Progress in machine learning and artificial intelligence has spurred the widespread adoption of automated decision systems (ADS). An extensive literature explores what conditions must be met for these systems' decisions to be fair. However, questions of legitimacy -- why those in control of ADS are entitled to make such decisions -- have received comparatively little attention. This paper shows that when such questions are raised theorists often incorrectly conflate legitimacy with either public acceptance or other substantive values such as fairness, (...) accuracy, expertise or efficiency. In search of better theories, we conduct a critical analysis of the philosophical literature on the legitimacy of the state, focusing on consent, public reason, and democratic authorisation. This analysis reveals that the prevailing understanding of legitimacy in analytical political philosophy is also ill-suited to the task of establishing whether and when ADS are legitimate. The paper thus clarifies expectations for theories of ADS legitimacy and charts a path for a future research programme on the topic. (shrink)

This volume brings together essential writings by the unjustly neglected nineteenth-century philosopher Frances Power Cobbe (1822-1904). A prominent ethicist, feminist, champion of animal welfare, and critic of Darwinism and atheism, Cobbe was well known and highly regarded in the Victorian era. This collection of her work introduces contemporary readers to Cobbe and shows how her thought developed over time, beginning in 1855 with her Essay on Intuitive Morals, in which she set out her duty-based moral theory, arguing that morality and (...) religion are indissolubly connected. This work provided the framework within which she addressed many theoretical and practical issues in her prolific publishing career. In the 1860s and early 1870s, she gave an account of human duties to animals; articulated a duty-based form of feminism; defended a unique type of dualism in the philosophy of mind; and argued against evolutionary ethics. Cobbe put her philosophical views into practice, campaigning for women's rights and for first the regulation and later the abolition of vivisection. In turn her political experiences led her to revise her ethical theory. From the 1870s onwards she increasingly emphasized the moral role of the emotions, especially sympathy, and she theorized a gradual historical progression in sympathy. Moving into the 1880s, Cobbe combatted secularism, agnosticism, and atheism, arguing that religion is necessary not only for morality but also for meaningful life and culture. -/- Shedding light on Cobbe's philosophical perspective and its applications, this volume demonstrates the range, systematicity and philosophical character of her work and makes her core ethical theory and its central applications and developments available for teaching and scholarship. Many women wrote philosophy in nineteenth-century Britain, and they wrote across the full range of philosophical topics. Yet these important women thinkers have been left out of the philosophical canon and many of them are barely known today. The aim of this book is to put them back on the map. It introduces twelve women philosophers - Mary Shepherd, Harriet Martineau, Ada Lovelace, George Eliot, Frances Power Cobbe, Helena Blavatsky, Julia Wedgwood, Victoria Welby, Arabella Buckley, Annie Besant, Vernon Lee, and (...) Constance Naden. Alison Stone looks at their views on naturalism, philosophy of mind, evolution, morality and religion, and progress in history. She shows how these women interacted and developed their philosophical views in conversation with one another, not only with their male contemporaries. The rich print and periodical culture of the period enabled these women to publish philosophy in forms accessible to a general readership, despite the restrictions women faced, such as having limited or no access to university education. Stone explains how these women became excluded from the history of philosophy because there was a cultural shift at the end of the nineteenth century towards specialised forms of philosophical writing, which depended on academic credentials that were still largely unavailable to women. Kant maintains that while claims to property are morally possible in a state of nature, such claims are merely “provisional”; they become “conclusive” only in a civil condition involving political institutions. Kant’s commentators find this thesis puzzling, since it seems to assert a natural right to property alongside a commitment to property’s conventionality. We resolve this apparent contradiction. Provisional right is not a special kind of right. Instead, it marks the imperfection of an action where public authorization is lacking. Provisional (...) right thereby functions as a methodological device in a sequential elucidation of the moral basis of public law. To develop this reading, we first explain Kant’s two-step account of property rights—his division between ‘having’ and ‘acquiring’. Joan Scott's poststructuralist critique of experience demonstrates the dangers of empiricist narratives of experience but leaves feminists without a meaningful way to engage nonempiricist, experience-oriented texts, texts that constitute many women's primary means of taking control over their own representation. Using Chandra Mohanty's analysis of the role of writing in Third World feminisms, I articulate a concept of experience that incorporates poststructuralist insights while enabling a more responsible reading of Third World women's narratives.

'Middle' Platonism has some claim to be the single most influential philosophical movement of the last two thousand years, as the common background to 'Neoplatonism' and the early development of Christian theology. This book breaks with the tradition of considering it primarily in terms of its sources, instead putting its contemporary philosophical engagements front and centre to reconstruct its philosophical motivations and activity across the full range of its interests. This article discusses the paradox of exclusion/inclusion: U.S. health policy prohibits Latinos who fall under certain classifications from accessing health services and insurance yet permits them to be human subjects in health research. We aim to advance the discussion of health research ethics post the Tuskegee syphilis experiment in Latinos by (a) tracing the impacts of policy exclusion and the social context of anti-Latino sentiment on Latinos' low participation rates in health research and inequitable access to treatment modalities; (b) challenging (...) researchers to address social sources of vulnerabilities; and (c) offering recommendations on adapting a social justice ethical stance to address these challenges, which are part of the Tuskegee Study legacy. To promote so-called cultural competence in work of direct-care providers and other health professionals among diverse peoples, cross-cultural training is now widely advised. However, in ethically assessing aims and content of CCT, and surrounding issues and concerns, what should guide us? And if we can elaborate satisfactory moral touchstones, what do they imply for healthcare professionals, overarching structures, and bioethicists? Building on prior work, this paper tries to help answer these questions.

Phaedo of Elis was well-known as a writer of Socratic dialogues, and it seems inconceivable that Plato could have been innocent of intertextuality when, excusing himself on the grounds of illness, he made him the narrator of one of his own: the "Phaedo". In fact the psychological model outlined by Socrates in this dialogue converges with the evidence we have (especially from fragments of the Zopyrus) for Phaedo's own beliefs about the soul. Specifically, Phaedo seems to have thought that non-rational (...) desires were ineliminable epiphenomena of the body, that reason was something distinct, and that the purpose of philosophy was its 'cure' and 'purification'. If Plato's intention with the "Phaedo" is to assert the separability and immortality of reason (whatever one might think about desire and pleasure), then Phaedo provides a useful standpoint for him. In particular, Phaedo has arguments that are useful against the 'harmony-theorists' (and are the more useful rhetorically speaking since it is only over the independence of reason that Phaedo disagrees with them). At the same time as allying himself with Phaedo, however, Plato is able to improve on him by adding to the demonstration that reason is independent a proof that it is actually immortal. (shrink)

Two claims that are hard to deny are that slurs can be offensive, and that not all uses of language are communicative. It’s therefore perplexing why no one has considered the possibility that slurs might be offensive not because of what they communicate but rather because of interpretive effects their uses might exact. In what follows, we intend to argue just that, namely, that confrontations with slurs can set in motion a kind of imaginative engagement that rouses objectionable psychological states. (...) I argue that people who believe fetuses have the same moral right to life as the rest of us have sufficient reasons to refuse to classify abortion as legal murder and to refuse to punish abortion as severely as legal murder.

How do hearers manage to understand speakers? And how do speakers manage to shape hearers' understanding? Lepore and Stone show that standard views about the workings of semantics and pragmatics are unsatisfactory. They advance an alternative view which better captures what is going on in linguistic communication.

This book traces, for the first time, a revolution in philosophy which took place during the early centuries of our era. It reconstructs the philosophical basis of the Stoics' theory that fragments of an ancient and divine wisdom could be reconstructed from mythological traditions, and shows that Platonism was founded on an argument that Plato had himself achieved a full reconstruction of this wisdom, and that subsequent philosophies had only regressed once again in their attempts to "improve" on his achievement.

Offering new insight into the pertinence of Simone Weil’s thought, this volume situates her in the Continental discourses which constituted her philosophical background, her milieu, and which frequently reflected her departures from her contemporaries.

Is there anything that is given immediately? This question seems to be of crucial importance for Phenomenology, a field perhaps known most principally for its attempt to return directly to the “things themselves.” The seeming simplicity of the idea is appealing: after all, where better for us to start in any philosophical investigation than with things as they appear to us in their most pure or “immediate” state? When put in its historical context as well, Husserl’s phenomenological project could even (...) be interpreted as a breath of fresh air in the midst of the environment of early 20th century philosophy in comparison with the seemingly constructive philosophy of its Neo-Kantian contemporaries. Indeed, rather than starting with a merely systematic account of our cognition and reality, is it not better for us to first return to the world just as it is given to us in perception or intuition in order to have a more faithful account of these issues? How closely do the theoretical notions of 'metaphor' and 'allegory' developed by ancient rhetoricians reflect the practice of classical writers? This question is tackled through eleven new essays by a team of distinguished academics. Ancient theories of metaphor are compared with twentieth century alternatives; theory is tested against practice; and allegory - a distinctive though neglected feature of ancient literature and philosophy - is explored against the background of the rhetoricians' claim that it is one form of metaphor.

Optimism about our ability to enhance societal decision‐making by leaning on Machine Learning (ML) for cheap, accurate predictions has palled in recent years, as these ‘cheap’ predictions have come at significant social cost, contributing to systematic harms suffered by already disadvantaged populations. But what precisely goes wrong when ML goes wrong? We argue that, as well as more obvious concerns about the downstream effects of ML‐based decision‐making, there can be moral grounds for the criticism of these predictions themselves. We introduce (...) and defend a theory of predictive justice, according to which differential model performance for systematically disadvantaged groups can be grounds for moral criticism of the model, independently of its downstream effects. As well as helping resolve some urgent disputes around algorithmic fairness, this theory points the way to a novel dimension of epistemic ethics, related to the recently discussed category of doxastic wrong.
