spacetimes they are describing is significantly non-spatiotemporal. On pain of empirical incoherence, approaches to quantum gravity must establish how relativistic spacetime emerges from their non-spatiotemporal structures. We argue that in order to secure this emergence, it is sufficient to establish that only those features of relativistic spacetimes functionally relevant in producing empirical evidence must be recovered. In order to complete this task, an account must be given of (...) how the more fundamental structures instantiate these functional roles. We illustrate the general idea in the context of causal set theory and loop quantum gravity, two prominent approaches to quantum gravity. (shrink)

Uffink and Valente claim that there is no time-asymmetric ingredient that, added to the Hamiltonian equations of motion, allows to obtain the Boltzmann equation within the Lanford’s derivation. This paper is a discussion and a reply to that analysis. More specifically, I focus on two mathematical tools used in this derivation, viz. the Boltzmann–Grad limit and the incoming configurations. Although none of them are time-asymmetric ingredients, by themselves, I claim that the use of incoming configurations, as taken within the B–G (...) limit, is such a time-asymmetric ingredient. Accordingly, this leads to reconsider a kind of Stoßzahlansatz within Lanford’s derivation. (shrink)

In this paper, I present a discrete solution for the paradox of Achilles and the tortoise. I argue that Achilles overtakes the tortoise after a finite number of steps of Zeno’s argument if time is represented as discrete. I then answer two objections that could be made against this solution. First, I argue that the discrete solution is not an ad hoc solution. It is embedded in a discrete formulation of classical mechanics. Second, I show that the discrete solution cannot (...) be falsified experimentally. (shrink)

No introductory textbook can do complete justice to the subject of ethics. The best it can do is to help students develop a basic competency in ethical analysis and acquire a measure of confidence in their judgment; it should also stimulate enough interest in the subject that they will want to continue learning about it, formally or informally, when the final chapter is completed and the course is over. Even that relatively modest aim is difficult to achieve. The author must (...) strike the right balance between the theoretical and the practical, between breadth and depth of treatment, and between rigor and relevance, so that students are challenged but not daunted. Je propose d’analyser une pratique de la recherche en mathématiques constructives, celle qui consiste à reformuler constructivement les théories physiques. Je discute plus précisément trois aspects de cette pratique. Je montre d’abord que celle-ci a la particularité d’être motivée par des considérations philosophiques et comment la physique est utilisée pour arbitrer un débat de philosophie des mathématiques entre constructivisme et classicisme. Ensuite, j’identifie la méthodologie de la recherche en mathématiques que cette pratique implique et montre qu’il s’agit, selon une terminologie (...) empruntée à Poincaré, d’une méthodologie de « logiciens ». Enfin, je montre que dans cette pratique, les théories physiques ont un rôle heuristique sur le développement des mathématiques constructives. Elles permettent avec succès de stimuler la recherche d’énoncés constructifs et d’orienter la recherche en mathématiques constructives vers de nouveaux domaines. (shrink)

Human interaction with the living world, in science and beyond, always involves classification. While it has been a long-standing scientific goal to produce a single all-purpose taxonomy of life to cater for this need, classificatory practice is often subject to confusion and disagreement, and many philosophers have advocated forms of classificatory pluralism. This entails that multiple classifications should be allowed to coexist, and that whichever classification is best, is context-dependent. In this paper, we discuss some practical consequences of classificatory pluralism, (...) in particular with regard to how one is supposed to find the best classification for a given context. We do so by means of a case study concerning oaks, in particular the pedunculate oak (_Quercus robur_ L.) and the sessile oak (_Quercus petraea_ (Matt.) Liebl.), two important putative species that present several classificatory challenges; and by applying one recent philosophical framework conceptualizing classification, the so-called Grounded Functionality Account (GFA) of (natural) kinds. We show how the GFA elucidates several issues related to oak classification and gives directions to optimize classificatory practices, and discuss some implications for scientific taxonomy. (shrink)

In this article, I reflect on the nature of innovation to lay the groundwork for a philosophy of innovation. First, I contrast the contemporary techno-economic paradigm of innovation with the work of Joseph Schumpeter. It becomes clear that Schumpeter’s work provides good reasons to question the techno-economic paradigm of innovation. Second, I contrast ‘innovation’ with ‘technology’ and identify five differences between the two concepts. Third, I reflect on the process-outcome dimension and the ontic-ontological dimension of innovation to develop four characteristics (...) of the phenomenon of innovation. These four characteristics move beyond the techno-economic paradigm of innovation and highlight, first, the importance of its process dimension understood as ontogenesis, second, the outcome of innovation, and third, the importance of the ontological dimension of innovation, which is considered adjacent to its fourth characteristic, i.e., the ontic level of the outcome of innovation. After drawing conclusions, a research agenda for future research is provided. (shrink)

Because climate change can be seen as the blind spot of contemporary philosophy of technology, while the destructive side effects of technological progress are no longer deniable, this article reflects on the role of technologies in the constitution of the (post)Anthropocene world. Our first hypothesis is that humanity is not the primary agent involved in world-production, but concrete technologies. Our second hypothesis is that technological inventions at an ontic level have an ontological impact and constitutes world. As we object to (...) classical philosophers of technology like Ihde and Heidegger, we will sketch the progressive contribution of our conceptuality to understand the role of technology in the Anthropocene world. Our third hypothesis is that technology has emancipatory potential and in this respect, can inaugurate a post-Anthropocene World. We consider these three hypotheses to develop a philosophical account of the ontology of technology beyond an abstract and deterministic understanding. This concept enables us to philosophically reflect on the role of technology in the Anthropocene World in general, and its contribution to the transition to the post-Anthropocene World in particular. In this article, we develop a concept of stakeholder dialogue in responsible innovation (RI) processes. The problem with most concepts of communication is that they rely on ideals of openness, alignment and harmony, even while these ideals are rarely realized in practice. Based on the work of Burke, Habermas, Deetz and Levinas, we develop a concept of stakeholder dialogue that is able to deal with fundamentally different interests and value frames of actors involved in RI processes. We distinguish four main (...) characteristics of stakeholder dialogue. Dialogical responsiveness (1) enhances self-criticism, (2) is characterized by the constitution and the destruction of the self or identity of the actors involved, (3) consists only in the actual enactment of the dialogue and (4) is primarily responsive to the grand challenges of our time. Based on our findings, we provide a novel conceptualization of the central notion of responsiveness in the RI literature. (shrink)

This paper studies some model-theoretic properties of special groups of finite type. Special groups are a first-order axiomatization of the algebraic theory of quadratic forms, introduced by Dickmann and Miraglia, which is essentially equivalent to abstract Witt rings. More precisely, we consider elementary equivalence, saturation, elementary embeddings, quantifier elimination, stability and Morley rank.

The human intestinal ecosystem, previously called the gut microflora is now known as the Human Gut Microbiota. Microbiome research has emphasized the potential role of this ecosystem in human homeostasis, offering unexpected opportunities in therapeutics, far beyond digestive diseases. It has also highlighted ethical, social and commercial concerns related to the gut microbiota. As diet factors are accepted to be the major regulator of the gut microbiota, the modulation of its composition, either by antibiotics or by food intake, should be (...) regarded as a fascinating tool for improving the human health. Scientists, the food industry, consumers and policymakers alike are involved in this new field of nutrition. Defining how knowledge about the HGM is being translated into public perception has never been addressed before. This raises the question of metaphors associated with the HGM, and how they could be used to improve public understanding, and to influence individual decision-making on healthcare policy. This article suggests that a meeting of stakeholders from the social sciences, basic research and the food industry, taking an epistemological approach to the HGM, is needed to foster close, innovative partnerships that will help shape public perception and enable novel behavioural interventions that would benefit public health. This paper aims to contribute to the ongoing conceptual debate on responsible innovation, and provides innovation practices and processes that can help to implement responsible innovation in the business context. Based on a systematic literature review of 72 empirical scholarly articles, it was possible to identify, analyse and synthesise empirical findings reported in studies on social, sustainable and responsible innovation practices in the business context. The synthesis of the included articles resulted in a refined framework for responsible innovation in the (...) business context. This framework includes an overview of innovation practices and processes that can enhance the dimensions of responsible innovation: anticipation, reflexivity, inclusion, deliberation, responsiveness and knowledge management. Additionally, knowledge gaps are identified and a research agenda for responsible innovation is proposed. This review can therefore serve as a next step in the theoretical and practical development of responsible innovation in general, and in the business context in particular. (shrink)

This study develops a genetic phenomenological sociology of space from the phenomenology and phenomenological sociology of space. Based on relational ontology, it argues that social space is a social relationship in genesis. An Apple walk-in store and an Apple online store are examples to illustrate the essence of social space. Any Apple store as a social space represents a set of social relations. The genetic phenomenological sociology of space in both store types includes two parts: first, the social ontology of (...) space, that is, ‘being-in-the-Apple-store’ or ‘being-in-the-Apple-online-store’; and second, the social epistemology of space, that is, the act of ‘encountering’ in either store. Examining the existence of space ontologically and the mode of existence epistemologically clarifies that the actual ‘meaning’ of social space, an Apple store or an Apple online store in this study, emerges through the act of encountering. Three characteristics of encountering are placelessness, ‘de-distancing,’ and mediation. (shrink)

The starting point of this article is the observation that the emergence of the Anthropocene rehabilitates the need for philosophical reflections on the ontology of technology. In particular, if technological innovations on an ontic level of beings in the world are created, but these innovations at the same time create the Anthropocene World at an ontological level, this raises the question how World creation has to be understood. We first identify four problems with the traditional concept of creation: the anthropocentric, (...) ontic and outcome orientation of traditional concepts of creation, as well as its orientation of material fabrication. We subsequently develop a progressive concept of World creation with four characteristics that move beyond the traditional conceptuality: a materialistic concept of creation that accounts for the ontogenetic process and the ontic and ontological nature of creation, and is conceptualized as semantic creation of the World in which we live and act.
