Increasingly, international governmental networks and organisations make it necessary to master the legal principles of other jurisdictions. Since the advent of international criminal tribunals this need has fully reached criminal law. A large part of their work is based on comparative research. The legal systems which contribute most to this systemic discussion are common law and civil law, sometimes called continental law. So far this dialogue appears to have been dominated by the former. Modern man has not yet reached Utopia where the necessity of labor and the ease of leisure would be reconciled; in many regards, he is still bound to toil for his subsistence. But he has invented artificial intelligence and thus has found a humanoid substitute for an endless number of cumbersome tasks; work is transformed into computer games. Modern man has not yet become the Lord of his life, he continues to miss a complete control over infirmities, afflictions, and, finally, death. But he has fathomed the biochemical basis of life and acquired the skills to manipulate the forms of being; the breath of life is recorded as genetic code. (shrink)

In this book, Leon ter Schure demonstrates the value of Bergson's philosophy of life for a more expansive understanding of history. Bergson is known for his explorations of time as duration, yet in his writings rarely referred to history. At the same time, historians and philosophers of history have not significantly incorporated Bergson's ideas about the nature of time into their work. Modernity has brought change at an ever-accelerating rate, and one of the results of this has been a tendency (...) toward presentism. Only the here and now matters, as past and future have been absorbed by the "omnipresent present" of the digital age. The distinction between ancient and modern modes of historical thought is characterized by the growing complexity of the discipline of history in modernity. Consequently, the epistemological and methodological standard of ancient historiography is typically held as inferior against the modern ideal. This book serves to address this apparent deficit. Its scope is three-fold. Firstly, it aims at encountering ancient modes of historical and historiographical thought within the province of their own horizon. History and Philosophy of Modern Mathematics was first published in 1988. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. The approach is historical because to ascribe a function is to make a claim about the past, but the relevant past is the recent past; modern history rather than ancient.

Like historical science in general, philosophy is, on the one hand, in touch with exact inquiry, while, on the other, it has a certain relationship with art. Metaphysical principles are less easily verified from experience than physical hypotheses, but also less easily refuted. Loneliness is one of the most neglected aspects of emotion history, despite claims that the 21st century is the loneliest ever. This article argues against the widespread belief that modern-day loneliness is inevitable, negative, and universal. Looking at its language and etymology, it suggests that loneliness needs to be understood firstly as an “emotion cluster” composed of a variety of affective states, and secondly as a relatively recent invention, dating from around 1800. Loneliness can be positive, and as much (...) a part of the body as the mind. Using a longue durée approach, I argue that we cannot understand loneliness as a “modern epidemic” without considering its history, its meanings, its practice, and its links with the body. (shrink)

Throughout the twentieth century calls to modernize natural history motivated a range of responses. It was unclear how research in natural history museums would participate in the significant technological and conceptual changes that were occurring in the life sciences. By the 1960s, the Museum of Vertebrate Zoology at the University of California, Berkeley, was among the few university-based natural history museums that were able to maintain their specimen collections and support active research. The MVZ therefore provides a window to the (...) modernization of natural history. This paper concentrates on the directorial transitions that occurred at the MVZ between 1965 and 1971. During this period, the MVZ had four directors: Alden H. Miller (Director 1940–1965), an ornithologist; Aldo Starker Leopold (Acting Director 1965–1966), a conservationist and wildlife biologist; Oliver P. Pearson (Director 1966–1971), a physiologist and mammalogist; and David B. Wake (Director 1971–1998), a morphologist, developmental biologist, and herpetologist. The paper explores how a diversity of overlapping modernization strategies, including hiring new faculty, building infrastructure to study live animals, establishing new kinds of collections, and building modern laboratories combined to maintain collections at the MVZ’s core. The paper examines the tensions between the different modernization strategies to inform an analysis of how and why some changes were institutionalized while others were short-lived. By exploring the modernization of collections-based research, this paper emphasizes the importance of collections in the transformation of the life sciences. (shrink)

Historically, many Christians have understood God’s transcendence to imply God’s properties categorically differ from any created properties. For multiple historical figures, a problem arose for religious language: how can one talk of God at all if none of our predicates apply to God? What are we to make of creeds and Biblical passages that seem to predicate creaturely properties, such as goodness and wisdom, of God? Thomas Aquinas offered a solution: God is to be spoken of only through analogy (the (...) doctrine of analogy). Gavin Hyman argues Aquinas’s doctrine of analogy was neglected prior to the early-modern period and the neglect of analogy produced the conception of a god vulnerable to atheistic arguments. Contra Hyman, in this paper, I show early-modern atheism arose in a theological context in which there was an active debate concerning analogy. Peter Browne (1665–1735) and William King (1650–1729) offered two competing conceptions of analogical predication that were debated through the 19th century, with interlocutors such as the freethinker Anthony Collins (1676–1729), theologian/philosopher George Berkeley (1685–1753), and skeptic David Hume (1711–1776). Lastly, I discuss the 18th century debate over theological analogy as part of the background relevant to understanding Hume’s Dialogues Concerning Natural Religion. (shrink)

It analyses prominent schemes of interpretation such as deconstruction, hermeneutics and contextualism and provides a critical reading of how particular thinkers including Machiavelli, Hobbes, Locke, Hegel, Rousseau, Marx, Bentham, Mill, Nietzsche, and Beauvoir are interpreted in the light of these schemes. This article considers the emergence of world environmental history as a rapidly growing but undertheorized research field. Taking as its central problematic the gap between the fertile theorizations of environmentally-oriented social scientists and the empirically rich studies of world environmental historians, the article argues for a synthesis of theory and history in the study of longue dureesocio-ecological change. This argument proceeds in three steps. First, I offer an ecological reading of Immanuel Wallerstein's The Modern World-System. Wallerstein's handling of the (...) ecological dimensions of the transition from feudalism to capitalism is suggestive of a new approach to world environmental history. Second, I contend that Wallerstein's theoretical insights may be effectively complemented by drawing on Marxist notions of value and above all the concept of “metabolic rift,” which emphasize the importance of productive processes and regional divisions of labor within the modern world-system. Finally, I develop these theoretical discussions in a short environmental history of the two great “commodity frontiers” of early capitalism – the sugar plantation and the silver mining complex. This study addresses two desiderata of historical emotion research: reflecting on the interdependence of textual functions and the representation of emotions, and acknowledging the interdependence of studies on the premodern and modern periods in the history of emotion. Contemporary research on the history of emotion is characterised by a proliferation of studies on very different eras, authors, themes, texts, and aspects. The enthusiasm and confidence with which situations, actions, and interactions involving emotions in history are discovered, however, has led (...) to overly direct attempts to access the represented objects (emotions/feelings/affects); as a result, too little attention has been paid to the conditions and functions of their representations. That is why this study engages with the emotion research of historians from an unashamedly philological perspective. Such an approach provides, among other things, insights into the varied, often contradictory, observations that can be made about the history of emotion in modernity and premodernity. (shrink)

Modern Jewish Philosophy and the Politics of Divine Violence Is commitment to God compatible with modern citizenship? In this book, Daniel H. Weiss provides new readings of four modern Jewish philosophers - Moses Mendelssohn, Hermann Cohen, Franz Rosenzweig, and Walter Benjamin - in light of classical rabbinic accounts of God's sovereignty, divine and human violence, and the embodied human being as the image of God. He demonstrates how classical rabbinic literature is relevant to contemporary political and philosophical (...) debates. Weiss brings to light striking political aspects of the writings of the modern Jewish philosophers, who have often been understood as non-political. In addition, he shows how the four modern thinkers are more radical and more shaped by Jewish tradition than has previously been thought.
