Marx and Rawls seems to have a very different concept of justice. Marx argued that the concept of justice functions in the performance of the dominant ideological mode of production required for the conduct, as universally binding legal code. Rawls is argued that justice is the first virtue of social institutions, its law may be recognized by all such people: they are fair and reasonable to discuss the issue is how to equitably divide among themselves the burden of social cooperation (...) and interests. Although embodied in Marx and Rawls an important difference between the various positions still exist, but I believe that the concept of justice is obviously two different positions, is able to reconcile. Despite the different effects of Hegel and Kant, Marx and Rawls's view can still show the same place. In a clear political concept of justice, Rawls believes that acceptable principles of justice, must be in the social system can be implemented. This led to his "Kantian constructivism", close to Hegel's view, at this point, Marx laid him on the universal, social rejection of a priori principles of justice. I believe that both Marx and Rawls are asked, and what can be seen as a social system to achieve the principles of justice as fairness. However, during which there are two important differences. First, Marx's vision, seems to be a Hume and Rawls beyond the so-called "environmental justice" society, while Rawls , the social environment beyond the justice is utopian. Secondly, Marx believed that, as the social basis of market relations should be exceeded, because the relationship between these markets to include the producers of natural and social process of production of the products of labor and social alienation. Although environmental justice in the society beyond the market's demise may be, Rawls was declared to be a just solution in the competitive demands of any society, the demise of the market are not. I believe that, if Marx's rejection of the market, as a fundamental denial "commodity fetishism", then the position of Marx and Rawls will be able to reconcile. The author concludes that, in addition to Marx's concept of the future classless society with the ideal ingredients, capitalism and the market in the concept of justice, Marx and Rawls's position is very close. Man and Raids appear to have quite different views at justice. Marx claims that the concept of justice functions ideologically to represent conduct required by the prevailing mode of production as universally binding imperatives. Rawls claims that justice is the first virtue of society, whose principles may be agreed to by all persons who impartially and rationally deliberate on the issue of fairly dividing the burdens and benefits of social cooperation. I argue that these apparently different positions on justice can be reconciled, although important differences between the standpoints of Marx and Rawls remain. Despite the differing influences on them of Hegel and Kant, the views of Marx and Rawls can be shown to converge. In proposing an explicitly political conception of justice, Rawls argues that acceptable principles of justice must be realisable in social institutions. This brings his' Kantian constructivism 'closer to the Hegelian view, on which Marx bases his rejection of universal, socially transcendent principles of justice. I argue that both Marx and Rawls can be seen as asking what social institutions can realise principles of justice as fairness. Nevertheless, two important differences remain. Marx seems to envisage a society which transcends the 'circumstances of justice', as specified by Hume and Rawls, whereas Rawls a society beyond the circumstances of justice as utopian. Secondly, Marx claims that market relations should be transcended as the basis of society, since they inherently involve alienation of producers from the social process of production and from the product of their social labour. However, while elimination of markets might be possible in a society that transcends the circumstances of justice, Rawls claims that it is not possible in any society where a fair resolution of competing claims is necessary. I argue that the positions of Marx and Rawls can be reconciled if we take Marx's objection to markets as fundamentally an objection to the 'fetishism of commodities'. I conclude that, apart from the utopian element in Marx's conception of a future classless society, the positions of Marx and Rawls on the justice of capitalism and the market are quite close. This essay performs a comparative reading of the themes of language, otherness and subjectivity in the work of Emmanuel Levinas and Jacques Lacan. Their focuses on the place and role of an ethical subjectivity who is profoundly affected and displaced by the (non)presence of the absolute Other provide apt philosophical material for comparison and contrast. Through a close analysis of the important philosophical and psychoanalytic themes in Levinas’ early work Totality and Infinity and Lacan’s Seminar VII: The Ethics of Psychoanalysis, (...) I demonstrate how the different articulations of alterity in both influence their separate conceptions of the possibility of ethics in relation to decentered notions of subjectivity. In reading both, I argue that Lacan’s treatment of otherness and the eccentric nature of language provides a reimaging of certain gaps in Levinas. In return, I position Levinas as being able to provide a notion of ethical community that Lacan leaves out. (shrink)

In his lecture course on Hölderlin's hymn “The Ister,” Heidegger makes a striking claim about translation which implies that the paradigm of translation can never be encapsulated by a passive substitution of one linguistic signifier for another, for what is involved is no less than the stance the translator takes within his original language as unconcealment, and how he ex-sists toward the other language as the site of another revelation. If the human being and Being belong together by the happening (...) of Ereignis in the way beings presence through language, the hermeneutical event of translation as unfolding, not only within history but also toward that which opens up historical understanding, grounds his entire authentic comportment toward this unconcealment. This article will argue that translation provides a useful correlative through which we can understand Ereignis as appropriative event. (shrink)

This essay compares the poetic and political theories of contemporary philosopher Giorgio Agamben with the poetry of Wallace Stevens in order to outline a dynamic of ‘inoperativity’ that foregrounds the intimate relationship between language, form and an existential expression of possibility. Through a reading of Stevens’s prose essays and poetry, I demonstrate how Agamben’s reconceptualization of potentiality as a power kept in a non-relational relationship towards its formal realization can be mapped onto the self-conscious articulations of Stevens’s poetic speakers who (...) employ poetic tropes and forms only to question and expose their claims to truth and foundationality. Rather than follow a tradition of poststructuralist readings of Stevens’s destabilizations, I argue for a framework of ‘inoperativity’ that preserves Stevens’s poetic attitude towards life, while showing how his emphasis on potentiality delineates an imaginative vigour that brings the poetic self into renewed attunement with his or her environment. In this article, I explore the impact of disability on one of life’s goods: achievement. Contra Campbell, Nyholm, and Walter, I argue that construing the magnitude of achievements in terms of subjective effort trivializes what it means to achieve. This poses a problem for the authors’ argument that disability, in general, does not reduce access to this good. I draw on an alternative construal of achievement that I have proposed elsewhere in order to show that, indeed, many disabilities do not (...) restrict access to achievement. I defend this argument against an objection that it problematically relativizes the achievements of persons with disability, and I close with general lessons for future work. (shrink)

This paper explores the ethical and conceptual implications of the findings from an empirical study (reported elsewhere) of decision-making capacity in anorexia nervosa. In the study, ten female patients aged thirteen to twenty-one years with a diagnosis of anorexia nervosa, and eight sets of parents, took part in semistructured interviews. The purpose of the interviews was to identify aspects of thinking that might be relevant to the issue of competence to refuse treatment. All the patient-participants were also tested using the (...) MacArthur Competence Assessment Tool—Treatment test of competence. This is a formalized, structured, interviewer-administered test of competence, which is a widely accepted clinical tool for determining capacity. The young women also completed five brief, self-administered questionnaires to assess their levels of psychopathology. The issues identified from the interviews are described under two headings: difficulties with thought processing and changes in values. The results suggest that competence to refuse treatment may be compromised in people with anorexia nervosa in ways that are not captured by traditional legal approaches. (shrink)

In days past, epistemologists expended a good deal of effort trying to analyze the basing relation—the relation between a belief and its basis. No satisfying account was offered, and the project was largely abandoned. Younger epistemologists, however, have begun to yearn for an adequate theory of basing. I aim to deliver one. After establishing some data and arguing that traditional accounts of basing are unsatisfying, I introduce a novel theory of the basing relation: the dispositional theory. In two recent papers, Mr Robert Young maintains that all attempts by philosophers to bolster the-violation-of-law concept of miracles are bound to fail and propounds what he claims to be a novel non-reductivist concept of miracles which avoids the conceptual difficulties of the violation-model. His view of miracles is of god being ‘an active agent-factor in the set of factors which actually was causally operative’ [p. 123] in an event dubbed a miracle. God is put in among ‘the plurality of (...) causes’ [p. 122, S p. 33] that could determine the event, but if he acts in a miracle, then ‘his presence…alters the outcome from what it would have been if, contrary to fact , he had not been present’ [p. 122]. Young claims that his concept ‘is neither a violation of … laws nor is it a coincidental occurrence religiously interpreted’ [p. 122, S p. 33], and so it avoids the difficulties, which he thinks are faced by the violation-model, of having an intelligible notion of an occurrence of the physically impossible, and also the reductivism inherent in taking mere coincidences as miracles. He also suggests a procedure of settling the epistemological issue regarding particular alleged miracles, an inquiry he thinks he has made possible by having first given a sense to miracles. What is social entrepreneurship? In, particular, what’s so social about it? Understanding what social entrepreneurship is enables researchers to study the phenomenon and policy-makers to design measures to encourage it. However, such an understanding is lacking partly because there is no universally accepted definition of entrepreneurship as yet. In this paper, we suggest a definition of social entrepreneurship that intuitively accords with what is generally accepted as entrepreneurship and that captures the way in which entrepreneurship may be altruistic. Kant conceived of 'critique' as a kind of winnowing exercise, with the aim of separating the wheat of good metaphysics from the chaff of bad. He used a less familiar metaphor to make this point, namely, that of 'the fiery test of critique'-not a medieval ordeal of trial by fire, but rather a metallurgical assay, or cupellation, a procedure in which ore samples are tested for their precious-metal content. When seen in this light, critique has a positive, investigatory side: it (...) seeks not merely to eliminate bad, 'dogmatic' metaphysics but also to uncover what of philosophical value might be contained in traditional speculative metaphysics. Many epistemologists have recently defended views on which all evidence is true or perceptual reasons are facts. On such views a common account of basic perceptual reasons is that the fact that one sees that p is one’s reason for believing that p. I argue that that account is wrong; rather, in the basic case the fact that p itself is one’s reason for believing that p. Most contemporary theorists regard the traditional thesis that perception is essentially conscious as just another armchair edict to be abandoned in the wake of empirical discovery. Here I reconsider this dramatic departure from tradition. My aim is not to recapture our prelapsarian confidence that perception is inevitably conscious (though much I say might be recruited to that cause). Instead, I want to problematize the now ubiquitous belief in unconscious perception. The paper divides into two parts. Part One is more purely (...) philosophical. It explains how standard arguments for unconscious perception rely on contentious background assumptions concerning the relation between ordinary perception and the explanatory constructs of scientific psychology. Part Two, in contrast, offers detailed engagement with relevant empirical work. It exposes how, even setting aside the concerns identified in Part One, a dilemma confronts the believer in unconscious perception. This dilemma arises because ordinary perception is an individual-level state or occurrence, yet criteria sufficiently stringent to guarantee that a putatively perceptual state is unconscious vitiate the grounds for its attribution to the individual. The dilemma foments a hypothesis, namely that the conditions for genuine, individual-level perception are sufficient conditions for perceptual consciousness. The viability of this hypothesis should unnerve anyone who thinks unconscious perception is simply an empirical given. (shrink)

Philosophers have lately seized upon Sperling's partial report technique and subsequent work on iconic memory in support of controversial claims about perceptual experience, in particular that phenomenology overflows cognitive access. Drawing on mounting evidence concerning postdictive perception, I offer an interpretation of Sperling's data in terms of cue-sensitive experience which fails to support any such claims. Arguments for overflow based on change-detection paradigms (e.g. Landman et al., 2003; Sligte et al., 2008) cannot be blocked in this way. However, such paradigms (...) are fundamentally different from Sperling's and, for rather different reasons, equally fail to establish controversial claims about perceptual experience. (shrink)

A great achievement makes one’s life go better independently of its results, but what makes an achievement great? A simple answer is—its difficulty. I defend this view against recent, pressing objections by interpreting difficulty in terms of competitiveness. Difficulty is determined not by how hard the agent worked for the end but by how hard others would need to do in order to compete. Successfully reaching a goal is a valuable achievement because it is difficult, and it is difficult because (...) it is competitive. A primary aim of our research was to provide empirical grounds on which to stimulate discussion about the nature of decision-making capacity (DMC). Whiting criticizes in particular the concept of (...) 'pathological values' that we suggested might be relevant in the assessment of DMC and in the related issue of deciding when a patient's refusal of beneficial treatment should be overridden.Whiting's central concern is with DMC. Whiting argues that the absence of pathological values should not be a criterion for DMC. We are unclear whether he is also arguing that pathological values do not provide a reason of any kind for overriding treatment refusal. At the end of the paper he writes: "we cannot justify compulsory treatment of patients who have pathological values... on the grounds that these patients lack DMC" (2009, XX). This seems to leave open the possibility that we may be able to justify compulsory treatment of patients who have pathological values on grounds other than that they lack DMC. As we wrote in our response to the discussants of our original paper, "The primary issue for us is whether the reasons for refusal to which we draw attention provide grounds for overriding refusal, and if they do how they can be characterized in such a way as to avoid the ever-present danger of simply overriding autonomy in a patient's best interests" (Tan et al. 2006b, 300).In deciding on whether to use compulsory treatment, there are other relevant factors that may need to be considered, such as the seriousness of the decision, which determines the threshold for competence. However, in this response we consider three issues. First, we argue that the current concept of DMC is by no means so clear cut or generally agreed upon as Whiting implies, and that some of the lack of clarity relates to pathological values. Second, that the concept of DMC is itself dependent on accounts of autonomy, and that it is plausible that pathological values can affect autonomy. Third, we directly consider the question of whether a coherent account of pathological values might be given based on a concept of authenticity.The Current Criteria for DMCWhiting argues that the current criteria for DMC are correct and that an additional criterion along the lines of absence of pathological values should not be added. This argument assumes that there is a clear and agreed understanding of the current criteria. We believe this is not the case for three reasons.(i) Whiting begins his account of DMC by saying that it is normally taken to include: "(1) [End Page 345] understanding (and appreciation)" (2009, 341). Already there is an area of dispute, and the use of parentheses reflects this. The concept of 'appreciation' was developed by Grisso and Applebaum (Grisso, Appelbaum, and Hill-Fotouhi 1997). It is not included in either English common law development, for example (ReC), nor in the criteria specified in the Mental Capacity Act 2005. More important, Grisso and Appelbaum in their comment on our original paper (2006) argue that our work advances thinking about 'appreciation' rather than requiring that we add new elements. The implication is that they believe that what we have called pathological values are relevant to the assessment of capacity and are already included in an account of capacity that incorporates the criterion of 'appreciation.' In our response, we argued that pathological values are not entirely captured within the account of appreciation that Grisso and Appelbaum had previously given. Block () highlights two experimental studies of neglect patients which, he contends, provide ‘dramatic evidence’ for unconscious seeing. In Block's hands this is the highly non-trivial thesis that seeing of the same fundamental kind as ordinary conscious seeing can occur outside of phenomenal consciousness. Block's case for it provides an excellent opportunity to consider a large body of research on clinical syndromes widely held to evidence unconscious perception. I begin by considering in detail the two studies of neglect to which (...) Block appeals. I show why their interpretation as evidence of unconscious seeing faces a series of local difficulties. I then explain how, even bracketing these issues, a long-standing but overlooked problem concerning our criterion for consciousness problematizes the appeal to both studies. I explain why this problem is especially pressing for Block given his view that phenomenal consciousness overflows access consciousness. I further show that it is epidemic—not only affecting all report-based studies of unconscious seeing in neglect, but also analogous studies of the condition most often alleged to show unconscious seeing, namely blindsight. Why save endangered species without clear aesthetic, economic, or ecosystemic value? This book takes on this challenging question through an account of the intrinsic goods of species. Ian A. Smith argues that a species’ intrinsic value stems from its ability to flourish—its organisms continuing to reproduce successfully and it avoiding extinction—which helps to demonstrate a further claim, that humans ought to preserve species that we have endangered. He shows our need to exercise humility in our relations with endangered species through (...) the preservation of their intrinsic goods, which in turn rectifies our degradation of their importance. Unique in its appeal to virtue ethics and to species concepts, _The Intrinsic Value of Endangered Species_ is an important resource for scholars working in environmental ethics and the philosophy of biology. We have two aims in this paper. The first is to provide the reader with a critical guide to recent work on relativity and persistence by Balashov, Gilmore and others. Much of this work investigates whether endurantism can be sustained in the context of relativity. Several arguments have been advanced that aim to show that it cannot. We find these unpersuasive, and will add our own criticisms to those we review. Our second aim, which complements the first, is to demarcate (...) the most defensible form of relativistic endurantism. A recurring theme of this paper is that even those philosophers who do worry about relativity have not taken it seriously enough. (shrink)

Philosophers have long struggled to understand our perceptual experience of temporal properties such as succession, persistence and change. Indeed, strikingly, a number have felt compelled to deny that we enjoy such experience. Philosophical puzzlement arises as a consequence of assuming that, if one experiences succession or temporal structure at all, then one experiences it at a moment. The two leading types of theory of temporal awareness—specious present theories and memory theories—are best understood as attempts to explain how temporal awareness is (...) possible within the constraints of this principle. I argue that the principle is false. Neither theory of temporal awareness can be made workable unless it is rejected. Our experience of temporal phenomena cannot be understood if we attempt to break experience down into instantaneous slices. Should we explicate truth in terms of meaning, or meaning in terms of truth? Ramsey, Prior and Strawson all favoured the former approach: a statement is true if and only if things are as the speaker, in making the statement, states them to be; similarly, a belief is true if and only if things are as a thinker with that belief thereby believes them to be. I defend this explication of truth against a range of objections.Ramsey formalized this account of (...) truth as follows: B is true =df ∃P; in §i, I defend this formula against the late Peter Geach's objection that its right‐hand side is ill‐formed. Davidson held that Ramsey and co. had the whole matter back to front: on his view, we should explicate meaning in terms of truth, not vice versa. In §ii, I argue that Ramsey's approach opens the way to a more promising approach to semantic theorizing than Davidson's. Ramsey presents his formula as a definition of truth, apparently contradicting Tarski's theorem that truth is indefinable. In §iii, I show that the contradiction is only apparent: Tarski assumes that the Liar‐like inscription he uses to prove his theorem has a content, but Ramsey can and should reject that assumption. As I explain in §iv, versions of the Liar Paradox may be generated without making any assumptions about truth: paradox arises when the impredicativity that is found when a statement's content depends on the contents of a collection of statements to which it belongs turns pathological. Since they do not succeed in saying anything, such pathological utterances or inscriptions pose no threat to the laws of logic, when these are understood as universal principles about the ways things may be said or thought to be. There is, though, a call for rules by following which we can be sure that any conclusion deduced from true premisses is true, and hence says something. Such rules cannot be purely formal, but in §v I propose a system of them: this opens the way to the construction of deductive theories even in circumstances where producing a well‐formed formula is no guarantee of saying anything. Most contemporary approaches to meaning presume the limitation of semiotics (Didi-Huberman, Gumbrecht, Belting). The question of what kind of “semiotics” is required has not been asked. However, without some general science of meaning it is impossible to reform theory without committing past errors or ignoring progress. In the interest of reconnecting contemporary interests in “presence” to long-evolving needs, I review the ossification and decline of one theory of semiotics that serves as the tacit model rejected today. I return to problems (...) of the nature of the sign – whether it is “digital” or “analog” and conceived as “communication” or merely “meaning.” I then reconstitute a workable visual cognitive semiotics based on phenomenological premises. These include: the puzzle of reasonable disagreement; the so-called (...) “problem of easy knowledge”; the intellectual virtues; and new theories in the philosophy of language relating to knowledge. Chapters include discussions of skepticism, the truth condition, belief and acceptance, justification, internalism versus externalism, epistemic evaluation, and epistemic contextualism. Evans and Smith do not merely offer a review of existing theories and debates; they also offer a novel theory that takes seriously the claim that knowledge is not unique to humans. Surveying current scientific literature in animal ethology, they discover surprising sophistication and diversity in non-human cognition. In their final analysis the authors provide a unified account of knowledge that manages to respect and explain this diversity. They argue that animals know when they make appropriate use of the cognitive processes available to animals of that kind, in environments within which those processes are veridically well-adapted. _Knowledge_ is a lively and accessible volume, ideal for undergraduate and post-graduate students. A prominent tradition in Nietzsche scholarship reads his views about will to power as a psychological thesis and his claims about the value of power as an attempt to derive normativity from psychological necessity. This article shows that these interpretations have failed to articulate a cogent reading faithful to Nietzsche’s texts, and so casts doubt on such an approach. My argument bears not only on how we read Nietzsche, but also on the viability of one recent constitutivist reading. After presenting (...) these critical arguments, I consider an original interpretation of will to power in terms of the motivation to grow. This revised interpretation, however, still fails to support the tradition’s derivation of normativity. Thus, I conclude we should look elsewhere for Nietzsche’s normative argument. (shrink)

Humanity has sat at the center of philosophical thinking for too long. The recent advent of environmental philosophy and posthuman studies has widened our scope of inquiry to include ecosystems, animals, and artificial intelligence. Yet the vast majority of the stuff in our universe, and even in our lives, remains beyond serious philosophical concern. In _Alien Phenomenology, or What It’s Like to Be a Thing_, Ian Bogost develops an object-oriented ontology that puts things at the center of being—a philosophy in (...) which nothing exists any more or less than anything else, in which humans are elements but not the sole or even primary elements of philosophical interest. And unlike experimental phenomenology or the philosophy of technology, Bogost’s alien phenomenology takes for granted that _all_ beings interact with and perceive one another. This experience, however, withdraws from human comprehension and becomes accessible only through a speculative philosophy based on metaphor. Providing a new approach for understanding the experience of things _as_ things, Bogost also calls on philosophers to rethink their craft. Drawing on his own background as a videogame designer, Bogost encourages professional thinkers to become makers as well, engineers who construct things as much as they think and write about them. How must experience of time be structured in time? In particular, does the following principle, which I will call inheritance, hold: for any temporal property apparently presented in perceptual experience, experience itself has that same temporal property. For instance, if I hear Paul McCartney singing ‘Hey Jude’, must my auditory experience of the ‘Hey’ itself precede my auditory experience of the ‘Jude’, or can the temporal order of these experiences come apart from the order the words are experienced as having? (...) A number of recent authors (Phillips Experience and Time, ‘The Temporal Structure of Experience’, Soteriou ‘Perceiving Events’, Hoerl ‘“A Succession of Feelings, in and of Itself, is Not a Feeling of Succession”’, Rashbrook) claim, to paraphrase Martin (399), that inheritance best characterises how our temporal experience seems to initial reflective intuition. For this reason, Phillips takes the principle to form part of our naïve view of temporal experience. An opposing group of theorists object that inheritance is subject to empirical counter-example. This article surveys such challenges. Section 2 considers Grush's case against inheritance based on postdiction. Section 3 examines Watzl's anti-inheritance argument based on silencing effects. Finally, Section 4 explores a number of alleged counter-examples proposed by Lee (‘Temporal Experience and the Temporal Structure of Experience’).
