A person incurs inchoate criminal liability when he incites another person or other persons to commit a crime. The most salient characteristic of incitement, in comparison with the other forms of inchoate crime, is the existence of a communication that is made with a view to persuading the addressee to commit an offence. This article explores the question of why incitement should incur criminal liability, and the nature of such liability. It also identifies its distinctive features. The principal focus here (...) is on ambiguity in the putative words of incitement and on questions of gauging whether the words have had any effect on the actions of the addressee. It covers both the standard criminal offences and conduct which, arguably, should not be regulated by the criminal law, thereby raising issues of freedom of speech. We examined the course of caregiver motherese and the course of the infant’s response based on home movies from two single cases: a boy with typical development and a boy with autistic development. We first blindly assessed infant CG interaction using the Observer computer-based coding procedure, then analyzed speech CG production using a computerized algorithm. Finally we fused the two procedures and filtered for co-occurrence. In this exploratory study we found that the course of CG parentese differed based on gender (...) and child status. The course of an infant’s response to CG vocalization differed according to the type of speech and child status. Mothers spent more time interacting with infants, and fathers appeared to interact with their child preferentially between 12 and 18 months in the TD boy, but not in the AD boy. The TD boy responded equally well to motherese compared to other speech after 1 year of age. For the AD boy, the responses to both types of speech were lower than in the boy with TD and decreased from the second to the third semester. Data from naturally occurring child counselling sessions are used to explore how counsellors seek to elicit therapeutically relevant talk in the face of resistance, or non-cooperation, from children. Focusing on a case in which a 6-year-old child persistently avoids collaborating in the kind of counselling talk that the counsellor is evidently aiming to produce, the analysis focuses both on the child's resistance strategies and on the counsellor's techniques for attempting to combat resistance and work towards a therapeutically relevant outcome. What unusual and important opportunities we face as we bring the lessons of the last few years to bear on complex theorizing, multi-issue praxis, and the work of twenty-first century democracy. We've been on the streets, in th classroom, and on the Internet, opposing war and occupation, protesting police brutality, demanding global peace and justice. We've helped organize teach-ins and lectures, meetings and potlucks, concerts and art (...) exhibitions. From the Revolutionary Association of the Women of Afghanistan to New Yorkers Say No to War, from Women in Black to Code Pink, feminists were some of the first vocal opponents of the Bush rush to war. In February 2003 we helped create the greatest global protest for peace in human history, proclaiming "The World Says No to War" under banners of the swirling blue earth, cracking open the hegemony of you're-either-with-us-or-you're-with-the-terrorists, and activating a phenomenal range of new coalitions. Hate speech is commonly defined with reference to the legal category of incitement. Laws targeting incitement typically focus on how the speech is expressed rather than its actual content. This has a number of unintended consequences: first, law tends to capture overt or obvious forms of hate speech and not hate speech that takes the form of ‘reasoned’ argument, but which nevertheless, causes as much, if not more harm. Second, the focus on form rather than content leads to categorization errors. (...) Hate speech taking the form of ‘reasoned argument’ is often legally characterized as either political or academic debate, and so is deemed both permissible and justified in societies where free speech principles exist. In this paper, I argue that it is important to identify instances of hate speech as hate speech, no matter how articulately or reasonably the speech is expressed. The danger in mischaracterizing an instance of hate speech by calling it academic or political debate is that it risks normalizing the views and sentiments that are expressed and accepting those views as an important part of our political and academic discourses. With reference to Habermas’ account of ‘distorted communication’, I propose different criteria for defining and understanding hate speech and suggest that there might be good reasons for interpreting the concept of incitement more broadly, so as to include these different kinds of it. This research employs the Bayesian network modeling approach, and the Markov chain Monte Carlo technique, to learn about the role of lies and violence in teachings of major religions, using a unique dataset extracted from long-standing Vietnamese folktales. The results indicate that, although lying and violent acts augur negative consequences for those who commit them, their associations with core religious values diverge in the final outcome for the folktale characters. Lying that serves a religious mission of either Confucianism or Taoism (...) (but not Buddhism) brings a positive outcome to a character (βT_and_Lie_O= 2.23; βC_and_Lie_O= 1.47; βT_and_Lie_O= 2.23). A violent act committed to serving Buddhist missions results in a happy ending for the committer (βB_and_Viol_O= 2.55). What is highlighted here is a glaring double standard in the interpretation and practice of the three teachings: the very virtuous outcomes being preached, whether that be compassion and meditation in Buddhism, societal order in Confucianism, or natural harmony in Taoism, appear to accommodate two universal vices—violence in Buddhism and lying in the latter two. These findings contribute to a host of studies aimed at making sense of contradictory human behaviors, adding the role of religious teachings in addition to cognition in belief maintenance and motivated reasoning in discounting counterargument. Folklore has a critical role as a cultural transmitter, all the while being a socially accepted medium for the expressions of culturally contradicting wishes and conducts. In this study of Vietnamese folktales, through the use of Bayesian multilevel modeling and the Markov chain Monte Carlo technique, we offer empirical evidence for how the interplay between religious teachings (Confucianism, Buddhism, and Taoism) and deviant behaviors (lying and violence) could affect a folktale’s outcome. The findings indicate that characters who lie and/or commit (...) violent acts tend to have bad endings, as intuition would dictate, but when they are associated with any of the above Three Teachings, the final endings may vary. Positive outcomes are seen in cases where characters associated with Confucianism lie and characters associated with Buddhism act violently. The results supplement the worldwide literature on discrepancies between folklore and real-life conduct, as well as on the contradictory human behaviors vis-à-vis religious teachings. Overall, the study highlights the complexity of human decision-making, especially beyond the folklore realm. (shrink)

Cet article vise à justifier, puis à appliquer une éthique climatique centrée sur les intérêts des acteurs économiques. Après avoir expliqué pourquoi le changement climatique pose un problème important de motivation, je montre pour quelles raisons les incitations peuvent au moins partiellement y remédier. Je développe ensuite deux possibilités d’institutionnalisation de l’éthique des incitations. La première consiste en une taxe internationale augmentant progressivement le coût des émissions de dioxyde de carbone, un dispositif auquel il convient d’ajouter des subsides pour la (...) recherche, le développement et le déploiement des énergies renouvelables. La seconde consiste en un marché global du carbone qui vise également à décourager l’utilisation des combustibles fossiles et à encourager l’utilisation de sources alternatives d’énergie. L’objectif est de montrer qu’une éthique climatique prenant en compte le problème de la motivation est plus efficace qu’une position qui se limite aux devoirs moraux incombant aux consommateurs et producteurs, soit de réduire leurs émissions. Judith Notter Il existe un important argument en faveur des inégalités de richesse, à savoir « l’argument de l’incitation au travail ». Selon cet argument, les inégalités sont justes car elles motivent les riches à travailler davantage, ce qui augmente la richesse collective et améliore le sort des plus démunis – par l’investissement, l’épargne et la redistribution. Cet argument est problématique car il existe un argument parfaitement similaire qui peut être utilisé pour critiquer les inégalités. Il s’agit de « (...) l’argument de l’envie ». Selon cet argument, les inégalités sont injustes car elles motivent les plus démunis à nuire aux intérêts des plus riches, ce qui détériore la situation économique collective. La similitude des deux arguments a pour conséquence que, si les partisans des inégalités veulent utiliser l’argument de l’incitation au travail en faveur de leur position, ils sont contraints d’admettre simultanément l’argument de l’envie à l’encontre de leur position. Pour sortir de cette situation difficile, les anti-égalitaristes avancent plusieurs arguments pour montrer que l’envie des pauvres et le besoin d’incitation au travail des riches doivent être traités différemment. Dans cet article, nous soutenons, contre les anti-égalitaristes, qu’il n’existe aucune raison de traiter différemment l’envie et le besoin d’incitation au travail. (shrink)

In this article, I argue that we need a better understanding of the theoretical underpinnings of the current debates in international law surrounding hate speech and inchoate crimes. I construct a theoretical basis for speech acts as incitement to genocide, distinguishing these speech acts from speech as genocide and speech denying genocide by integrating international law with concepts drawn from speech act theory and moral philosophy. I use the case drawn on by many commentators in this area of international criminal (...) law, the trial of media executives for the roles they played in the Rwandan genocide through public speech acts by media entities insulting an ethnic group or advocating violence against an ethnic group. Each of these men were institutional leaders and were charged with using their positions within Rwandan society to distribute what I call genocidal hate speech, genocidal incitement speech, and genocidal participation speech. I argue for a distinction between these three types of speech, and a difference in individual criminal liability for the dissemination of each type of speech. I also argue that there should be a difference in individual criminal liability for speech acts within the context of an ongoing or recent genocide, and speech acts that can be separated from a site of mass violence. The UN International Covenant on Civil and Political Rights obliges state parties to prohibit any advocacy of religious hatred that constitutes incitement to discrimination or violence. This book traces the origins of this provision and proposes an actus reus for this offence. The question of whether hateful incitement is a prohibition per se or also encapsulates a fundamental 'right to be protected against incitement' is extensively debated. Also addressed is the question of how to judge incitement. Is mens rea required (...) to convict someone of advocating hatred, and if so, for what degree of intent? This analysis also includes the paramount question if and to what extent content and/or context factors ought to be decisive. The author extensively engages with comparative domestic law and compares the workings of the UN Human Rights Committee with those of the UN Committee on the Elimination of Racial Discrimination and the European Court of Human Rights. Drosophila males sing a courtship song to achieve copulations with females. Females were recently found to sing a distinct song during copulation, which depends on male seminal fluid transfer and delays female remating. Here, it is hypothesized that female copulation song is a signal directed at the copulating male and changes ejaculate allocation. This may alter female remating and sperm usage, and thereby affect postcopulatory mate choice. Mechanisms of how female copulation song is elicited, how males respond to copulation song, (...) and how remating is modulated, are considered. The potential adaptive value of female signaling during copulation is discussed with reference to vertebrate copulation calls and their proposed function in eliciting mate guarding. Female copulation song may be widespread within the Drosophila genus. This newly discovered behavior opens many interesting avenues for future research, including investigation of how sexually dimorphic neuronal circuits mediate communication between nervous system and reproductive organs. Background: Research suggests that humans have the tendency to increase the valence of events when these are imagined to happen in the future, but to decrease the valence when the same events are imagined to happen in the past. This line of research, however, has mostly been conducted by asking participants to value imagined, yet probable, events. Our aim was to re-examine this time-valence asymmetry using real-life data: a Reuter’s news and a Facebook status updates corpus. Method: We organized the (...) Reuter news (120,000,000 words) and the Facebook status updates data (41,056,346 words) into contexts grouped in chronological order (i.e., past, present, and future) using verbs and years as time markers. These contexts were used to estimate the valence of each article and status update, respectively, in relation to the time markers using natural language processing tools (i.e., the Latent Semantic Analysis algorithm). Results: Our results using verbs, in both text corpus, showed that valence for the future was significantly higher compared to the past (future > past). Similarly, in the Reuter year condition, valence increased approximately linear from 1994 to 1999 for texts written 1996-7. In the Facebook year condition, the valence of the future was also significantly higher than past valence. Conclusion: Generally, the analyses of the Reuters data indicated that the past is devaluated relative to both the present and the future, while the analyses of the Facebook data indicated that both the past and the present are devaluated against the future. On this basis, we suggest that people strive to communicate the promotion of a bright future and the prevention of a dark future, which in turn leads to a temporal-valence asymmetrical phenomenon (valence = pastshrink)

L’article tente de présenter la tolérance comme une vertu, c’est-à-dire comme une capacité, un certain habitus , permettant à l’homme d’établir un rapport juste avec autrui. Cependant, avant de commencer à présenter la vertu de la tolérance, le concept de vertu est expliqué au sens aristotélicien du terme, notamment à la lumière de la vertu de l’amitié. Cet éclaircissement a abouti à la conclusion que la vertu était un état intérieur qui permet à un homme de mettre en harmonie ses (...) sentiments avec la donne naturelle. C’est pourquoi les vertus d’un homme impliquent la justesse de ses actes, que ce soit envers lui-même ou envers les autres. Ainsi, la tolérance sera présentée comme une vertu permettant à l’homme de vaincre les vices tels que les préjugés, l’attitude hostile ou la haine. Les vices en question ne représentent pas seulement un danger pour l’individu en tant que tel, mais aussi pour la société toute entière car ils mettent directement en péril la démocratie et les droits de l’homme. Donc, vaincre ces vices, à travers le dialogue et la tolérance, permet d’établir les fondements de la démocratie et des droits de l’homme en général. La fin de l’article se penche sur le rapport entre le droit et la morale, comprise au sens de la vertu, en concluant que le droit et la morale doivent se compléter plutôt que s’exclure. (shrink)

Originally, literary prizes were restricted to the world of academia, but since the 19th century they have grown to become commercial events in the publishing calendar. This article looks at the role of the literary prize as an agent of change by focusing on two prominent prizes in the United Kingdom: the Booker and the Women’s Prize for Fiction. By analysing data from archive material held at Oxford Brookes University, this article argues that the founding of the Women’s Prize highlighted (...) an issue with the Booker and promoted discussion around that issue, and that the Booker reacted positively in the years after the introduction of a competing literary prize. This article examines the issues raised by recent legislation proscribing incitement to religious hatred. In particular, it examines how far arguments for prohibiting racist hate speech apply also to the prohibition of religious hate speech. It identifies a number of significant differences between race and religion. It also examines several questions raised by the prohibition of religious hate speech, including the meaning and scope of religious identity, why that identity should receive special protection, and whether protection should be directed to (...) religious groups as groups or to their individual members. The central argument of the article is that the distinction between protecting religious groups from vilification and protecting their beliefs and practices from criticism—a distinction on which the British Government placed great emphasis in defending its legislation—is unsustainable. That conclusion is supported by the reasoning of the European Court of Human Rights in cases in which it has upheld the curtailing of freedom of expression for the sake of protecting religion. This paper discusses why speech regulations are logically necessary for any account of a moral right to free speech. My argument for limiting the right to free speech (and more widely any right to freedom) will be grounded in compossibility. Rights to freedom, formally speaking, are claims by an agent that other people not interfere with them; a compossible set of rights is one where the domains of permissible actions–permitted by each claim (and its correlative duty) within the set–do not (...) contradict one another across claims. I will argue that in order for claims to be coherent, they cannot generate contradictory domains, and that for a claim to non-interference to not generate contradictory domains across multiple people with the same claim, the claim must be restricted. This account as it currently stands can at least generate conclusions on the permissibility of incitement. (shrink)

Afropessimism incites controversy within and without the academy for the provocation that modernity’s ethical life, including its purportedly progressive facets, is entirely undergirded by a rejection of blackness. On this basis it squares a self-concept as a non-prescriptive theoretical framework with a negative prescription of “world-abolition.” I reconstruct Afropessimism’s conceptual apparatus in light of its criticism in academic philosophy. I then relate the theory’s negativism with Theodor Adorno’s view that “in wrong life there is no right life,” to argue that (...) Yuejiao was the primary form of education ever since the time of Emperors Yao and Shun. This tradition of valuing Yue over Li lasted till the Three Dynasties period. After the Spring and Autumn Period, Lijiao became the dominant form, but it still consisted of a lot of yue. Seeing the declining of this tradition, Confucius claimed to “follow upon Zhou”. That is, he wanted to recover and inherit this ideology that engages primarily in music cultivation supplemented by ritual normalization. (...) His statement: “Let a man be first incited by the Songs, then given a firm footing by the study of ritual, and finally perfected by music,” also shows his emphasis on Yue. More proofs can be found in Confucian classics such as Analects and the Record of Rites, in which discourses on/ about beauty and goodness are characterized by the juxtaposition of Li and Yue to serve a higher purpose for the pre-Qin Confucians. However, this ideology was not inherited by later Confucians. And the consequence is with the increasing status and impact of Confucianism in China in the past 2500 years, such a tradition of valuing Yue over Li gradually turned into a tradition of valuing Li over Yue. This, however, is inconsistent with both Confucius’ ideology of Li and Yue and the real characteristic of Chinese cultural tradition. (shrink)

Susanne K. Langer is best known as a philosopher of culture and student of Ernst Cassirer. In this chapter, however, I argue that this standard picture ignores her contributions to the development of analytic philosophy in the 1920s and 1930s. I reconstruct the reception of Langer’s first book *The Practice of Philosophy*—arguably the first sustained defense of analytic philosophy by an American philosopher—and describe how prominent European philosophers of science such as Moritz Schlick, Rudolf Carnap, and Herbert Feigl viewed her (...) as one of the most important allies in the United States. In the second half of this chapter, I turn to Langer’s best-selling *Philosophy in a New Key* and reconstruct her attempts to broaden the scope of the, by then, rapidly growing U.S. analytic movement. I argue that her book anticipated various developments in analytic philosophy but was largely ignored by her former colleagues. I end the chapter by offering some clues as to why New Key did not incite the same laudatory responses from analytic philosophers as her earlier work. (shrink)

This article explores whether perspective taking has an impact on the ascription of epistemic states. To do so, a new method is introduced which incites participants to imagine themselves in the position of the protagonist of a short vignette and to judge from her perspective. In a series of experiments, perspective proves to have a significant impact on belief ascriptions, but not on knowledge ascriptions. For belief, perspective is further found to moderate the epistemic side-effect effect significantly. It is hypothesized (...) that the surprising findings are driven by the special epistemic authority we enjoy in assessing our own belief states, which does not extend to the assessment of our own knowledge states. Do representations of violence incite or quell violent desires and actions? This question--the question of the relation between mimesis and catharsis--is as old as Western Philosophy itself. In this essay, I attempt to think through how Kristeva might describe the difference between representations of violence that perpetuate violent desires and actions versus representations of violence that sublimate violent desires and thereby prevent violent actions.

The subject of this paper, Excuses, is one not to be treated, but only to be introduced, within such limits. It is, or might be, the name of a whole branch, even a ramiculated branch, of philosophy, or at least of one fashion of philosophy. I shall try, therefore, first to state what the subject is, why it is worth studying, and how it may be studied, all this at a regrettably lofty level: and then I shall illustrate, in more (...) congenial but desultory detail, some of the methods to be used, together with their limitations, and some of the unexpected results to be expected and lessons to be learned. Much, of course, of the amusement, and of the instruction, comes in drawing the coverts of the microglot, in hounding down the minutiae, and to this I can do no more here than incite you. Books are well written, or badly written. That is all.” He was echoed by Auden, who said in his poem in memory of William Butler Yeats that poetry makes nothing happen (though the poem as a whole qualifies this overstatement), by Croce, and by formalist critics such as (...) Cleanth Brooks, a doyen of the New Critics, who insisted that edification was the function of religion but not of poetry. 1 George Orwell, though himself a didactic novelist, was of this view as well, 2 and it is one that most critics adopt when the issue is censorship. I accept Wilde’s thesis—the creed of aestheticism, of art for art’s sake—if understood to mean that the moral content and consequences of a work of literature are irrelevant to its value as literature; or as the critic Helen Vendler has put it, that “treating fictions as moral pep-pills or moral emetics is repugnant to anyone who realizes the complex psychological and moral motives of a work of art.” 3 This is not to deny that reading can have consequences, including moral and political ones. Information affects people’s outlook and behavior, and reading is a source of information. Imaginative literature conveys ideas, opinions, and information, often with great power. Think of the role that novels by Turgenev (Fathers and Sons), Dostoevsky (The Possessed), Conrad (The Secret Agent, Under Western Eyes), Koestler (Darkness at Noon), Orwell (Animal Farm, Nineteen Eighty-Four), and, of course, Solzhenitsyn played in exposing the horrors of anarchism and communism. Of A Passage to India it has been said that “as an account of the social conditions of British India it was powerful enough to have influenced events.” 4 Upton Sinclair’s novel The Jungle is thought to have incited federal regulation of food processing; and few doubt the effect of Uncle Tom’s Cabin (1852) on the abolitionist cause. [End Page 1]At the core of the aesthetic tradition, which I shall be defending in this essay particularly against its opponents in the “law and literature” movement, are three theses. First, immersion in literature does not make us better citizens or better people. One might be able to pick out some works of literature that would have such an effect because of the information they convey or the emotional state they induce, but they would constitute a skewed sample of literary works. Second, we should not be put off by morally offensive views encountered in literature even when the author appears to share them. A work of literature is not to be considered maimed or even marred by expressing unacceptable moral views; by the same token, a mediocre work of literature is not redeemed by expressing moral views of which we approve. The proper criteria for evaluating literature are aesthetic rather than ethical. Third, authors’ moral qualities or opinions should not affect our valuations of their works.The insistence, in short, is on the separation of the moral from the aesthetic—but with two qualifications. Some literature has little interest or value apart from the didactic and for it the proper criticism is didactic. And the separation of moral from aesthetic values is not a rejection of the former. The aesthetic outlook is a moral outlook, one that stresses the values of openness, detachment, hedonism, curiosity, tolerance, the cultivation of the self, and the preservation of a private sphere—in short, the values of liberal individualism.The counter tradition in literary criticism to the aesthetic originates with Plato and insists upon the importance, in some versions to the near or even total exclusion of anything else, of the ethical or political content and effects of works of literature, and less commonly of the author’s own morality. Enactivists frequently argue their account heralds a revolution in cognitive science: enactivism will unseat cognitivism as the dominant paradigm. We examine the lines of reasoning enactivists employ in stirring revolt, but show that none of these prove compelling reasons for cognitivism to be replaced by enactivism. First, we examine the hard sell of enactivism: enactivism reveals a critical explanatory gap at the heart of cognitivism. We show that enactivism does not meet the requirements to incite a paradigm shift in the (...) Kuhnian sense—there is no internal crisis in cognitivism. Nor does it provide inherently better explanations of cognition as some have claimed. Second, we consider the soft sell of enactivism: enactivism provides a more attractive, parsimonious, or clear-eyed lens on cognition. This move proves to boil down to a misunderstanding of how theories are selected in science. Instead we lend support to a broader and more desirable way to conceive of enactivism, the recent proposal that enactivism is a philosophy of nature. We explain how a philosophy of nature does more than support a single research paradigm by integrating scientific questions into a cohesive picture. (shrink)

Existing approaches to campaign ethics fail to adequately account for the “arms races” incited by competitive incentives in the absence of effective sanctions for destructive behaviors. By recommending scrupulous devotion to unenforceable norms of honesty, these approaches require ethical candidates either to quit or lose. To better understand the complex dilemmas faced by candidates, therefore, we turn first to the tradition of “adversarial ethics,” which aims to enable ethical participants to compete while preventing the most destructive excesses of competition. As (...) we demonstrate, however, elections present even more difficult challenges than other adversarial contexts, because no centralized regulation is available to halt potential arms races. Turning next to recent scholarship on populism and partisanship, we articulate an alternative framework for campaign ethics, which allows candidates greater room to maneuver in their appeals to democratic populations while nevertheless requiring adherence to norms of social and political pluralism. L’engagement actif des pentecôtistes dans un combat spirituel recentré sur des enjeux politiques se perçoit davantage en contexte kabyle où les représentations individuelles et les positions dans l’arène religieuse s’inscrivent dans (...) une configuration militante et prosélyte d’un religieux revendicatif et protestataire. "Pensar Europa en sus fronteras", como ya en 1992 proponían un grupo de filósofos de la Universidad de Estrasburgo -Denis Guénoun, Philippe Lacoue-Labarthe, Jean-Luc Nancy, Daniel Payot-, significa considerar qué es eso de la "geofilosofía de Europa" como una cuestión imprescindible que conlleva toda reflexión veraz en torno a la idea de Europa. El debate al que invitaron a una serie diversa de colegas y amigos, procedentes de diferentes naciones, planteaba la posibilidad misma de una identificación de Europa, así como (...) la profundidad, esto es, la misma violencia que esta posibilidad conlleva, como los hechos de la más reciente y rabiosa actualidad han confirmado una y otra vez desde aquellas fechas. La propuesta era todo menos fútil. En efecto, como es bien sabido y ellos mismos expresaron unos meses después, en julio de 1993, lo bien cierto es que ha habido terribles furores desencadenados y atroces desgarramientos tanto intra como extraeuropeos, que como mínimo nos urgen a pensar si el proyecto de lo que merece llamarse un 'mundo' puede o no puede confundirse con la exclusiva exportación de aquello que Europa habría inventado, producido e identificado. "Thinking Europe at its limits", as proposed in 1992 by a group of philosophers from the University of Strasbourg -Denis Guénoun, Philippe Lacoue-Labarthe, Jean-Luc Nancy, Daniel Payot-, means considering what the "geo-philosophy of Europe" is as an essential question that encompasses all truthful reflection surrounding the idea of Europe. The debate, to which a diverse group of colleagues and friends from different nations were invited, advanced the very possibility of an identification of Europe, together with the profoundness, in other words the very violence that this possibility implies, as confirmed time and again since then by recent and highly topical events. The proposal was everything but futile. Indeed, as is well known and was confirmed by the group itself some months later in July 1993, what is certain is that a storm of terrible furores broke out and atrocious upheavals were expressed, both intra- and extra-European, that, if nothing else, urge us to consider whether the project of what deserves to be known as a "world"may or may not be confused with the exclusive exportation of what Europe has invented, produced and identified. The future appears to be in the grip of two morbid figures, two symmetrical nightmares: the myth of a homogeneous planet, like a gigantic Europe spreading everywhere; and a confined Europe, imprisoned in its imprecise and uncertain boundaries, a kind of isolating barricade or trenches enabling it to reclusively consume the illusion of its supposed welfare. This deplorable alternative incites part of our responsibilities, since the arenas of the future necessarily feed off the forms and propositions of thought, which are worthy of an attempt to weigh up and understand. Manipulative actions come in a bewildering variety of forms: direct and indirect deception, playing on emotions, tempting, inciting, and so on. It is not obvious what feature all these actions share in virtue of which they are all of the same kind and in virtue of which they are all morally wrong. This article argues that all manipulative actions are cases in which the manipulator attempts to lead the victim astray by trying to get her to have emotions, beliefs, or (...) desires that, as the manipulator sees it, are not ideal for the victim. To attempt to lead a person astray in this way is to fail to respect the moral and rational agency of the victim. This analysis captures the fact that actions of many kinds--and with many different psychological effects--can be manipulative, and it tells us what is wrong with acting manipulatively. It also helps distinguish manipulation from non rational persuasion. (shrink)

When is life-sustaining treatment not in the best interests of a minimally conscious child? This is an extremely difficult question that incites seemingly intractable debate. And yet, it is the question courts in England and Wales have set out to answer in disputes about appropriate medical treatment for children.

One can rightly say of Peter Sloterdijk that each of his essays and lectures is also an unwritten book. That is why the texts presented here, which sketch a philosophical physiognomy of Martin Heidegger, should also be characterized as a collected renunciation of exhaustiveness. In order to situate Heidegger's thought in the history of ideas and problems, Peter Sloterdijk approaches Heidegger's work with questions such as: If Western philosophy emerged from the spirit of the polis, what are we to make (...) of the philosophical suitability of a man who never made a secret of his stubborn attachment to rural life? Is there a provincial truth of which the cosmopolitan city knows nothing? Is there a truth in country roads and cabins that would be able to undermine the universities with their standardized languages and globally influential discourses? From where does this odd professor speak, when from his professorial chair in Freiburg he claims to inquire into what lies beyond the history of Western metaphysics? Sloterdijk also considers several other crucial twentieth-century thinkers who provide some needed contrast for the philosophical physiognomy of Martin Heidegger. A consideration of Niklas Luhmann as a kind of contemporary version of the Devil's Advocate, a provocative critical interpretation of Theodor Adorno's philosophy that focuses on its theological underpinnings and which also includes reflections on the philosophical significance of hyperbole, and a short sketch of the pessimistic thought of Emil Cioran all round out and deepen Sloterdijk's attempts to think with, against, and beyond Heidegger. Finally, in essays such as "Domestication of Being" and the "Rules for the Human Park," which incited an international controversy around the time of its publication and has been translated afresh for this volume, Sloterdijk develops some of his most intriguing and important ideas on anthropogenesis, humanism, technology, and genetic engineering. This study argues that to understand Socrates we must uncover and analyze his religious views, since his philosophical and religious views are part of one seamless whole. Mark McPherran provides a close analysis of the relevant Socratic texts, an analysis that yields a comprehensive and original account of Socrates' commitments to religion. McPherran finds that Socrates was not only a rational philosopher of the first rank, but a figure with a profoundly religious nature as well, believing in the existence of (...) gods vastly superior to ourselves in power and wisdom and sharing other traditional religious commitments with his contemporaries. However, Socrates was just as much a sensitive critic and rational reformer of both the religious tradition he inherited and the new cultic incursions he encountered. McPherran contends that Socrates saw his religious commitments as integral to his philosophical mission of moral examination and, in turn, used the rationally derived convictions underlying that mission to reshape the religious conventions of his time. As a result, Socrates made important contributions to the rational reformation of Greek religion, contributions that incited and informed the theology of his brilliant pupil, Plato. (shrink)
