The notion that the application of basic rights requires “balancing” is widely and increasingly accepted. Balancing judgments are ever more frequently used in judicial decisions, particularly in constitutional courts and especially in contemporary supra-national human-rights courts. Many jurists deem that balancing is the only possible method to arrive to a rational decision in cases of conflict between basic rights. I assert that this kind of conflict between principles has the same structure of moral conflicts. And, as is the case with (...) moral conflicts, the way conflicts are solved will depend on the underlying concept of practical reasoning. I describe the two basic patterns that practical reasoning may follow in situations of conflict between moral principles in general and argue against the idea that balancing is the most appropriate procedure to cope with the conflict, either in general terms or in juridical argumentation in particular. Neste artigo avalio criticamente as diferentes tentativas de Mi-chael Smith e Bernard Williams de defender uma versão plausível da teo-ria da motivação humeana. Contra Smith, mantenho que a concepção disposicional dos desejos que defende não é apropriada, e que seu argu-mento fracassa porque ignora o papel que desempenham as condições da racionalidade nas explicações intencionais. Em relação a Williams, sustento que embora coloque corretamente um desafio contra qualquer perspectiva “racionalista” sobre a razão prática, seus argumentos não provam que a motivação (...) só possa ser entendida segundo esse modelo humeano melhorado que ele defende, e que sua posição não consegue dar conta plenamente do caráter normativo da motivação. Na parte final, desenvolvo as implicações dos argumentos de Smith e de Williams para a motivação moral e coloco em questão a plausibilidade de alguns de seus supostos básicos. (shrink)

This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the (...) conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

The objective of this paper is to reflect on the proper way for Christians to do philosophy, in respect of which I have been inspired by a phrase attributed to Cardinal Newman: “We do not need Christian philosophy. We need Christians making good philosophy.” This sentence can appear controversial, but I believe it is not, if its content is made explicit in an appropriate way. To better develop what I understand Newman to be proposing here, I have added another category (...) to his statement, with the consequence that my own text falls into three sections: 1) on Christian philosophy; 2) on Christian philosophers; 3) on Christians who do philosophy. This is the scheme that we will use to position ourselves as regards the complex issue of the relationship between philosophy and Christianity. (shrink)

Trabajar en las aulas la memoria histórica, como temática controvertida y que suscita debate social, es un reto de la enseñanza de las ciencias sociales. A nivel global han sido innumerables las acciones desarrolladas para que se recupere la memoria de aquellas personas silenciadas durante décadas, unidas a conflictos sociales y políticos. Sin embargo, existen pocas investigaciones que analicen los recursos didácticos que ofrecen las tecnologías digitales sobre la temática. En este trabajo se identifican cinco apps que tienen como eje (...) el Holocausto y se analizan sus posibilidades educativas y su tratamiento de la memoria histórica. El resultado apunta a que estas apps no presentan una arquitectura didáctica adecuada y proponen una función principalmente informativa, aunque poseen características específicas que permiten su uso en contextos educativos si se hace un buen uso de sus funcionalidades a través de una mediación adecuada. Respecto a la memoria, aunque presentan un tratamiento basado en testimonios y recuerdos individuales, obvian la necesidad de una metodología deliberativa que permita confrontar ideas y fomentar una actitud crítica ante la historia institucionalizada. We explore different ways in which the human visual system can adapt for perceiving and categorizing the environment. There are various accounts of supervised (categorical) and unsupervised perceptual learning, and different perspectives on the functional relationship between perception and categorization. We suggest that common experimental designs are insufficient to differentiate between hypothesized perceptual learning mechanisms and reveal their possible interplay. We propose a relatively underutilized way of studying potential categorical effects on perception, and we test the predictions of different perceptual (...) learning models using a two‐dimensional, interleaved categorization‐plus‐reconstruction task. We find evidence that the human visual system adapts its encodings to the feature structure of the environment, uses categorical expectations for robust reconstruction, allocates encoding resources with respect to categorization utility, and adapts to prevent miscategorizations. Canguilhem’s contemporary relevance lies in how he critiques the relation between knowledge and life that underlies Kantian rationality. The latter’s Critique of Pure Reason and Critique of Judgment represent life in the form of an exception: life is simultaneously included and excluded from understanding. Canguilhem’s critique can be grouped into three main strands of argument. First, his reference to concepts as preserved problems breaks with Kant’s idea of concepts regarding the living as a ‘unification of the manifold’. Second, Canguilhem’s vital (...) normativity represents life as the potential to resist normative orders that judge the living, relegating Kant’s ‘lawfulness of the contingent’ to a ‘mediocre regularity’. Third, Canguilhem’s introduction of the environment as a ‘category of contemporary thought’ decentres the living/knowing subject and introduces contingency. His idea of the ‘knowledge of life’ leads to the conclusion that life is the condition of possibility of rationality, rather than rationality’s ‘blind spot’. (shrink)

Criticism is a staple of the scientific enterprise and of the social epistemology of science. Philosophical discussions of criticism have traditionally focused on its roles in relation to objectivity, confirmation, and theory choice. However, attention to criticism and to criticizability should also inform our thinking about scientific pursuits: the allocation of resources with the aim of developing scientific tools and ideas. In this paper, we offer an account of scientific pursuitworthiness which takes criticizability as its starting point. We call this (...) the apokritic model of pursuit. Its core ideas are that pursuits are practices governed by norms for asking and answering questions, and that criticism arises from the breach of these norms. We illustrate and advertise our approach using examples from institutional grant review, neuroscience, and sociology. We show that the apokritic model can unify several indices of criticizability, that it can account for the importance of criticizing pursuits in scientific practice, and that it can offer ameliorative advice to erstwhile pursuers. We offer a new account of the role of values in theory choice that captures a temporal dimension to the values themselves. We argue that non-epistemic values sometimes serve as “inquiry tickets,” justifying scientists’ pursuit of certain questions in the short run, while the answers to those questions mitigate transient underdetermination in the long run. Our account of inquiry tickets shows that the role of non-epistemic values need not be restricted to belief or acceptance in order to be relevant to (...) hypothesis choice: the relevance of non-epistemic values to a particular cognitive attitude with respect to h vary over time. Marina McCoy explores Plato's treatment of the rhetoric of philosophers and sophists through a thematic treatment of six different Platonic dialogues, including Apology, Protagoras, Gorgias, Republic, Sophist, and Phaedras. She argues that Plato presents the philosopher and the sophist as difficult to distinguish, insofar as both use rhetoric as part of their arguments. Plato does not present philosophy as rhetoric-free, but rather shows that rhetoric is an integral part of philosophy. What, if anything, do the ‘square’ protests and ‘occupy’ movements of 2011 bring to contemporary democratic theory? And how can we, as political theorists, analyse their discourse and do justice to it? We address these questions through an analysis of the Greek and Spanish protest movements of the spring and summer of 2011, the so-called aganaktismenoi and indignados. We trace the centrality of the critique of representation and politics as usual as well as the ideas about horizontality and autonomy in (...) the protesters’ discourse. These ideas are not only important to their critique of the contemporary liberal democratic regimes in the two countries, but also important to the way in which the protesters organise themselves. Nonetheless, as we shall argue, the protesters are caught within a tension between horizontality and verticality, between autonomy and hegemony, or between moving beyond representation and accepting representational structures. Given this tension, we examine how the protesters negotiate it in three key areas: politics, representation and organisation. Drawing on Jacques Rancière, we further argue that the protesters can be seen as making a claim to equal voice. This is what Rancière refers to as politics proper, and the question is then whether such a politics is possible without falling back into traditional forms of politics. (shrink)

Phantasmagoria explores ideas of spirit and soul since the Enlightenment; it traces metaphors that have traditionally conveyed the presence of immaterial forces, and reveals how such pagan and Christian imagery about ethereal beings are embedded in a logic of the imagination, clothing spirits in the languages of air, clouds, light and shadow, glass, and ether itself. Moving from Wax to Film, the book also discusses key questions of imagination and cognition, and probes the perceived distinctions between fantasy and deception; it (...) uncovers a host of spirit forms--angels, ghosts, fairies, revenants, and zombies--that are still actively present in contemporary culture. It reveals how their transformations over time illuminate changing ideas about the self. Phantasmagoria also tells the accompanying story about the means used to communicate such ideas, and relates how the new technologies of the Victorian era were applied to figuring the invisible and the impalpable, and how magic lanterns (the phantasmagoria shows themselves), radio, photography and then moving pictures spread ideas about spirit forces. As the story unfolds, the book features the many eminent men and women--scientists and philosophers--who in the Society of Psychical Research applied their considerable energies to the question of other worlds and other states of mind: they staged trance seances in which mediums produced spirit phenomena, including ectoplasm. Major proponents of both Distributed Cognition and Predictive Processing have argued that the two theoretical frameworks are strongly compatible. An important conjecture supporting the union of the two frameworks is that cultural practices tend to reduce entropy —that is, to increase predictability— at all scales in a cultural cognitive ecosystem. This conjecture connects Distributed Cognition with Predictive Processing because it shows how cultural practices facilitate prediction. The present contribution introduces the following challenge to the union of Distributed Cognition and Predictive (...) Processing: the problem of entropic cultural practices. The problem lies in the existence of multiple cultural practices that tend to increase entropy instead of reducing it. This paper discusses these entropic cultural practices and the nature of the problem at hand. Finally, the paper advances an expanded conception of cultural practices that could unite the two frameworks and explores the difficulties of committing to such a conception. (shrink)

The philosopher Lev Shestov aimed to establish a new free way of thinking, which manifested itself as a struggle against the delusion that we have a rational grasp of the necessary truths on matters that are of the greatest importance to us, such as the questions of life and death. Philosophy, as the Russian philosopher understood it, is not pure thinking, but ‘some kind of inner doing, inner regeneration, or second birth’ (Shestov in Lektsii po Istorii Grecheskoi Filosofii [Lectures on (...) the history of Greek philosophy], YMCA-PRESS, Moscow, 2001, p. 53). Having adopted the notion of the ‘regeneration of one’s convictions’ from Dostoevsky’s vocabulary in his earlier works, Shestov developed the idea of ‘awakening’ further in his mature thought, in which the motif of ‘awakening’ comprised one of the main ideas of his philosophy: the fight for the individual’s right to freedom and to creative transformation at a time when she is in despair or on the brink of death. In this article, I analyse Shestov’s idea of ‘awakening’ as one of the key tropes and developmental characteristics of his philosophical vision. In particular, I argue that, having stemmed from Shestov’s earlier interpretations of Dostoevsky, Shakespeare and Plotinus, in his later writings, the notion of ‘awakening’—the possibility of a fundamental, inner transformation of one’s worldview (probuzhdenie, pererozhdenie)—marked the beginning of a new salvific mode in his writing. We argue for a new conventionalism about many kinds of evolutionary groups, including clades, cohesive units, and populations. This rejects a consensus, which says that given any one of the many legitimate grouping concepts, only objective biological facts determine whether a collection is such a group. Surprisingly, being any one kind of evolutionary group typically depends on which of many incompatible values are taken by suppressed variables. This is a novel pluralism underlying most any one group concept, rather than a (...) familiar pluralism claiming many concepts are legitimate. Consequently, we must help biological facts determine grouphood, even when given a single grouping concept. (shrink)

New technology develops with little attention to its impact upon human values. In particular, let us do what we can in this era of “the computer revolution” to see that computer technology advances human values. True enough, we could argue endlessly over the meanings of terms like “privacy,” “health,” “security,” “fairness,” or “ownership.” Philosophers do it all the time – and ought to. But people understand such values well enough to desire and even to treasure them. We do not need (...) absolute clarity or unattainable unanimity before we do anything to advance them. Professional groups are both technical and moral communities because in order to be self-regulatory the members must set shared goals and specify appropriate ways to achieve them. In order to specify these appropriatestandards it is necessary to detail what types of behavior are ethically acceptable or not. The three most important functions of a code, he notes, identify different types of codes. Codes are either primarily (1) aspirational, giving ideals to strive for, (2) educational, intending to educate or socialize some constituency, or (3) regulatory, hoping to sanction violations of the standards. Most codes are intended to achieve all three aims to some degree, but a careful examination may reveal a concentration upon one of these. Advancements in computer technology over the past twenty years have created ethical dilemmas, some similar toother professions and some unique to the computer field. Because of the questions that have been raised, and in some instances sensational news accounts of computer irregularities, including fraud, there is a growing perception that self-regulation may be the only means by which the computer professional associations will prevent governments from intervening to regulate the computer profession. Drawing on conservation of resources theory, this study examines the curvilinear relationship between harmonious and obsessive work passion and organizational citizenship behavior as well as the moderating effect of collectivistic values. Using 233 paired supervisor-employee responses from Russia, I found that harmonious work passion and OCB are positively related up to a point, after which higher levels of harmonious work passion are associated with declining OCB. The main curvilinear effect of obsessive work passion on OCB was not significant. Collectivistic values (...) were found to significantly interact with obsessive work passion but not harmonious work passion in the way they affect OCB. Employees who score high on collectivistic values tend to engage more in OCB than those who score low on collectivistic values. Interestingly, at low levels of collectivism, the inverted U-shaped curve illustrates the relations between obsessive passion and OCB changes into a U-shaped curve, suggesting that the highest engagement in OCB will no longer be observed at intermediate levels of obsessive work passion but rather at its lowest and highest levels. The findings contribute to work passion research and suggest that curvilinear rather than linear relationships may exist between work passion and work outcomes, which may account for the existing inconsistencies in the previous studies in regards to whether work passion-outcomes relationships are either positive or negative. ABSTRACT This paper reconstructs the Arendtian genealogy of the extreme forms of violence, taking desingularization processes as its guiding thread, with a twofold goal: on the one hand, to analyze the historical (dis)continuities of that genealogy, that goes beyond the physical-instrumental dimension of violence and comes into connection with the (de)configuration of personal identity; on the other hand, to claim the validity of Arendt's work to explore the echoes of that violence, without losing sight of its current specificity. Entre enero y febrero de 1970, el norteamericano Saul Kripke impartió tres importantes conferencias en la Universidad de Princeton que posteriormente se publicaron bajo el titulo de El nombrar y la necesidad. En dichas conferencias el autor, además de hacer una fuerte crítica a las teorías descripcioncitas, abordó temas de primer orden, como son el de los nombres, la referencia, la rigidez, la modalidad y la necesidad. A partir, de sus tres conferencias, y del artículo “Identidad y necesidad” publicado un (...) año después (1971), abordaremos aquí cuatro puntos, a saber: 1) La necesidad e identidad en las teorías de la referencia directa, 2) Designadores rígidos y mundos posibles, 3) Bautizo inicial, 4) el nombrar y la necesidad. En Mi visión de la filosofía, Friedrich Waismann afirma que un verdadero problema filosófico radica, no en darle solución, sino en encontrarle sentido, de modo que la tarea de la filosofía está en suministrar comprensión. Esto no sería posible si quien se hace una pregunta no da un giro en su manera de pensar para ver las cosas de modo distinto. Con esto en mente, para ayudarle a quien pregunta a dar este giro es necesario orientarlo con el fin de (...) que cruce la brecha de la demostración: hay que darle una discusión, no una prueba; es decir, no debe hostigársele pidiéndole que dé una respuesta, sino que debe pedírsele que considere pacientemente su pregunta. La intención no es, pues, resolver un problema, sino cambiar la actitud de quien pregunta, de lo cual se espera que se disuelvan los falsos problemas y, con base en enunciados claros y bien construidos, la filosofía pueda avanzar en sus argumentos de alguna forma. : This article presents a definition of action that links empirical facts with normative reasons to form an explanation of rational agency with predictive capabilities. This idea is developed along the lines of pragmatism which holds that a set of beliefs is a matter of linguistic evaluation from a particular community. This notion is related to the idea of facts as empirical information that is cognitively apprehended. Such information is regarded as an input which is later contrasted to expected behavioral (...) responses from the agent. The deviation of such observed behavior with respect to the expected one represents an evaluative output that is understood as the definition of reasonably expected behavior. Action is, thus, understood as the outcome of such an evaluative process. (shrink)
