The article deals with Kant's understanding of personhood and autonomy. It highlights the connection of autonomy and human dignity within Kant's appreciation of morality, and indicates how his distinction between the empirical and transcendental spheres enables Kant to extend dignity even to humans who are not actually autonomous. Turning to contemporary approaches within ethics that refer to Kant but omit this transcendental framework, it defends the necessity of a trans-empirical frame within the Kantian system and hints at consequences for bioethics. (...) It concludes that Kant works with neither an absolutist notion of freedom in terms of solipsistic autarky, nor an empirical freedom and autonomy that begin and end at certain points of time. ZusammenfassungDer Text versucht in Auseinandersetzung mit den Ansätzen von Jürgen Moltmann, Johann Baptist Metz und Odo Marquard und im Anschluss an lutherische Theologie zu einer Verhältnisbestimmung von Theodizeefrage und Kreuzestheologie zu gelangen. Dabei wird Luthers Einsicht fruchtbar gemacht, dass Gott verborgen im Leiden wirkt, das Leiden aber nicht zu seiner Wesenseigenschaft wird. Vielmehr eröffnet sich in der Klage des leidenden Menschen die Möglichkeit, das Leiden an Gott zu beenden und gegen Gott zu Gott zu fliehen. Von Luthers Kreuzestheologie her ist (...) eine gegenseitige Durchdringung von Theodizeefrage, Hamartiologie, Kreuzestheologie und Eschatologie anzumahnen. Gleichzeitig verhelfen Klage und Anklage dazu, sich aufgrund von erfahrenen Leiden nicht in sich selbst zu verschließen, sondern kontrafaktisch an Gott festzuhalten.SummaryDiscussing the thoughts of J. Moltmann, J. B. Metz and O. Marquard the essay attempts – whilst following Martin Luther's theologia crucis – to find a relation between the theodicy-question and the theology of the cross. For this concern it refers to the aspect that God acts in suffering in a hidden way but does not posses suffering as an intrinsic characteristic. Rather, the lament of suffering people address to God, as we find it in the Psalms, gives the opportunity of bringing suffering from God's hiddenness to an end and to “flee from God to God”. Returning to Luther's theologia crucis should lead to further reflections on theodicy, sin, theology of the cross and eschatology. At the same time, lamentation as bringing human suffering before God provides an aid for suffering people not to lock their suffering in themselves, but to maintain the relationship to God – even against the supposedly factual evidence of the experience of suffering. ZUSAMMENFASSUNGIm Rekurs auf Luthers Verständnis der communicatio idiomatum, also der gegenseitigen Mitteilung und Partizipation von Göttlichem und Menschlichem in der Person Jesu Christi, versucht der Text eine Annäherung zu leisten an eine kommunikative theologische Anthropologie innerhalb einer relationalen und kommunikativen Ontologie. Mit einem solchen Konzept erscheint es als möglich, innerhalb der Debatte um Leib und Seele beziehungsweise Gehirn und Geist, die in den vergangenen Jahrzehnten aufgrund der Forschungsergebnisse der Neurowissenschaften von neuem in die öffentliche Aufmerksamkeit gerückt ist, zu einer Klärung (...) zu gelangen und sowohl einen Leib-Seele-Dualismus als auch eine naturalistische Reduzierung mentaler Prozesse auf rein physische Vorgänge zu vermeiden. Luthers Modell der communicatio idiomatum dient in diesem Zusammenhang als Strukturmodell für die Kommunikation von Mensch und Gott im Glauben und für die leib-seelische Existenz des Menschen selbst.SUMMARYThe article tries – in referring to Martin Luther's understanding of communicatio idiomatum, thus the communication of divine and human nature in the person of Jesus Christ – to outline a communicative anthropology and ontology, in order to help to clarify the body-mind-problem and to overcome both the body-mind-dualism and a naturalistic approach currently favoured by several neuroscientist concepts. In comparing Luther's view of the communication of immaterial and material processes within the person of Jesus Christ and his concept of communication that takes place between Christ and the believer, the essay concludes that Luther seems to conceive a constitutively relationally structured view of man. In taking this approach seriously, there could be a way for Christian theology to appropriately deal with the challenges caused by the contemporary neuroscientist debate. Following Luther's concept of communication within the person of Jesus Christ, of Christ and man and within man himself, this communicative concept could turn out to be helpful in outlining a relational and communicational theological anthropology. This article notes differences in legislation in Germany and Great Britain regarding human embryo research and looks for an explanation in their divergent intellectual traditions. Whereas the German Stem Cell Act invokes an anthropological concept of human dignity to ground its ban on using embryos for research, there is no definition of what it means to be human in either the British Human Fertilisation and Embryology Act or in the advisory Warnock-Report. After studying the differences and providing some philosophical background, (...) the essay distinguishes two notions that are significant for understanding human dignity. It then proposes from a theological point of view a basic understanding within a relational anthropology, and comes to the conclusion that because of continuity in development and their relational constitution, humans embryos should be accepted as human from the moment of conception. The study investigates the »Four Principles of Biomedical Ethics« published by Tom Beauchamp and James Childress with a particular concern for the principle of respect for autonomy. The leading question is in which philosophical background autonomy is dealt with by Beauchamp/childress and by the enlightenment philosopher Immanuel Kant, while the more emipirical theoretical framework of Beauchamp/childress and the rationalistic framework of Kant are being analyzed. After having considered the foundation of autonomy both in Beauchamp/childress and Kant, the study turns to (...) the relationship of autonomy and human dignity by exploring the implicit extension of autonomy, human dignity and being human, and asks which consequences have to be drawn from a theological point of view. This volume views human existence from various perspectives and asks what its purpose is. The underlying thesis is that humans are creatures of relationships. Any anthropology that fails to take this fact seriously will of necessity remain abstract. Instead the authors are interested in how different academic disciplines describe the variety of relationships in human life, taking into account their ethical and theological dimensions.

Food retailers are powerful actors of the agro-industrial food system. They exert strong lock-in effects that hinder transitions towards more sustainable agri-food systems. Indeed, their marketing practices generally result in excluding the most sustainable food products, such as local, low-input, small-scale farmers’ products. Recently in Belgium, several initiatives have been created to enable the introduction of local products on supermarket shelves. In this article, we study three of those initiatives to analyse if the development of local sourcing in supermarkets opens (...) up an opportunity for a transition towards more sustainable agri-food systems. We conceptualise transitions as a shift in governance and ethical values and adopt a pragmatist approach of ethics combined with the systemic perspective of transition studies, to evaluate the impact of these initiatives. Our analysis shows that they mainly contribute to the reproduction of the incumbent agri-food system. It also highlights that first, to be a driver for sustainability transitions, food ethics need to be systemic i.e. relate to a systemic understanding of problems and perspective of sustainability, including social justice. And second, it highlights that governance arrangements involving not only representative organisations of the various agri-food and non-agricultural actors, but also actors upholding ethical values that are currently missing in conventional supply chains and representing excluded and marginalised interests, favour the uptake of such systemic ethics by incumbent actors. Hence, systemic ethics and inclusive governance are key features for initiatives to contribute to a sustainability transition. (shrink)

With the ever-growing quality of observational data in astronomy, the complexity of astrophysical models has been increasing in turn. This trend raises the question: Are there still reasons to prefer simpler models if the final goal is an actual model-target comparison? I argue for two aspects in which astrophysical research may favor models having reduced complexity: first, to address the problem of determining the values of adjustable parameters and, second, to pave the way for a validation of the model based (...) on the modeler’s understanding of the scope of the model and the critical processes on the target’s side. In particular, I will argue that the interpretation of an essentially invariant astrophysical model structure can change substantially over time. I will illustrate this claim using as an example the first 20 years (1985–2004) of development of the Paris-Durham shock code—a numerical model of slow interstellar shock waves (i.e. a disturbance of the medium that travel faster than the local (...) speed of sound). I will show that the model’s interpretation and, in particular, its underlying representational ideal—the modeler’s (often implicit) goal governing the development and the use of the model—changed notably during this period. Whereas the code was originally used in a purely exploratory fashion, it was later taken to represent and encompass the target phenomenon as completely as possible. It is noteworthy that during this transition the model’s change of epistemic status was never explicitly acknowledged or in any way articulated. However, the impetus for the change can, I claim, be found in the role that observational data came to play in the later publications. (shrink)

We provide first-order axioms for the theories of finite trees with bounded branching and finite trees with arbitrary (finite) branching. The signature is chosen to express, in a natural way, those properties of trees most relevant to linguistic theories. These axioms provide a foundation for results in linguistics that are based on reasoning formally about such properties. We include some observations on the expressive power of these theories relative to traditional language complexity classes.

In the eighteenth century, the sciences and their applications adopted a new attitude based on quantification and, increasingly, on a notion of precision. Within this process, instruments played a significant role. However, while new devices such as the micrometer, telescope, and pendulum clock embodied a formerly unknown potential of precision, this could only be realized by defining a set of practices regulating their application and control. The paper picks up the case of pendulum clocks used in eighteenth-century observatories in order (...) to show the process of learning in the course of which the pendulum clock first became a precision instrument. By examining the results of an especially developed statistical analysis, conducted to compare the performance of eighteenth-century clocks, it highlights the diversity of conditions, attitudes, and manners of handling that are characteristic for the epoch. In this way, it underlines the necessity of standardization of timekeeping practices rather than exclusively focusing on the technological development of clocks. Ultimately, the paper discusses the role of makers and users in order to show the evolution of a “precision instrument.”. (shrink)

Die Studie «Sittlichkeit und Verbrechen bei Hegel» analysiert den Komplex von Sittlichkeit, Verbrechen und Strafe bei Hegel. Sie verfolgt, wie Hegel das Verbrechen vom Standpunkt der Sittlichkeit aus einerseits als etwas davon Abweichendes beurteilt und andererseits die Strafe als die Realisation des Willens des Verbrechers deduzieren will. Dabei werden die logischen Abstraktionen, unter die Hegel das Verbrechen subsumiert, ebenso einer selbständigen Untersuchung unterzogen wie bei der Untersuchung der Sittlichkeit der Standpunkt der Sittlichkeit. Der Abschnitt der Hegelschen «Rechtsphilosophie» «Die bürgerliche Gesellschaft» (...) wird nachgezeichnet als eine Folge jeweils besonders bestimmter Existenzweisen der Begriffsbestimmungen der Idee der Sittlichkeit. The daughter of French psychoanalyst Jacques Lacan tries to make sense of her relationship with her father. “When I was born, my father was already no longer there.” Sibylle Lacan's memoir of her father, the influential French psychoanalyst Jacques Lacan, is told through fragmentary, elliptical episodes, and describes a figure who had defined himself to her as much by his absence as by his presence. Sibylle was the second daughter and unhappy last child of Lacan's first marriage: the (...) fruit of despair (“some will say of desire, but I do not believe them”). Lacan abandoned his old family for a new one: a new partner, Sylvia Bataille (the wife of Georges Bataille), and another daughter, born a few months after Sibylle. For years, this daughter, Judith, was the only publicly recognized child of Lacan—even if, due to French law, she lacked his name. In one sense, then, A Father presents the voice of one who, while bearing his name, had been erased. If Jacques Lacan had described the word as a “presence made of absence,” Sibylle Lacan here turns to the language of the memoir as a means of piecing together the presence of a man who had entered her life in absence, and in his passing, finished in it. In its interplay of absence, naming, and the despair engendered by both, A Father ultimately poses an essential question: what is a father? This first-person account offers both a riposte and a complement to the concept (and the name) of the father as Lacan had defined him in his work, and raises difficult issues about the influence biography can have on theory—and vice versa—and the sometimes yawning divide that can open up between theory and the lives we lead. A substantial body of empirical evidence shows that individuals overweight extreme events and act in conflict with the expected utility theory. These findings were the primary motivation behind the development of a rank-dependent utility theory for choice under uncertainty. The purpose of this paper is to demonstrate that some simple empirical rules of thumb for choice under uncertainty are consistent with the rank-dependent utility theory.

Die Untersuchung der wallonischen consolatio-Übersetzung führte zur Entdeckung und Neudatierung eines lateinischen consolatio-Kommentars, der auch von Jean de Meun benutzt wurde. Somit kann durch Gegenüberstellung von Vorlage und Übersetzung an einem konkreten Beispiel Einblick in die Übersetzungspraxis im Mittelalter gewonnen werden.

Abduction is considered the most powerful, but also the most controversially discussed type of inference. Based on an analysis of Peirce’s retroduction, Lipton’s Inference to the Best Explanation and other theories, a new theory of abduction is proposed. It considers abduction not as intrinsically explanatory but as intrinsically conditional: for a given fact, abduction allows one to infer a fact that implies it. There are three types of abduction: Selective abduction selects an already known conditional whose consequent is the given (...) fact and infers that its antecedent is true. Conditional-creative abduction creates a new conditional in which the given fact is the consequent and a defined fact is the antecedent that implies the given fact. Propositional-conditional-creative abduction assumes that the given fact is implied by a hitherto undefined fact and thus creates a new conditional with a new proposition as antecedent. The execution of abductive inferences is specified by theory-specific patterns. Each pattern consists of a set of rules for both generating and justifying abductive conclusions and covers the complete inference process. Consequently, abductive inferences can be formalised iff the whole pattern can be formalised. The empirical consistency of the proposed theory is demonstrated by a case study of Semmelweis' research on puerperal fever. (shrink)

This experimental study examines individuals’ legitimacy judgments. We develop a model that demonstrates the role of attributed motives and corporate credibility for the evaluation of organizational legitimacy and test this model with an experimental vignette study. Our results show that when a corporate activity creates benefits for the firm—in addition to social benefits—individuals attribute more extrinsic motives. Extrinsic motives are ascribed when a corporation is perceived as being driven by external rewards as opposed to an altruistic commitment to a social (...) cause. Extrinsic motives negatively affect corporate credibility and organizational legitimacy judgments. This article contributes to a better understanding of the complex process of organizational legitimacy judgment by shedding light on the individual’s perspective and expounding the relationship between attributed motives, corporate credibility, and organizational legitimacy. Friedman’s view on corporate social responsibility is often accused of being incoherent and of setting rather low ethical standards for managers. This paper outlines Friedman’s ethical expectations for corporate executives against the backdrop of the strong emphasis he puts on individual freedom. Doing so reveals that the ethical standards he imposes on managers can be strictly deduced from individual freedom and that these standards involve both deontological norms and the fulfillment of particular stakeholder expectations. These insights illustrate the necessity to (...) reconsider how Friedman’s approach relates to other important normative theories of business ethics. Contrasting Friedman’s approach with stakeholder theory and integrative social contract theory—when considering the importance he assigns to individual freedom—shows how and why these approaches differ. Still, the comparison also highlights striking similarities. This paper contributes to a better understanding of Friedman’s position—which is still one of the most influential approaches in business ethics research—because it enables a differentiated look at its strengths and weaknesses. Statements of the form ''Osorno is in Chile'' were presented in colors that made them easy or difficult to read against a white background and participants judged the truth of the statement. Moderately visible statements were judged as true at chance level, whereas highly visible statements were judged as true significantly above chance level. We conclude that perceptual fluency affects judgments of truth.

The (...) concept of ‘operative ontologies’ is not easy to understand. The article tries to explore the potential and limitations of this idea. The methodological approach of operative ontology aims at the fact that the ‘ontic’ (in the sense of the phenomenally given) deter- mines and produces the ‘ontological’ (in the sense of the comprehensibility of the world): The ontic gives birth to the ontological. The meaning of this statement is reconstructed with reference to Bernhard Siegert’s concept of ‘cultural technique’ as well as Lorenz Engell’s notion of ‘ontography’ and is further- more critically commented upon. The nature and scope of medical humanities are under debate. Some regard this field as consisting of those parts of the humanistic sciences that enhance our understanding of clinical practice and of medicine as historical phenomenon. In this article it is argued that aesthetic experience is as crucial to this project as are humanistic studies. To rightly understand what medicine is about we need to acknowledge the equal importance of two modes of understanding, intertwined and mutually reinforcing: the mode of (...) aesthetic imagination and the mode of analytical reflection.
