This is a case study on a series of at least thirty-four sixteenth-century notebooks from the Sloane collection, which reconsiders early modern note taking techniques and the organisation of knowledge. These notebooks were written by an anonymous compiler, a physician who read widely in the alchemical and medical literature available in his lifetime, the late sixteenth century. In the alchemica, he devotes individual volumes to specific alchemical substances, which are connected with each other by means of a complex system of (...) cross-referencing; they are constantly revised and change appearance according to the physician's latest ideas about alchemical medicines. As a result, the notebooks not only preserve received information — they also represent an equivalent to the alchemical workshop, where the combination of different textual elements generates knowledge. What happens when human beings fail to do as reason bids? This book is an attempt to address this age-old question within Kant’s mature practical philosophy, i.e. the practical philosophy that emerged with the watershed discovery of autonomy in the mid-1780s. As always, Kant is good for a surprise. There is, it is argued, not one answer but two: he advocates Socratic intellectualism in the realm of prudence whilst defending an anti-intellectualist or volitional account of immoral action. This ‘hybrid’ theory (...) of practical failure is more than a philosophical curiosity. There are ramifications for Kant’s theory of practical reason as a whole. In particular, the hybrid account emphasizes the divide between pure and empirical practical rationality to the extent that the latter, while containing practically relevant propositions, no longer counts as a branch of practical reason at all. Hypothetical and categorical imperatives exemplify two entirely distinct kinds of normativity. In fact, the dichotomy between pure and empirical determining grounds of the will goes hand in hand with many other dualisms and dichotomies that, whether we like them or not, continue to define Kant’s mature ethical thought. Any system for the protection of intellectual property rights (IPRs) has three main kinds of distributive effects. It will determine or influence: (a) the types of objects that will be developed and for which IPRs will be sought; (b) the differential access various people will have to these objects; and (c) the distribution of the IPRs themselves among various actors. What this means to the area of pharmaceutical research is that many urgently needed medicines will not be developed at all, (...) that the existing medicines will not be suitable for countries with a precarious health infrastructure or not target the disease variety that is prevalent in poorer regions. Such effects are commonly captured under the rubric of the “10/90 gap” in biomedical research. High prices will also restrict access to medicines as well endanger compliance to treatment schemes. IPRs are mainly held by multinational corporations situated in the developed world, which not only raises egalitarian concerns, but also severely limits the possibilities of companies in poorer countries to realize improvements on existing inventions, as they cannot financially afford to secure freedom to operate, which systematically shrinks the number of potential innovators. Those inequities lead to an enormous burden for the global poor and since no institution is willing to assume the responsibility to fulfil the right to health and the corresponding right of access to essential medicines, we have to analyse alternatives or additions to the actual intellectual property regimes in order to create new incentives to fill this gap. This article supports calls for an increased integration of patients into taxonomic decision making in psychiatry by arguing that their exclusion constitutes a special kind of epistemic injustice: preemptive testimonial injustice, which precludes the opportunity for testimony due to a wrongly presumed irrelevance or lack of expertise. Here, this presumption is misguided for two reasons: the role of values in psychiatric classification and the potential function of first-person knowledge as a corrective means against implicitly value-laden, inaccurate, or incomplete diagnostic criteria (...) sets. This kind of epistemic injustice leads to preventable epistemic losses in psychiatric classification, diagnosis, and treatment. (shrink)

Wszalek offers a detailed examination of the challenges involved in assisting people with language and communication impairments in the comprehension of legal language and concepts (LLC). If we settle for a minimum threshold of LLC comprehension, we are likely to observe that some people will not meet this threshold due to personal choices, such as not having practiced reading sufficiently or having avoided intellectually stimulating social interactions.

Section I of Kant's Groundwork of the Metaphysics of Morals is meant to lead us from our everyday conception of morality to the supreme principle of all moral action, officially christened the ‘categorical imperative’ some twenty Academy pages further into the treatise. It is quite striking that in this first section Kant dispenses with the notorious technical language that pervades not just other parts of the Groundwork but also most of the remaining philosophical writings of the critical period. The mere (...) fact that Groundwork I is comparatively accessible does not, of course, make it straightforward or uncontroversial. Kant's readers are faced with, amongst other things, four unconvincing paragraphs on the natural purpose of practical reason (G IV 394–6), a crucial change of topic from good volition to acting from duty (G IV 397), an unstated ‘first proposition’ about moral value that has baffled generations of interpreters (presumably G IV 397–9), and a contentious shift from an allegedly unproblematic principle of practical universalizability to a substantive moral command (G IV 402). There have been few empirical studies into what non-medical factors influence physicians and nurses when deciding about admission and discharge of ICU patients. Information about the attitudes of healthcare professionals about this process can be used to improve decision-making about resource allocation in intensive care. To provide insight into ethical problems that influence the ICU admission and discharge process, we aimed to identify and explore ethical dilemmas healthcare professionals are faced with.

In this paper, I explore two closely related ethical principles, ‘Ought implies Can’ and the Kantian ‘Du kannst, denn du sollst’ . The former principle is mainly used to diffuse moral dilemmas and other problem cases. Possibility is a necessary condition of obligation. Recent criticism notwithstanding, the principle is shown to be defensible and useful in the case of genuine, action-guiding oughts. The latter principle makes use of the former, but it in addition presupposes the validity of a moral command (...) and on that basis concludes that the agent must be able to act accordingly. ‘Du kannst, denn du sollst’ has its roots in Kantian ethics: the firm consciousness of moral necessity serves as the ratio cognoscendi of human freedom. The principle is mainly directed against metaphysical scepticism turning on the validity of natural determinism. It is doubtful whether many non-Kantians would be willing to support it in its original metaphysical incarnation. (shrink)

International negotiations on anthropogenic climate change are far from running smoothly. Opinions are deeply divided on what are the respective responsibilities of developed and developing countries with regard to the reduction of greenhouse gas emissions and the alleviation of the negative effects of global warming. A major bone of contention concerns the role of intellectual property rights (especially patents) in the development and diffusion of climate-friendly technologies. While developing countries consider IPRs as a formidable barrier to the rapid transfer and (...) the widest possible diffusion of such technologies, developed countries, by contrast, see IPRs as a vital prerequisite for the development and transfer of these same technologies. This debate shows some similarity with the earlier debate on patents and access to lifesaving medicines, although there are also important differences. In our contribution we will explore both the analogies and the differences with this earlier debate. To provide a focus for our discussion, we will examine whether something similar to the Health Impact Fund (HIF), which has been proposed by philosopher Thomas Pogge as a reasonable solution to the ethical dilemmas of protection and accessibility in the field of pharmaceuticals, can also be elaborated for the development and diffusion of climate-friendly technologies. Thus the central question is how an analogous ‘Climate Impact Fund’ would look like and how it would work. This whole exercise will also yield a normative yardstick for assessing the various designs for a Green Climate Fund or a Technology Mechanism that are currently on the table of the international climate negotiations. Islamic education, from a holistic point of view, is more than just the direct transmission of the pure Islamic sciences. It encompasses other branches of specialisation and ideally accompanies Muslims, through reflections of the Islamic worldview, during their formal and informal formation. This paper reflects how, in the contemporary tertiary education in the Islamic world, commodified concepts stemming from a non-Islamic worldview are being proliferated, and what the expected results are for Muslim students. The paper expounds on differences in worldview (...) and educational systems and the commodification of ideas. It gives examples from business school curricula, psychology and the impact of teaching in a foreign language, to summarise intended consequences on the students’ educational developments. It also shows how the agency of the theory of Maqāṣid, the higher objectives of Islamic law, has immersed Islamic thought in reaction to the bias in the educational system. (shrink)

The reception and revival of Ibn Rušd in the Arab world of the 20th century provides a profound insight into the efforts of prominent Arab intellectuals to redefine Islamic culture and reveals the possibilities and limits of a dialogue with the West.

In this paper I will analyze several cases from the American Civil War, the two World Wars and the American Vietnam War, and contemporary research in enhancement substance, to determine how drug use can be analyzed and understood in both physical and moral (ethical) terms. This will require a discussion of drug use at different levels. First, I will address the consequences of drug use for the physical and mental sanity of soldiers, during and after wartime, irrespective of the reason (...) for drug use. Second, I will look into the moral questions related to drug use for the enhancement of soldiers, that is, as a method for modern warfare. The moral dimension has at least two different angles: (i) the moral responsibility of superiors administering drugs to their inferiors who are exposed to the rule of full obedience, and (ii) the ethical consequences of enhancement for moral judgment by soldiers in the gray zone between acts of war and war crimes (the difference between the Super soldier and the Killing machine). So-called climate-ready GM crops can be of great help in adapting to a changing climate. Climate change, caused in great part by anthropogenic greenhouse gases released in the atmosphere since the industrial revolution by the developed world, is felt much stronger in the developing world, causing unexpected droughts and floods that will cause large harvest loss, leading to more hunger and malnutrition, rising death tolls and disease vulnerability. The current intellectual property regime (IPR) strikes an unfair balance between profit oriented (...) seed industry giants and low-acreage farmers. The biotechnology industry, mainly headquartered in the developed world, has started to patent new seed varieties, taking biomaterials from developing countries, with the claim, that they will be more tolerant to flood, drought, heat, and cold. Special sales contracts prohibit saving seeds from the harvest for the next season, thus forcing the farmers to buy them every season anew, which goes against traditional farming. Using a widely accepted concept of global justice, that tackles the fact that around 10% of the world's population profits from 90% of the earth's resources, and by taking into account the feasibility of a fair IPR, we will discuss three issues. First, an ethically acceptable IPR should prevent unjust and unfair assignments of property rights (e.g. patents) that completely ignore small-scale farmers inventiveness and efforts to save agrobiodiversity. As a second task, this regime should encourage globally a just distribution of the objects of innovation that are covered by patents. Third, such a regime should encourage innovations at a rate that is effective to cope with climate change. (shrink)

While Gabriel Watts and Ainsley Newson argue that diagnostic laboratories do not have a general duty to routinely reinterpret genomic variant classifications, they do formulate several restricted duties to actively reinterpret specific types of classifications.1 They place these duties with laboratories, acknowledging that they are setting aside any responsibilities that might arise for clinicians. Here, we will discuss the implications of this obligation for clinicians and the moral tension it may confront them with. We focus in particular on the consequences (...) of the proposed moral obligation to actively reinterpret variant classifications that carry a higher risk of being false positives. Such reclassification is likely to result in ‘downgrades’: previously pathogenic variants (pathogenic/likely pathogenic, P/LP) reclassified to benign (likely benign/benign, LB/B) or uncertain variants (variant of uncertain significance, VUS). Any laboratory policy to actively reinterpret (specific sets of) classifications will confront the clinician with the question whether the person tested should be recontacted on a reinterpretation of previously reported results. As others have pointed out, recontacting in general comes with challenges, since patients may not want to be recontacted or have forgotten about their genetic test.2 3 Recontacting in case of a downgrade, however, is particularly impactful. Ethical evaluation of deep brain stimulation as a treatment for Parkinson’s disease is complicated by results that can be described as involving changes in the patient’s identity. The risk of becoming another person following surgery is alarming for patients, caregivers and clinicians alike. It is one of the most urgent conceptual and ethical problems facing deep brain stimulation in Parkinson’s disease at this time. In our paper we take issue with this problem on two accounts. First, we elucidate what is (...) meant by “becoming another person” from a conceptual point of view. After critically discussing two broad approaches we concentrate on the notion of “individual identity” which centers on the idea of “core attitudes”. Subsequently we discuss several approaches to determine what distinguishes core attitudes from those that are more peripheral. We argue for a “foundational-function model” highlighting the importance of specific dependency relations between these attitudes. Our second aim is to comment on the possibility to empirically measure changes in individual identity and argue that many of the instruments now commonly used in selecting and monitoring DBS-patients are inappropriate for this purpose. Future research in this area is advised combining a conceptual and an empirical approach as a basis of sound ethical appraisal. (shrink)
