Considering that in times of state of emergency or civil emergency (such as the pandemic caused by COVID 19), governments in many countries around the world have restricted human rights and freedoms through legally binding government decrees. These restrictive measures increasingly raise dilemmas about their effect and possible violations by the government of international norms guaranteeing human rights. The paper aims to analyze whether these restrictive measures set out in the decisions of the Government of the Republic of Northern Macedonia (...) (RNM) are in compliance with the derogations allowed under the European Convention on Human Rights and Freedoms (ECHR) and the positive laws in power. In the framework of this paper is analyzed whether these measures have the sole purpose of protecting the health of citizens or not. The work is limited in terms of time (as long as the state of emergency lasted three months) and territory (government decrees with the force of law). Descriptive, historical, analytical, comparative and citizen survey methods are used in this paper. Government decrees have been analyzed in order to assess whether they were prudent, in accordance with international standards and consequences that they have caused to citizens. The conclusions provide data on whether the management of the situation has been appropriate or not and to what extent it has been effective, as well as how much it has been within the international framework and how they have affected the quality of life of citizens. As it is known, in the early Islamic period, that is, during the time of the Prophet and his companions it was not difficult to find answers to the questions. However, when we look at the later periods, we see that people who had just accepted Islam, belonging to many new cultures, asked new questions. It was not so easy to answer these questions merely based on the Qur'an and the Sunnah. For this reason, Kufa scholars considered it necessary to (...) use ijtihad with raʾy (free legal reasoning). They were subjected to a lot of criticism in that period and today because they resorted to raʾy while doing ijtihad. One of the two main schools that criticized the Ahl al-Ra’y the most was the Ahl al-Hadith (people of hadith) school. From the early days of the formation of the Hadith school of jurisprudence, the Iraqi school has been accused of abandoning the book and the Sunnah in the interpretation of Shari'ah rulings and preferring the rulings obtained by the intellectual method. This intellectual method that we are talking about has been the target of criticism in certain historical periods, sometimes in the name of ra’y, sometimes inthe name of qiyas (analogy), and sometimes in the name of istihsan. Abu Hanifa is one of the famous scholars who have been criticized by Ahl al-Hadith. This article deals with the life, works and school of ra’y of Abu Hanifa. (shrink)

A comparison between Muḥammad and Siddhārtha’s psychological states is made to identify how they had their mystical experiences and how their presuppositions and personalities shaped their interpretation of these experiences. Muḥammad’s mystical experience appeared to be based on an altered state of consciousness. Siddhārtha’s teachings include that one must not have blind faith and remain open to various truths. These teachings may reflect that he was high in openness to experience, which may have fortified him from becoming delusional. While mystical (...) experiences may have pathological overlaps, they could be categorized in a similar way to psychological states. Yet, mindful presuppositions and personality traits, especially from within openness to experience spectrum, are what make perceptions of these experiences diverse. (shrink)

The aim of the study was to study heuristic and interactive technologies in teaching informatics at a pedagogical university as a means of developing students' thinking flexibility. The main method used in this research work is the analysis of scientific and pedagogical literature. It was concluded that the integration of heuristic and interactive technology in teaching informatics is a pedagogical condition for the formation of flexibility of thinking of students of a pedagogical university.

The Qurʾānic term, ‘ẓann,’ is usually understood and translated as conjecture. However, I argue that the Qurʾān uses ‘ẓann’ to mean dogmatic zeal or, in other words, being zealous to a certain belief. For conjecture, the Qurʾān uses the root ‘ḥ-s-b,’ such as, ‘ayaḥsabu.’ Although the Qurʾān may criticize some people's conjectures, it does not criticize the act of formulating opinions with the root ‘ḥ-s-b.’ However, the Qurʾān does criticize the act of ‘ẓann.’ This further emphasizes the distinction between conjecture (...) and ‘ẓann,’ according to the Qurʾān. The main emphasis is that when the Qurʾān requires people to shun most ‘ẓann,’ it is argued that it is asking to shun zealous beliefs and dogmas, and it is not asking to shun the formulation of conjectures. The method used is philological, in which the cognates are analyzed in their contexts and compared with their uses in the Qurʾān. Defining ‘ẓann’ as dogmatic zeal rather than conjecture has far-reaching implications in understanding Qurʾānic epistemology and the epistemic process it expects its audience to have. (shrink)

The Qur’an frequently abhors blind faith based on tradition in its arguments against non-believers. Nonetheless, the Qur’an repeatedly asks people to believe in its message. How does the Qur’an distinguish between both kinds of faith? This article investigates the type of epistemology the Qur’an expects from its audience. Linguistically, the Qur’anic concept of īmān may be compared to taking refuge in Buddhism, in that it is through experience and insight (prajñā), as portrayed in the Kālāma Sutta, and not zeal. The (...) Qur’an differentiates between two types of conviction, that which is received through discernment and understanding, and that which is blind. The Qur’an shows cues of an attempt to harmonise faith and reason. It does not entertain non-believers in their request to have supernatural physical proofs, but frequently reminds them to use their reason and observation. This opens further avenues of interfaith dialogue between Buddhism and Islam. (shrink)

On the teachings of Prophet Muḥammad, d. 632 with reference to humanity.

In the modern age, the confl ict between science and religion manifests itself in the debate between evolution and creation. If we adopt a creationist’s reading of the Qur’ān, we discover an interesting anomaly. Reading the Qur’ān literally does not necessarily provide the foundation of creationism. Creationists usually have in mind the concept of creatio ex nihilo, or ‘creation out of nothing’. However, in the Qur’ān, one of the words used for creation, khalaqnā, has the root khlq, which means ‘to (...) split’ or ‘to divide’. This root word may even apply to the biological process of cell division. Therefore, from a scientifi c perspective, using the word khlq to describe this physical process is not problematic. In addition, with close textual analysis of the Qur’ān, we realize that the word for creation ‘be’ does not truly describe the moment of creation, but rather that of ‘being’. The Qur’ān separates the notion of creation from being, which poses the question as to what the text constitutes as the ontological nature of the human being and the universe. Therefore, even if we do adopt a literal reading of the Qur’ān, we fi nd that it does not necessarily support a worldview that endorses creatio ex nihilo. (shrink)

It is deemed that the effectiveness of teachers is highly entangled with psycho-emotional constructs, such as critical thinking (CT), emotion regulation (ER), and immunity. Despite the potential roles of CR, ER, and immunity, their possible relationships have remained unexplored in the higher education context of Iran. To fill in this lacuna, this study explored the potential role of CT and ER in university teachers' immunity in the Iranian higher education context. For this purpose, a total of 293 English university teachers (...) were selected using a convenience sampling method. They were invited to fill out the Watson–Glaser Critical Thinking Appraisal-Form, Language Teacher Emotion Regulation Inventory, and Language Teacher Immunity Instrument. The findings of path analysis indicated that the university teachers with higher CT were more productively immunized. Moreover, the results revealed that ER could predict the university teachers' immunity. The findings of the study lead to this implication that higher order thinking skills, emotion regulatory strategies, and immune enhancement should be incorporated into educational programs of higher education. BackgroundCultural competence is considered as one of the main skills of nurses enabling them to provide nursing care for those with different cultures. One of the cases related to nurses’ cultural competence is observance of ethical codes, but it has not been investigated sufficiently in studies.AimThis study has been conducted to determine the relationship between nurses’ cultural competence and observance of ethical codes in practice.Research designThis descriptive-correlational study was conducted in 2020. The questionnaires were provided to the subjects by the corresponding researcher and the data were analyzed using Pearson correlation test.Participants and research contextThis study was done with participation of 267 nurses working in four training hospitals located in northwestern Iran and 16 head nurses of selected wards.Ethical considerationsThe study was approved by Human Ethics Committee of Hamadan University of Medical Sciences. Participation was voluntary. Consent was obtained and confidentiality kept.FindingsThe results of Pearson correlation coefficient test showed a positive and statistically significant relationship between cultural competence and observance of ethical codes (r = 0.524, p = 0.001). In addition, cultural competence and observance of ethical codes by most nurses were at a moderate level.ConclusionsThe results of the present study showed a significant relationship between nurses’ cultural competence and observance of ethical codes. Therefore, it can be concluded that by strengthening the level of nurses, the level of observing ethical codes by them can be increased. Cultural competency and observance of ethical codes are important components of nursing care, and their development can improve nursing care delivery to clients through academic training, hidden curriculum and in-service education. The suspension system is referred to as the set of springs, shock absorbers, and linkages that connect the car to the wheel system. The main purpose of the suspension system is to provide comfort for the passengers, which is created by reducing the effects of road bumpiness. It is worth noting that reducing the effects of such vibrations also diminishes the noise and undesirable sound as well as the effects of fatigue on mechanical parts of the vehicle. Due to the (...) importance of the abovementioned issues, the objective of this article is to reduce such vibrations on the car by implementing an active control method on the suspension system. For this purpose, a conventional first-order sliding mode controller has been designed for stochastic control of the quarter-car model. It is noteworthy that this controller has a significant ability to overcome the stochastic effects, uncertainty, and deal with nonlinear factors. To design a controller, the governing dynamical equation of the quarter-car system has been presented by considering the nonlinear terms in the springs and shock absorber, as well as taking into account the uncertainty factors in the system and the actuator. The design process of the sliding mode controller has been presented and its stability has been investigated in terms of the Lyapunov stability. In the current research, road surface variations are considered as Gaussian white noise. The dynamical system behavior for controlled and uncontrolled situations has been simulated and the extracted results have been presented. Besides, the effects of existing uncertainty in the suspension system and actuator have been evaluated and controller robustness has been checked. Also, the obtained quantitative and qualitative compressions have been presented. Moreover, the effect of controller parameters on the basin of attraction set and its extensiveness has been assessed. The achieved results have indicated the good performance and significant robustness of the designed controller to stabilize the suspension system and mitigate the effects of road bumpiness in the presence of uncertainty and noise factors. The roots of ‘ancient sport’, or Zurkhaneh, as its name implies, go back to ancient Iran and the rituals of Mithraism, in which believers pray and learn morality and humanity in cave-shape temples built in connection with running water. After the advent of Islam and the fall of the ancient religions, temples gave way to Zurkhanehs, and athletes who, while learning moral teachings, cultivated physical strength to resist external enemy forces and internal oppression, grown in those Zurkhanehs. With a tendency (...) to Sufism, Shi`ism and following the first Imam of the Shiites, athletes became heroes and knights, many of whom today, after hundreds of years, are still the cultural myths of the people of Iran. The ancient sports such as wrestling are a symbol of human and moral virtues, the promotion of which can lead to the growth and development of the moral beauty and chivalry culture among all athletes in various sports and lead to institutionalize characteristics of heroism and magnanimity in society. Ancient sports exercising tools, art and architecture of Zurkhaneh, poems, rituals and personalities form the nature of Zurkhaneh and ancient sports have a great impact on the formation of heroic identity and the way to perform the sport movements with the special instruments of Zurkhaneh, which is accompanied by epic and religious poems. In fact, Zurkhaneh instruments, the type of poems that are recited and the existence of epic and religious patterns complement each other. This process increases the effect of Zurkhaneh on the formation of athletic and heroic identity among sportsmen. ABSTRACTThe unprecedented progress in bio‐medical sciences and technology during the last few decades has resulted in great transformations in the concepts of health and disease, health systems and healthcare organisation and practices. Those changes have been accompanied by the emergence of a broad range of ethical dilemmas that confront health professionals more frequently. The classical Hippocratic ethical principles, though still retaining their relevance and validity, have become insufficiently adequate in an increasing range of problems and situations. Healthcare that has been (...) practised for centuries on the basis of a direct doctor‐patient relationship has been increasingly transformed into a more complex process integrating the health‐team, the patient and the community. Systematic review of the specialised literatures revealed that Healthcare Ethics education has become a basic requirement for any training programme for health professionals, and should cover the different stages of undergraduate, postgraduate and continuing education. Both theoretical foundations and practical skills are required for the appropriate ethical reasoning, ethical attitude and decision‐making abilities. There is growing evidence that physicians’ professional and moral development is not only determined by the formal curriculum of ethics; rather more, it is determined by the moral environment of the professional practice, the ‘hidden curriculum’ which deserves serious consideration by medical education. In this paper, we give a step by step introduction to the theory of well quasi-ordered transition systems. The framework combines two concepts, namely (i) transition systems which are monotonic wrt. a well-quasi ordering ; and (ii) a scheme for symbolic backward reachability analysis. We describe several models with infinite-state spaces, which can be analyzed within the framework, e.g., Petri nets, lossy channel systems, timed automata, timed Petri nets, and multiset rewriting systems. Utilization of renewable energies in association with energy storage is increased in different applications such as electrical vehicles, electric boats, and smart grids. A robust controller strategy plays a significant role to optimally utilize the energy resources available in a power system. In this paper, a suitable controller for the energy resources of an EB which consists of a 5 kW solar power plant, 5 kW fuel cell, and 2 kW battery package is designed based on the linear parameter varying (...) controller design approach. Initially, all component dynamics are augmented, and by exploiting the sector-nonlinearity approach, the LPV representation is derived. Then, the LPV control method determines the suitable gains of the states’ feedbacks to provide the required pulse commands of the boost converters of the energy resources to regulate the DC-link voltage and supply the power of EB loads. Comparing with the state-of-the-art nonlinear control methods, the developed control approach assures the stability of the overall system, as it considers all component dynamics in the design procedure. The real-time simulation results demonstrate the performance of the designed controller in the creation of a constant DC-link voltage. (shrink)

The study focuses on the mobile telecommunications industry in Afghanistan prior to the Taliban takeover of the country in 2021 and seeks to study how the mobile telecommunications corporations engage with the different area-specific governance systems in order to gain legitimacy to operate across Afghanistan. The study capitalises on mixed qualitative data to conduct an embedded case study of the Afghan mobile telecommunications industry as an extreme context for understanding business-society relations in South Asia. Theoretically, the article integrates insights from (...) governance literature on areas of limited statehood to conceptualise business–society relations in Afghanistan beyond state-centric views and assumptions. The findings result in two modalities of business engagement that are conceptualised as a single vis-à-vis multiple governance system approach. Each of these modes of engagement implies a political nature and role for the businesses that are embedded in ethical dilemmas as discussed in the article. These findings contribute to the debate on the ‘political turn’ in the CSR literature and the governance literature on areas of limited statehood. (shrink)

Propositional logic, with the aid of SAT solvers, has become capable of solving a range of important and complicated problems. Expanding this range, to contain additional varieties of problems, is subject to the complexity resulting from encoding counting constraints in conjunctive normal form. Due to the limitation of the expressive power of propositional logic, generally, such an encoding increases the numbers of variables and clauses excessively. This work eliminates the indicated drawback by interpolating constraint symbols and the set of natural (...) numbers \ into the alphabet of propositional logic and adjusting the underlying language accordingly. In the extended logic counting constraints are naturally formulated, while many important aspects, such as Boolean nature and the soundness and completeness theorems, are kept preserved. (shrink)

É claro que Montaigne não nos dirá nada sobre a natureza do vírus, nem sobre nosso sistema imunológico, muito menos sobre metodologias de investigação científicas (...) para a procura de medicamentos para o tratamento da doença. There are many examples of professional Secretariats used in both formal education and in professional settings that have proven their capabilities. There is a close relationship between private lessons intelligent, (...) cognitive learning and design theories; and there are ongoing to improve the effectiveness of ITS research. And it aims to find a solution to the problem of over-reliance on students' teachers for quality education. The program aims to provide access to high-quality education to every student, and therefore the reform of the education system as a whole. In this paper, we will use Intelligent Tutoring System Builder (ITSB) to build an education system on cloud computing in terms of the concept of cloud computing and components and how to take advantage of cloud computing in the field. In this introductory article we explore the relationship between statehood and governance, examining in more detail how non-state actors like MNCs, international NGOs, and indigenous authorities, often under conditions of extreme economic scarcity, ethnic diversity, social inequality and violence, take part in the making of rules and the provision of collective goods. Conceptually, we focus on the literature on Areas of Limited Statehood and discuss its usefulness in exploring how business-society relations are governed in the global South, and beyond. Building (...) on insights from this literature, among others, the four articles included in this special issue provide rich illustrations and critical reflections on the multiple, complex and often ambiguous roles of state and non-state actors operating in contemporary Syria, Nigeria, India and Palestine, with implications for conventional understandings of CSR, stakeholders, and related conceptualizations. This qualitative research study with a content analysis approach aimed to explore families’ experiences of an organ donation request after brain death. Data were collected through 38 unstructured and in-depth interviews with 14 consenting families and 12 who declined to donate organs. A purposeful sampling process began in October 2009 and ended in October 2010. Data analysis reached 10 categories and two major themes were listed as: 1) serenity in eternal freedom; and 2) resentful grief. The central themes were peace (...) and honor versus doubt and regret. The findings indicated that the families faced with an organ donation request of a brain-dead loved one experienced a lasting effect long after the patient's demise regardless of their decision to donate or refusal to donate. In conclusion, this study highlights the importance of family support and follow-up in an efficient healthcare system aimed at developing trust with the families and providing comfort during and after the final decision. The COVID-19 pandemic has introduced new challenges for governments and individuals. Unprecedented efforts at reducing virus transmission launched a novel arena for human face recognition in which faces are partially occluded with masks. Previous studies have shown that masks decrease accuracy of face identity and emotion recognition. The current study focuses on the impact of masks on the speed of processing of these and other important social dimensions. Here we provide a systematic assessment of the impact of COVID-19 masks on (...) facial identity, emotion, gender, and age. Four experiments were conducted in which participants categorized faces on a predefined dimension. Both speed and accuracy were measured. The results revealed that masks hindered the perception of virtually all tested facial dimensions, interfering with normal speed and accuracy of categorization. We also found that the unwarranted effects of masks were not due to holistic processes, because the Face Inversion Effect was generally not larger with unmasked compared with masked faces. Moreover, we found that the impact of masks is not automatic and that under some contexts observers can control at least part of their detrimental effects. (shrink)

The novel coronavirus disease is impactful on all aspects of individuals’ lives, particularly mental health due to the fear and spirituality associated with the pandemic. Thus, purpose of this study was to identify the relationship among fear, spirituality, and mental health on COVID-19 among adults in Malaysia. This study also examines spirituality as a mediator in relationship between fear and mental health. The study involved around 280 adults in Malaysia. This research is a quantitative study. Data analysis method has been (...) used for data analysis. Based on descriptive analysis, mental health questionnaire indicated that 60.0% of them are at a poor level of mental health whereas 57.5% of respondents showed a moderate level of COVID-19 fear, and 60.4% of respondents owned moderate level of spiritual well-being. The results also demonstrated that respondents that have a high level of fear would have a high level of mental health; interestingly, those with a high level of spirituality will have a lower level of mental health. Findings indicated that spirituality significantly mediated the relationship between fear and mental health. This research will help to demonstrate how important spirituality values to control mental health to be more positive among adults in Malaysia. Creativity, especially, is an essential skill in a complex and unforeseeable world/era, and an important step in any effort to enhance creativity is to identify students’ creative strengths and relative weaknesses. This review aims to offer school psychologists and other educators such as teachers, (...) policymakers, and curriculum designers a comprehensive and practical guide to one of the most well-known creativity assessments—the Torrance Tests of Creative Thinking that was developed by E. Paul Torrance in the 1960s. The paper discusses the history, components, training, psychometric properties, and uses of the TTCT. Contrary to the notion that the TTCT is only a measure of divergent thinking skills, the current article presents its other uses. It is the authors’ hope that teachers, school psychologists, and other educators will find the information reported in this article useful to better understand the TTCT and use it most effectively. An indigenous instrument was used to assess the nurses’ competencies in spiritual care.Ethical considerations:A research ethics committee approved the study. All the participants were briefed on the study aims, were assured of the confidentiality of their personal information, and signed a written informed consent.Results:Among a total of 250 nurses, 239 answered the questionnaire completely, and in total, 23%, 51%, and 26% had poor, moderate, and favorable competence in spiritual care, respectively. No significant differences were found between the mean competence scores of spiritual care in terms of gender, marital status, employment status, and level of qualification. Significant difference was found between nurses’ overall score of competence in spiritual care and receiving training on spiritual care, nurses’ position, and the ward they worked in.Discussion:Confirming the findings of the international literature, this study puts light on the situation of nurses’ perceived competence and barriers to providing spiritual care in Iran as an eastern and Islamic context.Conclusion:Three-quarters of the nurses had moderate or unfavorable competence in spiritual care. Due to the crucial role of spiritual care in quality of care and patient satisfaction, nurses should be trained and supported to provide spiritual care. (shrink)

This paper discusses the empirical, Application Programming Interface -based analysis of very large Facebook Pages. Looking in detail at the technical characteristics, conventions, and peculiarities of Facebook’s architecture and data interface, we argue that such technical fieldwork is essential to data-driven research, both as a crucial form of data critique and as a way to identify analytical opportunities. Using the “We are all Khaled Said” Facebook Page, which hosted the activities of nearly 1.9 million users during the Egyptian Revolution and (...) beyond, as empirical example, we show how Facebook’s API raises important questions about data detail, completeness, consistency over time, and architectural complexity. We then outline an exploratory approach and a number of analytical techniques that take the API and its idiosyncrasies as a starting point for the concrete investigation of a large dataset. Our goal is to close the gap between Big Data research and research about Big Data by showing that the critical investigation of technicity is essential for empirical research and that attention to the particularities of empirical work can provide a deeper understanding of the various issues Big Data research is entangled with. The interplay between the virus, infected cells and immune responses to SARS-CoV-2 is still under debate. By extending the basic model of viral dynamics, we propose here a formal approach to describe neutralisation versus weak (or non-)neutralisation scenarios and compare them with the possible effects of antibody-dependent enhancement (ADE). The theoretical model is consistent with the data available in the literature; we show that both weakly neutralising antibodies and ADE can result in final viral clearance or disease progression, but that (...) the immunodynamics are different in each case. As a significant proportion of the world’s population is already naturally immune or vaccinated, we also discuss the implications for secondary infections after vaccination or in the presence of immune system dysfunctions. The current study investigated correlations among gifted students’ academic performance; emotional, social, analytical, creative, and practical intelligence; and their implicit theories of intelligence. Furthermore, it studied the effect of gender and grade on these variables. The participants included 174 gifted fifth and sixth grade students, comprising 53.4% male and 46.6% female. The following analytical, creative, and practical intelligence tests were administered: Aurora Battery, the emotional intelligence scale, the implicit theories of intelligence scale, and an assessment scale of students’ performances. The (...) results revealed significant correlations among academic performance, kinds of intelligence, and implicit theories of intelligence. There were no significant differences between the male and female students in these measures. There were, however, significant differences between the fifth and sixth grade students, with the sixth-grade students showing higher levels of all kinds of intelligence, except emotional intelligence. Moreover, the results indicated that the intelligence measures were non-significantly affected by either gender or gender–grade interaction. Overall, our results showed that most types of intelligence are related to giftedness, and that there were no gender differences among gifted students on measures of intelligence. (shrink)

This study sought to gauge ethical attitudes about professional boundary issues of physicians and nurses in the Kingdom of Saudi Arabia. Respondents scored 10 relevant boundary vignettes as to their ethical acceptability. The group as a whole proved “aware/ ethically conservative,” but with the physicians' score falling on the “less ethically conservative” part of the spectrum compared to nurses. The degree of ethicality was more related to profession than to gender, with nurses being more “ethical” than physicians.

Starting from 2009, national courts of the EU Member States for the first time gained a “real” right to request the EU Court of Justice for preliminary rulings in asylum matters. First judgments of this Court demonstrate equivocal tendencies: some are blaming the Court for incompetence in asylum matters, others believe that the adoption of authoritative decisions at the European level will assist in developing consistent practice of applying asylum law in the European Union, something that failed at international level (...) due to absence of a single authoritative body to provide guidance on interpretation and application of the 1951 Refugee Convention. Considering that the judgments of the EU Court are part of the EU law, the Member States should develop their national asylum law with due regard being taken to those judgments. By the beginning of 2012, the Court has issued eight judgments on the interpretation of various problematic issues of EU asylum law. This Article analyses the jurisprudence of the EU Court in asylum cases, related to the granting of refugee status and subsidiary protection. It also provides a critical evaluation of those judgments. The main objective of the Article is to familiarise the relevant Lithuanian institutions and lawyers with the first judgments of the EU Court in asylum cases and encourage discussions concerning the application of rules established by the Court in the Lithuanian context. Due to limited size, this Article presents the analysis of two EU Court judgments adopted on interpretation of the 2004 Qualification Directive: Elgafaji v. The Netherlands (2009) dealing with granting of subsidiary protection, and Abdulla and others v. Bundesrepublik Deutschland (2010), dealing with cessation of refugee status. The value of those judgments first of all lies in the guidance they provided to the Member States on such concepts as: protection in a situation of an armed conflict, agents of protection, effectiveness of protection; as well as determination of a relationship between refugee status and subsidiary protection, relationship of the Qualification Directive with the European Convention on Human Rights and Fundamental Freedoms (ECHR), also cessation of protection. Elgafaji decision, while quite liberal with regard to persons seeking international protection, is not so liberally applied in the Member States’ practice and does not in itself guarantee positive outcome of the application of a concrete individual fleeing from an armed conflict, or a liberal approach to granting subsidiary protection in the Member States. Based on Elgafaji judgment it is clear that: Art. 15(b) of the Qualification Directive correspond to Art. 3 ECHR, while Art. 15(c) provides additional protection and in that it expands the Member States’ obligations beyond the ECHR to provide protection to persons fleeing in situations of armed conflict. While not every person arriving from an armed conflict situation would automatically fall under the granting of subsidiary protection, in certain exceptional situations indiscriminate violence may amount to individual threat without invoking personal circumstances. The EU Court departed from the individualisation requirement applied by the European Court of Human Rights in Art. 3 cases and did not also rely on international humanitarian law, by introducing a “sliding scale” formula for establishing an individual threat in armed conflict situation instead. This formula addressed the alleged internal discrepancy between “individual threat” and “indiscriminate violence”. The Abdulla decision brought in the human rights and law enforcement perspectives to the interpretation of cessation clauses, however it represents a rather superficial approach in the context of the analysed concepts (e.g. towards effectiveness of protection provided by the multinational armed forces) and is likely to be incompatible with the latest legislative trends in the EU asylum instruments (e.g. determination of refugee status and subsidiary protection by means of a single procedure) and the recent jurisprudence under the ECHR (e.g. failure to ensure a minimum standard of living may violate the ECHR).
