Timothy Michael Fowler has argued that, as a consequence of their commitment to neutrality in regard to comprehensive doctrines, political liberals face a dilemma. In essence, the dilemma for political liberals is that either they have to give up their commitment to neutrality (which is an indispensible part of their view), or they have to allow harm to children. Fowler’s case for this dilemma depends on ascribing to political liberals a view which grants parents a great degree of freedom in (...) deciding on the education of their children. I show that ascribing this view to political liberals rests upon a misinterpretation of political liberalism. Since political liberals have access to reasons based upon the interests of children, they need not yield to parent’s wishes about the education of their children. A correct understanding of political liberalism thus shows that political liberals do not face the dilemma envisaged by Fowler. (shrink)

According to John Rawls’s famous Liberal Principle of Legitimacy, the exercise of political power is legitimate only if it is justifiable to all citizens. The currently dominant interpretation of what is justifiable to persons in this sense is an internalist one. On this view, what is justifiable to persons depends on their beliefs and commitments. In this paper I challenge this reading of Rawls’s principle, and instead suggest that it is most plausibly interpreted in externalist terms. On this alternative view, (...) what is justifiable to persons is not in any way dependent on, or relativized to, their beliefs and commitments. Instead, what is justifiable to all in the relevant sense is what all could accept as free and equal. I defend this reinterpretation of the view by showing how it is supported by Rawls’s account of the freedom and equality of persons. In addition, a considerable advantage of this suggestion is that it allows for an inclusive account of to whom the exercise of political power must be made justifiable. (shrink)

This paper considers the view that the basis of equality is the range property of being a moral person. This view, suggested by John Rawls in his A Theory of Justice (1971), is commonly dismissed in the literature. By defending the view against the criticism levelled against it, I aim to show that this dismissal has been too quick. The critics have generally failed to fully appreciate the fact that Rawls's account is restricted to the domain of distributive justice. On (...) Rawls's view distributive justice is a matter of the fair terms of cooperation among the participants of a system of social cooperation. I argue that this understanding of distributive justice can provide a compelling rationale for considering moral personality as the basis of equality for this domain of morality. That moral persons are indeed equal is further supported by an intuitive argument concerning the irrelevance of morally arbitrary factors, giving us reasons to believe that varying capacities among moral persons does not result in an unequal moral status. The dismissal of Rawls's account of equality has thus been premature, and it remains an important view to consider. (shrink)

The repugnant conclusion can be formulated as follows: For any population consisting of people with very high positive welfare, there is a better population in which everyone has a very low positive welfare, other things being equal. As the name indicates, this conclusion appears unacceptable. Yet it has proven to be surprisingly difficult to find a theory that avoids it without implying other very counterintuitive conclusions. Moreover, the conclusion is a problem not just for total utilitarians or those committed to (...) welfarism but for all moral theories according to which welfare matters at least when all other things are equal, which arguably is a minimal adequacy condition for any moral theory. And, not the least, how to deal with it has implications for the present generations’ duties to future generations and intergenerational justice. The question as to how the repugnant conclusion should be dealt with has thus become one of the cardinal challenges of modern ethics, and the inquiry into what it shows about the nature of ethics has opened up many new avenues for research. This chapter covers the different suggestions in the literature on how to do deal with the conclusion, both on the axiological and on the normative levels. Moreover, the conclusion and different ways of deriving it are explained in detail. (shrink)

This thesis is an inquiry into the Liberal Principle of Legitimacy, formulated by John Rawls in his later writings. According to this principle, the exercise of political power is legitimate only if it is justifiable to all citizens. This view can be interpreted in different ways, and I argue that the presently most popular way of doing so faces serious problems. The aim is to identify and defend a more plausible version of the principle, which overcomes these problems, and yet (...) preserves the most essential and appealing features of the approach. Among the most central issues for how to interpret the principle are how to understand the notion of justifiability to a person, and who should be included in the group of persons referred to as "all citizens". On the currently received view, only justifiability to those who count as "reasonable" matter, and justifiability to these persons is understood in non-moral terms, as being determined by what is accessible to them, given the beliefs that they happen to hold. I argue that we have good reasons to reject both of these suggestions. We should instead spell out justifiability to a person in terms of what could be reasonably accepted in a moral sense, which allows us to retain the appealing idea that legitimacy is dependent on justifiability to all citizens over whom political power is exercised. I further suggest that we can use the original position – Rawls’s version of the social contract – to determine what is justifiable to all in this sense. I defend this suggestion against the expected objection that it will not be able to take reasonable pluralism – the assumption of deep disagreement between citizens – into account, by explaining why we should sharply distinguish this principle of political legitimacy from the theory of Political Liberalism. This distinction also contributes to my response to the objection, raised against this principle, that it is self-defeating. That my suggested interpretation allows us to convincingly respond to this line of criticism is yet another reason as to why it is preferable to the standard view. (shrink)

In constructivist contractualist theories, such as Rawls’, principles of justice should mirror beliefs that we all, in some sense, share. One would then arrive at principles that everybody could, in that sense, accept. These principles should specify, among other things, to whom to distribute the relevant benefits and burdens and to whom to assign responsibility for the distribution. In addition to this classical assignment problem, however, constructivist contractualism must also deal with a new, and quite different, assignment problem sincewhat to (...) count as beliefs that weall share depends on how the set of people that make up the “we” is delimited. Thus, for constructivist contractualism, the questions of whom to assign a part in the justification procedure and whom to exclude, and how to justify these inclusions and exclusions, are of crucial importance. In this chapter we consider the inclusion or exclusion of future generations, and how this case illuminates a general problem for constructivist contractualism. (shrink)

This is a review of contemporary philosophical discussions of population policies. The focus is on normative justification, and the main question is whether population policies can be ethically justified. Although few analytical philosophers have directly addressed this question – it has been discussed more in other academic fields – many arguments and considerations can be placed in the analytical philosophical discourse. This article offers a comprehensive review and analysis of ethically relevant aspects of population policies evaluated on the basis of (...) the main ethical theories. This analysis is preceded by a brief historical contextualisation of when and how population policies became ethically contentious and how this relates to philosophical debates in environmental ethics, population ethics and political philosophy. The article also includes a conceptual analysis of population policies in which the empirical intricacies around individual fertility decisions are sorted out and the different ways in which they can be affected are categorised in a taxonomy which highlight the most relevant ethical aspects of population policies. The ethical analysis shows that while population policies can be justified on the basis of most ethical theories, it all depends on what prior assumptions are made about what is at stake. (shrink)

We consider the expressive power of second - order generalized quantifiers on finite structures, especially with respect to the types of the quantifiers. We show that on finite structures with at most binary relations, there are very powerful second - order generalized quantifiers, even of the simplest possible type. More precisely, if a logic is countable and satisfies some weak closure conditions, then there is a generalized second - order quantifier which is monadic, unary and simple, and a uniformly obtained (...) sublogic of which is equivalent to. We show some other results of the above kind, relating other classes of quantifiers to other classes of structures. For example, if the quantifiers are of the simplest non-monadic type, then the result extends to finite structures of any arity. We further show that there are second - order generalized quantifiers which do not increase expressive power of first- order logic but do increase the power significantly when added to stronger logics. The aim of this study was to describe the experiences of undergoing a presymptomatic genetic test for the hereditary and fatal Huntington’s disease, using a case study approach. The study was based on 18 interviews with a young woman and her husband from the decision to undergo the test, to receiving the results and trying to adapt to them, which were analysed using a life history approach. The findings show that the process of undergoing a presymptomatic test involves several closely (...) connected ethical and medical questions, such as the reason for the test, the consequences of the test results and how health-care services can be developed to support people in this situation. If the condemnation and crucifixion of Christ is interpreted in the key of Lutheran divine omniscience and absence of alternative possibilities, an apparent contradiction regarding the moral responsibility and duties of the Israelite executioners of Christ would arise. This contradiction would be the following: How can we sustain the moral responsibility of the executioners if they did not have alternative possibilities and, according to Christ’s first Saying on the cross, they did not know what they were doing? How could it (...) be possible to attribute duties to the executioners if they were not able to fulfill them? These problems can be addressed from a semicompatibilistic perspective of moral responsibility. It could be argued that: 1) the absence of alternative possibilities does not exclude the fact that the executioners could be considered morally responsible for Christ’s crucifixion, and that 2) the impossibility of fulfilling certain duties does not imply that the executioners would not have had these duties and cannot be considered morally responsible for their breach. Evolutionary Transitions in Individuality have been responsible for the major transitions in levels of selection and individuality in natural history, such as the origins of prokaryotic and eukaryotic cells, multicellular organisms, and eusocial insects. The integrated hierarchical organization of life thereby emerged as groups of individuals repeatedly evolved into new and more complex kinds of individuals. The Social Protocell Hypothesis proposes that the integrated hierarchical organization of human culture can also be understood as the outcome of an ETI—one that produced (...) a “cultural organism” from a substrate of socially learned traditions that were contained in growing and dividing social communities. The SPH predicts that a threshold degree of evolutionary individuality would have been achieved by 2.0–2.5 Mya, followed by an increasing degree of evolutionary individuality as the ETI unfolded. We here assess the SPH by applying a battery of criteria—developed to assess evolutionary individuality in biological units—to cultural units across the evolutionary history of Homo. We find an increasing agreement with these criteria, which buttresses the claim that an ETI occurred in the cultural realm. (shrink)

It seems odd that in such a densely theological text that Augustine would bring up something like the KK-thesis, which is so epistemological. Yet, as one progresses through the book it does begin to make sense. In this paper, I aim to try to come to some understanding of how and why Augustine uses something like the KK-thesis in Book 11 of The City of God. The paper will progress in the following way: First, I discuss Jaakko Hintikka's work on (...) the KK-thesis in order to have a clear idea of what the KK-thesis is, and some associated problems with it. Next, since Augustine most explicitly deals with the KK-thesis in De Trinitate, with the help of Gareth Matthews work, I discuss Augustine's use of the KK-thesis there. Finally, I return to The City of God, in order come to an understanding of Augustine's use of the KK-thesis there. (shrink)

The vital status of patients who are a part of controlled donation after circulatory death (cDCD) is widely debated in bioethical literature. Opponents to currently applied cDCD protocols argue that they violate the dead donor rule, while proponents of the protocols advocate compatibility. In this article, we argue that both parties often misinterpret the moral implications of the dead donor rule. The rule as such does not require an assessment of a donor’s vital status, we contend, but rather an assessment (...) of whether procurement of organs in cDCD cause the death of the donor or not. We then argue that commonly practiced cDCD protocols do not violate the dead donor rule, since the donation does not trigger or cause the death of the donors. (shrink)

In the history of ideas, however, it has been a controversial as well as neglected idea associated mostly with Rousseauian and Leftist models of democracy. The autor points to the key features of participatory democracy such as the idea of self-mastery. The philosophical idea of participation lies at the heart of the pragmatist conception of democracy as developed (...) by J. Dewey. Its functioning may be illustrated by the concept of "democratic normative community". This conception of participatory democracy as a broad social rather than a narow political phenomenon provides the framework that makes it both a vital ideal and a creative task for current global as well as local efforts to bring about the sociopolitical change. The "Practice Turn" in the Contemporary Socio-Human Sciences The paper provides an overview of the current situation in the socio-human sciences, which is characterised by attempts to overcome traditional one-sided approaches and look for new alternatives. One of the latest alternatives to traditional approaches in the philosophy and methodology of the social sciences is the "practice turn". It is the turn to another, non-traditional approach to practice but also to Aristotelian phronesis. When should nudging be deemed as permissible and when should it be deemed as intrusive to individuals’ freedom of choice? Should all types of nudges be judged the same? To date the debate concerning these issues has largely proceeded without much input from the general public. The main objective of this study is to elicit public views on the use of nudges in policy. In particular we investigate attitudes toward two broad categories of nudges that we label pro-self and pro-social (...) nudges. In addition we explore how individual differences in thinking and feeling influence attitudes toward nudges. General population samples in Sweden and the United States were presented with vignettes describing nudge-policies and rated acceptability and intrusiveness on freedom of choice. To test for individual differences, measures on cultural cognition and analytical thinking were included. Results show that the level of acceptance toward nudge-policies was generally high in both countries, but were slightly higher among Swedes than Americans. Somewhat paradoxically a majority of the respondents also perceived the presented nudge-policies as intrusive to freedom of choice. Nudge-polices classified as pro-social had a significantly lower acceptance rate compared to pro-self nudges. Individuals with a more individualistic worldview were less likely to perceive nudges as acceptable, while individuals more prone to analytical thinking were less likely to perceive nudges as intrusive to freedom of choice. To conclude, our findings suggest that the notion of “one-nudge- fits-all” is not tenable. Recognizing this is an important aspect both for successfully implementing nudges as well as nuancing nudge theory. (shrink)

Six case studies on nursing home staff attitudes to patient autonomy have been analysed. The case studies are based on six polarities within autonomy, as developed by Collopy. In total, 189 professional caregivers, comprising the staff of 13 nursing homes in the county of Stockholm, Sweden, responded to questions based on the case studies. Results show that the attitudes within each professional category had a high level of internal correspondence. Nurses consistently supported patient preferences to the highest degree, followed by (...) assistant nurses and auxiliary staff. Nurses' aides ranked lowest in supporting patient preferences. In only one of the cases were background variables of significance. (shrink)

Much recent literature on comparability problems focuses on what the appropriate explanation of the phenomenon is. Is it due to vagueness or the possibility of non-conventional comparative relations such as parity? This paper argues that the discussions on how to best explain comparability problems has reached an impasse at which it is hard to make any progress. In 1997 John Broome presented the Collapsing Argument that was meant to establish that non-conventional comparative relations cannot exist. Broome's argument has faced a lot of scrutiny and a certain type of counterexample has been used to undermine it. Most of the counterexamples focus on the Collapsing Principle which plays a central role in Broome's argument. In this article we will take a closer look at the most common type of counterexample and propose how to adjust the Collapsing Principle in (...) order to avoid objections based on these counterexamples. We argue that a weaker version of the Collapsing Principle is not susceptible to the classical counterexamples. Furthermore, after an explorative discussion about the intuitions behind the original principle, we show that this weaker formulation is at least as intuitive as the principle suggested by Broome. It has been argued that Hume's denial of infinite divisibility entails the falsity of most of the familiar theorems of Euclidean geometry, including the Pythagorean theorem and the bisection theorem. I argue that Hume's thesis that there are indivisibles is not incompatible with the Pythagorean theorem and other central theorems of Euclidean geometry, but only with those theorems that deal with matters of minuteness. The key to understanding Hume's view of geometry is the distinction he draws between a precise and (...) an imprecise standard of equality in extension. Hume's project is different from the attempt made by Berkeley in some of his later writings to save Euclidean geometry. Unlike Berkeley, who interprets the theorems of Euclidean geometry as false albeit useful approximations of geometrical facts, Hume is able to save most of the central theorems as true. (shrink)

When Australia was circumnavigated by Europeans in 1801–02, French and British natural historians were unsure how to describe the Indigenous peoples who inhabited the land they charted and catalogued. Ideas of race and of savagery were freely deployed by both British and French, but a discursive shift was underway. While the concept of savagery had long been understood to apply to categories of human populations deemed to be in want of more historically advanced ‘civilisation’, the application of this term in (...) the late 18th and early 19th centuries was increasingly being correlated with the emerging terminology of racial characteristics. The terminology of race was still remarkably fluid, and did not always imply fixed physical or mental endowments or racial hierarchies. Nonetheless, by means of this concept, natural historians began to conceptualise humanity as subject not only to historical gradations, but also to the environmental and climatic variations thought to determine race. This in turn meant that the degree of savagery or civilisation of different peoples could be understood through new criteria that enabled physical classification, in particular by reference to skin colour, hair, facial characteristics, skull morphology, or physical stature: the archetypal criteria of race. While race did not replace the language of savagery, in the early years of the 19th century savagery was re-inscribed by race. (shrink)

Despite remarkable empirical and methodological advances, our theoretical understanding of the evolutionary processes that made us human remains fragmented and contentious. Here, we make the radical proposition that the cultural communities within which Homo emerged may be understood as a novel exotic form of organism. The argument begins from a deep congruence between robust features of Pan community life cycles and protocell models of the origins of life. We argue that if a cultural tradition, meeting certain requirements, arises in the (...) context of such a “social protocell,” the outcome will be an evolutionary transition in individuality whereby traditions and hominins coalesce into a macroscopic bio-socio-technical system, with an organismal organization that is culturally inherited through irreversible fission events on the community level. We refer to the resulting hypothetical evolutionary individual as a “sociont.” The social protocell provides a preadapted source of alignment of fitness interests that addresses a number of open questions about the origins of shared adaptive cultural organization, and the derived genetic adaptations that support them. Also, social cooperation between hominins is no longer in exclusive focus since cooperation among traditions becomes salient in this model. This provides novel avenues for explanation. We go on to hypothesize that the fate of the hominin in such a setting would be mutualistic coadaptation into a part-whole relation with the sociont, and we propose that the unusual suite of derived features in Homo is consistent with this hypothesis. David Lewis argued that Newcomb’s Problem and the Prisoner’s Dilemma are “one and the same problem” or, to be more precise, that the Prisoner’s Dilemma is nothing else than “two Newcomb problems side by side” (Lewis Philosophy and Public Affairs 8:235–240, 1979 : 235). It has been objected that his argument fails to take into account certain epistemic asymmetries which undermine the one-problem thesis. Sobel ( 1985 ) acknowledges that many tokens satisfy the structural requirements of both problems, while questioning (...) the generality of the thesis. Bermúdez (Analysis 73:423–429, 2013 ), on the other hand, argues that there is a deeper structural conflict between the two problems in the sense that the epistemic requirements that give Newcomb’s Problem its force are precisely those that prevent it from being a Prisoner’s Dilemma. I argue that the epistemic asymmetry objections raised by Sobel and Bermúdez fail to undermine the one-problem thesis. A different type of objection raised by Bermúdez, one which relies on the contrast between parametric and strategic choices, fares no better. Although NP is a problem that has been primarily studied for its implications to decision theory, it contains enough game theoretic elements to justify the claim that a juxtaposition of two such problems can be thought of as a strategic game. It has been argued that there is a genuine conflict between the views of geometry defended by Hume in the Treatise and in the Enquiry: while the former work attributes to geometry a different status from that of arithmetic and algebra, the latter attempts to restore its status as an exact and certain science. A closer reading of Hume shows that, in fact, there is no conflict between the two works with respect to geometry. The key to understanding Hume's view (...) of geometry is the distinction he draws between two standards of equality in extension. (shrink)

This thesis explores whether the three standard value relations, “better than”, “worse than” and “equally as good”, exhaust the possibilities in which things can relate with respect to their value. Or more precisely, whether there are examples in which one of these relations is not instantiated. There are cases in which it is not obvious that one of these relations does obtain; these are referred to as “hard cases of comparison”. These hard cases of comparison become interesting, since if it (...) not the case that the standard three value relations obtains in these cases then the three standard relations do not exhaust the possibility of instantiated value relations. It is argued that for some of the hard cases of comparison, the standard relations determinately obtain. For some it is indeterminate, due to vagueness, which of the three relations obtains, but it is determinate that one of them obtains. Thereafter it is argued that the influential Collapsing Argument fails in ruling out other accounts of the hard cases of comparison. Since one cannot depend on the Collapsing Argument in order to conclude that all items are related by the standard three relations, the investigation continues. It is argued that none of the hard cases of comparison are cases of incomparability. Furthermore, none of them are cases of a fourth basic positive value relation such as “parity”. Consequently, for all the hard cases of comparison one of the standard value relations holds, although sometimes we do not know which one and sometimes it is indeterminate which one holds. This means that there is no reason to assume that one of the standard three value relations does not hold between items we are comparing. This is followed by a brief discussion about the normative consequences of this result. The thesis ends with four different appendices in which related topics are discussed. (shrink)
