The dominant image of courts as agencies of trial and judgment has a long history in the common law world. Yet across that region sponsorship of settlement is now widely identified as the courts’ primary responsibility, transforming them into sites where the profoundly different rationalities that ground negotiated agreement increasingly supersede those of rule-based adjudication. This study examines the work of one English court—the Mayor's and City of London Court—in sponsoring settlement and considers how that role is legitimated on both (...) propositional and symbolic levels. This evolving role raises questions about the Victorian court premises themselves. How are we to regard the now frequently empty courtrooms, designed for trial and judgment and decorated with Gothic elevations linking them symbolically with processes of medieval kingship? Should we simply see this Victorian site of contemporary settlement processes as no more than the quaint residue of a vanished era? Or can these historic features retain potency and relevance at a symbolic level, providing legitimacy for bilateral negotiation rather than the open processes of trial and judgment for which they were originally constructed? Using data from the National Hospital Discharge Survey, this paper analyzes the effect of Medicaid eligibility expansions from 1985 to 1996 on the health insurance coverage of women giving birth. We find that the eligibility expansions reduced the proportion of pregnant women who were uninsured by approximately 10%, although the magnitude of this decrease is sensitive to specification. The decrease in the proportion of uninsured pregnant women came at the expense of a substantial reduction in private insurance coverage (crowd-out) of (...) at least 55%. Substantial crowd-out and the relatively small change in the proportion uninsured suggest that Medicaid eligibility expansions may have had small effects on infant and maternal health. (shrink)

BACKGROUND: There is a need for interdisciplinary research to better understand how pedagogical approaches in primary physical education (PE) can support the linked development of physical, cognitive and affective aspects of physical literacy and physical activity behaviours in young children. The Skill Acquisition Methods fostering Physical Literacy in Early-Physical Education (SAMPLE-PE) study aims to examine the efficacy of two different pedagogies for PE, underpinned by theories of motor learning, to foster physical literacy, especially for children living in disadvantaged areas. METHODS: (...) SAMPLE-PE will be evaluated through a cluster-randomised controlled trial targeting 5-6 year old children from schools located in areas of high deprivation in Merseyside, North-West England. Schools will be randomly allocated to one of three conditions: Linear Pedagogy, Nonlinear Pedagogy or Control. Nonlinear and Linear Pedagogy intervention primary schools will receive a PE curriculum delivered by trained coaches over 15 weeks, while control schools will follow their usual practice. Data will be collected at baseline (T0), immediately post-intervention (T1) and six months after the intervention has finished (T2). Children’s movement competence is the primary outcome in this trial. Secondary outcomes include physical activity, perceived competence, motivation, executive functions, and self-regulation. An extensive process evaluation will also examine implementation factors such as intervention context, reach, dose, fidelity and acceptability. DISCUSSION: The SAMPLE-PE project will enable better understanding surrounding how to operationalise physical literacy through enrichment of PE practices in early PE. The study will provide robust scientific evidence regarding the efficacy of underpinning PE pedagogy with theories of motor learning to promote the development of physical literacy. (shrink)

Emmanuel Levinas is now widely recognised alongside Heidegger, Merleau-Ponty and Sartre as one of the most important Continental philosophers of the twentieth century. His abiding concern was the primacy of the ethical relation to the other person and his central thesis was that ethics is first philosophy. His work has also had a profound impact on a number of fields outside philosophy such as theology, Jewish studies, literature and cultural theory, psychotherapy, sociology, political theory, international relations theory and critical legal (...) theory. This volume, first published in 2002, contains overviews of Levinas's contribution in a number of fields, and includes detailed discussions of his early and late work, his relation to Judaism and talmudic commentary, and his contributions to aesthetics and the philosophy of religion. This fourth edition has been updated with new examples, including a discussion of Spygate by the New England Patriots and recent discoveries on the use of performance enhancing drugs by top athletes. Two additional authors, Cesar R. Torres and Peter (...) F. Hager, bring to this edition a discussion of the moral issues involved in youth sports and the ethics of being a fan, as well as a fresh perspective on the theories of broad internalism and the quest for excellence. The empirical phenomenon at the center of this paper is projection, which we define (uncontroversially) as follows: (1) Definition of projection An implication projects if and only if it survives as an utterance implication when the expression that triggers the implication occurs under the syntactic scope of an entailment-cancelling operator. Projection is observed, for example, with utterances containing aspectual verbs like stop, as shown in (2) and (3) with examples from English and Paraguayan Guaraní (Paraguay, Tupí-Guaraní).1 The Guaraní example in (...) (2) and its English translation have at least the following implications: (i) Carla has previously smoked, and (ii) Carla stopped smoking. The first but not the second of these implications is also conveyed by the question version of sentence (2), as in (3a), or when (2) is embedded under entailment-cancelling sentential operators, such as negation, as in (3b), the antecedent of a conditional, as in (3c), or an epistemic modal, as in (3d). This article begins with a review of the literature on the ethics of tax evasion and identifies the three main views that have emerged over the centuries, namely always ethical, sometimes ethical, and never or almost never ethical. It then reports on the results of a survey of HK and U.S. university business students who were asked to express their opinions on the 15 statements covering the three main views. The data are then analyzed to determine which of the three (...) viewpoints is dominant among the sample population. Although it was found that HK scores were significantly different from the U.S. scores, both HK and U.S. respondents were opposed to the view that tax evasion is always or almost always ethical. The strongest arguments justifying tax evasion were in cases where the government was corrupt, the tax system was unfair and unaffordable. The weakest arguments for justifying tax evasion were in cases where there was a selfish motive. The underlying cultural differences are further explored in hope of accounting for differing perceptions of ethics of tax evasion. Policy implications for increasing people’s awareness of ethics on tax evasion are also highlighted. (shrink)

Understanding cooperation and punishment in small-scale societies is crucial for explaining the origins of human cooperation. We studied warfare among the Turkana, a politically uncentralized, egalitarian, nomadic pastoral society in East Africa. Based on a representative sample of 88 recent raids, we show that the Turkana sustain costly cooperation in combat at a remarkably large scale, at least in part, through punishment of free-riders. Raiding parties comprised several hundred warriors and participants are not kin or day-to-day interactants. Warriors incur substantial (...) risk of death and produce collective benefits. We propose that procedures of separation have two functions, namely first, to establish the integrity of individual parts, and second, to make previously joint entities discreet and therefore countable. This allows taking stock of available resources, including evaluating the use of individual objects, a process that is especially adaptive under conditions of threat of contagious disease and resource scarcity.

The institution of slavery is an unjust institution. The aim of this paper is to provide an explanation of why it is unjust. I argue that slavery is unjust because it makes it impossible for slaves to realise both their interest in self-respect and their interest in being at home in the world. Furthermore, I argue that this explanation of the injustice of slavery also provides us with an argument for political equality.

Building from Irigaray's ethics, the book describes a poetics of being-two as concerns gendered subjectivity in literary poetics and then traces the on-going emergence of a poetics of being-two in the post-symbolist poetic tradition. Irigaray scholars will be interested in the sustained interpolation of Irigaray's ethical concepts as principles for a critical aesthetics and in their hermeneutic application in reading a literary tradition. Readers in comparative literature will find the first sustained feminist engagements with the major French poets Bonnefoy and Perse and an elucidation of their influence on the Pulitzer Prize winning poet Jorie Graham. This is an introduction to the Symposium on Artificial Intelligence and Apocalypticism, which resulted from a conference hosted by the Centre for the Critical Study of Apocalyptic and Millenarian Movements (CenSAMM) in Bedford, UK. The introduction provides a brief history of scholarly work in the intersections of apocalypticism and artificial intelligence and of the emergence of CenSAMM from a millenarian religious community, the Panacea Society. It concludes by pointing toward the contributions of the symposium's essays.

A mass casualty (MASCAL) event is different to a major incident. The crux of this difference is that in a major incident, by the adoption of special measures, normal or near-normal standards of care can be maintained. In a MASCAL, irrespective of what special measures are instituted, standards of care inevitably drop. This is a, currently unmet, challenge for medical planning and planning policy. Twenty-First century weaponry is capable of producing thousands of causalities a day over a period of several (...) days in peer-on-peer conflict. In this chapter, we propose that medical planning for military events on this scale should include the following: explicit acceptance that ‘gold standard’ care cannot be given to patients who are triaged for treatment, a better understanding how to identify those patients who will not be triaged for treatment, a focus on ensuring patient flow (which includes diversion, self-care and remote monitoring), and implementation of the principle that care should be given by the lowest capable provider. We attempt to begin to develop some principles for planners to consider drawing on historical precedents and explore some of the ethical implications of our proposals. (shrink)

Novice designers produced a sequence of sketches while inventing a logo for a novel brand of soft drink. The sketches were scored for the presence of specific objects, their local features and global composition. Self‐assessment scores for each sketch and art critics' scores for the end products were collected. It was investigated whether the design evolves in an essentially random fashion or according to an overall heuristic. The results indicated a macrostructure in the evolution of the design, characterized by two (...) stages. For the majority of participants, the first stage is marked by the introduction and modification of novel objects and their local and global aspects; the second stage is characterized by changes in their global composition. The minority that showed the better designs has a different strategy, in which most global changes were made in the beginning. Although participants did not consciously apply these strategies, their self‐assessment scores reflect the stages of the process. (shrink)

We examine physicists’ charge of ad hocness against the Higgs mechanism in the standard model of elementary particle physics. We argue that even though this charge never rested on a clear-cut and well-entrenched definition of “ad hoc”, it is based on conceptual and methodological assumptions and principles that are well-founded elements of the scientific practice of high-energy particle physics. We further evaluate the implications of the recent discovery of a Higgs-like particle at the CERN’s Large Hadron Collider for the charge (...) of ad hocness against the Higgs mechanism. (shrink)

The traditional view of symbol grounding seeks to connect an a priori internal representation or ‘form’ to its external referent. But such a ‘form’ is usually itself systematically composed out of more primitive parts, so this view ignores its grounding in the physics of the world. Some previous work simulating multiple talking/listening agents has effectively taken this stance, and shown how a shared discrete speech code can emerge. Taking the earlier work of Oudeyer, we have extended his model to include (...) a dispersive force intended to account broadly for a speaker’s motivation to increase auditory distinctiveness. New simulations show that vowel systems result that are more representative of the range seen in human languages. These simulations make many profound abstractions and assumptions. Relaxing these by including more physically and physiologically realistic mechanisms for talking and listening is seen as the key to replicating more complex and dynamic aspects of speech, such as consonant-vowel patterning. In Neutrality and the Academic Ethic, distinguished philosopher Robert L. Simon explores the claim that universities can and should be politically neutral. He examines conceptual questions about the meaning of neutrality, distinguishes different conceptions of what neutrality involves, and considers in what sense, if any, institutional neutrality is both possible and desirable. In Part II, a collection of original and previously published essays provides different views on these and related issues.

In this paper we explore the practice of interdisciplinarity by examining how the UK research councils addressed the problem of the sustainable city during the 1990s. In developing their research programmes, the councils recognised that the problems of the sustainable city transcended conventional disciplinary boundaries and that an interdisciplinary approach was needed. In practice, however, initially radical proposals to research the city as a complex combination of science and technology and society contracted into more cognate collaborations that emphasised either science (...) or technology or society, with the result that interdisciplinarity came to be located within research councils rather than between them. This, in turn, led to the development of a third kind of interdisciplinarity as the responsibility for making the connections between the research programmes was outsourced to the user communities—the local authorities. Unfortunately, local authorities struggled to find the resources to conduct this work so that the radical interdisciplinarity recommended at the start of the decade remained unaccomplished at the end. In describing these events we emphasise roles of paradigms and epistemic cultures in shaping research approaches and the complications they raise for the triangulation between approaches that is assumed in the idea of interdisciplinarity. We do not wish to be entirely negative, however, and conclude by suggesting some ways in which the quality and success of this much-needed interdisciplinary work could be increased. (shrink)

Projective contents, which include presuppositional inferences and Potts's conventional implicatures, are contents that may project when a construction is embedded, as standardly identified by the FAMILY-OF-SENTENCES diagnostic. This article establishes distinctions among projective contents on the basis of a series of diagnostics, including a variant of the family-of-sentences diagnostic, that can be applied with linguistically untrained consultants in the field and the laboratory. These diagnostics are intended to serve as part of a toolkit for exploring projective contents across languages, thus (...) allowing generalizations to be examined and validated crosslinguistically. We apply the diagnostics in two languages, focusing on Paraguayan Guaraní, and comparing the results to those for English. Our study of Paraguayan Guaraní is the first systematic exploration of projective content in a language other than English. Based on the application of our diagnostics to a wide range of constructions, four subclasses of projective contents emerge. The resulting taxonomy of projective content has strong implications for contemporary theories of projection, which were developed for the projective properties of particular subclasses and fail to generalize to the full set of projective contents. The philosophy suggested by Jan Zwicky's expanded understanding of lyric and use of the fragment-as-method inspired this notebook of misunderstanding. Seeking to read Zwicky in the tradition of the aleatory genre and its basic form, the fragment, Roberts finds that her own sense of poetics and ethics accords generally with Zwicky's lyric philosophy and epistemology of imagination. Roberts's resonance with Zwicky's theory is conflicted by Zwicky's choice to isolate her fragment-method from the larger history of the aleatory genre and its (...) complex political evolution. Misunderstandings are compounded by Zwicky's disengagement from her contemporaries in the aleatory genre, the instability of her definitions by way of gestalt, and the impossible scale of her “ontological imperative.” In the end, Roberts is disappointed by this tempting but failed affinity. The Ethics of Sport explores moral issues that arise in sports in a manner that is accessible to a wide audience but which also explores and evaluates arguments on different sides of major controversies in the world of sports, such as the controversy over the use of performance enhancing drugs.

Pragmatists have traditionally been enemies of representationalism but friends of naturalism, when naturalism is understood to pertain to human subjects, in the sense of Hume and Nietzsche. In this volume Huw Price presents his distinctive version of this traditional combination, as delivered in his René Descartes Lectures at Tilburg University in 2008. Price contrasts his view with other contemporary forms of philosophical naturalism, comparing it with other pragmatist and neo-pragmatist views such as those of Robert Brandom and Simon Blackburn. Linking (...) their different 'expressivist' programmes, Price argues for a radical global expressivism that combines key elements from both. With Paul Horwich and Michael Williams, Brandom and Blackburn respond to Price in new essays. Price replies in the closing essay, emphasising links between his views and those of Wilfrid Sellars.
