The Person and the Inpersonal: confronting Max Scheler’s phenomenological thought with Heidegger’s. This essay starts from a similarity between the thought of Max Scheler and Martin Heidegger in their correspondent approaches to the way the being of the human as non-substantial. Both Scheler’s notion of “Person” and Heidegger’s notion of “Dasein” are conceived of as acts, always already determined by their being-in-the-world, and not as substantial entities with a kind of identity previous to their “actuality”. Nonetheless, Scheler and Heidegger extract (...) from that originally common thought divergent pathways of thinking: whereas the first one addresses the mode of being of the Person, the second derives to the “impersonal” (das Man). The consequences of foreign direct investment (FDI) for human rights protection are poorly understood. We propose that the impact of FDI varies across industries. In particular, extractive firms in the oil and mining industries go where the resources are located and are bound to such investment, which creates a status quo bias among them when it comes to supporting repressive rulers (“location-bound effect”). The same is not true for nonextractive multinational corporations (MNCs) in manufacturing or services, which can, in comparison, (...) exit problematic countries more easily. We also propose that strong democratic institutions can alleviate negative impacts of extractive FDI on human rights (“democratic safeguard effect”). Using U.S. FDI broken up into extractive and nonextractive industries in 157 host countries (1999–2015), we find support for these propositions.1 Extractive FDI is associated with more human rights abuse, but nonextractive FDI is associated with less abuse, after controlling for other factors, including concerns about endogeneity. We find also that the negative human rights impact of extractive FDI vanishes in countries where democratic institutions are stronger. The number of available legal documents has presented an enormous growth in recent years, and the digital processing of such materials is prompting the necessity of systems that support the automatic relevant information extraction. This work presents a system for ontology-based information extraction from natural language texts, able to identify a set of legal events. The system is based on an innovative methodology based on domain ontology of legal events and a set of linguistic rules, integrated through inference (...) mechanism, resulting in a flexible approach and scalable approach. A case study with the use of documents from the Superior Court in Brazil is related, with satisfactory results in precision and recall. (shrink)

This paper analyses the phenomenology and epistemology of chatbots such as ChatGPT and Bard. The computational architecture underpinning these chatbots are large language models (LLMs), which are generative AI (Artificial Intelligence) systems trained on a massive dataset of text extracted from the Web. We conceptualise these LLMs as multifunctional computational cognitive artifacts, used for various cognitive tasks such as translating, summarizing, answering questions, information-seeking, and much more. Phenomenologically, LLMs can be experienced as a “quasi-other”; when that happens, users anthropomorphise them. (...) For most users, current LLMs are black boxes, i.e., for the most part, they lack data transparency and algorithmic transparency. They can, however, be phenomenologically and informationally transparent, in which case there is an interactional flow. Anthropomorphising and interactional flow can, in some users, create an attitude of (unwarranted) trust towards the output LLMs generate. We conclude this paper by drawing on the epistemology of trust and testimony to examine the epistemic implications of these dimensions. Whilst LLMs generally generate accurate responses, we observe two epistemic pitfalls. Ideally, users should be able to match the level of trust that they place in LLMs to the degree that LLMs are trustworthy. However, both their data and algorithmic opacity and their phenomenological and informational transparency can make it difficult for users to calibrate their trust correctly. The effects of these limitations are twofold: users may adopt unwarranted attitudes of trust towards the outputs of LLMs (which is particularly problematic when LLMs hallucinate), and the trustworthiness of LLMs may be undermined. In communities of user-generated content, systems for the management of content and/or their contributors are usually accepted without much protest. Not so, however, in the case of Wikipedia, in which the proposal to introduce a system of review for new edits (in order to counter vandalism) led to heated discussions. This debate is analysed, and arguments of both supporters and opponents (of English, German and French tongue) are extracted from Wikipedian archives. In order to better understand this division of the (...) minds, an analogy is drawn with theories of bureaucracy as developed for real-life organizations. From these it transpires that bureaucratic rules may be perceived as springing from either a control logic or an enabling logic. In Wikipedia, then, both perceptions were at work, depending on the underlying views of participants. Wikipedians either rejected the proposed scheme (because it is antithetical to their conception of Wikipedia as a community) or endorsed it (because it is consonant with their conception of Wikipedia as an organization with clearly defined boundaries). Are other open-content communities susceptible to the same kind of ‘essential contestation’? (shrink)

In this article, our objective was to analyze the emotions expressed regarding the Covid-19 vaccine in content published in Brazilian Portuguese on TikTok, a video sharing platform that has recently experienced global popularity. Our data set for this investigation was comprised of posts including the hashtag #vacina (vaccine), extracted using the Python TikTokAPI library. Emotions were identified and classified using standardized descriptors from the Human-Machine Interaction Network on Emotion (HUMAINE) and the Core Affect Model. Given the diversity of content on (...) TikTok, videos with emotional content were also separated into categories. Results revealed a prevalence of positive emotions such as contentment, enthusiasm, and interest regarding the vaccines, especially in videos of a personal and informative character. Negative emotions, such as doubt and disapproval, were associated with contextual and strategic factors, with significant expression in humorous and infotainment publications. (shrink)

“Fair and equitable benefit-sharing” is one of the objectives of the UN Convention on Biological Diversity and the FAO International Treaty on Plant Genetic Resources for Food and Agriculture. In essence, benefit-sharing holds that countries, farmers, and indigenous communities that grant access to their plant genetic resources and/or traditional knowledge should share in the benefits that users derive from these resources. But what exactly is understood by “fair” and “equitable” in this context? Neither term is defined in the international treaties. (...) A complicating factor, furthermore, is that different motivations and perspectives exist with respect to the notion of benefit-sharing itself. This paper looks at six different approaches to benefit-sharing that can be extracted from the current debates on “Access and Benefit-Sharing.” These approaches form the basis of a philosophical reflection in which the different connotations of “fair and equitable” are considered, by analyzing the main principles of justice involved. Finally, the various principles are brought together in order to draw some conclusions as to how a fair and equitable benefit-sharing mechanism might best be realized. This article proposes an original analysis of the international debate on climate change through the use of digital methods. Its originality is twofold. First, it examines a corpus of reports covering 18 years of international climate negotiations, a dataset never explored before through digital techniques. This corpus is particularly interesting because it provides the most consistent and detailed reporting of the negotiations of the United Nations Framework Convention on Climate Change. Second, in this paper we test an original approach to (...) text analysis that combines automatic extractions and manual selection of the key issue-terms. Through this mixed approach, we tried to obtain relevant findings without imposing them on our corpus. The originality of our corpus and of our approach encouraged us to question some of the habits of digital research and confront three common misunderstandings about digital methods that we discuss in the first part of the article. In addition to reflecting on methodology, however, we also wanted to offer some substantial contribution to the understanding of UN-framed climate diplomacy. In the second part of the article we will therefore introduce some of the preliminary results of our analysis. By discussing three visualizations, we will analyze the thematic articulation of the climatic negotiations, the rise and fall of these themes over time and the visibility of different countries in the debate. Terra incognita: the space is vibrant with reality and yet, as to its essentials, it eludes, like a hypothesis, all the modes of knowledge that I have at my disposal, and it appears that it ought to remain unaffected by every research procedure, whether intuitive or discursive, indirect or direct, whatever its process of creation, through experience, conscience or reasoning. Moreover, I have to speak without the protection of any critical distance, since the question that has been put to me (...) concerns the status of the unknowable in my own work. This means that we are talking about a testimony that already implies the transgression of several taboos. During a radio interview, Matisse once explained: “I said to my young students: Would you like to paint? First of all, you will have to cut off your tongue, because this decision deprives you of the right to express yourselves in any other way than with brushes.” If what the painter wants to say could be expressed in words, he would be a novelist, a poet, or a philosopher rather than a painter. Further, I believe that there is an antinomy today—and perhaps even a kind of open conflict, a permanent tension—between painting and writing. It is partly this conflict on which my research is based. Everything that follows should therefore be taken with caution. Purpose– The medical advances and historical fluctuations in the demographics are contributing to the rise of the average age. These changes are increasing the pressure to organize adequate care to a growing number of individuals. As a way to provide efficient and cost-effective care, eHealth systems are gaining importance. However, this trend is creating new ethical concerns. Major issues are privacy and patients’ control over their data. To deploy these systems on a large scale, they need to offer strict privacy (...) protection. Even though many research proposals focus on eHealth systems and related ethical requirements, there is an evident lack of practical solutions for protecting users’ personal information. The purpose of this study is to explore the ethical considerations related to these systems and extract the privacy requirements. This paper also aims to put forth a system design which ensures appropriate privacy protection.Design/methodology/approach– This paper investigates the existing work in the area of eHealth systems and the related ethical considerations, which establish privacy as one of the main requirements. It lists the ethical requirements and data protection standards that a system needs to fulfil and uses them as a guideline for creating the proposed design.Findings– Even though privacy is considered to be a paramount aspect of the eHealth systems, the existing proposals do not tackle this issue from the outset of the design. Consequently, introducing privacy at the final stages of the system deployment imposes significant limitations and the provided data protection is not always to the standards expected by the users.Originality/value– This paper motivates the need for addressing ethical concerns in the eHealth domain with special focus on establishing strict privacy protection. It lists the privacy requirements and offers practical solutions for developing a privacy-friendly system and takes the approach of privacy-by-design. Additionally, the proposed design is evaluated against ethical principles as proposed in the existing literature. The aim is to show that technological advances can be used to improve quality and efficiency of care, while the usually raised concerns can be avoided. (shrink)

ABSTRACT This study set out to analyze the academic discourse on internationalization as deployed by English teachers who took part in Seminário Internacional da Associação Brasileira de Professores de Língua Inglesa da Rede Federal de Ensino Básico, Técnico e Tecnológico (2020) [2020 International Seminar of the Brazilian Association of English Language Teachers in the Federal Network of Basic, Technical and Technological Education]. Grounded in Dialogic Discourse Analysis, we built a corpus with five oral presentation summaries extracted from the conference’s book (...) of abstracts. We found that internationalization was predominantly associated with learning English but less strongly regarded as an institutional imperative. Our findings were thus indicative of dialogic relationships amongst academic, theoretical, official and advertising discourses. In the arena where opinions meet, there emerged two mutually complementing perspectives on internationalization efforts: one focused on the role of integral education and another focused on institutional conformation against an international backdrop. El objetivo de este artículo es plantear algunos desafíos epistémicos para la investigación social en Latinoamérica desde la discusión de la utilidad de la auto-etnografía como una estrategia metodológica. La línea argumentativa seleccionada para alcanzar el aludido objetivo es la siguiente: a) se reseñan algunas de las discusiones sobre el lugar del investigador en las ciencias sociales en la literatura de finales del siglo XX en los países centrales, b) se señalan las principales características de la auto-etnografía, c) se bosqueja (...) una experiencia del uso de la auto-etnografías en una investigación, y finalmente, d) se discuten algunas moralejas y desafíos que se pueden extraer desde lo narrado.The aim of this article is to discuss some epistemic challenges for social research in Latin America since the consideration of the usefulness of auto-ethnography as a methodological strategy. The argumentative strategy selected to achieve the objective is: a) outline some of the discussions on the place of the researcher in social sciences in the literature of the late twentieth century, b) indicates the main characteristics of the auto-ethnography, c) outlines an experience of using auto-ethnographies in research, and finally, d) discuss some conclusions and challenges that can be extracted. When we read Rousseau's Social Contract, we tend to focus on its explicit goal, which is to investigate and establish a safe and legitimate rule of administration for a single political community. In accordance with the abstract character of the work, we tend to see this community as something pre-existing and isolated, without asking what those individuals who decide to submit to the rule of his general will had initially in common, and how the political body thus formed is related (...) to those who are not they themselves, but "the others", i.e., with other societies among which they will inevitably have to live. Such issues were of great importance to Rousseau, and only the fragmentary and inconclusive nature of the Social Contract explains why they did not receive the detailed treatment that would be due to them. In this paper I intend to explore some aspects of the solutions Rousseau left sketched elsewhere, especially in Emile and in the Extract and Judgment of the the Abbé de Saint-Pierre's project of perpetual peace, which point to Rousseau's very lucid understanding of the problem of relations between nations, and to a solution that has, surprisingly, much in common with the one that he proposed, in the Social Contract, to the problem of relations between individuals. I Intend to show that there is, in Rousseau, the germ of a conception of international relations that do not reduce them to the mere play of forces proposed by Hobbesian "realism" and, at the same time, allows a regulated and civilized coexistence without imposing the uniformity of values and perspectives characteristic of Kantian cosmopolitanism.Ao ler o Contrato social de Rousseau, tendemos a nos concentrar em seu objetivo explícito, que é o de investigar e estabelecer uma regra de administração legítima e segura para uma comunidade política individual. Em conformidade com o próprio caráter abstrato da obra, somos levados a ver essa comunidade como alguma coisa pré-existente e isolada, sem perguntar o que já havia inicialmente de comum a esses indivíduos que decidem submeter-se à regra de sua vontade geral, e como esse corpo político assim constituído se relaciona com os que não são eles mesmos, mas "os outros", isto é, com as demais sociedades com as quais terá inevitavelmente de conviver. Tais questões tinham grande importância para Rousseau, e só o caráter fragmentário e inconcluso do Contrato social explica por que não receberam o tratamento aprofundado que lhes seria devido. Pretendo, em minha exposição, explorar alguns aspectos das soluções que Rousseau deixou esboçadas em outras obras, especialmente no Emílio e em seu Extrato e Julgamento, do projeto de paz perpétua do Abbé de Saint-Pierre, e que apontam para uma compreensão muito lúcida do problema das relações entre as nações, e para uma solução que tem, surpreendentemente, muito em comum com a que propôs, no Contrato social, para a questão das relações entre indivíduos. Pretendo mostrar que há, em Rousseau, o gérmen de uma concepção das relações internacionais que não as reduz ao mero jogo de forças proposto pelo "realismo" hobbesiano e, ao mesmo tempo, viabiliza a convivência civilizada e regulada, sem impor a uniformidade de valores e perspectivas característica do cosmopolitismo kantiano. Positioning technologies, such as GPS are widespread in society but are used only sparingly in behavioural science research, e.g., because processing positioning technology data can be cumbersome. The current work attempts to unlock positioning technology potential for behavioural science studies by developing and testing a research tool to analyse GPS tracks. This tool—psyosphere—is published as open-source software, and aims to extract behaviours from GPSs data that are more germane to behavioural research. Two field experiments were conducted to test application of (...) the research tool. During these experiments, participants played a smuggling game, thereby either smuggling tokens representing illicit material past border guards or not. Results suggested that participants varied widely in variables, such as course and speed variability and distance from team members in response to the presence of border guards. Subsequent analyses showed that some of these GPS-derived behavioural variables could be linked to self-reported mental states, such as fear. Although more work needs to be done, the current study demonstrates that psyosphere may enable researchers to conduct behavioural experiments with positioning technology, outside of a laboratory setting. In this paper I explore the ways in which Alexander of Aphrodisias employs and develops so-called ‘common notions’ as reliable starting points of deductive arguments. He combines contemporary developments in the Stoic and Epicurean use of common notions with Aristotelian dialectic, and axioms. This more comprehensive concept of common notions can be extracted from Alexander’s commentary on Metaphysics A 1–2. Alexander puts Aristotle’s claim that ‘all human beings by nature desire to know’ in a larger deductive framework, and adds weight (...) to Aristotle’s use of the common understanding of the notion of ‘wisdom’. Finally I will indicate how these upgraded common notions are meant to play an important role in the general framework of metaphysics as a science. (shrink)

Background: The way the death of a dear person is communicated can have a profound impact on the entire bereavement process. The words and expressions that are used to give the tragic news, the characteristics of who communicates it, the physical setting in which the notification is given, the means used (e.g., in person, via phone call, etc.) are just some of the factors that can influence the way survivors face one of the most difficult moments in their lives. Aim: (...) To review the literature on the topic of death notification to verify the state of the art related to this important procedure. Methods: A systematic review was conducted with PRISMA criteria on English-written materials produced from 1966 to 2019. Results: Out of the initial 3,166 titles considered, 65 articles were extracted for this review. Four main themes emerged: 1) protocols and guidelines; 2) emotional reactions of recipients and notifiers; 3) professional figures involved in the notification process; and, 4) types of death. Discussion: The communication of death represents a complex and stressful experience not only for those who receive it but also for those who give it. Alongside the acquisition of a necessary technique and execution methods, the process should involve the selection of notifiers based on personality characteristics and communication styles. Conclusion: Indications for the need of better training and protocols sensitive to different circumstances emerge. Adequate preparation can deeply affect the quality of communication and the effects it produces, both on recipients and on notifiers. In vocational training, more space should be devoted to this demanding task. (shrink)

Background Maternal mental health during the peripartum period is critically important to the wellbeing of mothers and their infants. Numerous studies and clinical trials have focused on various aspects of interventions and treatments for perinatal mental health from the perspective of researchers and medical health professionals. However, less is known about women’s experiences of participating in perinatal mental health research, and the ethical issues that arise. Aim To systematically review the literature on the ethical issues that emerge from pregnant and/or (...) postpartum women’s experiences of taking part in perinatal mental health-related research. Methods Systematic review of nine bibliographic databases, from inception to July 2021. Qualitative, quantitative and mixed method studies were included if they reported on ethical issues experienced by perinatal women. Research ethical issues encompassed any issue relating to women’s experiences of being offered study information, recruitment, consent, retention and respect for autonomy. Titles, abstracts and full text screening, appraisal of the methodological quality of included studies, and data extraction, were conducted independently by two reviewers. Ethical considerations Ethical approval was not required for this systematic review. Findings A total of 9830 unique citations was retrieved. Six studies met the inclusion criteria. Studies were clinically and methodologically heterogenous, and only one was purposively designed to explore women’s experiences. The key finding was the establishment of trust between the researcher and participant in all stages of the research process. Findings are presented according to recruitment and consent processes, participation and retention, and study follow-up and completion. Conclusion The establishment of trust between the researcher and perinatal women leads to a dynamic with research ethical implications relevant to all stages of perinatal mental health-related research. Further research on the research ethical issues experienced by perinatal women is required because of the limited literature. (shrink)

The idea of personalised medicine (PM) has gathered momentum recently, attracting funding and generating hopes as well as scepticism. As PM gives rise to differing interpretations, there have been several attempts to clarify the concept. In an influential paper published in this journal, Schleidgen and colleagues have proposed a precise and narrow definition of PM on the basis of a systematic literature review. Given that their conclusion is at odds with those of other recent attempts to understand PM, we consider (...) whether their systematic review gives them an edge over competing interpretations. We have found some methodological weaknesses and questionable assumptions in Schleidgen and colleagues’ attempt to provide a more specific definition of PM. Our perplexities concern the lack of criteria for assessing the epistemic strength of the definitions that they consider, as well as the logical principles used to extract a more precise definition, the narrowness of the pool from which they have drawn their empirical data, and finally their overlooking the fact that definitions depend on the context of use. We are also worried that their ethical assumption that only patients’ interests are legitimate is too simplistic and drives all other stakeholders’ interests—including those that are justifiable—underground, thus compromising any hope of a transparent and fair negotiation among a plurality of actors and interests. As an alternative to the shortcomings of attempting a semantic disciplining of the concept we propose a pragmatic approach. Rather than considering PM to be a scientific concept in need of precise demarcation, we look at it as an open and negotiable concept used in a variety of contexts including at the level of orienting research goals and policy objectives. We believe that since PM is still more an ideal than an achieved reality, a plurality of visions is to be expected and we need to pay attention to the people, reasons and interests behind these alternative conceptions. In other words, the logic and politics of PM cannot be disentangled and disagreements need to be tackled addressing the normative and strategic conflicts behind them. (shrink)

BackgroundDespite the rapid global growth of biobanking over the last few decades, and their potential for the advancement of health research, considerations specific to the sharing of benefits that accrue from biobanks have received little attention. Questions such as the types and range of benefits that can arise in biobanking, who should be entitled to those benefits, when they should be provided, by whom and in what form remain mostly unanswered. We conducted a scoping review to describe benefit sharing considerations (...) and practices in biobanking in order to inform current and future policy and practice. MethodsDrawing on the Arksey and O’Malley framework, we conducted a scoping review of the literature in three online databases (PubMed, Cochrane library, and Google Scholar). We extracted and charted data to capture general characteristics, definitions and examples of benefits and benefit sharing, justification for benefit sharing, challenges in benefit sharing, governance mechanisms as well as proposed benefit sharing mechanisms.Results29 articles published between 1999 and 2020 met the inclusion criteria for the study. The articles included 5 empirical and 24 non-empirical studies. Only 12 articles discussed benefit sharing as a stand-alone subject, while the remaining 17 integrated a discussion of benefits as one issue amongst others. Major benefit sharing challenges in biobanking were found to be those associated with uncertainties around the future use of samples and in resultant benefits.ConclusionMost of the benefit sharing definitions and approaches currently in use for biobanking are similar to those used in health research. These approaches may not recognise the distinct features of biobanking, specifically relating to uncertainties associated with the sharing and re-use of samples. We therefore support approaches that allow decisions about benefit sharing to be made progressively once it is apparent who samples are to be shared with, the intended purpose and expected benefits. We also highlight gaps in key areas informing benefit sharing in biobanking and draw attention to the need for further empirical research. (shrink)

RESUMO Neste artigo, analiso um conjunto de seis cartões comerciais pertencentes a uma duradoura campanha de marketing da Liebig Extract of Meat Co. A análise crítica dos textos promocionais produzidos na virada do século XX oferece insights significativos sobre os mecanismos discursivos que contribuíram para a hegemonização do capitalismo burguês. Diferentemente de outras formas de publicidade, os cartões comerciais não são rapidamente descartados e esquecidos; pelo contrário, eles podem se distanciar dos produtos anunciados para se tornar parte dos discursos populares (...) de instrução em massa. Como produtos e produtores de ideologias capitalistas, os anúncios são um local privilegiado de inscrição do capitalismo e, portanto, se prestam a uma análise crítica. Minha análise mostra como os textos selecionados se baseiam e texturizam os discursos do progresso, impregnados como crenças colonialistas e desencadeando uma cadeia de ações pela qual, mesmo antes de realmente obterem os cartões, são promulgadas ações e crenças capitalistas. ABSTRACT In this paper, I analyze a set of six trading cards belonging to Liebig’s Extract of Meat Co. long-standing marketing campaign. The critical analysis of promotional texts produced at the turn of the 20th century offer meaningful insights on the discursive mechanisms that contributed to the hegemonization of bourgeois capitalism. Unlike other forms of advertising, trading cards are not rapidly discarded and forgotten; on the contrary, they can detach themselves from the advertised products to become part of popular discourses of mass instruction. As both products and producers of capitalist ideologies, ads are a privileged site of inscription of capitalism, and thus lend themselves to a critical analysis. My analysis shows how the selected texts draws on and textures the discourses of progress, inculcated as colonialist beliefs and triggering an actional chain whereby, even before they actually obtained the cards, capitalist actions and beliefs are enacted. With the aim of reflecting on a Pedagogy of the Franciscan Schools, the Franciscan Itinerary took place from February to December 2022, with the participation of collaborators and teachers from the schools maintained by the Charitable and Literary Society of St. Francis of Assisi - North Zone (SCALIFRA - ZN). The training consisted of webinars and evaluative activities, with themes extracted from works from the Franciscan writings. The article presents an analysis of an extract from a Collective Philosophical Inquiry. Through this case study, we show the possible misunderstandings linked to the duality of two « worlds » : that of the teacher who experiments with CPI in her classroom and that of the researcher who is responsible for the design of this type of session. The « world » is defined as « conceptual, axiological and praxical background ». The confrontation between these worlds therefore questions both (...) the modalities of their necessary collaboration and the conditions of the construction and use of a true « professional genesis. Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a (...) set of modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

In this chapter, one considers finance at its very foundations, namely, at the place where assumptions are being made about the ways to measure the two key ingredients of finance: risk and return. It is well known that returns for a large class of assets display a number of stylized facts that cannot be squared with the traditional views of 1960s financial economics (normality and continuity assumptions, i.e. Brownian representation of market dynamics). Despite the empirical counterevidence, normality and continuity assumptions (...) were part and parcel of financial theory and practice, embedded in all financial practices and beliefs. Our aim is to build on this puzzle for extracting some clues revealing the use of one research strategy in academic community, model tinkering defined as a particular research habit. We choose to focus on one specific moment of the scientific controversies in academic finance: the ‘leptokurtic crisis’ opened by Mandelbrot in 1962. The profoundness of the crisis came from the angle of the Mandelbrot’s attack: not only he emphasized an empirical inadequacy of the Brownian representation, but also he argued for an inadequate grounding of this representation. We give some insights in this crisis and display the model tinkering strategies of the financial academic community in the 1970s and the 1980s. (shrink)

Rationale, aims and objectives Given the increasing prevalence of cataract and demand for cataract extraction surgery, patients must often wait to undergo this procedure. We validated a previously developed priority scoring system in terms of clinical variables, pre-intervention health status, appropriateness of surgery and gain in visual acuity (VA) and health-related quality of life (HRQoL).Methods Explicit prioritization criteria for cataract extraction created by a variation of the Research and Development (RAND) and University of California Los Angeles appropriateness methodology (...) were retrospectively applied to a prospective cohort of 5257 patients on waiting lists to undergo cataract by phacoemulsification at 17 hospitals in Spain. Demographic data, clinical data and data related to surgical technique were collected by trained ophthalmologists. Patients were evaluated by their ophthalmologist before the intervention and 6 weeks afterward. They also completed, by mail, the Visual Function Index (VF-14) before the intervention and 3 months afterward.Results High-priority patients experienced greater improvement in VA and HRQoL than those classified as intermediate or low-priority (P < 0.0001), even after adjusting by VA and the VF-14 score at baseline. The time to intervention was the same for high-priority patients as it was for intermediate and low-priority patients.Conclusions The priority score we developed identified patients most likely to experience the greatest improvements from cataract extraction. Use of this tool could provide a fairer and more rational way to prioritize patients for cataract extraction. (shrink)

The concept of polarity is pervasive in natural language. It relates syntax, semantics and pragmatics narrowly, Semantics: an international handbook of natural language meaning, De Gruyter Mouton, Berlin, 2011; Israel in The grammar of polarity: pragmatics, sensitivity, and the logic of scales, Cambridge studies in linguistics, Cambridge University Press, Cambridge, 2014), it refers to items of many syntactic categories such as nouns, verbs and adverbs. Neutral polarity items appear in affirmative and negative sentences, negative polarity items cannot appear in affirmative (...) sentences, and positive polarity items cannot appear in negative sentences. A way of reasoning in Natural Language is through Natural Logic. This logic is based on the concept of polarity in order to make the meaning of a sentence weaker o stronger without changing its truth value. There exist many proposals to compute polarity in the Natural Logic context, the most widely known are the ones by: van Benthem, Sánchez-Valencia, Dowty, and van Eijck, 6th international Tbilisi symposium on logic, language, and computation, Batumi, Georgia, Springer, 2007). If Natural Logic is going to be used, as an inferential mechanism between text fragments, in Natural Language Processing applications such as text summarization, question answering, and information extraction, it is a priority to know what the existing relationship among the aforementioned algorithms is; for example, to implement the most general. We show in this paper the equivalence among the analyzed algorithms, filling a gap in Natural Logic research, particularly in computing polarity, and the soundness of their algorithms. (shrink)

Emergency departments are challenging research settings, where truly informed consent can be difficult to obtain. A deeper understanding of emergency medical patients’ opinions about research is needed. We conducted a systematic review and meta-summary of quantitative and qualitative studies on which values, attitudes, or beliefs of emergent medical research participants influence research participation. We included studies of adults that investigated opinions toward emergency medicine research participation. We excluded studies focused on the association between demographics or consent document features and participation (...) and those focused on non-emergency research. In August 2011, we searched the following databases: MEDLINE, EMBASE, Google Scholar, Scirus, PsycINFO, AgeLine and Global Health. Titles, abstracts and then full manuscripts were independently evaluated by two reviewers. Disagreements were resolved by consensus and adjudicated by a third author. Studies were evaluated for bias using standardised scores. We report themes associated with participation or refusal. Our initial search produced over 1800 articles. A total of 44 articles were extracted for full-manuscript analysis, and 14 were retained based on our eligibility criteria. Among factors favouring participation, altruism and personal health benefit had the highest frequency. Mistrust of researchers, feeling like a ‘guinea pig’ and risk were leading factors favouring refusal. Many studies noted limitations of informed consent processes in emergent conditions. We conclude that highlighting the benefits to the participant and society, mitigating risk and increasing public trust may increase research participation in emergency medical research. New methods for conducting informed consent in such studies are needed. (shrink)

La première partie du texte refait un bref historique de la définition des NSS et ajoute un nouvel argument à ceux de Adler pour appuyer l’idée que ces noms ne participent d’aucune « hiérarchie-être ». La seconde propose une répartition des NSS en trois sous-classes sur la base de critères syntaxiques, (...) qui font apparaître que toutes les structures spécificationnelles ne sont pas identiques, en dépit des apparences. Fait et les noms de « faits qualifiés » constituent une de ces sous-classes. Resumo: No início do capítulo XIII do Leviatã, Hobbes apresentou o princípio da igualdade original de poder entre homens como um princípio básico de seu sistema político, do qual todas as teses subseqüentes deveriam ser estritamente deduzidas como teoremas. Surpreendentemente, porém, quando Hobbes mais tarde chega à dedução da 9ª Lei de Natureza, ele parece estar tentando demonstrar o próprio princípio da igualdade a partir do qual todas as leis da natureza, inclusive a 9ª, devem ter sido supostamente derivadas. Meu (...) objetivo neste artigo é oferecer uma explicação para esta aparente circularidade, e meu ponto de partida é que devemos distinguir o papel do princípio da igualdade no capítulo XIII, que trata do estado de natureza, do contexto em que opera a 9ª Lei, que é o da sociedade civil. Mas embora esta distinção de contextos nos permita chegar, em cada caso, a diferentes medidas de desigualdade, vou argumentar que essa diferença situa-se inteiramente na métrica, e que a topologia básica da desigualdade na distribuição do poder original permanece a mesma em ambos os casos. Como resultado, vou propor que, ao contrário da opinião costumeira, a posição de Hobbes não difere essencialmente da de Aristóteles, quanto a serem os homens naturalmente desiguais quanto a suas capacidades mentais, embora as conseqüências políticas que cada filósofo extrai desta tese sejam radicalmente diferentes. Nesse sentido, para Hobbes, a 9ª Lei é o meio pelo qual esta desigualdade pode ser minimizada retoricamente para fins de estabilidade política.Palavras-chave: Hobbes - Desigualdade - Estado de natureza.: In the beginning of Chapter XIII of his Leviathan, Hobbes presented the principle of the original equality in power among men as a basic tenet of his political system, from which all the subsequent thesis were to be strictly deduced as theorems. Surprisingly, however, when Hobbes later arrives at deduction of the 9th Law of Nature, he seems to be trying to demonstrate the very principle of equality from which all laws of nature, including the 9th, should be purportedly derived. My aim in this paper is to offer an explanation of this apparent circularity, and my point is that we must distinguish the role of the principle of equality in the Chapter XIII, which deals with the state of nature, from the context in which the 9th Law operates, which is that of the civil society. However, although this distinction of contexts allows us to arrive at very different measures of inequality in each case, I will argue that this difference lays entirely in the metrics, and the basic topology of the inequality in the original distribution of power remains the same in both cases. As a result I will propose that, contrarily to the usual opinion, Hobbes's position doesn't differ essentially from Aristotle's as to men being naturally unequal as regards their mental abilities, though the political consequences that each philosopher extracts from this thesis are radically different. In this sense, for Hobbes, the 9th Law is the means by which this inequality can be rhetorically minimized for the purposes of political stability. (shrink)

A classic avenue that victims can take to hold a corporation to account and obtain redress for the harms they have suffered is civil litigation. In the past decades, such attempts have been pursued against corporations in the tobacco industry, the pharmaceutical industry, the asbestos industry or industries working with asbestos and, more recently, the extractive industries. However, it is notoriously difficult for victims whose rights have been violated by corporations to obtain effective redress in civil procedures. A rich body (...) of burgeoning scholarly literature and policy documents has addressed the extent to which systematic and institutional factors are obstacles to victims seeking justice for corporate misconduct. In this article, we will not focus on these systemic and institutional factors but on the role of corporate defence lawyers as their functioning also impacts the capacity of victims of corporate wrongdoing to effectuate their rights. We will address the question of what can be expected from a legal-ethical point of view from corporate defence lawyers advising and representing their corporate clients in large-scale civil liability cases. As a partial answer, we will develop a critique of amoral lawyering as a working philosophy in this context. In addition, we will touch upon the feasibility of a possible alternative. (shrink)

Spatial and temporal scales are essential components of geological sciences; both are almost always imbricated in complex ways, challenging geoscientific knowledge among nonspecialists and students. The present paper focuses on the efforts made by the French naturalist Simon-Suzanne Nérée Boubée (1806–62) regarding popular education on geology. Though Boubée is poorly known nowadays, he experienced some prestige during his lifetime. He worked as an independent teacher, offering private as well as free public courses. Boubée, as a nineteenth-century science popularizer, repeatedly insisted (...) on his disposition for “spreading science for all.” He extensively published books and journals on geology, all aimed at popularizing geological scientific knowledge, considered to be of paramount relevance. This paper analyzes three visual examples extracted from his works: the Tableau Mnémonique des Terrains Primitifs, destiné au géologue voyageur, avec son explication (1831), the Tableau de l’État du Globe à ses différents âges (1832), and the Tableau figuratif de la structure minérale du globe, ou résumé synoptique du Cours de géognosie de M. N. Boubée (1839), supplemented with images from the travel guide Deux Promenades au Mont Doré (1834). Our goal is to understand Boubée’s efforts to synthesize information, scaling down geologic time and space into foldable materials that made geological knowledge cognitively and materially accessible to laypeople. Ever since the publication of Halliday and Hasan, cohesion analysis has received much attention in several branches of linguistics. Lexical cohesion in particular has been shown to contribute to the coherence of discourse in a number of ways, and specific patterns of lexical cohesion have emerged as relevant for the description of different registers and genres. In the present article I challenge existing models of lexical cohesion and offer a revised one which affords particular attention to what I call ‘associative (...) cohesion’. I go on to test the adequacy of the proposed framework in a corpus of 15 telephone conversations extracted from the International Corpus of English-Great Britain. Using both quantitative and qualitative methods the article analyses 3480 ties and demonstrates that telephone conversations are lexically cohesive mostly due to repetitions, associative cohesion and inclusive relations, which overwhelmingly occur across the turns and over remote-mediated spans. In addition, lexical patterns are shown to collaborate in topic management processes and to be sensitive to genre-specific factors, thereby demonstrating the descriptive potential and applicability of the framework. Over the course of the 19th century, several campaigns in African territories led by white European or North-American scientists, explorers, entrepreneurs, or military officials have been transposed into travelogues where different stages of imperialism and colonialist presences are portrayed. While most of the approaches to these writings tend to favor a post-colonial framework for the interpretation of the interactions depicted there, it is also possible to employ a critical apparatus modeled after the recent developments in the field of the environmental (...) humanities. In this essay, I discuss how Slavoj Žižek’s contributions to the debates around the ideas of nature, ecology, and global capitalism have the potential to deepen our understanding of colonial regimes of oppression, serving as a powerful tool to explore processes of world-making involved in the imperial projects developing over the course of the 19th century. To do so, I propose a close reading of several instances of the travel book Angola and the River Congo, by Joachim John Monteiro, focusing on the entanglements between the human and non-human agencies, vegetable landscapes and extractive transnational economies, and the articulation of racism and scientific projects in the Angolan territory. The axiom at the heart of this article stipulates that everything that can be extracted from Heidegger's thought by way of political contribution can be so extracted only from a position that is itself essentially non-political. This means that everything Heidegger says about politics, or that can be seen to resonate with our political situation, is articulated from a position or a space that is itself not political, a space that, furthermore, defines and decides the essence of politics. His contribution, (...) then, is not to the political debate as such. Rather, it consists in asking whether what is historically at stake in politics and played out in political terms is itself political, and so a matter for political thought, or whether the questions and concepts of political thought are themselves shaped in response to a phenomenon, possibly an event, which it, as political thought, cannot interrogate, or even intimate. Following Heidegger, I envisage our political situation from a non-political perspective, and provide the measure for an evaluation of contemporary politics as an ontohistorical phenomenon. This, I do by following a lead Heidegger develops in the 1930s and 1940s, and by focusing on the concept of Macht, the translation of which will turn out to raise key philosophical issues. Despite its obvious political connotations and overtones, this concept will turn out to designate a phenomenon that is not so much political, as it is metaphysical: it is metaphysics itself, and metaphysics in its entirety, that is of power. This means that all metaphysics is metaphysics of power, and that power itself is through and through metaphysical. Politics, especially modern politics, turns out to be an effect of Macht understood as a metaphysical phenomenon. Having revealed the structure of power, its logic, imperatives and different regimes, I consider briefly the possibility of a politics that would not be governed by such a principle of power, the possibility of what I would call a politics of powerlessness, or a politics of the otherwise than power (Ohnmacht). Could that be ‘politics’ in the highest and ownmost sense? Could ‘Europe’ stand for such radical politics? (shrink)

The main aim of the study is to ascertain contrastively, in English and Spanish, how directive speech acts are represented in film discourse. For the purpose of the investigation, the directive speech acts of 24 films, 12 in English and 12 in Spanish, were extracted and analysed. A classification taxonomy, inspired by previous research, was created in order to categorize the different types of directive speech acts and determine their level of (in)directness. The results show that indirectness is more widely (...) represented in the English than in the Spanish film scripts, thus confirming the assertion that being indirect is a distinctive feature of English native speakers (Grundy, 2008). This research makes a valuable contribution to the exploration of speech acts in filmspeak and informs the existing local grammar descriptions of the linguistic patterns of directive speech acts. This article is an attempt to investigate a classic problem associated with the human action that can be extracted from the Leibnizian texts about the weakness of will, an issue emblematically briefed by Ovide: “I see clearly which [way] is better, and I know it is right, yet I follow the way that is worse”. The author of the Theodicy seems to suggest a way to understand the phenomenon of akrasia. A good source for this research is his work New (...) Essays on Human Understanding, in which he directly debates thesis of the book An Essay Concerning Human Understanding by Locke. In Leibnizian text, one of the concepts discussed is the uneasiness. Locke believes that the fundamental basis for human actions would be to prevent the uneasiness caused by the feeling of missing something. Leibniz not completely refutes the idea of the English philosopher, however looks for improving it by introducing “the perceptions which are not apperceived”. In Leibnizian philosophy the problem of weakness of will may be linked to a region that the agent does not know directly but which is fundamental to any action, even for the so-called rational. The goal of this work is writing about the importance of the poetic art, especially the tragedy to understand the psyche. The literature, besides showing an epoch, represents in a clear and poetic way the human conflicts. To reach this goal, we went through some literary works – Edipo King, by Sofocles, Hamlet and Macbeth by Shakespeare; Goriot Father by Balzac; Twenty Four Hours in a Woman’s Life by Stefan Zweig – extracting from them some fragments in which human sufferings (...) are explicit. We checked the importance of the speech in the emotions relief. We verified in the psychoanalytic and literary speeches that the poetic art seems to illuminate Freud’s steps in such a way that the poets anticipated the technical and psychoanalytic theory. What are the prospects of a Christian ethics of responsibility? In the article the versions of a Christian ethics of responsibility that have been developed since the nineteen eighties in dialogue with the philosopher Hans Jonas by the four Protestant theologians William Schweiker, Wolfgang Huber, Johannes Fischer and Ulrich Körtner, are critically discussed. It is pointed out that the disparity of their views is the main reason why a responsibility ethics school within Christian ethics could not have developed up till (...) now. An attempt is made in the article to identify common denominators for such an ethics by extracting from the views of the theologians a number of ways in which responsibility can and should today qualify Christian ethics fundamentally. Vehicle type recognition algorithms are broadly used in intelligent transportation, but the accuracy of the algorithms cannot meet the requirements of production application. For the high efficiency of the multilayer perceptive layer of Network in Network, the nonlinear features of local receptive field images can be extracted. Global average pooling can avoid the network from overfitting, and small convolution kernel can decrease the dimensionality of the feature map, as well as downregulate the number of model training parameters. On that basis, (...) the residual error is adopted to build a novel NIN model by altering the size and layout of the original convolution kernel of NIN. The feasibility of the algorithm is verified based on the Stanford Cars dataset. By properly setting weights and learning rates, the accuracy of the NIN model for vehicle type recognition reaches 97.2%. (shrink)

Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted (...) by two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from (...) countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals.
