For over two decades, the debate about whether legally to recognize environmental refugees as refugees has been ongoing. Because their numbers are growing, environmental refugees should be recognized as convention refugees or a new UN convention should be drafted to address their needs. A typology of the environmental refugee should be developed to make the term more concrete and useful.

In “The Search for Environmental Rights,” Joseph Sax argues that each individual should have, as a right, freedom from environmental hazards and access to environmental benefits, but he makes clear that environmental rights do not exist and their recognition would truly be a novel step. Sax states that environmental rights are different from existing human rights and argues that the closest analogy is welfare interests. In arguing for environmental rights, I follow Sax’s direction and draw from the work of those (...) who are the most relevant in establishing environmental rights. I consider Joel Feinberg’s notion of welfare interests, Henry Shue’s notion of basic rights, and James Nickel’s right to a safe environment. I draw from Mill’s harm principle, the superfund legislation, and the Clean Air Act to illustrate the existing ethical and legal bases for establishing environmental rights. Anonymous sperm donation offspring often yearn for information about their biological fathers, and as they come of age that yearning increases in intensity. We first explore will and interest theory regarding this desire to know one’s heritage and argue that both theories lead to a right of the offspring to know. We then turn to the donor contract, look at the inconsistencies between donor ability to eschew parental responsibility compared to other biological fathers, and argue that there should be a (...) procedure similar to adoption procedures, whereby sperm donors take seriously the legal severing of their parental rights and responsibilities. We conclude that the offspring have a right to their genetic heritage and call for caring reproductive technological practices that ensure children of donors this right. (shrink)

The term ‘Bakhtin Circle’ is used to refer to a group of Russian thinkers centred around Mikhail Bakhtin in the years following the 1917 Revolution. The group's prime concern was with the importance of questions of language-use in social life, and with the way in which language-use registered conflicts between social groups and classes. Prominent members, as well as Bakhtin himself, included P.N. Medvedev and V.N. Voloshinov. Between 1929, when a number of members were arrested, and his death in 1975, (...) This book explores the significance of implicit understandings and tacit expectations of the parties to different kinds of contractual agreements.

There is an incompatibility between the deflationist approach to truth, which makes truth transparent on the basis of an antecedent grasp of meaning, and the traditional endeavour, exemplified by Davidson, to explicate meaning through of truth. I suggest that both parties are in the explanatory red: deflationist lack a non-truth-involving theory of meaning and Davidsonians lack a non-deflationary account of truth. My focus is on the attempts of the latter party to resolve their problem. I look in detail at Davidson's (...) more recent work and suggest that it seeks to articulate a primitive notion of truth that may balance between a notion that collapses into deflationism and one that is wholly subsumed under a general theory of interpretation. I conclude that this tightrope walk is ultimately unsuccessful. Equally, however, some reasons are provided for thinking that deflationism might be equally unsuccessful with its problem. The author argues that the fourth-century philosophers used protreptic discourses to market philosophical practices and to define and legitimize the school of higher learning.

Individuals sometimes pass their duties on to collectives, which is one way in which collectives can come to have duties. The collective discharges its duties by acting through its members, which involves distributing duties back out to individuals. Individuals put duties in and get (transformed) duties out. In this paper we consider whether (and if so, to what extent) this general account can make sense of states' duties. Do some of the duties we typically take states to have come from (...) individuals having passed on certain individual duties? There are complications: states can discharge their duties by contracting fulfilment out to non-members; states seem able to dissolve the duties of non-members; and some of states' duties are not derived in this way. We demonstrate that these complicate, but do not undermine, the general account and its application to states. And the application has an interesting upshot: by asking which individuals robustly participate in this process of duty transfer-and-transformation with a given state, we can begin to get a grip on who counts as a member of that state. L. A. Paul argues that epistemically transformative choice poses a special problem for standard theories of decision: when values of outcomes cannot be known in advance, deliberation cannot even get started. A standard response to this is to represent ignorance of the nature of an experience as uncertainty about its utility. Assign subjective probabilities over the range of possible utilities it may have, and an expected utility for the outcome can be figured despite the agent’s ignorance of its nature. But (...) this response to Paul’s challenge seems inadequate. Decision theory should leave conceptual room for rational neophobia. A decision theory like Isaac Levi’s, which allows for indeterminacy in utility, might accomodate the phenomenon. Levi’s discussion of indeterminate utility has focused on examples of risk aversion like the Allais problem and on situations in which there are conflicts of value. Cases of unknowable value arising in transformative choice problems might be handled similarly. (shrink)

Experts often communicate probabilities verbally (e.g., unlikely) rather than numerically (e.g., 25% chance). Although criticism has focused on the vagueness of verbal probabilities, less attention has been given to the potential unintended, biasing effects of verbal probabilities in communicating probabilities to decision-makers. In four experiments (Ns = 201, 439, 435, 696), we showed that probability format (i.e., verbal vs. numeric) influenced participants’ inferences and decisions following a hypothetical financial expert’s forecast. We observed a format effect for low probability forecasts: verbal (...) probabilities were interpreted more pessimistically than numeric equivalents. We attributed the difference to directionality, a linguistic property that biases attention toward an outcome. In the high-probability conditions, the directionality of verbal and numeric probabilities aligned (both were positive), whereas they differed in the low-probability conditions (verbal probabilities were more negative). Participants inferred recommendations congruent with the communicated direction and these inferences mediated the effect of probability format on decisions. (shrink)

The paper considers our ordinary mentalistic discourse in relation to what we should expect from any genuine science of the mind. A meta-scientific eliminativism is commended and distinguished from the more familiar eliminativism of Skinner and the Churchlands. Meta-scientific eliminativism views folk psychology qua folksy as unsuited to offer insight into the structure of cognition, although it might otherwise be indispensable for our social commerce and self-understanding. This position flows from a general thesis that scientific advance is marked by an (...) eschewal of folk understanding. The latter half of the paper argues that, contrary to the received view, Chomsky's review of Skinner offers not just an argument against Skinner's eliminativism, but, more centrally, one in favour of the second eliminativism. This paper takes a unique approach to framing the political obligation social media companies like Twitter and Facebook have in a democratic society by casting the public sphere as a common-pool resource. Over the last decade or so much of our civic discourse has moved to social media platforms such as Facebook and Twitter. This paper argues that just as citizens have an obligation to one another, social media companies have an obligation to promote agonistic forms of civic, political discourse (...) through their algorithms. This algorithmic obligation that social media companies have must be reconciled with social media companies’ formulation of their fiduciary shareholder obligations. We posit that a commons based view of social media discourse allows these companies to make both a democratic health and fiduciary interest argument. (shrink)

I defend a theory of mental representation that satisfies naturalistic constraints. Briefly, we begin by distinguishing (i) what makes something a representation from (ii) given that a thing is a representation, what determines what it represents. Representations are states of biological organisms, so we should expect a unified theoretical framework for explaining both what it is to be a representation as well as what it is to be a heart or a kidney. I follow Millikan in explaining (i) in terms (...) of teleofunction, explicated in terms of natural selection. -/- To explain (ii), we begin by recognizing that representational states do not have content, that is, they are neither true nor false except insofar as they both “point to” or “refer” to something, as well as “say” something regarding whatever it is they are about. To distinguish veridical from false representations, there must be a way for these separate aspects to come apart; hence, we explain (ii) by providing independent theories of what I call f-reference and f-predication (the ‘f’ simply connotes ‘fundamental’, to distinguish these things from their natural language counterparts). -/- Causal theories of representation typically founder on error, or on what Fodor has called the disjunction problem. Resemblance or isomorphism theories typically founder on what I’ve called the non-uniqueness problem, which is that isomorphisms and resemblance are practically unconstrained and so representational content cannot be uniquely determined. These traditional problems provide the motivation for my theory, the structural preservation theory, as follows. F-reference, like reference, is a specific, asymmetric relation, as is causation. F-predication, like predication, is a non-specific relation, as predicates typically apply to many things, just as many relational systems can be isomorphic to any given relational system. Putting these observations together, a promising strategy is to explain f-reference via causal history and f-predication via something like isomorphism between relational systems. -/- This dissertation should be conceptualized as having three parts. After motivating and characterizing the problem in chapter 1, the first part is the negative project, where I review and critique Dretske’s, Fodor’s, and Millikan’s theories in chapters 2-4. Second, I construct my theory about the nature of representation in chapter 5 and defend it from objections in chapter 6. In chapters 7-8, which constitute the third and final part, I address the question of how representation is implemented in biological systems. In chapter 7 I argue that single-cell intracortical recordings taken from awake Macaque monkeys performing a cognitive task provide empirical evidence for structural preservation theory, and in chapter 8 I use the empirical results to illustrate, clarify, and refine the theory. This article examines the prisoner's dilemma paradox and argues that confessing is the rational choice, despite this probably entailing a less-than-ideal outcome.

So-called ‘generics’ are members of a diverse class of constructions that express generalisations that do not directly involve any precise cardinality of individuals, but rather the kinds or ‘typical’ or ‘normal’ members of the kinds contributed by arguments of the predicate. The paper argues that genericity as a unitary phenomenon of human thought has a psychological, rather than linguistic, basis. This claim is argued for by way of a survey of the linguistic diversity of the forms of genericity, and the (...) presentation of a psychological model from recent experimental work done by Prasada and Dillingham that promises to confer unity on the genericity phenomena while explaining how the linguistic diversity relates to a single cognitive representation of a form of generality. While numerous studies have examined the impact that powerful CEOs have on their compensation and overall firm decisions, relatively little is known about how powerful CFOs influence their compensation and important firm financial reporting and operational outcomes. This is somewhat surprising given the critical role CFOs play in the financial reporting process of a firm. Using managerial power theory and the theory of power and self-focus :635–658, 2013), we predict that powerful CFOs employ a two-part strategy to camouflage excessive incentive (...) compensation above what efficient contracting would dictate. First, powerful CFOs use their power and influence to negotiate shorter incentive pay duration to maximize the present value of their performance—based compensation. Second, when their incentive equity compensation vests, we suggest that CFOs manage earnings to further enhance their personal income. Consistent with our theoretical expectations, we find higher levels of income-increasing accrual-based earnings management and real transactions management, a potentially unethical practice, in firms with powerful CFOs who have short pay durations. We discuss the implications of our analysis in the context of mitigating CFO power and managing the ethical environment “tone at the top.”. (shrink)

This article commemorates the journal's quest "to improve the human condition" (Michalos, 1988, p. 1) with a summary and assessment of the first eighteen volumes. The first part provides an overview of JBE, highlighting the journal's growth, types of methodologies published, and the breadth of the field. The second part provides a detailed account of the quantitative research findings.
