Elvira Basevich, Martin Sticker, and Helga Varden offered generative criticism of my monograph, Kant’s Theory of Labour. In this response, I explore how the resources they offer for thinking about gender, labour, and the state’s responsibility to ensure the material conditions of freedom can deepen both our attentiveness to patterns of systemic injustice in Kant’s political philosophy, and the resources Kant offers for addressing contemporary patterns of intersectional and material injustice.

Disasters change how we understand the world, and in doing so they can accelerate social movements that drive long-term change. This book uses social epistemology to chart how disaster experiences change us, how current systems harm us by shutting down that change, and how we can reform disaster practices to better adjust to our future crises.

This Element examines Kant's innovative account of labour in his political philosophy and develops an intersectional analysis of Kant. By demonstrating that Kant's analysis of slavery, citizenship, and sex developed in inter-linked ways over several decades, culminating in his development of a 'trichotomy' of Right, the author shows that Kant's normative account of independence is configured through his theory of labour, and is continuous with his anthropological accounts of race and gender, providing a systemic justification for the dependency of women (...) and non-whites embedded in his philosophy of right. By examining Kant's arguments about slavery as intertwined with his account of domestic labour, the author argues that his ultimate rejection of slavery may owe more to his changing conceptualization of labour than to his theory of race, and that his final arguments against slavery rehearse strategies for embedding intersectional patterns of domestic dependence in his account of the rightful state. This paper formulates a response to standard accounts of Kantian sexual morality, by first clarifying why sex should be understood as a case of using a person as a thing, rather than merely as a means. The author argues that Kant’s remedy to this problem is not sexual consent, but a model of setting and sharing sexual ends. Kant’s account of sexual morality, read in this way, is a critical framework for contemporary moves to think beyond consent, and to grapple (...) with concerns about sexual violation and “bad sex” that have gained uptake in the wake of the MeToo movement. The author defends an account of sex as a process of setting and sharing sexual ends in a Kantian key, which provides us with resources for thinking about the robust ongoing project of making our sexual selves in nonideal conditions, as well as for identifying the wrongs of both “bad” sex and sexual harassment. In doing so, they offer a critical middle ground between contemporary accounts of sexual morality that center questions of individual agency or autonomy, and those that foreground the intersubjective nature of sex. Community resilience, a system’s ability to maintain its essential functions despite disturbance, is a cornerstone of public health preparedness. However, as currently practiced, community resilience generally focuses on defined neighborhood characteristics to describe factors such as vulnerability or social capital. This ignores the way that residents of some neighborhoods (as ‘essential workers’’) were required during the COVID-19 pandemic to sacrifice their wellbeing for the sake of others staying at home in more affluent neighborhoods. Using the global care chain theory, we (...) analyze the way that the resilience of affluent neighborhoods depends on siphoning off the labor of other, less affluent neighborhoods, creating what we call the parasitic nature of resilience. We argue that understanding this neighborhood interdependence—and accounting for its parasitic nature— should be prioritized by public health authorities to prevent unintentional harm in future pandemics. Otherwise, any public health emergency response that relies on this labor (as did the COVID-19 pandemic response) depends on exploitative practices that produce the very disparities the response is trying to address. We explore the theoretical grounding and practical effects of this idea to provide the preparedness enterprise with an initial set of theoretical tools to move from a model of community resilience to one of community renewal. The community renewal model is based on an underlying ethics of care, in which systems are redesigned to become more prosocial during a public health response. We believe this model can more successfully address the tragic inequities in labor and health outcomes that we see during public health emergencies. (shrink)

I defend the right to an abortion at any stage of pregnancy by drawing on a Kantian account of consent and innate right. I examine how pregnant women are positioned in moral and legal debates about abortion, and develop a Kanitan account of bodily autonomy in order to pregnant women’s epistemic authority over the experience of pregnancy. Second, I show how Kant's distinction between innate and private right offers an excellent legal framework for embodied rights, including abortion and sexual consent, (...) and I draw on the legal definition of sexual consent in order to show how abortion discourse undermines women's innate right. I then explore Kant’s treatment of the infanticidal mother, and draw out the parallels between this case and contemporary abortion rights in order to develop a distinctly Kantian framework of reproductive rights in non-ideal conditions. Finally, I explore the implications of this non-ideal approach for contemporary abortion discourse, arguing that debates about the legality of abortion should more broadly engage the barbaric conditions of reproductive injustice. The #MeToo movement generated a feminist insistence that we “believe women.” But the men accused of assault, harassment, and other violations frequently defended themselves with the insistence that they had always “respected women” – sometimes, going so far as to get numerous women to sign letters swearing that these men had always respected them. This common MeToo defense reveals the core inconsistency – and the core entitlement – at the heart of misogyny and sexual injustice: some women deserve respect. But (...) the duty to respect those women relies on an invisible entitlement to disrespect – indeed, to assault, harass, dominate, or exploit – others. This chapter explores consent’s role within the superstructure of misogyny and sexual injustice, arguing what consent is a key apparatus of white supremacy. It argues that consent has been constructed through dynamics of colonial and racist sexual entitlement, mapping some (white) women as deserving of respect and the right to consent, while marking other women as expendable or disposable within the sexual economy. This means not only that consent is historically constructed as white, but also that whiteness, and in particular, white womanhood, is constructed through consent. Thus, white women’s right to consent – or to refuse – is premised upon the inability of other women to do so. In this way, the right to sexual consent does not disrupt the norm of male sexual entitlement. Consent has always been premised on non-consent, from coloniality and slavery to contemporary porn, which offers a vision of the world without proper consent, so that granting consent to actual women is an exceptional practice, an “act of respect.” By including race and class alongside gender in my analysis of consent, I argue that contemporary feminist visions of sexual justice must do more than defend or ameliorate consent, but develop intersectional interrogations of sexual justice that reckon with the complicities of consent. ABSTRACT. Public discourse about ethics in the COVID-19 pandemic has tended to focus on scarcity of resources and the protection of civil liberties. We show how these preoccupations reflect an established disaster imaginary that orients the ethics of response. In this paper, we argue that pandemic ethics should instead be oriented through a relational account of persons as vulnerable vectors embedded in existing networks of care. We argue for the creation of a new disaster imaginary to shape our own understandings (...) of the interrelated social, political, and economic hardships under conditions of social distancing. We develop a pandemic ethics framework rooted in uBuntu and care ethics that makes visible the underlying multidimensional structural inequities of the pandemic, attending to the problems of resource scarcity and inequities in mortality while insisting on a response that surges existing and emergent forms of solidarity. In this essay, I draw on Kant’s legal philosophy in order to defend the right to voluntary motherhood by way of abortion at any stage of pregnancy as an essential feature of women’s basic rights. By developing the distinction between innate and acquired right in Kant’s legal philosophy, I argue that the viability standard in US law (as established in Planned Parenthood v. Casey) misunderstands the nature of embodied right. Our body is the site of innate right; it is the (...) means through which we can set and pursue ends in the world. The law, therefore, cannot adjudicate the relationship between the will and the body: it cannot require us to allow our bodies to be used against our will. By comparing unwanted pregnancy to sexual assault, I problematize the notion that consent to pregnancy, like consent to sex, can ever be conclusive. I examine Kant’s own account of unwanted pregnancy, in which he describes mother and child finding themselves “in a state of nature” in order to rethink the status of the fetus in law, and I argue that we should understand the fetus’s right to life as provisional, rather than as enforceable by law. In “Rethinking Race and Gender in Kant: Toward a Non-Ideal, Intersectional Kant,” Jordan Pascoe argues that Kant’s moral philosophy is productively read through the “non-ideal” lens of the sociopolitical concerns he faced and espoused. This lens in turn offers possibilities for thinking differently about the particular articulation that his formal principles take. She defends a non-ideal, modified methodological approach in which Kant’s problematic conception of race and gender are opportunities for expanding our reflection on Kant’s moral philosophy as (...) a whole. This paper explores Kant's account of marriage and its relevance to contemporary debates over same-sex marriage. Kant's defense of marriage is read against debates unfolding in Prussia in the 1790s, when the question of whether marriage was a "universal estate" was a central point of debate surrounding the Prussian Legal Code of 1794. By reading Kant's arguments in light of this historical context, and in comparison with those offered by his contemporaries, Fichte and von Hippel, this article shows both that (...) the debates about marriage in the 1790s mirror contemporary tensions, and that Kant took a "middle path" that innovatively defended marriage as a basic feature of the state. The article offers a challenge to, and an invocation of, the values of Lasallian mission against rape culture. It addresses the continuum of violence, from outright misogynistic terrorism to an ongoing threat of assault and harassment, to the normalization of emotional and physical coercion of (primarily) women; and it explores historical responses within the Lasallian tradition to this pervasive problem in society and identifies a few rich resources within its underlying charism for tackling this pernicious evil (the virtue of silence (...) / listening & a paradigm of association). The Lasallian obligation to address rape culture and attitudes of patriarchal normalcy is articulated; and a challenge is issued to actively teach students about healthy relationships, gender norms, and sexuality. Women and men on college campuses need to be willing to engage these difficult but necessary conversations and take responsibility for their part in the transformations needed in society and on college campuses. The purity test scandal highlights a pervasive double standard: reputations shape the lives of just about everyone, but to be declared a slut is to be publicly denied the right to even basic kinds of respect. This chapter talks about purity test results where Meg Manning finds out that her score of 48 is plastered across her locker, along with the word “slut.” The locker next to hers, however, is marked with a 32 and the words “You're the best!” Either (...) this locker belongs to a girl being mocked for her low score or it belongs to a guy being praised. Veronica Mars doesn't take the test, but a fake score is posted for her anyway—a shamefully low 14. The purity test reminds us that sluts and studs aren't terribly different. The only difference is that studs are applauded for their reputation, while sluts are shamed for theirs. (shrink)

Carla Pascoe Leahy 101 The daily lives and long-term aspirations of Australian mothers have undergone significant changes over the past seventy years, alongside shifting cultural and personal concepts of mothering, employment, and female identity. At face value, these quotes from three generations of Australian mothers imply a trajectory of shifting understandings of care, work, gender, and subjectivity, with women’s self-identity increasingly associated with paid work outside the home. Each of these women positions herself in relation to the dominant gender culture at the time she experienced matrescence.2 Marjorie, who had her children in the 1950s, characterizes herself as “the little wife” and recalls being contented with her role as a stay-at-home mother. Sally, who became a mother in the late 1970s, remembers wanting to believe that “women can do it all” without sacrificing family or career, but she experienced this radical ideal as conflicted at both a cultural and personal level. Ariana, a twenty-first-century mother, feels ambivalent about sending her children to childcare, but had always assumed that she would combine paid work with mothering. Despite this seemingly linear progression from a female identity centered on mothering to one focused on paid work, I argue that closer attention to these maternal narratives reveals that changing gender discourses were experienced as riven with internal contradictions by individual mothers. Drawing on a new collection of fifty-six oral history interviews co-created with Australian women about their experiences of becoming mothers, I will analyze the ways in which changing cultural understandings of selfhood, work, care, and gender have played out in the lives of mothers from 1945 to the present. When I started this project, I envisaged it partially as a history of my grandmother’s, my mother’s, and my own maternal generations. In this sense, it is a record of the living memory of Australian mothering; an archive of the maternal memories still circulating in contemporary Australia. But it is also a history of Australian mothering before, during, and after the women’s liberation movement of the 1970s. This paper explores the details of Malebranche‘s philosophy of mind, paying particular attention to the mind-body relationship and the roles of the imagination and the passions. I demonstrate that Malebranche has available an alternative to his deontological ethical system: the alternative I expose is based around his account of the embodied aspects of the mind and the sensations experienced in perception. I briefly argue that Hume, a philosopher already indebted to Malebranche for much inspiration, read Malebranche in the positive way (...) that I here describe him. Malebranche should therefore be acknowledged as a serious influence on Enlightenment philosophy of sensibility. (shrink)

In their effort to emphasize the positive role of nature in our lives, environmental thinkers have tended to downplay or even to ignore the negative aspects of our experience with nature and, even when acknowledging them, have had little to offer by way of psychologically and spiritually productive ways of dealing with them. The idea that the experience of value begins with the experience of existential shame—arising from awareness of the limitations that define the self—needs to be explored. The primary (...) purpose of the “technologies of the imagination”—myth, symbol, ritual and the arts—is to provide a passage through this shame to the experience of values such as community, meaning, beauty, and the sacred and, through these experiences, to inscribe them into conscience. The implications of this idea for environmental thinking and practice can be explored in two areas involving strong engagement with nature: ecological restoration and the production and eating of food. An environmentalism that fails to provide productive ways of dealing with existential shame may well prove inadequate to the task of providing means for achieving a healthy, sustain­able relationship between humans and the rest of nature. Viewing the brain as an organ of approximate Bayesian inference can help us understand how it represents the self. We suggest that inferred representations of the self have a normative function: to predict and optimise the likely outcomes of social interactions. Technically, we cast this predict-and-optimise as maximising the chance of favourable outcomes through active inference. Here the utility of outcomes can be conceptualised as prior beliefs about final states. Actions based on interpersonal representations can therefore be understood as minimising (...) surprise – under the prior belief that one will end up in states with high utility. Interpersonal representations thus serve to render interactions more predictable, while the affective valence of interpersonal inference renders self-perception evaluative. Distortions of self-representation contribute to major psychiatric disorders such as depression, personality disorder and paranoia. The approach we review may therefore operationalise the study of interpersonal representations in pathological states. (shrink)

Strawson (1994) and Peacocke (1992) introduced thought experiments that show that it seems intuitive that there is, in some way, an experiential character to mental events of understanding. Some (e.g., Siewert 1998, 2011; Pitt 2004) try to explain these intuitions by saying that just as we have, say, headache experiences and visual experiences of blueness, so too we have experiences of understanding. Others (e.g., Prinz 2006, 2011; Tye 1996) propose that these intuitions can be explained without positing experiences of understanding. (...) Call this the debate between Realism and Anti-Realism about experiences of understanding. This paper aims to advance that debate in two ways. In the first half, I develop more precise characterizations of what Realists and Anti-Realists propose. In the second half, I distinguish the four most plausible versions of Anti-Realism and argue that Realism better explains the target intuition than any of them does. (shrink)

The ‘black box problem’ is a long-standing talking point in debates about artificial intelligence. This is a significant point of tension between ethicists, programmers, clinicians and anyone else working on developing AI for healthcare applications. However, the precise definition of these systems are often left undefined, vague, unclear or are assumed to be standardised within AI circles. This leads to situations where individuals working on AI talk over each other and has been invoked in numerous debates between opaque and explainable (...) systems. This paper proposes a coherent and clear definition for the black box problem to assist in future discussions about AI in healthcare. This is accomplished by synthesising various definitions in the literature and examining several criteria that can be extrapolated from these definitions. There are no data in this work. (shrink)

In the debate surrounding the morality and legality of the practices of physician-assisted death and euthanasia, a common logical argument regularly employed against these practices is the “slippery slope argument.” One formulation of this argument claims that acceptance of physician-assisted death will eventually lead down a “slippery slope” into acceptance of active euthanasia, including its voluntary, non-voluntary, and/or involuntary forms, through psychological and social processes that warp a society’s values and moral perspective of a practice over an extended period of (...) time. This formulation is known as the psychological slippery slope argument. This paper analyzes the psychological slippery slope argument as it is applied to the practice of physician-assisted death, and utilizing recent empirical evidence from various nations around the world that practice physician-assisted death and/or euthanasia, the paper argues that employing the psychological slippery slope argument against physician-assisted death is logically fallacious, this kind of slippery slope is unfounded in practice, and thus the psychological slippery slope argument is insufficient on its own to justify continued legal prohibition of physician-assisted death. To systematically answer the generalized Kretschmann objection, I propose a mean to make operational a criterion widely recognized as allowing one to decide whether the gauge symmetry of a theory is artificial or substantial. My proposition is based on the dressing field method of gauge symmetry reduction, a new simple tool from mathematical physics. This general scheme allows one in particular to straightforwardly argue that the notion of spontaneous symmetry breaking is superfluous to the empirical success of the electroweak theory. (...) The purpose of this essay is to introduce the symposium within the _Journal of Analytic Theology _on Mark Murphy’s latest book, _Divine Holiness and Divine Action. _To this end, the main aims of Murphy’s book are presented and the essays within the symposium are summarized.

The COVID-19 pandemic is putting the NHS under unprecedented pressure, requiring clinicians to make uncomfortable decisions they would not ordinarily face. These decisions revolve primarily around intensive care and whether a patient should undergo invasive ventilation. Certain vulnerable populations have featured in the media as falling victim to an increasingly utilitarian response to the pandemic—primarily those of advanced years or with serious existing health conditions. Another vulnerable population potentially at risk is those who lack the capacity to make their own (...) care decisions. Owing to the pandemic, there are increased practical and normative challenges to following the requirements of the Mental Capacity Act 2005. Both capacity assessments and best interests decisions may prove more difficult in the current situation. This may create a more paternalistic situation in decisions about the care of the cognitively impaired which is at risk of taking on a utilitarian focus. We look to these issues and consider whether there is a risk of patients who lack capacity to make their own care decisions being short-changed. (shrink)

A persistent controversy in language evolution research has been whether language emerged in the gestural-visual or in the vocal-auditory modality. A “dialectic” solution to this age-old debate has now been gaining ground: language was fully multimodal from the start and remains so to this day. In this paper, we show this solution to be too simplistic and outline a more specific theoretical proposal, which we designate as pantomime-first. To decide between the multimodal-first and pantomime-first alternatives, we review several lines of (...) interdisciplinary evidence and complement it with a cognitive-semiotic experiment. In the study, the participants saw – and then matched to hand-drawn images – recordings of short transitive events enacted by 4 actors in two conditions: visual and multimodal. Significantly, the matching accuracy was greater in the visual than the multimodal condition, though a follow-up experiment revealed that the emotional profiles of the events enacted in the multimodal condition could be reliably detected from the sound alone. We see these results as supporting the proposed pantomime-first scenario. (shrink)

This article defends the thesis that biochemical molecules are clustered chemical kinds, some of which—namely, evolutionarily conserved units—are also biological kinds. This article addresses a classical question: Can a machine use language meaningfully and if so, how can this be achieved? The first part of the paper is mainly philosophical. Since meaning implies intentionality on the part of the language user, artificial systems which obviously lack intentionality will be `meaningless'. There is, however, no good reason to assume that intentionality is an exclusively biological property and thus a robot with bodily structures, interaction patterns and development similar to those of human beings (...) would constitute a system possibly capable of meaning – a conjecture supported through a Wittgenstein-inspired thought experiment. The second part of the paper focuses on the empirical and constructive questions. Departing from the principle of epigenesis stating that during every state of development new structure arises on the basis of existing structure plus various sorts of interaction, a model of human cognitive and linguistic development is proposed according to which physical, social and linguistic interactions between the individual and the environment have their respective peaks in three consecutive stages of development: episodic, mimetic and symbolic. The transitions between these stages are qualitative, and bear a similarity to the stages in phylogenesis proposed by Donald and Deacon. Following the principle of epigenetic development, robotogenesis could possibly recapitulate ontogenesis, leading to the emergence of intentionality, consciousness and meaning. (shrink)

We argue that while it is a valuable contribution, Carruthers' model may be too restrictive to elaborate our understanding of the development of mindreading and metacognition, or to enrich our knowledge of individual differences and psychopathology. To illustrate, we describe pertinent examples where there may be a critical interplay between primitive social-cognitive processes and emerging self-attributions.
