The paper addresses a contemporary Polish debate on the limits and functions of juristic interpretation of law. After presenting the main theses and features of Jerzy Wróblewski’s clarificative theory of juristic interpretation and Maciej Zieliński’s derivational theory of juristic interpretation, the author critically discusses various arguments used in the debate. Finally, a tentative solution of the controversy, based on the criticism of Zieliński’s conception of legal norm, is proposed. In this article, I give a counterexample to a claim made in that empirically equivalent theories can often be regarded as theoretically equivalent by treating one as having surplus structure, thereby overcoming the problem of underdetermination of theory choice. The case I present is that of Lorentz's ether theory and Einstein's theory of special relativity. I argue that Norton's suggestion that surplus structure is present in Lorentz's theory in the form of the ether state of rest is based on a (...) misunderstanding of the role that the ether plays in Lorentz's theory, and that in general, consideration of the conceptual framework in which a theory is embedded is vital to understanding the relationship between different theories. Megaregional trade negotiations have become the subject of heated debate, above all in the context of the Transatlantic Trade and Investment Partnership and the Trans-Pacific Partnership. In this article, I argue that the justice of the global order suffers from its institutional fragmentation into regime complexes. From a republican perspective, which aspires to non-domination as a guiding principles and idea of global justice, regime complexes raise specific and important challenges in that they open the door to specific forms of domination. I thereby challenge a more optimistic outlook in regime complexes, which paints a positive normative picture of regime complexes, arguing that they enable the enhancement of democracy beyond the state and, consequently, have the potential to reduce the democratic deficit in global governance. By drawing attention to how regime complexes reinforce domination-related injustice, this article contributes an original perspective on megaregionals and to exploring the implications of global justice as non-domination. The cyclic GMP‐AMP synthase–stimulator of interferon genes (cGAS‐STING) pathway is central for the initiation of anti‐tumoural immune responses. Enormous effort has been made to optimise the design and administration of STING agonists to stimulate tumour immunogenicity. However, in certain contexts the cGAS‐STING axis fuels tumourigenesis. Here, we review recent findings on the regulation of cGAS expression and activity. We particularly focus our attention on the DNA‐dependent protein kinase (DNA‐PK) complex, that recently emerged as an activator of inflammatory responses in tumour (...) cells. We propose that stratification analyses on cGAS and DNA‐PK expression/activation status should be carried out to predict treatment efficacy. We herein also provide insights into non‐canonical functions borne by cGAS and cGAMP, highlighting how they may influence tumourigenesis. All these parameters should be taken into consideration concertedly to choose strategies aiming to effectively boost tumour immunogenicity. (shrink)

Violent extremism is often explicitly motivated by commitment to abstract ideals such as the nation or divine law – so-called “sacred” values that are relatively insensitive to material incentives and define our primary reference groups. Moreover, extreme pro-group behavior seems to intensify after social exclusion. This fMRI study explores underlying neural and behavioral relationships between sacred values, violent extremism, and social exclusion. Ethnographic fieldwork and psychological surveys were carried out among young men from a European Muslim community in neighborhoods in (...) and around Barcelona, Spain. Candidates for an fMRI experiment were selected from those who expressed willingness to engage in or facilitate, violence associated with jihadist causes. In the scanner, participants were assessed for their willingness to fight and die for in-group sacred values before and after an experimental manipulation using Cyberball, a toss ball game known to yield strong feelings of social exclusion. Results indicate that neural activity associated with sacred value processing in a sample vulnerable to recruitment into violent extremism shows marked activity in the left inferior frontal gyrus, a region previously associated with sacred values and rule retrieval. Participants also behaviorally expressed greater willingness to fight and die for sacred versus non-sacred values, consistent with previous studies of combatants and noncombatants. The social exclusion manipulation specifically affected non-sacred values, increasing their similarities with sacred values in terms of heightened left inferior frontal activity and greater expressed willingness to fight and die. These findings suggest that sacralization of values interacts with willingness to engage in extreme behavior in populations vulnerable to radicalization. In addition, social exclusion may be a relevant factor motivating violent extremism and consolidation of sacred values. If so, counteracting social exclusion and sacralization of values should figure into policies to prevent radicalization. (shrink)

: Creativity, mostly ignored in Western philosophy due to its supposed mysteriousness, has recently become a respected research topic in psychology, neuroscience, and artificial intelligence. We discuss how in science the approach has mainly been to describe creativity as an information-based process, coherently with a computational view of the human mind started with the cognitive revolution. This view has produced progressively convincing models of creativity, up to current artificial neural network systems, vaguely inspired by biological neural processing, but already competing (...) with human creativity in several fields. These successes suggest that creativity might not be an exclusively human function, but actually a way of functioning of any natural or artificial system implementing the creative process. We conclude by acknowledging that the information-based view of creativity has tremendous explanatory and generative power, but we propose a thought experiment to start discussing how it actually leaves out the experiential side of being creative. Questa prospettiva ha prodotto modelli della creatività sempre più convincenti, fino agli attuali sistemi di reti neurali artificiali, vagamente inspirati al processamento biologico neurale, ma già competitivi rispetto alla creatività umana in molti ambiti. Questi successi suggeriscono che la creatività possa non essere una funzione esclusivamente umana ma in effetti un modo di funzionare di un sistema naturale o artificiale capace di implementare il processo creativo. Background There is ongoing debate regarding whether and under which circumstances secondary findings (SF) should be offered in the pediatric context. Although studies have examined patient perspectives on receiving SF, little research has been conducted examining the experiences of clinicians offering SF to parents of newborns receiving genomic sequencing for a recently diagnosed medical condition.Methods To address this, we conducted qualitative interviews exploring the views and experiences of 12 clinicians who offered SF to parents of infants who had diagnostic exome (...) sequencing (ES) to identify the cause of their hearing loss. Interviews explored clinicians’ accounts of parents’ choices and decision-making about receiving SF, their views on whether and when to offer SF, their experiences returning SF, and any ethical challenges they encountered. Interviews were audio-recorded, transcribed and analyzed using inductive content analysis.Results Clinicians reported parents who declined all SF often felt finding out about future conditions unrelated to their child’s hearing loss may be unhelpful, or even harmful, or were overwhelmed by their child’s diagnosis. Clinicians also reported that some parents chose SF because they felt obliged to, even if they did not want to receive them. They explained that while some parents experienced decision-making regarding SF as positive, for others, this process was challenging or distressing. While clinicians generally agreed SF should be offered, mainly to promote parental choice, most felt SF should be offered after disclosing diagnostic results, primarily to avoid overwhelming parents. Clinicians encountered several ethical challenges, including balancing parental autonomy with non-maleficence, wanting to report or not report certain SF, and questioning whether parents can make an autonomous choice regarding SF.Conclusions Our findings, which are novel as they relate to parents of young infants with a recent diagnosis of hearing loss, add new insights into clinicians’ and parents’ decision-making regarding SF in pediatrics. Feminist Policymaking in Turbulent Times offers a unique and timely reflection of the critical debates around the institutionalisation of feminist and gender-focused ideas and norms into policy. Many states and non-governmental organisations are increasingly invested in 'feminist policymaking' at the domestic and international levels. Yet, this liberal (feminist) agenda is also vastly disputed by critical, intersectional and decolonial voices on the one hand, and by anti-gender movements around the world on the other. Indeed, while opposition to 'gender ideology' is mounting (...) from reactionary, religious and secular forces, feminist policymaking is also being challenged in important ways from within. Thus, this book situates feminist policymaking in a challenging and 'turbulent', global context. This book explores feminist policymaking in multiple areas of policy, examining various gender-focused programmes that states and international organisations have undertaken in the last decade, offering critical interventions and rethinking the relationship between feminism and policy. The book not only reflects on the advances of feminist policymaking globally, but also critically assesses the intersectional challenges embedded within it and lying ahead. It moves the field forward by creating opportunities, based on lived experiences, for re-imagining the transformative potential of the nexus between feminism and policymaking. Interdisciplinary in scope and bringing to the fore the voices of both academics and practitioners, the book is the product of an international collaboration, forging links and dialogue that are increasingly necessary to question some of the exclusionary, militaristic and hierarchical assumptions of policymaking which is labelled as feminist. Bilinguals have been shown to perform worse than monolinguals in a variety of verbal tasks. This study investigated this bilingual verbal cost in a large-scale picture-naming study conducted in Spanish. We explored how individual characteristics of the participants and the linguistic properties of the words being spoken influence this performance cost. In particular, we focused on the contributions of lexical frequency and phonological similarity across translations. The naming performance of Spanish-Catalan bilinguals speaking in their dominant and non-dominant language was compared (...) to that of Spanish monolinguals. Single trial naming latencies were analyzed by means of linear mixed models accounting for individual effects at the participant and item level. While decreasing lexical frequency was shown to increase naming latencies in all groups, this variable by itself did not account for the bilingual cost. In turn, our results showed that the bilingual cost disappeared when naming words with high phonological similarity across translations. In short, our results show that frequency of use can play a role in the emergence of the bilingual cost, but that phonological similarity across translations should be regarded as one of the most important variables that determine the bilingual cost in speech production. Low phonological similarity across translations yields worse performance in bilinguals and promotes the bilingual cost in naming performance. The implications of our results for the effect of phonological similarity across translations within the bilingual speech production system are discussed. (shrink)

The generic idea that the human should enhance seems uncontroversial. However, there is a great controversy about the meaning of enhance and the means that should be used. The possibilities of enhance humans through the use of biotechnology are a central theme of the current bioethical debate. Human Enhancement is the concept used to translate the idea that a biotransformation would generate a bioenhancement. In this article, we present a proposal for a factual-elementary framework of the generic concept of human (...) enhancement, in order to highlight the differences between a normative terminology and a descriptive terminology. Then, we contest the radical polarization that creates a harmful bias in the debate, arguing that what is at issue is a decision making based on non-universal value judgments. (shrink)

Previous studies have explored the impact of magic tricks on different basic cognitive processes yet there is a need of examining effectiveness of a cognitive training program through magic tricks for children with attention deficit hyperactivity disorder. The present study examines the effectiveness and feasibility of the MAGNITIVE program, a manualized intervention for cognitive training through the learning of magic tricks. A total of 11 children with ADHD participated in separated groups of two different community settings, and were assessed at (...) pre-treatment, post-treatment, and a 3-month later follow-up in different tasks involving processing speed, sustained attention, selective attention, and mental flexibility. Using non parametric statistical analyses and Reliable Change Index, the results showed that these children receiving MAGNITIVE particularly improved their performance in sustained attention, shifting attention, and mental flexibility, changes were also observed in processing speed performance yet further research is needed in terms of selective attention and inhibition, given the great individual differences within this sample. Changes were maintained when the program was finished. In terms of viability, the study proved a good treatment integrity in different contexts, adherence to the curriculum, and high levels of engagement satisfaction. In this second clinical trial, MAGNITIVE program appears to be a feasible training program for children with ADHD, as an alternative for medication when possible. (shrink)

IntroductionRegular exercise has long been shown to positively impact the immune system responsiveness and improve mental well-being. However, the putative links between biomarkers of mental health and immune efficiency in exercising subjects have been scarcely investigated. The aim of this study was to verify the effect of a 14-week combined chair-based exercise program on salivary steroid hormones and anti-microbial proteins, functional fitness, and MWB indexes in pre-frail older women.MethodsThe participant women were randomly divided into the exercising group and the non-exercising (...) control group. The pre/post assessment included: salivary anti-microbial proteins lysozyme; and immunoglobulin-A ; salivary steroid hormones of testosterone and cortisol ; functional fitness ; MWB questionnaires.ResultsSignificant differences with large Cohen’s effect sizes were found on increased salivary TT after exercise intervention. The results revealed a decrease in IgA levels after CEP. The increase in subjective happiness levels and decrease of stress perception and depressive state were found after intervention in the CEP group. Robust statistical differences in gait speed and balance tests were also found in the CEP group. In control, COR increased moderately while no changes were found for the other indicators. Correlation analyses showed inter-dependence between pre–post variations of MWB, biochemical indexes, and fitness function.ConclusionThe CEP program was able to improve functional-fitness performance, decrease feelings of stress, and increase happiness. The CEP also induced clinically relevant hormonal and immune responses, which suggests that chair exercises that combine muscular strength, balance, and gait speed training are promising interventions to improve physical and mental health of older pre-frail adults. We argue that planning and control may not be separable entities, either at the behavioural level or at the neurophysiological level. We review studies that show the involvement of superior and inferior parietal cortex in both planning and control. We propose an alternative view to the localization theory put forth by Glover.

The topic of this article is to develop an alternative, ontologically settled, problematic intuition about how to establish theoretical criteria of (non) conceptuality of an intentional content which kind of properties must an object possess to be able to furnish a full formal satisfaction to a conceptualization process? Are there any objects upon which our concepts can only go in vain in a sort of non conceptual short circuit’s breakdown in the very same act, in order to be caught in (...) a perceptual process? To give one or more answers to these questions, the article analyzes some examples of thing which are very difficult to conceive immediate y by means of predicative concept, the so -called Odradek object (O/o),taking inspiration by the case of a Kafka’ s famous tale character.It is possible to show the existence of almost a odd phenomenon of optical illusion in which the behaviour of perceptual structure of certain objects is very clear y similar to an O/o s one (Frisby’s effect in the Waterfall illusion, for example). Nevertheless, conclusions of the article will show how the reasons to believe in the plausibility of this hypothesis are more a priori and conceptually based than psychologically and experimentally inspired. Patients with psychotic disorders experience a range of reality distortions. These often include auditory-verbal hallucinations, and thought insertion to a lesser degree; however, their mechanisms and relationships between each other remain largely elusive. Here we attempt to establish a integrative model drawing from the phenomenology of both AVHs and TI and argue that they in fact can be seen as ‘spectra’ of experiences with varying degrees of agency and ownership, with ‘silent and internal own thoughts’ on one extreme and ‘fully (...) external and clearly audible voices’ in the absence of a speaker on the other. We believe a spectral model will add emphasis to the continuity of experience and help to better understand how one type of psychotic symptom may interact with another, and put forward the argument that the experience of TI itself is not sufficient to classify as a delusion. In addition we aim to discuss some of the conceptual issues surrounding AVHs and TI with first-person accounts and current philosophical and neuropsychological theories in mind. We propose that the mechanisms behind AVHs and TI are more complex than source-monitoring deficits; indeed, to understand such phenomena one must appreciate that their very ‘existence’ and ‘reality’ as experienced by the individual have much deeper implications and meaning, both philosophically and clinically. Further: What is truthful comes about by negation of what there is, because this is itself nothing, pure negation as such. What is truthful is therefore the negation of negation. This is an idealistic thesis which cannot be described as being thomistic, but rather which corresponds to the metaphysics of German Idealism, especially of (...) Fichte. This essay shows that the thesis that Eckhart was thomistic until his Parisian idealistic turn at the beginning of the 14th century is not correct. It argues that Eckhart’s metaphysics is unambiguously idealistic, i. e. non-thomistic, and that this is also the case in works which he certainly wrote before the Parisian Questions. This applies especially to the Rede der underscheidunge und the Tractatus super oratione dominica. (shrink)

Schizophrenia as a pathology of self-awareness has attracted much attention from philosophical theorists and empirical scientists alike. I view schizophrenia as a basic self-disturbance leading to a lifeworld of solipsism adopted by the sufferer and explain how this adoption takes place, which then manifests in ways such as first-rank psychotic symptoms. I then discuss the relationships between these symptoms, not as isolated mental events, but as end-products of a loss of agency and ownership, and argue that symptoms like thought insertion (...) and other ego-boundary disorders are by nature a multitude of paradoxes created by a fragmented awareness. I argue that such fragmentation does not always require or lead to a delusional elaboration as the definitive feature of its phenomenology, and present reasons for the role of the first-person pronoun as a mere metaphor used to represent the patient’s bizarre experiences where sensory perception and thinking processes converge. Organisations have implemented intensive home-based teleworking in response to global COVID-19 lockdowns and other pandemic-related restrictions. Financial pressures are driving organisations to continue intensive teleworking after the pandemic. Understanding employees’ teleworking inclinations post COVID-19, and how these inclinations are influenced by different factors, is important to ensure any future, more permanent changes to teleworking policies are sustainable for both employees and organisations. This study, therefore, investigated the relationships between the context of home-based teleworking during the pandemic, productivity perceptions during home-based (...) teleworking, and employees’ future teleworking inclinations beyond the pandemic. Specifically, the study examined whether pandemic-teleworking conditions related to the job, and the physical and social environments at home, influenced employees’ FTI, and if perceptions of improved or reduced productivity mediated these relationships. Data were collected during April and May 2020 with a cross-sectional online survey of teleworkers in Germany, Switzerland, the United Kingdom, and other countries during the first COVID-19 lockdowns. Reported FTI were mixed. Most participants reported wanting to telework more post-pandemic compared to before the pandemic; however, 18% wanted to telework less. Hierarchical multiple regression analysis revealed that some teleworking conditions were positively associated with FTI. Other teleworking conditions were not associated with FTI. Perceived changes in productivity mediated the relationship between work privacy fit and FTI. Findings highlight the role of work privacy fit and job demands in influencing pandemic productivity perceptions and teleworking inclinations post-pandemic. Results raise questions about the suitability and sustainability of home-based teleworking for all staff. As organisations plan to increase the proportion of teleworking post-pandemic, this study suggests there is a need to support employees who perceived their productivity to be poor while home-working during the pandemic. We address a recent proposal concerning ‘surplus structure’ due to Nguyen et al.. We argue that the sense of ‘surplus structure’ captured by their formal criterion is importantly different from—and in a sense, opposite to—another sense of ‘surplus structure’ used by philosophers. We argue that minimizing structure in one sense is generally incompatible with minimizing structure in the other sense. We then show how these distinctions bear on Nguyen et al.’s arguments about Yang-Mills theory and on the hole argument.

The principle of omnia sunt interpretanda refers to the derivational conception and derivational theory of interpretation. The principle appears in disputes concerning the role of a judge in the process of interpretation, and this has produced an effect that Polish theory of law is currently getting closer to the conceptions presented in the American debate on activism and textualism. In the practice of jurisdiction, the principle of omnia sunt interpretanda is mostly invoked outside theoretical context. It (...) becomes a manifestation of a new dimension of judicial independence, namely an independent authority over the meaning of legal text. In the following paper the legal cultures and legal theories involved in the dispute are being disclosed in order to put in question the possibility of achieving a clear result of interpretation against a background of a crisis of the relations between law and law-making state, which manifests itself in the peculiar process of legal institutions becoming autonomous in relation to state institutions. In this context, the aforementioned principle constitutes the manifestation of the way in which courts come up with a new definition of the role of the third (sui generic) power. The certain organizational requirements placed upon the courts (especially the SAC and provincial administrative courts) are being scrutinized in order to find out in which mode it is possible to at least reduce the degree of inconsistency of the results of interpretation. Here, the attempt to organize a community of judges for the activities of legal interpretation undertaken by them plays a crucial role. (shrink)

In the article I undertake the question of the Ockham’s razor. I consider the basic version of this methodological postulate: entia non sunt multiplicanda praeter necessitatem. I propose to interpret this postulate as a criterion of non-existence. In this context I analyse the matter of accidental entities as well as the ontological principle of economy.

We argue that several apparently distinct responses to the hole argument, all invoking formal or mathematical considerations, should be viewed as a unified “mathematical response.” We then consider and rebut two prominent critiques of the mathematical response before reflecting on what is ultimately at issue in this literature.

Feminist-Pragmatism is a philosophical tradition, which draws upon the insights of both feminist and pragmatist theory and practice. It is fundamentally concerned with enlarging philosophical thought through activism and lived experience, and assumes feminist and pragmatist ideas to be mutually beneficial for liberatory causes. Feminist-pragmatism emphasises the need to redress false distinctions, or dualisms, as these usually result in a denigration of one oppositional by another. Thus, feminist-pragmatists critique such bifurcations as thought/action, mind/body, universal/particular, and they show how the skewed (...) favouring of one over the other results in philosophical theories which are incapable of explaining our gendered existences, positions in society, understandings of knowledge, or learning experiences. Feminist-pragmatists contribute to current debates in epistemology, social and political philosophy, philosophy of education, ethics, and metaphysics. Their work reflects the theoretical advances made by feminist theorists especially over the course of the latter part of the twentieth century, while being rooted in the principles and criticisms of the classical pragmatists. Los profesores saben bien que, en numerosas ocasiones, para asegurar el éxito de su acción, deben a menudo "perder tiempo" dejándose paradójicamente llevar por él. El conocimiento del tiempo educativo nos introduce en el estudio de este peculiar contratiempo que, a diferencia del tiempo objetivo, predecible y cronométrico que sirve para racionalizar las actividades pedagógicas, permite a los educadores impedir que en educación el tiempo (...) pase, se consuma sin más, fluya o simplemente suceda. De ahí que la autora plantee las relaciones tiempo y educación desde una perspectiva más integradora, incorporando para ello los múltiples tiempos que confluyen en la realidad educativa junto aquéllos que confieren legitimidad al proyecto educativo. La escuela ha venido recreando un modelo no normativo tiempo -básicamente predictivo y probabilístico- y ha aplicado una racionalidad ahistórica que dificulta la emergencia del sujeto al que se dirige y el modelo de sociedad hacia la que se proyecta. En la actualidad se plantea la necesidad de educar desde una nueva perspectiva ética que integre el tiempo como categoría normativa de acción. Educar hoy para mañana exigirá, en este sentido, atender a dos lógicas temporales: impregnar de historicidad la dimensión de sentido de todo proyecto educativo y planificar las acciones pedagógicas de acuerdo con una nueva tecnología temporal que incorpore la incertidumbre, la complejidad, la interdependencia y la sostenibilidad temporal. In the field of clinical practice, there does not seem to be too much contention about what schizophrenia is, at least from a high level. After all, there are various diagnostic systems and guidelines, all of which point toward schizophrenia as a psychotic syndrome which likely forms a continuum with other psychotic disorders. It may sound obvious that, according to the current definitions, the major commonality between schizophrenia and all other psychoses is psychotic symptoms; more precisely, delusions and hallucinations. En este artículo buscamos mostrar que, tanto en la filosofía de Schopenhauer como también en la de Bergson, la experiencia estética se constituye como el paradigma del conocimiento intuitivo. A diferencia de lo que establece la teoría kantiana, para Schopenhauer y Bergson la intuición no sólo es la única forma de conocimiento inmediato, sino que no necesita de conceptos para aprehender aquello dado en la sensibilidad. Asimismo, puesto que actualmente no encontramos demasiada literatura sobre la influencia de Schopenhauer en la (...) filosofía de Bergson, dicho análisis pretende contribuir al establecimiento de los posibles vínculos entre ambas teorías. In recent decades, psychological research on the effects of mindfulness-based interventions has greatly developed and demonstrated a range of beneficial outcomes in a variety of populations and contexts. Yet, the question of how to foster subjective well-being and happiness remains open. Here, we assessed the effectiveness of an integrated mental training program The Art of Happiness on psychological well-being in a general population. The mental training program was designed to help practitioners develop new ways to nurture their own happiness. This (...) was achieved by seven modules aimed at cultivating positive cognition strategies and behaviors using both formal and informal practices. The program was conducted over a period of 9 months, also comprising two retreats, one in the middle and one at the end of the course. By using a set of established psychometric tools, we assessed the effects of such a mental training program on several psychological well-being dimensions, taking into account both the longitudinal effects of the course and the short-term effects arising from the intensive retreat experiences. The results showed that several psychological well-being measures gradually increased within participants from the beginning to the end of the course. This was especially true for life satisfaction, self-awareness, and emotional regulation, highlighting both short-term and longitudinal effects of the program. In conclusion, these findings suggest the potential of the mental training program, such as The Art of Happiness, for psychological well-being. (shrink)

While the list of 17 Sustainable Development Goals proposed by the United Nations’ Open Working Group comprises a catalog of highly important post-2015 development priorities, one of the key issue that has not received the attention it deserves is the need to safeguard the Earth's life-support system. Over the course of the past decades, we have concentrated much more on socioeconomic development rather than on environmental sustainability while putting a number of the Earth's systems at risk, and with it poverty (...) eradication and sustainable development. There is thus a need to put the spotlight on global environmental change and to take account of the insights from the latest Earth system science and its implications for the future of global development and global ethics. The ongoing debate on the post-2015 SDGs offers an important occasion for this endeavor. Three perspectives on international trade are present in current debates. From the first perspective, trade is regarded as a set of individual transactions among consenting parties and considerations of fairness and justice barely feature, if at all. The second perspective underlines the importance of background structures for trade, maintained by states, which gives rise considerations of fairness and justice. One prominent version of this perspective, for example as defended by Aaron James, views all trading states as having in principle equal (...) claims to the gains from trade. A third perspective puts the focus on exploitation. In this special issue, Mathias Risse and Gabriel Wollner claim that the first perspective should be abandoned and that the type of approach that is instantiated by James fails. This article does not follow them in dismissing the second perspective in its entirety. It suggests that there is a different version of this perspective that is defensible and develops key elements of that version. In a second step, the article seeks to show that, even if there were no plausible account of fairly dividing gains from trade among states, fairness in trade would still generate demanding normative requirements – that can be and should be integrated into a theory of global justice. COVID-19 is compromising all aspects of society, with devastating impacts on health, political, social, economic and educational spheres. A premium is being placed on scientific research as the source of possible solutions, with a situational imperative to carry out investigations at an accelerated rate. There is a major challenge not to neglect ethical standards, in a context where doing so may mean the difference between life and death. In this paper we offer a rubric for considering the ethical challenges in (...) COVID-19 related research, in the form of an ethics toolkit for global research developed at the University of Edinburgh in collaboration with more than 200 global researchers from around the world. This toolkit provides a framework to support confrontation of ethical conflicts through the integrated and iterative analysis of Place, People, Principles and Precedents, throughout the research journey. Two case analyses are offered to exemplify the utility of the toolkit as a flexible and dynamic tool to promote ethical research in the context of COVID-19. (shrink)

Este artículo propone un análisis de las relaciones entre una idea clave del pensamiento filosófico moderno como es la del llamado cogito cartesiano y un trastorno de naturaleza psiquiátrica descrito por el médico francés Jules Cotard en las últimas décadas del siglo XIX. Mientras que Descartes, y toda la estela de sus descendientes, habrían tendido a situar en la existencia auto-trasparente del sujeto el fundamento de la filosofía en la Modernidad, los pacientes aquejados del síndrome de Cotard piensan, con el (...) mismo grado de evidencia clara y distinta, que no existen. El ensayo termina por sugerir que trastornos psicopatológicos como el de Cotard tienden a disolver la hipóstasis cartesiana del ego apuntando en la dirección de un sujeto concebido como anómalo y atravesado por discontinuidades.
