This book presents a philosophical analysis of the different forms of political resistance and protest. It explores the normative space of resistance that is beyond self-defense and civil disobedience, and proposes the concept of “resistance violence” as a separate and special normative category. Instances that fall under this category can be, accordingly justified, even if they prove to be practically ineffective, by appealing to their role in preserving or upholding the dignity of the resistors or those who they aim to (...) protect. It is not reducible to self-defense because it does not always involve protecting the life of the actor but, instead, is an expression of establishing one’s dignity and humanity. Applied to women as a vulnerable class in the face of sexual violence, this article looks at a case study of an enslaved teenager named Celia who killed her owner in order to end his sexual (...) abuse. Various philosophies of epistemic injustices (including Fricker, Pohlhaus, Medina, Dotson, Mills, and Card) establish that socially/politically dominant groups help create a context in which compartmentalization, active ignorance, and inconsistencies contribute to the conditions in which marginalized groups reside in spaces of little to no protection from the state. As such, resistance violence emerges as a legitimate option. Selective epistemic attention that fails to contextualize resistance violence supports unjust systems. (shrink)

We have a complicated, sometimes contradictory, perception of the use of political violence. This article discusses the possible legitimacy of a particular kind, referred to as “resistance violence,” or violence carried out by vulnerable targeted social groups. After providing distinctions regarding who, when, and why resistance violence happens, this article considers two examples that highlight different factors. By considering the work of various philosophers including Locke, Arendt, Fanon, and Fricker, this article proposes two theses: first, that epistemic contextualization requires that (...) the legitimacy of resistance violence always be evaluated with the understanding that vulnerable social groups often reside outside the parameters of legal/criminal/judicial protection. And, second, that resistance violence is a politically legitimate option and need not promise practical success to be worth pursuing due to the fact that resistance actors often see violence as establishing their dignity and humanity. Pet adoption from an animal rescue shelter would seem to be one of those indisputable things in life that only increases a person's positive karma. Kant spoke of morality residing in a good will and pure intention; saving a dog from being euthanized by providing it with a loving, secure home seems the living embodiment of that. Or so it would seem.

The debate between the Mendelians and the (largely Darwinian) biometricians has been referred to by R. A. Fisher as ‘one of the most needless controversies in the history of science’ and by David Hull as ‘an explicable embarrassment’. The literature on this topic consists mainly of explaining why the controversy occurred and what factors prevented it from being resolved. Regrettably, little or no mention is made of the issues that figured in its resolution. This paper deals with the latter (...) topic and in doing so reorients the focus of the debate as one between Karl Pearson and R. A. Fisher rather than between the biometricians and the Mendelians. One reason for this reorientation is that Pearson's own work in 1904 and 1909 suggested that Mendelism and biometry could, to some extent, be made compatible, yet he remained steadfast in his rejection of Mendelism. The interesting question then is why Fisher, who was also a proponent of biometric methods, was able to synthesise the two traditions in a way that Pearson either could not or would not. My answer to this question involves an analysis of the ways in which different kinds of assumptions were used in modelling Mendelian populations. I argue that it is these assumptions, which lay behind the statistical techniques of Pearson and Fisher, that can be isolated as the source of Pearson's rejection of Mendelism and Fisher's success in the synthesis. ABSTRACTTransitional justice encompasses a global body of scholarship and practice that concentrates on responses to large-scale wrongdoing in the context of an attempted shift from conflict and/or repression. In my book, The Conceptual Foundations of Transitional Justice I argue that transitional justice is a distinctive type of justice. Transitional justice requires the just pursuit of societal transformation. I define transformation relationally, as the terms defining interaction among citizens and between citizens and officials. Transformation is necessary because of the presence of (...) pervasive structural inequality and wrongdoing. Transformation is a practical possibility because of the uncertainty characteristic of transitions. Processes of transitional justice pursue transformation by dealing with past wrongs. The just pursuit of societal transformation requires heeding the moral claims of victims and moral demands on perpetrators. In this paper, I address four issues raised by Sirkku Hellsten, George Hull, Thaddeus Metz, and Margaret Urban Walker. I first discuss the methodological questions pressed. I then consider challenges to the substantive view of transitional justice I propose. I next turn to queries about the distinctiveness of transitional justice. Finally, I respond to skepticism about the necessity and value of a substantive normative theory of transitional justice. (shrink)

This paper is about “othering” in cyberspace. The roots of othering of non-Muslims in Saudi Arabia are seen in the perception of umma as special and superior, therefore automatically categorising “non-believers” as “other”. The in-group and out-group demarcation strategies and consequent marginalisation are considered from both perspectives as bilateral and mutually exclusive. The focus is placed on othering e-space, where marginalised voices can be heard via virtual communication. The effects of virtual reality on real life interaction and resulting involvement in (...) controversial and taboo topics are also discussed. This dissertation argues that corporate moral responsibility can be an element of functioning corporations and is a choice that society can make. Although many in the lay community would say that of course corporations should attend to moral questions, the philosophy of how this can be rightly said is controversial. Section one (first three chapters) gives an account of the nature of functioning business corporations involving the readily observable facts about a corporation doing business, and a tripartite model of the (...) corporation is presented. The tripartite model consists in 1) the legal entity that owns assets and liabilities, 2) a group of persons contracted to the legal entity and 3) a set of roles and relationships between the corporate associates and the legal entity. Additionally, an account of the main extant theories of the nature of corporations and their inability to account for the readily observable facts of corporations is argued. The conclusion is that the corporation, as a tripartite model, is best served by a theory that designates it as a real entity apart from but dependent on its employees. Chapter three answers the question, ‘What type of real entity is a corporation?’, using John Searle’s theory of social ontology to show that corporations are institutional facts, a social entity. The second part of the thesis argues that corporations have moral dispositions analogous to those held by natural persons and maintains that it is these that allow corporate entities to be capable of moral concern. A constitutive rule is introduced, ‘moral company rule’, that may be used as a guide for society to assess the extent of corporate moral responsibility. An account of the powers and responsibilities corporations would have if the moral company rule was followed is presented. Additionally, the dilemma for society, to insist on corporate moral responsibility or preserve the status quo, is explored. The last chapter recapitulates the argument for corporate moral responsibility to illustrate the two aims of this thesis: first to give a clear understanding of the functioning business corporation as a real entity with a series of moral dispositions, and second to show that society has a choice to insist that these moral dispositions are used in business. The ideal of value free science states that the justification of scientific findings should not be based on non-epistemic (e.g. moral or political) values. It has been criticized on the grounds that scientists have to employ moral judgements in managing inductive risks. The paper seeks to defuse this methodological critique. Allegedly value-laden decisions can be systematically avoided, it argues, by making uncertainties explicit and articulating findings carefully. Two meta-analyses of 66 behavioral studies examined variables influencing functional cerebral lateralization of each language of brain-intact bilingual adults. Functional lateralization was found to be primarily influenced by age of onset of bilingualism: bilinguals who acquired both languages by 6 years of age showed bilateral hemispheric involvement for both languages, whereas those who acquired their second language after age 6 showed left hemisphere dominance for both languages. Moreover, among late bilinguals, left hemisphere involvement was found to be greater for those (...) less proficient in their second language, those whose second language was English, and for studies involving dichotic listening paradigms; early bilinguals instead showed bilateral involvement in every condition. Implications of the observed differences in lateralization between early and late bilinguals are explored for existing theories of bilingualism and for neurocognitive models of brain functional organization of language. Reflective equilibrium (RE) is often regarded as a powerful method in ethics, logic, and even philosophy in general. Despite this popularity, characterizations of the method have been fairly vague and unspecific so far. It thus may be doubted whether RE is more than a jumble of appealing but ultimately sketchy ideas that cannot be spelled out consistently. In this paper, we dispel such doubts by devising a formal model of RE. The model contains as components the agent’s commitments and a (...) theory that tries to systematize the commitments. It yields a precise picture of how the commitments and the theory are adjusted to each other. The model differentiates between equilibrium as a target state and the dynamic equilibration process. First solutions to the model, obtained by computer simulation, show that the method allows for consistent specification and that the model’s implications are plausible in view of expectations on RE. In particular, the mutual adjustment of commitments and theory can improve one’s commitments, as proponents of RE have suggested. We argue that our model is fruitful not only because it points to issues that need to be dealt with for a better understanding of RE, but also because it provides the means to address these issues. As a central part of the regulation of contemporary economies, intellectual property (IP) is central to all aspects of our lives. It matters for the works we create, the brands we identify and the medicines we consume. But if IP is power, what kind of power is it, and what does it do? Building on the work of Michel Foucault, Gordon Hull examines different ways of understanding power in copyright, trademark and patent policy: as law, as promotion of public (...) welfare, and as promotion of neoliberal privatization. He argues that intellectual property policy is moving toward neoliberalism, even as that move is broadly contested in everything from resistance movements to Supreme Court decisions. Of special interest is the previously unpublished presidential address of Henry Walgrave Stewart, second president of the Pacific Division of The American Philosophical Association. The work contains the biographies, photographs, and addresses of 24 past presidents, (...) and photographs and addresses of others. No other publication has collected the presidential addresses of this, the largest society of philosophers, during its third decade of existence, and in no other publication are the biographies and photographs of all of its presidents available. Disagreement is a hot topic right now in epistemology, where there is spirited debate between epistemologists who argue that we should be moved by the fact that we disagree and those who argue that we need not. Both sides to this debate often use what is commonly called “the method of cases,” designing hypothetical cases involving peer disagreement and using what we think about those cases as evidence that specific normative theories are true or false, and as reasons for believing (...) as such. With so much weight being given in the epistemology of disagreement to what people think about cases of peer disagreement, our goal in this paper is to examine what kinds of things might shape how people think about these kinds of cases. We will show that two different kinds of framing effect shape how people think about cases of peer disagreement, and examine both what this means for how the method of cases is used in the epistemology of disagreement and what this might tell us about the role that motivated cognition is playing in debates about which normative positions about peer disagreement are right and wrong. This paper explores possible connections between gender and the willingness to engage in unethical business behavior. Two approaches to gender and ethics are presented: the structural approach and the socialization approach. Data from a sample of 213 business school students reveal that men are more than two times as likely as women to engage in actions regarded as unethical but it is also important to note that relatively few would engage in any of these actions with the exception of buying (...) stock with inside information. Fifty percent of the males were willing to buy stock with insider information. Overall, the results support the gender socialization approach. (shrink)

Humanity and the very notion of the human subject are under threat from postmodernist thinking which has declared not only the 'Death of God' but also the 'Death of Man'. History is useful when it is used properly: to understand why we and those we must deal with think and react in certain ways. It can offer examples to inform our decisions and guesses about the consequences of our actions. But we should be wary of looking to history for dogmatic lessons.We should distrust those who abuse history when they call on it to justify unreasonable claims to land, for example, or restitution.
