The so-called uncontrolled donation after circulatory determination of death (uDCDD) have been implemented in several countries, including Spain and France, to increase the availability of organs for transplantation. These protocols allow obtaining kidneys, livers and lungs of patients who do not survive cardio-pulmonary resuscitation performed in out-of-hospital settings. Simultaneously with the development and recent proliferation of these protocols, some emergency teams have begun to employ unconventional methods of CPR, with still uncertain but promising results. The coexistence of these two possibilities (...) raises some questions: At what point should attempts to save a patient with circulatory arrest be abandoned so that this individual can begin to be considered as a potential organ donor? How to manage potential conflicts of loyalties that may arise within emergency and procurement teams? How should the information to the families of those patients and potential organ donors be managed? This article gathers the conclusions of a workshop in which an interdisciplinary working group addressed these and other questions related to DCDD and non-conventional CPR. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. One might gather from a reading of Lacan’s ouvre that he never advanced an explicit and systematic theory of resistance and defense, his early critique of IPA methods notwithstanding. Indeed, the combativeness of this critique may lead readers to think that any talk of defense analysis is non-Lacanian. Yet such an omission of a key psychic phenomenon presents a puzzle for clinicians and theorists alike, insofar as it disallows a reckoning with a real-life phenomenon. Taking as its focus Lacan’s remarks (...) in Seminars 1 and 2, this article pushes beyond Lacan’s critique of Ego Psychology, claiming that it is possible to establish a positive Lacanian theory of defenses and of defense analysis in the clinical context. To this end, the article offers a systematic and standardized reconstruction of a positive – distinctively Lacanian – view of what defenses are, where they come from, and how analysts should handle them. In so doing, it presents his startling claim that resistance itself was ultimately a red herring, an artificial problem occasioned by the analyst’s erred handling of the transindividual defenses speaking through the analysand. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Este es el viaje apasionante que se propone en este libro, un viaje en el que autores como Poe, Stevenson o Conrad se atreven a proponernos lecturas de Nietzsche, Heidegger o Deleuze y Foucault, en el que personajes como Frankenstein o el doctor Jekyll nos enseñan aspectos inéditos de la filosofía de los siglos modernos, un viaje en el que la posmodernidad se revela como el penúltimo recurso retórico de un personaje ficticio y casi olvidado. This article reconstructs Slavoj Žižek’s theory of ideology as a form of fetishistic disavowal. By seeking out Žižek’s relevant influences and clarifying them, the article seeks to make the theory of fetishistic disavowal in politics intelligible to a wider audience. Moreover, the article argues that the theory of ideology advanced by Žižek in this period of his work can be understood as a theory of unconscious defense, a fact that raises important questions about the utility of psychoanalysis for political philosophy. Libertas philosophandi è una indagine del rapporto disciplinare tra filosofia e teologia che ruota intorno alla celebre Lettera alla granduchessa Cristina di Lorena di G. Galilei, lettera-trattato con cui lo scienziato cerca di salvare uno spazio di libertà di ricerca nel contesto della cultura controriformata. La prima parte del libro illustra criticamente le polemiche sorte a partire dalla pubblicazione del Sidereus nuncius e proseguite fino alla condanna del copernicanesimo nel 1616. La seconda è dedicata all'analisi strutturale della Lettera e alla (...) ricerca delle fonti testuali che l'hanno ispirata, identificandone talora l'edizione precisa. La terza parte sviluppa i diversi temi della Lettera, presentando alcuni elementi fin qui ignoti o ignorati, tra i quali un forte indebitamento con la tradizione del trattato aristotelico De anima (in particolare con Giovanni Pico della Mirandola, Pietro Pomponazzi e Cesare Cremonini); la scoperta di un plagio da parte di Cremonini; la sensibilità politica di Galileo. Viene poi discusso il problema del cosiddetto concordismo del trattato e proposta una lettura controcorrente; si presenta una analisi iconografica che evidenzia, tra l'altro, il legame tra la Lettera a Cristina e l'Accademia dei Lincei. Ancora, si offre un documento inedito che getta luce sul ruolo del cardinale Bellarmino nella condanna del 1616. Infine una rilettura dei documenti dei due processi a Galileo mostra come una lieve, ma decisiva manipolazione della sentenza del primo processo riproponga la problematicità del secondo. La quarta parte del libro contiene il testo della Lettera accompagnato da numerose note di commento storico. (shrink)

Philosophers of perception frequently assume that we see actual states of affairs, or facts. Call this claim factualism. In his book, William Fish suggests that factualism is supported by phenomenological observation as well as by experimental studies on multiple object tracking and dynamic feature-object integration. In this paper, I examine the alleged evidence for factualism, focusing mainly on object detection and tracking. I argue that there is no scientific evidence for factualism. This conclusion has implications for studies on the phenomenology (...) and epistemology of visual perception. (shrink)

Este artículo alude a la manera como dicha lectura concretó las interpretaciones del colombiano, principalmente a la luz de una filosofía práctica y una perspectiva crítica. De dichas posturas, el italiano destaca la vocación vital y el carácter provocador del pensamiento de Gómez Dávila.

At the beginning of the 20th century, Gestalt psychologists put forward the concept of psychoneural isomorphism, which was meant to replace Fechner’s obscure notion of psychophysical parallelism and provide a heuristics that may facilitate the search for the neural correlates of the mind. However, the concept has generated much confusion in the debate, and today its role is still unclear. In this contribution, I will attempt a little conceptual spadework in clarifying the concept of psychoneural isomorphism, focusing exclusively on conscious (...) visual perceptual experience and its neural correlates. Firstly, I will outline the history of our concept, and its alleged metaphysical and epistemic roles. Then, I will clarify the nature of isomorphism and rule out its metaphysical role. Finally, I will review some epistemic roles of our concept, zooming in on the work of Jean Petitot, and suggest that it does not play a relevant heuristic role. I conclude suggesting that psychoneural isomorphism might be an indicator of robustness for certain mathematical descriptions of perceptual content. (shrink)

Is consistency the sort of thing that could provide a guide to mathematical ontology? If so, which notion of consistency suits this purpose? Mark Balaguer holds such a view in the context of platonism, the view that mathematical objects are non-causal, non-spatiotemporal, and non-mental. For the purposes of this paper, we will examine several notions of consistency with respect to how they can provide a platon-ist epistemology of mathematics. Only a Gödelian notion, we suggest, can provide a satisfactory guide to (...) a platonist ontology. Is consistency the sort of thing that could provide a guide to mathematical ontology? If so, which notion of consistency suits this purpose? Mark Bala-guer holds such a view in the context of platonism, the view that mathematical objects are non-causal, non-spatiotemporal, and non-mental. Balaguer's version of Platonism, Full-Blooded Platonism (FBP), is the view that "there are as many abstract mathematical objects as there could be-i.e., there actually exist abstract mathematical objects of all possible kinds" (Balaguer, 2017, p. 381). He continues: Since FBP says that there are abstract mathematical objects of all possible kinds, it follows that if FBP is true, then every purely mathematical theory that could be true-i.e., that is internally consistent-accurately describes some collection of actually existing abstract objects. Thus it follows from FBP that in order to acquire knowledge of abstract objects, all we have to do is come up with an internally consistent purely mathematical theory (and know that it is internally consistent). The objective of this study has been to establish the level of significance that Gustavo Gutierrez and Juan Luis Segundo attribute to politics in their contributions to liberation theology and to extract the relevant consequences for political theory. ;A systematic analysis of the theory of history in the works of these two authors indicates a higher level of integration between Christianity and politics that is usual in Christian political thought. Liberation is equated with salvation and political liberation is seen as (...) one of its components. This brings politics to a position of privilege. When at the service of justice it occupies, for our authors, a high rank among Christian concerns and when devoted to oppression it requires diligent response from every Christian. ;This understanding of politics is valuable in that it accentuates the political aspect of the Christian theory of history, an element frequently underestimated. Certain tensions remain, however, in the theory as a result of this emphasis: between the moral improvement expected from the involvement in political activities conducive to justice and the moral ambiguity of political structures emerging from such activity; and between the use of the concept of class struggle and notions of conversion and reconciliation. Finally, there is the danger of reducing the critical ability of Christians regarding a particular political project by identifying it with the concept of eschatology. (shrink)

ResumenEste artículo propone una idea de intervención e institución que se entrelace en lo social a través del concepto de contagio como elemento filosófico articulador. En primer lugar, se establece un marco teórico-filosófico para pensar la vida como una ontología social del contagio, que permita habitar un pensar relacional etológico que se abra a otros modos de existencia. Desde este marco, los hallazgos perfilan la relación intervención-institución desde la sensibilidad que evoca esta forma distinta de intervención en lo social, disponiendo (...) de otros modos las variaciones de la institución y sus procesos de instituir el campo social. Se concluye discutiendo la relación entre intervención y sus capacidades transformativas como componente metódico y epistemológico distinto que trae consigo un fuerte potencial político y ético. Al multiplicar los modos de ser y los procesos de subjetivación se abren prácticas humanas y más-que-humanas, instituyendo otros modos de hacer-y-pensar toda intervención del presente.Palabras clave: institución; intervención; contagio; formas de vida; cartografías. Ortega y Gasset’s old lament that no one had so far attempted a rigorous phenomenology of pain no longer holds since the appearance of Christian Grüny’s recent monograph Zerstörte Erfahrung. Eine Phänomenologie des Schmerzes. Grüny argues for the use of phenomenological categories from Merleau-Ponty in order to understand physical pain as a “blocked escape-movement” , concluding that corporeal suffering makes impossible both a clean distinction and a pure identification between the lived body and the physical body that I am. In (...) my paper, I would like to suggest some improvements to Grüny’s approach through the utilization of the category of self-affection, as the material phenomenology of Michel Henry has developed it. In addition to the radical immanence in which hyle, noesis, and noema are unified into a “carnal cogito,” however, I argue that it is necessary to describe the painful self-affection not only in terms of any sensitive excess whatever , as Grüny posits, but also in terms of a mutation of the sensitive excess into the intra-tactile sphere of sensibility. Thus I endorse the Husserlian insight that makes tactility the primordial structure of sensibility. (shrink)

En varios pasajes de la obra de Lévinas vemos que su manera de presentarse frente a lo político es ambigua. O bien, resulta mejor decir que solo en apariencia el "objeto" de lo político en sus reflexiones sobre la justicia y el Estado resultan claras; hay una suerte de equívoco que vale la pena precisar y distinguir. Así, el objetivo central de este trabajo es describir dos momentos políticos en Lévinas leídos en clave Estado, como una figura posible de la (...) política; desentrañamos así la trama anti-política en tanto crítica política al Estado, para llegar a la trama del Estado justo e igualitario, lo que abre nuevas puertas para pensar lo político. A partir de esta descripción reflexionamos, por un lado, una postura crítica frente a las ideas sobre el Estado de Lévinas desde las vinculaciones ético-políticas que hace, tal como la de Alberto Sucasas. Y por otro, en contraposición a éstas, las interesantes y extravagantes lecturas que hace Miguel Abensour de Lévinas creyendo que las relaciones ético-políticas levinasianas aportan a renovar críticamente una nueva figura de Estado dejando el terreno político y estatal abierto a nuevas reflexiones. In several passages of Levinas' work we see that his way of presenting the political front is ambiguous. Or, more precisely, that the "object" of the political in his reflections about justice and the State is only apparently clear; there is a sort of equivocalness that is worth clarifying and distinguishing. The aim of this article is to describe two political moments in Levinas, read in terms of the State as a possible figure in politics. We thus unravel an anti-political theme which is critical of the politics of the State, in order to reach a theme of a State that is just and egalitarian. This opens up new territory from which to think of the political. One critique of Levinas' ideas of the State in terms of its ethical-political linkages is that put forth by Alberto Sucasas. A second contrasting critique is the interesting and extravagant reading of Miguel Abensour, in which Levinasian ethical-political relationships lead to a critical renewal of a new figure of the State, leaving the political and state terrain open to new reflections. Contemporary theories of consciousness are based on widely different concepts of its nature, most or all of which probably embody aspects of the truth about it. Starting with a concept of consciousness indicated by the phrase “the feeling of what happens” (the title of a book by Antonio Damásio), we attempt to build a framework capable of supporting and resolving divergent views. We picture consciousness in terms of Reality experiencing itself from the perspective of cognitive agents. Each conscious experience is (...) regarded as composed of momentary feeling events that are combined by recognition and evaluation into extended conscious episodes that bind cognitive contents with a wide range of apparent durations (0.1 secs to 2 or more secs, for us humans, depending on circumstances and context). Three necessary conditions for the existence of consciousness are identified: a) a ground of Reality, envisaged as an universal field of potentiality encompassing all possible manifestations, whether material or 'mental'; b) a transitional zone, leading to; c) a manifest world with its fundamental divisions into material, 'informational' and quale-endowed aspects. We explore ideas about the nature of these necessary conditions, how they may relate to one another and whether our suggestions have empirical implications. (shrink)

Observational studies have suggested that some nonhuman primates’ cooperative behavior may rely on their capacity to share goals and understand the role of their partners. Experimental studies have tried to find evidence for this under controlled conditions, investigating aspects like the degree of organization in different primate species and the individuals’ capacity to recognize and choose good partners, switch roles with them, and care about their outcomes. Often, the results have been mixed. Partly, this is because of the methodological difficulties (...) inherent to empirical research. In this paper, I offer a critical, methodological review of the experimental studies done in the last years on nonhuman primates’ cooperation, I discuss their findings, and suggest possible solutions to some of the procedural problems. Hopefully, this will contribute to improve the design of future studies and therefore our knowledge about the evolutionary history of cooperation. (shrink)

The theme of the other (autrui) in Deleuze is confused with the double task of articulating a new perspective of the sense while questioning the traditional image of thought. This opens up ground from which to analyze this theme in the work of Deleuze which although is systematically visible in Différence et répétition (1968) and Logique du sens (1969) some elements of are discernable in Proust et les signes (1964). This study addresses the idea that the territory of the other (...) is the sense as identified in these three texts. Further ideas will also be introduced that center on the face and the manner in which it reformulates ties to sense. As suggested in Deleuze, a type of thinking is installed in the opening to the other, however not necessarily entering into the registry of morality nor of knowledge. (shrink)
