Abstract In 1995, the constitution of the Mexican state of Oaxaca was reformed to recognise indigenous usages and customs for the election of municipal governments. This recognition is problematic from a normative perspective, as women, new?comers and dwellers in municipal sub?units are disenfranchised in a good number of indigenous municipalities of the state. Nevertheless, this article argues against a summary assessment of the (presumably illiberal) consequences of this recognition policy. Following James Tully, it advocates an intercultural, dialogical and inclusive procedure (...) to tackle the perils of the politics of recognition in Oaxaca and Mexico. However, this procedure?based approach raises problems of its own related to the issues of representation and intra?communal divisions. As a result, the ultimate role of substantive commitments, in particular to individual rights, needs to be recognised. Despite these shortcomings, though, an approach based on an intercultural, dialogical and inclusive conflict?solving procedure is the best option to deliver more just answers to indigenous demands for recognition. When should we expect compliance with international human rights norms? Previous literature on the causal mechanisms underlying compliance have focused independently on the roles of state willingness, thought of as the preferences of the regime leadership, and on state capacity, in improving human rights practices within a state. We build an argument that neither of these factors are sufficient on their own to improve compliance with human rights norms. Instead, improved human rights practices require both “the will and the way.” (...) Our central hypothesis is that capacities and willingness, acting jointly, are key determinants of improvements in compliance with international human rights norms. The paper confirms this proposition using two-staged and single-stage regression models and a time-series cross-sectional approach at the country-year level. A highly capable bureaucracy and a state that has signaled its willingness through the acceptance of individual complaint and inquiry procedures in the UN treaty regime are jointly necessary for improved human rights practices. In this paper we discuss the extent to which the very existence of substructural logics puts the Tarskian conception of logical systems in jeopardy. In order to do this, we highlight the importance of the presence of different levels of entailment in a given logic, looking not only at inferences between collections of formulae but also at inferences between collections of inferences—and more. We discuss appropriate refinements or modifications of the usual Tarskian identity criterion for logical systems, and propose an (...) alternative of our own. Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

This paper makes the claim that the overall structure of Plato’s Laws follows the principle of indirect access to the knowledge of human soul, which consists in the understanding that a philosophical approach to the soul is only possible initially through an image of it. The structure of the Laws can be interpreted as a movement towards the soul’s interior, beginning with the famous image of the puppet. According to this image, the movement opens with the analysis of the non-rational (...) elements of the soul, which are capable of an harmonic relation with the rational element, and advances bit to bit to the rational or epistemic element. The political necessity of undertaking the dialectical investigation in order to attain a philosophical knowledge of the human soul and its specific excellence appears only at the end of the dialogue. In this way, the structure of the Laws dramatizes the progressive birth of philosophy, conceived as the dialectical investigation of the unity of virtue, starting from the initial understanding of the human soul contained in the myth of the puppet. El objetivo del presente ensayo es reflexionar sobre el modo como la investigación en filosofía –especialmente la investigación formativa que se lleva a cabo en un doctorado– es, por un lado, una experiencia erótica, pues el filósofo es siempre un principiante que está jalonado por el ansia de infinitud y, a la vez, por el hecho de no poder avanzar sino de parcialidad en parcialidad; y, por otro, una experiencia de la amistad, pues el trabajo de pensar jamás se hace (...) en solitario, sino que implica la compañía, el amparo de un interlocutor que amorosamente recrea con sus palabras una constelación de sentido que nos revela que no sabemos. Veremos entonces que lo que está en juego aquí es la invitación a considerar que la realización de la investigación de una tesis doctoral en filosofía es auténtica experiencia de amor, encuentro y compañía. Complementariamente desde la conexión entre ética y política el conflicto Palestino-Israelí y revisa brevemente las Teorías del Fin (...) de la Historia y Guerra de Civilizaciones, de Fukuyama y Huntington, respectivamente, para concluir en un plano de reflexiones y proposiciones, que desembocan en la búsqueda de construcción de un Nuevo Contrato Social Planetario. Jerónimo Salvador de Araujo, in this brief treatise, argues why it should be considered that there is a philosophy of arms, as well as why said philosophy must conform a science. For this purpose, he will rely on the Sacred Scriptures as an initial legitimation and, throughout the argumentation, on Aristotle and his definitions of universal science, particular science, technique, etc. The whole treatise is structured following syllogistic forms of Aristotelian origin.

This book brings together a number of contributions dealing with certain fundamental structures of practical rationality, as they are presented in the areas of the philosophy of action and normative ethics, namely: intentionality, normativity, and reflexivity. With the term “intentionality,” is meant a set of problems that are linked not only with the teleological structure of praxis-oriented rationality, but also with its temporal structure. “Normativity”, in turn, refers to a distinct set of problems, which cannot simply be reduced to those (...) entailed in the intentional nature of human action, even if this notion incorporates a reference to the good or value in its very structure. Finally, with the term “reflexivity” we point at the linkage between the normative dimension of reason with both the contingent circumstances of action and the moral receptivity of the agent, as it is experienced in moral judgment. El presente artículo ofrece una revisión crítica de la noción de injusticia hermenéutica de Miranda Fricker a partir de dos elementos de la obra de Frantz Fanon: 1) la «historicidad» como una carga cultural en las categorías sociales que es productiva, lo que exige cuestionar la definición de injusticia hermenéutica como ausencia o tergiversación de categorías; 2) la redefinición que Fanon hizo del «esquema corporal» de Merleau Ponty: la experiencia vivida del cuerpo, lo que muestra que los recursos hermenéuticos no (...) son solo categorías mentales, sino que están imbricados con la dimensión material. Nuestro objetivo es mostrar cómo estos dos elementos de la teoría fanoniana hacen una contribución a la noción de injusticia hermenéutica y por qué esta es relevante para entender la injusticia estructural del racismo. Joseph Li Vecchi entwickelt ein formales Modell für Inferenzen, die auf der Grundlage von analogischen Verhältnissen basieren. Niels Öffenberger charakterisiert die abgeleiteten Wahrheitswerte, die sich durch die Dichotomie der schlichten (...) Wahrheit und der schlichten Falschheit ergeben. Paloma Pérez-Ilzarbe und María Cerezo verteidigen durch eine Interpretation der Struktur der Assertion die Gültigkeit des Bivalenz prinzips im Rahmen der Aristotelischen Wahrheitstheorie. Gabriela Rossi präsentiert eine systematische Darstellung der Rolle der lysis als Instrument der Aristotelischen Dialektik. Mirko Skarica untersucht die zeitgenössische Rezeption der Aristotelischen Auffassung des einfachen prädikativen Satzes bei Vertretern sowohl der analytischen als auch der phänomenologischen Tradition. Alejandro G. Vigo charakterisiert das Aristotelische Modell der Kausalerklärung in der Naturphilosophie in Verbindung mit dem Begriff eines sog. Hintergrundsholismus. (shrink)

El artículo intenta establecer las configuraciones que asume el humanismo crítico en la escritura de Aimé Césaire en la encrucijada de la diferencia colonial, entendida desde una perspectiva decolonial, y a partir de una noción de espectralidad que deriva y se diferencia de las perspectivas derrideanas. Así entonces, se destaca el hecho de que la escritura de Césaire produce una fuerte impugnación de los procesos de la representación colonial y abre el campo de la experiencia política y cultural signada por (...) la heterogeneidad. The article tries to establish the settings that the critical humanism assumes in Aimé Césaire´s writing at the crossroads of the colonial difference, which is understood from a decolonial perspective, and from a notion of spectrality which derives and differs from the Derridean perspective. So then, the article remarks the fact that Césaire´s writing produces a strong challenge to the processes of colonial representation and it opens the field of political and cultural experience marked by heterogeneity. Focusing on the contributions of Frantz Fanon's writing to the construction of a theory of the postcolonial subject, this book engages post-structuralist discussions on subjectivity and explores the most important readings and discussions of Fanon's work. Problems such as historicity, contingency, and the positions of the subject in postcolonial contexts receive special attention together with phenomenological approaches to Fanonian writing. The central idea is to give Fanon a privileged place in social, political, and cultural analysis. The objectives of the book (...) are to insert Fanon’s texts in contemporary critical theory on modernity and coloniality and to incorporate Fanon in the epistemological and conceptual context of the academy. This innovative work allows us to understand Fanon’s writing as key to linking the experiences and critical developments between the global south and the global north. (shrink)

El artículo se concentra en el cruce conceptual y político de dos escrituras, las de Frantz Fanon y Gilles Deleuze y Félix Guattari, en el momento en que trabajan una crítica a la representación como categoría filosófica y política. Aprovechamos las inducciones que están en él para trazar nuestra propia intervención en dicha crítica. Hemos puesto en contacto estas dos escrituras porque apostamos a comprenderlas dentro de un movimiento crítico de la modernidad, pero también de la colonialidad. Esta última categoría, (...) con frecuencia escamoteada, permite conectar textos, conceptos y escrituras para entender la dimensión organizacional de los cuerpos en la diferencia colonial y en la racialización. Los textos de Fanon son anteriores, cronológicamente hablando, a los de Deleuze y Guattari. No obstante, los tres autores participan del proceso crítico que se inició a mediados de siglo XX, en particular a partir del movimiento histórico de la descolonización. Si bien cada una de estas escrituras apunta inicialmente a audiencias distintas, ambas ofrecen intervenciones asimilables entre sí para una heurística en nuestro presente de la relación modernidad/colonialidad. Abstract This article focuses on the conceptual and political crossroads of two contemporary writings, Frantz Fanon´s and Gilles Deleuze and Felix Guattari´s, and it read them in the precise moment they develop a critique of representation as a philosophical and political category. We take inductions that are in it to draw our own involvement in such criticism. Both writings are committed not only to produce a critical movement of modernity but also of coloniality, especially Fanon. The latter category, often retracted, is crucial to connect texts and concepts to understand the organizational dimension of bodies in the colonial difference and racialization. Fanon´s texts predate, chronologically speaking, to Deleuze and Guattari work. However, both are part of the critical process that began in the mid-twentieth century, particularly from the historical movement of decolonization. While each of these writings is initially aimed at different audiences, both offer comparable interventions which make sense for a heuristic, in our present, of modern/colonial relationships. The article addresses the relationship between modernity and coloniality in the field of colonial theories, both postcolonial and decolonial, emphasizing the problems of representation and putting in the foreground the problem of not having a language suitable to express the tensions that the same relationship produces. For this, it discuss the crossroads of the coloniality and modernity, present in representative authors of these theories, and it assumes such a crossroads as a cultural and theoretical arena. From there, a reading exercise (...) is proposed, as an example, in texts by Joseph Conrad and Frantz Fanon. Finally, the article discusses some nuances of the problem of representation that could affect our understanding of the processes of subjectivity, their histories and the morphologies of our knowledge. La circulación de la escritura de Frantz Fanon en medios intelectuales y políticos de los años sesenta y setenta en la Argentina, ofrece la oportunidad de analizar dos dimensiones centrales de sus tesis sobre el colonialismo: por un lado, el carácter revisionista que ellas tienen con respecto a visiones eurocéntricas de la modernidad y, por otro, las formas específicas en que se articularon con algunas posiciones intelectuales del período. Recorremos algunos aspectos de tres lecturas de Fanon: las de Francisco Delich, (...) José Sazbón y Carlos Fernández Pardo y las ponemos en relación con los debates poscoloniales y descoloniales acerca de la colonialidad del saber y la diferencia colonial. The circulation of Frantz Fanon's writings in the political and intellectual milieu of the sixties and seventies in Argentina offers the opportunity to analyze two central dimensions of his theses about colonialism: first, their revisionist nature in relation to Eurocentric visions of modernity, and second, the specific ways in which they articulated with some intellectual points of view from that period. We visit here three readings of Fanon, by Francisco Delich, José Sazbón and Carlos Fernández Pardo, and place them in relation to postcolonial and decolonial debates about the coloniality of knowledge and colonial difference. Le printemps austral au Chili a été le théâtre d’un grand soulèvement qui a mis fin à la politique néolibérale de Piñera tout en critiquant le cadre constitutionnel, héritage de l’époque Pinochet. Au départ, le mouvement était une grève métropolitaine contre l’augmentation du prix du ticket des transports publics. Face à la répression qui a suivi la grève s’est transformée en un soulèvement des multitudes pour la démocratie et un nouveau système de protection sociale. Même les tentatives de médiation institutionnelles (...) ne semblent ne pas avoir de succès pour bloquer le mouvement qui tout de même rentre en hibernation à cause de la pandémie. Mais le résultat du plébiscite pour une nouvelle constituante qui montre que le pays s’émancipe du cadre pinochetiste. (shrink)

In a recent paper, Berger and Nanay consider, and reject, three ways of addressing the phenomenon of unconscious perception within a naïve realist framework. Since these three approaches seem to exhaust the options open to naïve realists, and since there is said to be excellent evidence that perception of the same fundamental kind can occur, both consciously and unconsciously, this is seen to present a problem for the view. We take this opportunity to show that all three approaches considered remain (...) perfectly plausible ways of addressing unconscious perception within a naïve realist framework. So far from undermining the credibility of naïve realism, Berger and Nanay simply draw our attention to an important question to be considered by naïve realists in future work. Namely, which of the approaches considered is most likely to provide an accurate account of unconscious perception in each of its purported incarnations? (shrink)

Health Wearable Devices enhance the quality of life, promote positive lifestyle changes and save time and money in medical appointments. However, Wearable Devices store large amounts of personal information that is accessed by third parties without user consent. This creates ethical issues regarding privacy, security and informed consent. This paper aims to demonstrate users’ ethical perceptions of the use of Wearable Devices in the health sector. The impact of ethics is determined by an online survey which was conducted from patients (...) and users with random female and male division. Results from this survey demonstrate that Wearable Device users are highly concerned regarding privacy issues and consider informed consent as “very important” when sharing information with third parties. However, users do not appear to relate privacy issues with informed consent. Additionally, users expressed the need for having shorter privacy policies that are easier to read, a more understandable informed consent form that involves regulatory authorities and there should be legal consequences the violation or misuse of health information provided to Wearable Devices. The survey results present an ethical framework that will enhance the ethical development of Wearable Technology. (shrink)

Este artículo se ocupa de la concepción del alma elaborada por Alejandro de Afrodisia, con especial atención a un aspecto específico que la distingue de la concepción aristotélica: la introducción de una facultad o capacidad impulsiva. En primer lugar, se considera la reformulación de la concepción jaristotélica del alma como forma del cuerpo que Alejandro lleva a cabo, en conexión con su original reconstrucción del hilemorfismo. Aquí se pone especial énfasis en el modo en el cual Alejandro (...) construye lo que puede llamarse un “modelo escalonado” de composición hilemórfica. En segundo lugar, se considera el tratamiento de la facultad impulsiva, atendiendo especialmente al rendimiento teórico que extrae Alejandro de la adopción de la noción de impulso. Por último, se considera brevemente el modelo reformulado de psicología de la acción que elabora Alejandro, para dar cuenta de la secuencia del proceso de producción del movimiento voluntario y la acción. Se trata de un modelo explicativo que deja de lado el recurso aristotélico a la estructura del silogismo práctico e incorpora, en cambio, los elementos más característicos de la concepción estoica. Ello no implica, sin embargo, el abandono de la tesis básica de la concepción aristotélica de la motivación, por oposición al intelectualismo socrático, a saber: la tesis de la primacía del deseo, en todas sus posibles formas, como factor que da cuenta del origen del movimiento voluntario y la acción. It has been claimed that naïve realism predicts phenomenological similarities where there are none and, thereby, mischaracterises the phenomenal character of perceptual experience. If true, this undercuts a key motivation for the view. Here, we defend naïve realism against this charge, proposing that such arguments fail (three times over). In so doing, we highlight a more general problem with critiques of naïve realism that target the purported phenomenological predictions of the view. The problem is: naïve realism, broadly construed, doesn’t make (...) phenomenological predictions of the required sort. So, as a result, opponents must resign themselves to attacking specific incarnations of naïve realism, or approach matters quite differently. (shrink)

While recognizing its origins and scope, Alejandro A. Vallega offers a new interpretation of Latin American philosophy by looking at its radical and transformative roots. Placing it in dialogue with Western philosophical traditions, Vallega examines developments in gender studies, race theory, postcolonial theory, and the legacy of cultural dependency in light of the Latin American experience. He explores Latin America’s engagement with contemporary problems in Western philosophy and describes the transformative impact of this encounter on contemporary thought.

Despite the promises made by molecular evolutionists since the early 1960s that phylogenies would be readily reconstructed using molecular data, the construction of molecular phylogenies has both retained many methodological problems of the past and brought up new ones of considerable epistemic relevance. The field is driven not only by changes in knowledge about the processes of molecular evolution, but also by an ever-present methodological anxiety manifested in the constant search for an increased objectivity—or in its converse, the avoidance of (...) subjectivity.This paper offers an exhaustive account of the methodological and conceptual difficulties embedded in each of the steps required to elaborate molecular phytogenies. The authors adopt a historical perspective on the field in order to follow the development of practices that seek to increase the objectivity of their methods and representations. These include the adoption and development of explicit criteria for evaluation of evidence, and of procedures associated with methods of statistical inference, quantification and automation. All these are linked to an increasing use of computers in research since the mid 1960s. We will show that the practices of objectivity described are highly dependent on the problems and tools of molecular phylogenetics. (shrink)
