O artigo tem por objeto o estudo dos limites do sigilo bancário e empresarial na concessão de empréstimos pelo Banco Nacional de Desenvolvimento Econômico e Social (BNDES), a partir da contraposição entre o dever de transparência da Administração Pública e os direitos fundamentais à intimidade e livre iniciativa. Através do método dedutivo e revisão bibliográfica, analisou-se as normas constitucionais envolvidas, a evolução da transparência nas operações de empréstimos do referido banco público, além de importante julgado do Supremo Tribunal Federal (...) The tremendous recent growth of the women's movement as a political force has been accompanied by an event of equal import to the academic world--the development of the discipline of women's studies. Colleges across the nation are establishing programs in this area. Women's Studies is a classroom anthology designed for use in these newly-introduced courses.

The purpose of this work consists of analyzing the place that the big’s and people’s conflict, circumscribed by the theory of humors, occupies in Machiavelli’s political thought and to investigate its relationship with the political freedom. The central hypothesis is that the freedom can only be reached by a balance point among the forces in conflict. For that, it is necessary that the conflict, not being annulled, be rationally regulated and normalized by the republican institutions, changing from negative force into (...) force capable to converge in the State the commonwealth, the social order and the freedom of the whole political body. The republican law, born of the permanent confrontation of the antagonistic desires, subverts the negative character of the humors of big and people and it channels the force for the political life, demanding active citizenship of their members, it means, the participation of both humors in the public space as political agents for the maintenance of the freedom. To make it clear, we tried to demonstrate the characteristics of the conflict of the humors, in agreement with those which the desire of the big gets confused with a desire of power, while the desire of the people is associated to freedom. For Machiavelli, the true political freedom is only possible when the antagonistic humors can relieve their desires through the participation in the public space of debates and collective decisions, what can only happen in a republican regime. This collection of eighteen readings provides a basic text for undergraduates taking sociology of science courses. A general survey of articles published between 1961 and 1981, the book is also a useful overview for students taking courses in social and political studies of science; science, technology, and society; and "social issues" components of courses in the environmental sciences, geography, philosophy, and history of science. The editors have organized the book around "the relationship between the subculture of science and (...) the wider culture which surrounds it. This chapter provides an outline of consent in the history of medical ethics. In doing so, it ranges over attitudes towards consent in medicine in ancient Greece, medieval Europe and the Middle East, as well as the history of Western law and medical ethics from the early modern period onwards. It considers the relationship between consent and both the disclosure of information to patients and the need to indemnify physicians, while attempting to avoid an anachronistic projection of concern with patient (...) autonomy too far back into the historical record. The chapter also includes a survey of the development of the social and intellectual infrastructure that underpins modern medical consent. It concludes with a brief discussion of possible future directions for ethical approaches to medical consent and competence that would depart from the models that arose in the twentieth-century. Many scholars and activists seek to eliminate “race”—the word and the concept—from our vocabulary. Their claim is clear: because science has shown that racial essentialism is false and because the idea of race has proved virulent, we should do away with the concept entirely. Michael O. Hardimon criticizes this line of thinking, arguing that we must recognize the real ways in which race exists in order to revise our understanding of its significance. Rethinking Race provides a novel answer to the (...) question “What is race?” Pernicious, traditional racialism maintains that people can be judged and ranked according to innate racial features. Hardimon points out that those who would eliminate race make the mistake of associating the word only with this view. He agrees that this concept should be jettisoned, but draws a distinction with three alternative ideas: first, a stripped-down version of the ordinary concept of race that recognizes minimal physical differences between races but does not consider them significant; second, a scientific understanding of populations with shared lines of descent; and third, an acknowledgment of “socialrace” as a separate construction. Hardimon provides a language for understanding the ways in which races do and do not exist. His account is realistic in recognizing the physical features of races, as well as the existence of races in our social world. But it is deflationary in rejecting the concept of hierarchical or defining racial characteristics. Ultimately, Rethinking Race offers a philosophical basis for repudiating racism without blinding ourselves to reality. (shrink)

My aim in this piece is to understand what kinds of acts sneering acts are. I aim to look at what sneering acts do and what social function they perform. In particular, I want to mark them out as acts of ‘making people feel’. I explore the grounds on which we might criticize sneering acts, and ask whether the thing that we do when we sneer is always vicious.

According to the “standard framing” of racial appeals in political speech, politicians generally rely on coded language to communicate racial messages. Yet recent years have demonstrated that politicians often express quite explicit forms of racism in mainstream political discourse. The standard framing can explain neither why these appeals work politically nor how they work semantically. This paper moves beyond the standard framing, focusing on the politics and semantics of one type of explicit appeal, candid racial communication. The linguistic vehicles of (...) CRC are neither true code words, nor slurs, but a conventionally defined class of “racialized terms.”. (shrink)

He explores Rousseau's reflections on developmental psychology, the nature of the political order, relations between the sexes, language and religion. The book argues that the category of mother is distinct from the category of woman and that many of the problems mothers face-socially, economically, politically, culturally, and psychologically-are specific to women's work and identity as mothers. Indeed, mothers, arguably more so than women in general, remain disempowered despite forty years of feminism. Mothers, thus, need a feminism of their own, one that positions mothers' concerns as the starting point for a theory and politic of empowerment. O'Reilly terms this new mode (...) of feminism matricentic feminism and the book explores how it is represented and experienced in theory, activism, and practice. The chapter on maternal theory examines the central theoretical concepts of maternal scholarship to include Adrienne Rich's distinction between mothering and motherhood, Sara Ruddick's model of maternal thinking and practice and Patricia Hill Collins' concept of othermothering while the chapter on activism considers the 21st century motherhood movement. Feminist mothering is likewise examined as the specific practice of matricentric feminism and this chapter discusses varies theories and strategies on and for maternal empowerment. Matricentric feminism is also examined in relation to the larger field of Feminist Theory and Women's Studies; here O'Reilly persuasively shows how matricentric feminism has been marginalized in feminist scholarship and considers the reasons for such exclusion and how such may be challenged and changed. This book broadens the range of theoretically informed empirical research on business ethics (using data from major American corporations) and addresses the underlying questions about business ethics scholarship. It culminates a decade’s work by the authors—individually, jointly, and with others. The first part of the book addresses the major theoretical questions involved in doing empirical research about normative issues. It addresses the boundaries—methodological, conceptual, and institutional—that too easily separate philosophical and social scientific approaches to business ethics and reviews various (...) ways in which those approaches can be brought close together to benefit research and practice. The second part of the book describes and explains the increasing institutionalization of formal systems designed to manage ethics in organizations. It reviews the state of the art initiatives to foster ethical business conduct and also looks at the relative roles of executives and external policies (e.g., government regulations) in creating meaningful ethical initiatives. In the third part, the focus shifts to individual ethical behavior and how organizations influence it, describing in detail some of the outcomes of organizational ethics initiatives. BackgroundBiobanks are considered to be key infrastructures for research development and have generated a lot of debate about their ethical, legal and social implications. While the focus has been on human genomic research, rapid advances in human microbiome research further complicate the debate.DiscussionWe draw on two cystic fibrosis biobanks in Toronto, Canada, to illustrate our points. The biobanks have been established to facilitate sample and data sharing for research into the link between disease progression and microbial dynamics in the (...) lungs of pediatric and adult patients. We begin by providing an overview of some of the ELSI associated with human microbiome research, particularly on the implications for the broader society. We then discuss ethical considerations regarding the identifiability of samples biobanked for human microbiome research, and examine the issue of return of results and incidental findings. We argue that, for the purposes of research ethics oversight, human microbiome research samples should be treated with the same privacy considerations as human tissues samples. We also suggest that returning individual microbiome-related findings could provide a powerful clinical tool for care management, but highlight the need for a more grounded understanding of contextual factors that may be unique to human microbiome research.ConclusionsWe revisit the ELSI of biobanking and consider the impact that human microbiome research might have. Our discussion focuses on identifiability of human microbiome research samples, and return of research results and incidental findings for clinical management. (shrink)

Jason Stanley’s How Propaganda Works roots the danger of undermining propaganda in an ideology based account of politics, treating individuals’ beliefs and social belief systems as the primary target and mechanism of undermining propaganda. In this paper I suggest a theoretical alternative to the role ideology plays in Stanley’s theory and theories like it, which I call practice first. A practice first account instead treats public behavior as the primary target of propaganda, and analyzes undermining propaganda as altering the (...) incentive structure that sets the terms for public behavior. Discursive accounts of the body have been prominent recently. While acknowledging the usefulness of these, the author, drawing upon specific philosophers of the body and a wide range of other theorists, focuses attention on the experiencing body which she refers to as 'creatural existence’. Thinking in terms of the creatural, she argues, can better situate human beings in their environment, thus emphasizing a kind of 'ecological notion of subjectivity’, in which place-based existence is understood anew. The educational implications of focusing (...) on what bodies 'do' and not so much in terms of how they are socially inscribed, presents them as practico-sensory totalities which should perhaps be seen as systems rather than an as mere organisms or entities. Such an articulation of creatural existence emphasizes animality, and in so doing reminds us of the centrality of the senses in all knowing and doing, including crucially, in relation to those practices which we have understood as 'work'. Multi-sensorial education is a major sub-theme of the book and the author argues persuasively for this by means of a critical analysis of the ocularcentrism that is characteristic of contemporary culture. É amplamente reconhecido que para mitigar a mudança climática antropogênica são necessários urgentes esforços institucionais em várias dimensões: tecnológicos, infraestruturais, mas também socioculturais. Isso significa que, para que haja a transição ecológica para uma sociedade mais verde e sustentável, um conjunto de mudanças estruturais econômicas, políticas e culturais deverão ser rearticuladas nos próximos anos. Por um lado, ao passo que é inegável que, para conter a mudança antropogênica, o uso do poder institucional deve ser usado de modo mais incisivo nas (...) mais diversas esferas que estruturam o social. Por outro lado, não fica evidentemente se as liberdades serão afetadas e, em caso positivo, como elas serão afetadas. Diante da urgência do problema, o artigo propõe normativamente explorar o conflito entre, por um lado, a exigência do uso do poder institucional para conter a mudança climática antropogênica em tempo e, por outro, a garantia pelo mais amplo esquema de liberdades políticas, econômicas e civis nas sociedades democráticas liberais. This article makes two arguments. First, that social justice constitutes an inherent part of the conception of sustainable development that the World Commission on Environment and Development outlined in Our Common Future. The primary goal of the Commission was to reconcile physical sustainability, need satisfaction and equal opportunities, within and between generations. Sustainable development is what defines this reconciliation. Second, it is argued that this conception of sustainable development is broadly compatible with liberal theories of justice. Sustainable development, however, (...) goes beyond liberal theories of justice in many respects. It is based on three assumptions, which are for the most part ignored in liberal theories: an accelerating ecological interdependence, historical inequality in past resource use, and the 'growth of limits'. These assumptions create a conflict between intra- and intergenerational justice, which is ignored in liberal theories, but which sustainable development tries to solve. It does so by imposing duties on developed countries that goes beyond liberal demands, and by abandoning the focus 'solely on protection' that dominates non-anthropocentric approaches to environmental sustainability. Race was once thought to be a real biological kind. Today the dominant view is that objective biological races don't exist. I challenge the trend to reject the biological reality of race by arguing that cladism (a school of classification that individuates taxa by appeal to common ancestry) provides a new way to define race biologically. I also reconcile the proposed biological conception with constructivist theories about race. Most constructivists assume that biological realism and social constructivism are incompatible views (...) about race; I argue that the two conceptions can be compatible. (shrink)

Moral principles or the rules of conduct are based in the society. If the purpose of ethics in research is to take into consideration the needs and the rights of the experimental subject, his social milieu must then largely determine the ethical considerations of a projected study. The inability to comprehend such rights may often be due to ignorance, disease and his societal values. Blood letting, biopsy and post-mortem examinations may so conflict with local beliefs that so called 'consent' (...) to these is much more than a surrender of the rights of the individual. It is difficult to conform with the highest principles of ethics in research in any uniform society. It is more so when the many variables are further complicated by cultural demands and social taboos. The best custodians of ethical standards must relate intimately with the norms of the local population. (shrink)

_Purpose__._ This article aims at outlining the socio-communicative prerequisites for the influence of personality on the acquisition of rigorous scientific knowledge. _Theoretical__ basis__._ The communicative foundations of an individual’s activity in general and the functioning of his consciousness in particular were laid by the philosophy of Edmund Husserl, primarily due to his introduction of the concepts of "intersubjectivity" and "lifeworld". From these positions, attempts were made to understand the discussion of Karl Popper and Thomas Kuhn regarding the role of the (...) individual in science, in particular, the concept of a "normal scientist" as a participant in the lifeworld of scientists who support special intersubjective norms of reproduction of this lifeworld through scientific communication. The concept of "communicative mind", correlated with the philosophy of Jürgen Habermas, best expresses the rational and argumentative principles of achieving consensus in science. _Originality__._ Social anthropology reveals the constitutive significance of teamwork in science as a way of achieving rigorous scientific knowledge. Social phenomenology concretizes this by emphasizing the need for constant improvement of the rules of this communication. The verification of scientific knowledge by facts is strictly determined by the observance of community-recognized scientific tools for achieving such verification, in particular, the conventional agreement within a certain community of scientists regarding the language of science, which is used to describe verification, falsification, and other procedures for organizing scientific knowledge into a system. _Conclusions._ Verification of the obtained scientific knowledge critically depends on the formulation, dissemination and observance of certain institutional rules of scientific communication. This applies, in particular, to the conventionally recognized rules for the verification of scientific knowledge by empirical facts: it is not an isolated scientist who should identify, verify, organize and evaluate empirical facts, but a community of scientists who conduct scientific research in an organized manner. Team scientific work is a special case of collective action, which is characterized by a high level of reflection and application of critical thinking on a communicative basis. In particular, the legitimation of acquired scientific knowledge occurs in the process of scientific research due to the observance of procedural rules and careful work with empirical facts. This article explores how post-war documentary film-makers negotiated complex social, formal, and autobiographical issues associated with representing mental illness and its treatments, and the extent to which their respective approaches helped to challenge conventional attitudes to alternative psychotherapies – especially within the context of advances in new documentary film-making technologies, alongside a wider culture of social activism. Focussing on A Look at Madness ( Regard sur la folie; Mario Ruspoli, 1962, France) and Now Do You Get It Why (...) I Am Crying? ( Begrijpt u nu waarom ik huil?; Louis van Gasteren, 1969, Netherlands), the article discusses how the collaborative, democratic aims of cinéma direct coincided with the ethos of institutional psychotherapy, and compares this with the relations between the documentary form and the subject of LSD-assisted psychotherapeutic techniques in Van Gasteren's film. Rather surprisingly, T.H.Green's ideas on women and the family are as neglected today as they were immediately after his death in 1882, when his thought was first interpreted for a wider public by his colleagues and friends.1 Silence on such matters in the 1880s is not remarkable. It is odd, however, that it persists today, despite recent intense concern with the history of women and the family, including their place in political thought, and despite reviving philosophical interest in the British (...) Idealists and readiness to credit them with a significant impact on politics, education and social work. It has often been remarked that Green's political ideas have much in common superficially with those of John Stuart Mill, since their values and precepts are very similar, although the substructure of their thought is utterly different. Nevertheless it has altogether escaped notice that this is equally true of their ideas on women, marriage and family relationships. Today Mill's fabled feminism easily appears limited and imperceptive, and the priority he gave to the parliamentary vote strangely simplistic. Did Green show any greater realism and understanding? Did he practise as well as preach real equality between men and women, in private as well as public life? In short, what precisely was Green's position on 'the woman question'�? (shrink)

In his celebrated_ Essay on Population_, Thomas Malthus raised the puzzle of why a benevolent Creator would permit material scarcity in human existence. Albino Barrera revisits this question using Thomas Aquinas’s metaphysics of participation and Sacred Scripture’s invitation to covenant fidelity and kingdom discipleship as analytical lenses with which to examine the seeming incongruity of scarcity in God’s providence. Barrera concludes that scarcity turns out to be a signal opportunity for economic agency to receive, internalize, and communicate God’s goodness and (...) righteousness within the human community. Written for theologians, philosophers, social scientists, and policymakers interested in the theological and philosophical foundations of economics, this study argues that precarious, subsistence living is not an immutable law of nature. Rather, such a chronic, dismal condition reflects personal and collective moral failure.
