This book provides a reconstructive and critical interpretation of Sartre’s mature dialectical ethics. Taken together, as Sartre intended, the posthumously published key texts demonstrate that the ultimate goal of praxis is “integral humanity” and that “making the human” is always possible because the means to humanity can always be invented.

This essay considers whether the model of conscience operative in Christian ethics, what I call the “reflexive conscience,” is adequate to meet the global moral challenges we face today, problems such as gun violence, climate change, and the Zika virus. Drawing primarily on the work of Willis Jenkins, I argue that conscience has not yet caught up to the scale and interconnectedness of our global moral challenges. A truly “engaged conscience” must be focused not primarily on the self but on (...) the other, and must be active. I conclude by turning to Elisabeth Vasko’s criticisms of the victim/perpetrator binary to suggest that conscience must call us to greater responsibility for the systemic injustices in which particular moral challenges are embedded. Repression is one of the most haunting concepts in psychology. Something shocking happens, and the mind pushes it into some inaccessible corner of the unconscious. Later, the memory may emerge into consciousness. Repression is one of the foundation stones on which the structure of psychoanalysis rests. Recently there has been a rise in reported memories of childhood sexual abuse that were allegedly repressed for many years. With recent changes in legislation, people with recently unearthed memories are suing alleged perpetrators for (...) events that happened 20, 30, even 40 or more years earlier. These new developments give rise to a number of questions: (a) How common is it for memories of child abuse to be repressed? (b) How are jurors and judges likely to react to these repressed memory claims? (c) When the memories surface, what are they like? and (d) How authentic are the memories? (shrink)

When at the ancient city of Anuradhapura, I stole away from the group I was with to return for a few minutes to the shrine room adjacent to the sacred bo tree, the one believed to have grown from a cutting of the original tree under which (...) the Buddha gained enlightenment. Devotees dressed in white were sitting or prostrating silently. I joined them and looked toward the image, which showed the Buddha sitting in meditation against a painted scene of pale blue sky, white clouds, and mountains. Suddenly the image became more than mere plaster. All I can say is that it communicated. It beckoned. Against the blue of the sky, the serene head became suffused with cosmic significance. I know that there was unfinished business between me and the Buddha.The moment was prophetic. Two years later, I returned to Sri Lanka to study Buddhism and stayed over seven years. ‘Study’ is not quite the right word because, together with the academic, I also sought to immerse myself in Buddhism with the wish to see it through the eyes of Buddhists. I practiced meditation under Buddhist teachers, participated in temple devotion, and joined pilgrimages. It was a process that meant temporarily letting go of much that was dear to me as a Christian. But the rewards were inestimable. Never again has the image at Anuradhapura ‘spoken’ to me. In fact, on return visits it has appeared artistically poor, certainly no match for the older stone images, open to the air, in other parts of the city. I remain a Christian, but the Buddha has become part of me. An exquisitely carved wooden image of the Buddha in meditation is now part of my home. The peace that emanates from it gives me strength. This article explores recent developments inthe regulation of Internet speech, inparticular, injurious or defamatory speech andthe impact the attempts at regulation arehaving on the `body' in the sense of theindividual person who speaks through the mediumof the Internet and upon those harmed by thatspeech. The article proceeds in threesections. First, a brief history of the legalattempts to regulate defamatory Internet speechin the United States is presented; a shortcomparative discussion of defamation law in theUK and Australia is included. As discussedbelow, this (...) regulation has altered thetraditional legal paradigm of responsibilityand, as a result, creates potential problems forthe future of unrestricted and even anonymousspeech on the Internet. Second, an ethicalassessment is made of the defamatory speechenvironment in order to determine which actorshave moral responsibility for the harm causedby defamatory speech. This moral assessment iscompared to the developing and anticipatedlegal paradigm to identify possible conformityof moral and legal tenants or to recognize theconflict between morality and law in assigningresponsibility to defamatory actors. In this paper, we explore how the prospect of artificial placenta technology (nearing clinical trials in human subjects) should encourage further consideration of the loss experienced by individuals when their pregnancy ends unexpectedly. Discussions of pregnancy loss are intertwined with procreative loss, whereby the gestated entity has died when the pregnancy ends. However, we demonstrate how pregnancy loss can and does exist separate to procreative loss in circumstances where the gestated entity survives the premature ending of the pregnancy. In outlining (...) the value that can be attached to pregnancy beyond fetal-centric narratives, we illustrate how pregnancy loss, separate to procreative loss, can be experienced. This loss has already been recognised among parents who have experienced an unexpected early ending of their pregnancy, resulting in their child being cared for in neonatal intensive care unit. Artificial placentas, however, may exacerbate these feelings and make pregnancy loss (without procreative loss) more visible. We argue that pregnancy is an embodied state in which gestation is facilitated by the body but gestation itself should be recognised as a process—and one that could be separable from pregnancy. In demarcating the two, we explore the different ways in which pregnancy loss can be understood. Our objective in this paper goes beyond contributing to our philosophical understanding of pregnancy towards practical-orientated conclusions regarding the care pathways surrounding the artificial placenta. We make recommendations including the need for counselling and careful consideration of the language used when an artificial placenta is used. (shrink)

A large body of literature considers the ethico-legal and regulatory issues surrounding assisted conception. Surrogacy, however, within this body of literature is an odd-fit. It involves a unique demand of another person—a form of reproductive labour—that many other aspects of assisted conception, such as gamete donation do not involve. Surrogacy is a form of assisted gestation. The potential alternatives for individuals who want a genetically related child but who do not have the capacity to gestate are ever increasing: with the (...) advent of uterus transplantation, and the anticipated development of artificial placentas.In this paper, I highlight the pertinent conceptual differences between technologies assisting conception and those assisting gestation to demonstrate that distinct issues arise when assisted gestative technologies are used. I argue that there is utility in considering AGTs as a genus of technologies. These technologies perform the same function from the perspective of putative parents and might exist on a spectrum of alternatives when they become more available. Moreover, since many of the same or very similar ethical, social and legal issues are raised by surrogacy, UTx and ectogestation, analysis of these issues will be better contextualised by considering these technologies together. Many of the matters currently being highlighted for reform in the context of surrogacy will inevitably impact on how other forms of assisted gestation are governed. The conversation should be broadened; we should consider how far other emerging technologies might be accommodated in revised regulatory schemes. (shrink)

A new resolution of the mind-body problem that reconciles materialism and idealism.

In the United Kingdom the law and medical guidance is supportive of women making choices in childbirth. NICE guidelines are explicit that a competent woman’s informed request for MRCS should be respected. However, in reality pregnant women are routinely denied MRCS. In this paper I consider whether there is sufficient justification for restricting MRCS. The physical and emotive significance of childbirth as an event in a woman’s life cannot be understated. It is, therefore, concerning that women are having their wishes (...) ignored, and we must ascertain whether the denial of agency is justifiable. To answer this question I first demonstrate that access to MRCS is a lottery in the UK. Second, I argue that there is nothing unique about pregnancy that displaces the ethical norm of respecting patents’ sufficiently autonomous choices. Thus, the starting presumption is that all informed choices regarding MRCS should be respected. To ascertain whether any restriction of MRCS is justifiable the burden of proof must be placed on those who argue that MRCS is ethically impermissible. I argue that the most common justifications in the literature against MRCS are insufficient to displace the presumption in favour of autonomous choice in childbirth. I conclude that MRCS should be available to pregnant women, and we must strive to reduce the lottery in access to choice. (shrink)

In this paper, I explore how viability, meaning the ability of the fetus to survive post-delivery, features in the law regulating abortion provision in England and Wales and the USA. I demonstrate that viability is formalized differently in the criminal law in England and Wales and the USA, such that it is quantified and defined differently. I consider how the law might be applied to the examples of artificial womb technology and anencephalic fetuses. I conclude that there is incoherence in (...) the meaning of viability and argue that it is thus a conceptually illegitimate basis on which to ground abortion regulation. This is both because of the fluidity of the concept and because how it has been thus far understood in the law is unsupported by medical realities. Furthermore, it has the effect of heavily diluting pregnant people’s rights with overly moralistic limitations on access to healthcare. (shrink)

This article provides a broad survey of issues facing rural communities and suggests that medicalization of poverty concepts and interventions need to be tailored to those populations. Rural poverty may be both broader and deeper than in urban areas. Those challenges seem to produce a constellation of health conditions, as rural residents struggle with unemployment and lack of opportunities. Relatedly, rural communities struggle to maintain financially viable hospitals and specialty providers. In their paper, ‘How to reach trustworthy decisions for caesarean sections on maternal request: a call for beneficial power’, Eide and Bærøe present maternal request caesarean sections (MRCS) as a site of conflict in obstetrics because birthing people are seeking access to a treatment ‘without any anticipated medical benefit’. While I agree with the conclusions of their paper -that there is a need to reform the approach to MRCS counselling to ensure that the structural vulnerability of pregnant people making birth (...) decisions is addressed—I disagree with the framing of MRCS as having ‘no anticipated medical benefit’. I argue that MRCS is often inappropriately presented as unduly risky,without supporting empirical evidence,and that MRCS is most often sought by birthing people on the basis of a clinical need. I argue that there needs to be open conversation and frank willingness to acknowledge the values that are currently underpinning the presentation of MRCS as ‘clinically unnecessary’; specifically there needs to be more discussion of where and why the benefits of MRCS that are recognised by individual birthing people are not recognised by clinicians. This is important to ensure access to MRCS for birthing people that need it. (shrink)

Much recent literature in metaphysics attempts to answer the question, ‘What is metaphysics?’ In this paper I argue that many of the most influential contemporary answers to this question yield the result that feminist metaphysics is not metaphysics. I further argue this result is problematic.

This paper argues that abortion access is an important subject for bioethics scholarship and reflects on the relationship between legal frameworks and access to care. The author uses the example of the United Kingdom to examine the benefits and limitations of abortion-permissive legal frameworks in terms of access. These are legal frameworks that enable the provision of abortion but subject to restrictions. An abortion-permissive regime—first in Great Britain and then in Northern Ireland—has gone some way to improving access to care (...) over time. However, aspects of the regime (that lead to its description as permissive rather than supportive of abortion) have the potential to endanger abortion access in the future and so legal reform is necessary. This article explores the implications of Hegel’s Philosophy of World History with respect to colonialism. For Hegel, freedom can be recognized and practised only in classical, Christian and modern Europe; therefore, the world’s other peoples can acquire freedom only if Europeans impose their civilization upon them. Although this imposition denies freedom to colonized peoples, this denial is legitimate for Hegel because it is the sole condition on which these peoples can gain freedom in the longer term. The article then considers (...) whether Hegel’s basic account of freedom can be extricated from his Eurocentric and pro-colonialist interpretation of the course of history. The article argues that matters are more complicated because that interpretation has significant connections with Hegel’s conception of freedom as self-determination. (shrink)

This paper makes an argument for greater consideration of negativity in queer engagements with biological or natural systems. Focusing on one particular paper by Karen Barad – “Nature’s Queer Performativity ” – I argue that this work tends to under-read the negativity and confusion that queer entails, and so it renders nature, and the politics we might extract from it, more palatable than perhaps they should be. What interests me is that Barad’s argument about nature’s queer performativity begins and ends (...) with sodomy. While it has been a highly cathected site of analysis for some early and influential work in queer theory, sodomy has been little discussed in feminist and queer science studies where Barad’s work has been so influential. I argue that sodomy spoils any identitarian queer politics that attempt to depathologize or reaffirm the natural world. (shrink)

The Hard Problem is surrounded by a vast literature, to which it is increasingly hard to contribute to in any meaningful way. Accordingly, the strategy here is not to offer any new metaphysical or ‘in principle’ arguments in favour of the success of materialism, but to assume a Type Q(uinian) approach and look to contemporary consciousness science to see how the concept of consciousness fares there, and what kind of explanations we can hope to offer of it. Habit has been understood, through the work of Descartes, Kant and Sartre, as a form of mechanism that arrests and inhibits consciousness, thought and freedom. This article addresses the concept of habit through a different tradition that links it instead to an ever-moving world. In a world of constant change, habits are not so much forms of fixity and repetition as they are modes of encounter materiality and life. Habit is the point of transition between living beings and matter, enabling (...) each to be transformed through its engagement with the other. The article focuses on the work of Ravaisson, Bergson and Deleuze, who understand habit as fundamentally creative and addressed to the future rather than consolidating the past. Habit, within this tradition, is the opening of materiality to the forms of engagement required by life, and the modification of life imposed by the requirements of a material universe. Using an interdisciplinary approach to reading Plato's Apology of Socrates, I argue that the counter penalty offered by Socrates, what is commonly translated as maintenance in the Prytaneion, was a literary addition from Plato, resembling comic topoi from Aristophanes. I begin with the accounts we have from Plato and Xenophon, then analyze the culture and context of the Prytaneion. Given the evidence, I provide arguments for why the historical Socrates wouldn't respond with sitēsis in the Prytaneion. Most readers of Louis Althusser first enter his work through his writings on ideology. Within the Australian university context, research has uncovered increasing levels of psychological distress, in the form of stress, anxiety and depression. Higher rates of psychological distress have been reported in undergraduate students specifically enrolled in creative arts programs. Despite these increasing levels of psychological distress, university students are reluctant to engage with mental health and wellbeing supports. To explore ways to meet the mental health and wellbeing needs of creative arts university students, the Creative Arts and Music Therapy Research Unit (...) at The University of Melbourne commenced a project exploring the benefits and pitfalls of a brief creative arts therapies approach for students attending a campus based wellbeing clinic. This exploratory research study formed the art therapy component of this much broader research endeavor. Creative arts students in this research study were invited to participate in a single session art therapy encounter that involved the visual exploration of the miracle question, asking students to visually depict “what the problem looks like and how it will look when the problem is resolved or you feel like you can cope with it better?” The descriptive findings of this exploratory research study revealed how the combination of art therapy used within a single session framework was able to afford students a novel means to externalize problems, leading students to forming a less internalized view of the self. Over the past several decades, a large number of publications have claimed that there are important similarities between mindfulness and phenomenology, with a particular emphasis on the epoché and phenomenological reduction. We argue that these comparisons trade on a rather superficial and often misleading presentation of phenomenology. The epoché-reduction is treated either as a matter of bracketing our 'theoretical baggage' so as to allow for a full disclosure and precise description of the objects of experience, or as a matter of (...) bracketing our preoccupation with and absorption in worldly affairs so as to allow for a close attention to subjective acts. Both interpretations mischaracterize the proper scope of phenomenology, namely the subject-object (mind-world) correlation. Furthermore, both miss the theoretical, systematic, and (most importantly) philosophical character of phenomenology. We suggest that, in the end, comparisons between phenomenology and Buddhism would be better off focusing on Buddhist philosophy, rather than Buddhist meditative practice. (shrink)
